Mr. Chair, what I would like to ask is if instead of being called clerk, it would go to vice chair. A clerk is administrative, sort of like what Robin does and what Michelle does. And to me, they are the clerks. They're the administrative to the planning board. The vice chair is someone who supports the chair and fills in. But it's not the clerk. Like, we don't really have someone that's taking minutes and doing things like that that does the role of clerk. Minutes can be signed like Michelle signed them. Minutes can be signed after we correct correct them by our administrative assistant.
I agree with you. I had the same question when I first got on the board. And Jack had an explanation, and I can't remember what it was. Mr. Chair? I wasn't going to argue the point either.
But it's always been a call to the clerk. They also sign stuff, but also if the chair can't be there, the clerk becomes the chair.
Mr. Chair? So I did some research today. So the following towns have vice chairs for planning boards. Lakeville, Acushnet, Bridgewater, Halifax, Raynham, Carver, Rochester, Weigham, East Bridgewater, West Bridgewater, Hansen, and Plympton is the only one that does not have a vice chair. And in addition, a lot of these communities also have a clerk position in addition to a vice chair. So I kind of think that I had brought this up a long time ago when I first got on the board that I thought that we needed a vice chair. And they didn't want to change. But I think that it's time that we make this change which is in line with everybody else around us. That's it.

It's brought to my attention that Taco Bell was operating after midnight, and I asked Joe to look it up. Joe's good.
So the hours that were agreed to for Taco Bell were Thursday, Sunday through Thursday, 10AM to 12AM and Friday and Saturday, 10AM to 1AM. So those were the hours that we agreed to. If there are hours that they're working outside of that, we would have to find out how we would go about enforcing that.
The coroner of the neighbor told me it was still open at 02:00, so I don't know for sure. I always thought that all of it was midnight, he just showed it to me that we gave him Friday and Saturday nights later, an hour later.

Good evening, Mr. Chairman. Congratulations to yourself for election to the Planning Board and Tracy for getting on the Select Board. Can you pull up the plan, Rob? So as the Board may recall, we're here for preliminary subdivision plan.
We were here about a month ago. As I mentioned at that meeting, this is just the step we have to do to comply with the statute. We still owe you a definitive plan set that you will engage an engineer to review of the drainage, the roadway, traffic, all good stuff. But a couple of comments were brought up the last time. Could you go to the lobbying plan, please? Might be the next sheet. One more. That's good. So the last time we were here, I think Tracy had brought up a comment about the roadway within the right of way. After our meeting, we had talked to the engineers.
And on the definitive plan set, you'll see, I think, it's 65 foot right of way. We'll have one lane in. We'll have a concrete median in the middle, and we'll have a left turn and a right turn egress lane. The engineers felt that would be satisfactory for if there's any further development of the site. So they felt comfortable with that. If you could scroll up a little bit more, Tracy. Tracy, I'm sorry. I'm sorry, the other direction. One more. Keep going.
That's good. We'll just use that. Again, for the Board's edification, again, we're proposing a roadway here, two drainage parcels, one here, one here. We're proposing one lot and then we'll have the second larger lot. Nancy had picked up that the lotting sheets had a few errors on them.
I think they on the civil set, it was Lot one and Lot one, where the lotting sheet, we called it out as Lot one, two and three. That information was related to the engineers as well. That will be corrected on the definitive plan set. But as far as this plan set goes, those will be the only edits that you would see on a definitive plan set when we submit it to you. Obviously, once the peer review gets going back and forth, those plans could change. But I don't think it will change a whole heck of a lot. But with that, I'd be happy to answer any questions the Board may have.
So you're saying one lane in, two lanes out?

They don't think we need justify needing two to go in?
They didn't think so. They think there was enough there's enough room in that leg right there to absorb whatever traffic would be needed. Getting in and out is
I know, because you got to walk through it because of it being the hill. We think we should need to have an easement wide enough. So if you need that second lane to go in, property width is already enough and only build one lane in case and if there is a problem you could add on?
Yeah. I don't think that would be an unreasonable ask. We'll talk to the engineers about it and the property owners. And again, I don't
You know what I'm saying? Why we're laying it out. So just in case there is a problem, we have the ability to ask for that.
I don't think that's unreasonable. On this side of the roadway, I think we have 10 feet of, call it, green space, bell grass. So I think we would have the room to do it anyways, but I'll look into it.
Because that entrance is going to be halfway down the hill, though, right? It's on the downhill slope.
This entrance way is based the house is right here right now. That entrance way is the best sight lines for the hill and in the other direction.
That's what I'm saying. It's as going if you're coming from South Middleborough going uptown

And it's on your left hand side, you already made the crest of the hill and you're going down the hill Right. Where that's gonna be. Yes. So I didn't know traffic wise, you know what I'm trying to say? Somebody's I can understand it's coming the other way, coming up. Because all the other industrial parks we have have the ability to have two lanes in and two lanes out. We'll look at it. I'm not saying you have to build two in on the Definitely way two on the way out because people are gonna go left to right.
Mr. Chair? Yep. So I agree with Bill. I definitely would like to see the capability of expanding that entrance into two lanes. Reason being is you've spoken that there may be events being held there and we cannot have traffic backing up down Route 28 to get into that place. So I think that you might want to on the side of caution and fix it while you have all your equipment out there and when you're paving, do it at the same time so you don't have to go back and rip things up and redo everything. And you said a concrete median. How far is the concrete median? Is it going be down the whole road?
It's going to be up for discussion. Right now, you don't have the benefit of these plants. So it's approximately 100 feet from the roadway.
And when you say concrete median, what do you are you talking about like the dividers that are like three feet, four feet tall? Are you talking like a little ramped area or
It would be a concrete curb of some sort, whether it's granite curbing or whatever it is. So there would be a come up to six or eight inches, go straight across and come down to six or eight
inches. Usually, what they do is they put granite curbing on a little bit of an angle. And then they pull it in between the center, they pull it. So in case if somebody has to drive over, they can drive over it. That's what they do. In case if something happens and cars have to go around it, that's why they cap wood. Chair? With concrete.
I was thinking something nicer than concrete like Compass Park. They have the median and then it has plantings in the middle. And it looks so much nicer.

Through you, Mr. Chair, to Mike. I just want to go back to our last discussion that you were here because I didn't ask it that night. And it's not to go into it, just to get a definition.

So you mentioned MEPA. Could you explain what MEPA is? And also if it talks to other agencies? Just so we understand it.
Well, MEPA process, the Mass Environmental, help me out with And P Policy what it is, is this is what we did for Campus 44. So we started with you guys and then what we did is we applied for a MEPA permit and there's different phases. And basically what it is, is we make an application, we say, okay, Commonwealth of Massachusetts, this is what we want to do here. In the Campus 44, we did the worst case scenario, so we could try to get all of the traffic, get all of that. And that was an environmental notification form is the first step.
And Leanne probably knows the process better than I do because I don't do it. And we submit that, the state comes back and says, no, no, no, you got to do more than just the basics. You got to show us more. And it's they made us file a draft environmental impact report. And what happens is, is they send it out to all the agencies in the Commonwealth of Massachusetts. So you have DEP commenting on to your mass historical commenting on it, you have mass doc commenting on it, who else comments on it?
Everybody, Serpent.
Serpent. The town has the ability to comment on it.
Abutting towns.
So that all gets submitted back to the state and they say, okay, here's all the comments. We want you to do a final environmental impact report and address as much as you can. So that's what we did. And at the end of the process, we get a certificate that says, yes, we comply with the MEPA process. That's the thumbnail version.
No, appreciate it. I just want to make sure that we went over it briefly and I want to make sure the public understands what it is. The only other thing I want to know is if this is all approved, is it going to start right away? Or does it have to wait for the MEPA process? Like you can't dig until MEPA says it's Okay, right? Like you can't do any grading?
I don't think I would not want to do any work until I had all my permits in hand.

Bill? So what's the width of that? They're going be width on that plan? Or you if we vote tonight, is it going to be a big enough easement for two lanes in, two lanes out?
Well, I think I got to talk to the property owners about it. Like I said, Bill, I think right now, the right of way with, because I've seen it at 65 feet, that was more than enough to fit. I think it was 10 feet on either side of the road. We have 12 foot in the middle, five foot median and 12 foot lanes. So I think we had wiggle room there. But if we don't, we'll talk about increasing the size

Just a question. I know that we don't have sidewalks on 28. Do you or the engineers foresee needing a sidewalk on one side of the the roadway to accommodate? Like, say you have people that are visiting the hotel and they wanna go for a walk. They want to walk down or I

know, like I don't
know. So the plan that I saw, and I don't want to commit myself to anything right now, and please don't, but I believe we had a sidewalk on one side of the road that went down to Route 28. I think that's what we did at Campus 44. We'll do it here. It's kind of a sidewalk to nowhere. But if there's internal traffic, I think it makes sense.
We did a subdivision on roofs and ramps on sidewalks, because the developers couldn't build them right. We said we eliminated sidewalks unless they disenrolled it, that the new road comes off and has sidewalks. Or if it's a through road to another road, then we require sidewalks. Other than that, we don't require sidewalks unless the dirtiest sidewalk and the main road.
I literally just ran by the site this afternoon. Those that attract me. And there's no sidewalks. There's Right. Nothing to Right. Was That was not much. Two miles in either direction. Right. I mean, Ampisees is close, but
I was thinking just internally, say, you have people visiting one of the facilities and they have a child in a stroller and they wanna take it for a walk while the people are doing things, at least it would be a safety thing for visitors to the site. But I mean, it's not a no vote to me, but I'm
just Like we can't tell the state to put sidewalks in '20
Well, yeah, I think that's what Tracy's asked. Just internally, we've Right, an internal sidewalk, yes.
So I haven't done one of these before, Mr. Chair. Bill brings up a really good point about that easement. Is there a way to make a comment on the plan itself? Because it's going to go through a process, right? It's going to go to another board.

Chair, I was thinking we could take care of that in the motion, that we could approve the preliminary plan as presented with the addition of a 10 foot easement on the incoming lane and a concrete median or similar thing. We could adapt it in the motion.

So first, in your packet, there was one that I did that really was just throwing out some numbers to generate a discussion. And then today, you got another one that if you look at the top, it says 20% increase. Just to give you an idea of if we were to put a 20% increase across the board on our fees, what it would look like. So just two options to really get you guys going. And what do you think?
So looking at Interesting choice of words there. Yeah. I was looking at it real quick. Noticed that the draft one was more money, was more than 20%. And the 20% is is a little bit less. Yeah, I went a little just I'm just There's some numbers on Didn't realize it till I thought it was both the same until I just looked at it.
Oh, no, they're different. Yeah.
What's a is that compatible to other towns nearby? Honestly, wasn't worried about
it, but I think there was a little research done.
Before? When was the last time we increased the fees? What year? Do we know?
Don't know. 2022.

And yeah, of course. So Lakeville and Berkeley, one of the things I was looking at mostly was Form A. I did look at the other ones, like retreat lots and stuff like that, too. But Form A, Lakeville says $250 for a modified line adjustment and $500 per new lot. But then other towns have an application fee, and then $200 per lot or $250 So Hingham, just say Hingham because I know there's another one too.
Well, Cabba, I'll go for Cabba. Cabba has a filing fee of $250 and a per lot fee of $200 Hingham had $250 and then a $250 per lot. So it just seems like a lot of people were charging between $200 and $250 for an application fee and then the other $250 or whatever, even if you want another $250 for the per lot. And I had asked the question the other day if there was an application fee. And we don't really have an application fee. What we see is what we have.
So
one of the things that I was always told is that when you raise fees, you just can't raise fees because there's a budget problem. The raising of the fee has to be justified. Can we justify raising these fees 20%? Because are you doing 20% more work?
It can
also coincide with the rate of inflation.
And is the rate of inflation 20%? It's more than 20%.
Is 22% or 6%? Well, 20%.
I'm saying it's much more than 20%.
So, Mr.
Chair, the average cost of increase is anywhere between 35% per year, supposedly. If the fees were adjusted in twenty twenty two, five percent a year using the high numbers, which again, with the cost of inflation in the last four years being probably double that, 5% a year, 20% seems extremely reasonable. In fact, to be honest with you, I think it's probably not enough.
Considering that the 5% increase is on the 5% increase over the year. Yes. So it isn't 20.
It so it's not an actual 5% increase technically. Yes.
2022, inflation was at so realistic 5%.
What was that number?
Inflation was at 6.5%. And as what you were saying, like the cost of municipal construction is generally higher than inflation. So that compounds year after year. So I don't
So Tracy, answer your question, are we doing more work? Or is the work we're doing costing more?

The question should be what does it cost, not are we doing more work? The cost of the work has increased.

Wages, insurance? Yeah.
Yeah. Building we're in. Let's look at the budget. Our budget, the department budget for 2022 and see how much, know. But I think it's completely justified. I'm fine with the 20% increase. But yeah, I agree. It has to be justified. And I think a pretty quick look. We're actually underselling it at the moment.
We're way under with other times. We're under Actually Lakeville. Lakeville, like I said, is $2.50. You know what I mean? Carver, $2.50 for an application filing fee. Like we're not getting a filing fee. We should have a filing fee on it. The other thing I wanted to mention is and it's not on here is other towns are actually charging a waiver fee. So like, you know how we get the plans that say we want a waiver for this? They're charging $100 $150 every waiver. That's good. Yeah, like I that.
Does that mean we get a raise?
20 percent raise?
Don't know. I didn't think of that.
And then the other thing they're saying is even if they come in just for boundary lines, they're charging upwards of $300 in all different communities. The retreat lots were the same application fee plus a creation fee. You'll know more about what that is. Don't know. But that's what I was reading. And I was like, Okay.
I would like our fees to stay as low as we can. But this department shouldn't be losing money because of it. We have to at least stay even. I certainly don't want to generate we shouldn't be generating funds, or extra funds, should say. There's no enterprise account for the planning department. But we should at least cover our costs.
I can confidently say that the amount of fees that we took in last year was lower than what Robin makes in a year.
So yeah, we're not even covering our

Do we know if we charge a site plan review fee? Because other towns do. Like there's a lot of fees.

And it changes fee? So if they made any changes, like Lakeville gets 500 plus 200 per lot if they modify it, if they change the plan after they put it through. I mean, these are just all things to look at.

So I am waiting to hear back from ethics on that. And that was at the recommendation the town manager. Because I will stay on CPC if it's okay. And if not, then we'll have to appoint someone else.
