Thank you very much. So we're going to move on to the Virginia Key Advisory Board discussion item, which is an update on the status of the Marine Stadium request for proposals.

Fellow board members, it's under a cone of silence, so there's not much I can say about it, but it It was published. The RFP was published in the final days of January. I think January 29th, maybe. And so it's available on BidSync or whatever the city's procurement website's called these days. And yeah, you can register for free there and download the materials. And I think there's a question and answer period going on right now. And that is where things stand.

Andrew, violating the cone of silence, what are the deadlines or when are people supposed to submit applications and when do you make it?

Yeah, so I think the deadline, I think it was written with a 60-day deadline, so end of January to February, end of March, so end of March deadline, I believe. But if you want to download the official materials, you can get everything there. There's also, there was, I believe, an on-site meeting that happened with any interested parties. There's also, I guess, a deadline at some point for the questions to close, and then answers and addendums to be published, and then nothing, no communications from that point until the proposals are due.

Oh, thank you. And do you have a committee that will be reviewing the applications?

There will be an evaluation committee put together by the manager. I don't know who that will consist of.

How many people?

I don't know. It's at his discretion.

I'm sure he'll work with the procurement department to establish that. But at this point, things are being handled through procurement.

Let me ask a question here. What area are you looking at as far as having somebody on the board?

They're talking about the Marine Stadium area.

Okay, so you want someone, because that is sectioned out. Different people is on the board here from different sections of the beach. Oh, okay. From Virginia Key Beach. Got it.

Yeah, so this is, you know, the RFP, just maybe bring up to speed, the RFP is for a private sector partner for the city to manage, to renovate and manage the Marine Stadium and the Flex Park. parking lot. So we're looking, you know, for private sector companies who could partner with the city to design those, manage and oversee the design of renovations, the renovations themselves, and then the operation and programming of the resulting venue.

Andrew, thank you. What's the status with the planning proposal for the Flex Park and the associated acreage that was being done by the group from Colorado?

I'm not familiar with this. Colorado group.

Is that a consultant? Civitas. Oh. Civitas has received, I think, a $900,000 fee to do the planning for the parking spaces, the parking lot, the areas north, east, west of Marine Stadium?

I believe that work was through the planning department, and I believe that work has been concluded. I don't know. I'm not sure what that report looks like or whether... and to what extent it might be useful, because without a partner in understanding the economic viability of that site, I think it's always been kind of a stab in the dark to tell a designer to design something without that. Yeah.

Okay. I guess then we'll need somebody from the planning department to give us an update on that. Raffaella, could we get an update at our next meeting on the Civitas report?

Yes, I'll inquire with the planning department.

We've had a few over the years, but we haven't had a full report in four or five or six or seven months. But I believe they started working on this three or maybe almost four years ago. Okay. And yes, Vincent, you have a question?

Andrew, can you tell us if the RFP was well-received? I mean, a lot of interest, no interest?

Yeah, there was... I don't... Procurement has a sign-in sheet for the in-person meeting that we had, so I don't... It would know exactly how many people were there, but I would say... probably 20 people showed up. I mean, probably certain groups sent a few representatives, so that's not to say there were 20 different groups available, but... Ten? I don't know. I don't know how to count staff versus lobbyists. I don't know. But maybe... I don't know. I'd be guessing at this point. If it was six groups and they each sent three representatives, right, then you got 18 people. Maybe it was around what it was. I don't know.

Can I ask a question about the RFP? Will there be a specific time where the respondents will be able to make a presentation and It'll be open for everyone to see, or is it just going to be closed and only the committee that is reviewing will have that opportunity?

I believe it's just the evaluation committee. Yeah, so I think that's how it works.

So the RFP did not put any specifics in there for a presentation for the group?

NOT FOR PRESENTATION, I DON'T BELIEVE FOR PRESENTATION OF INDIVIDUAL PROPOSALS. I THINK THAT WHEN THE COMMITTEE MAKES A SELECTION ABOUT, AND AGAIN, I HAVE TO REFER BACK TO THE EXACT WORDING OF THE PROPOSAL, BUT THERE WILL BE A FIRST RANK PROPOSER AND THEN THAT FIRST RANK PROPOSER WOULD BE RECOMMENDED TO THE COMMISSION. And there would be a public presentation at that point of the first ranked proposal.

I'm sorry. I was pushing the whole thing. No, I was really shocked when I read that Herald article. I tried to get a hold of Peter and left him a note, but I don't know. This group was founded in, what, 2016? With... I believe... Stadium in charge, and so Andrew, I don't... I just felt like I was blindsided and felt like it's on a bull or something. I don't know.

I'm sorry for that, sir, but we did circulate a draft of the RFP, and we're checking on the date of that right now.

Mr. Chair, I think it's really important that we be represented on that review. We've been on other review boards associated with RFP, so there's no reason why we shouldn't be on this one. And I would leave it to you to open the doors and communicate with the administration to find out how we go about identifying someone. And I would like to vote Vincent as far as the representative if we do get a place on that board, if Vincent's up for that.

I would just suggest that we could resend it. It'll be... The draft from September, I think that there were some changes Maybe between September like minor boilerplate tweaks and things like that. So if you want to download the latest and greatest You can go to the city's procurement website and I have to say that I Don't even have a copy of the latest and greatest because I didn't register for the website and but So, but that would be only, you could only get that through the procurement website, but just FYI.

Through the chair. Yes. The RFP includes the scope of services or the scope of requirements. Are they separate or it's all included in the RFP? So we'll know exactly what the city is looking for for a vendor.

Yeah, I mean, the RFP is like 72 pages of qualifications, scope, criteria, you know, bid requirements, everything like that. It's all in there. Great. Thank you. And then also, if you register for that, I believe you'll also get notification if there's any addendums or answers to questions. So you'll always have the latest.

And another recommendation, too. Andrew, ultimately, as this process goes along with a selection committee choosing somebody for the RFP, Andrew, can you ask this city manager that he bring the winning proposer through this board before it goes to city commission?

So it can be a request from the board, similar to the resolution that was just passed, making this recommendation. That's an option. Or it can just be relayed as a request from the board that's been mentioned.

Well, I think the legislation that creates this board requires the city administration to bring important items to this board before they go to the city commission. Isn't that right, Ms. City Attorney?

So let me go to the provision quickly.

Andrew, while she does that, I'm on the procurement website, and I don't know, I don't see anything that says, is it notices in meetings? Is that what I would look under?

Like I said, I do not. I HAVE NOT REGISTERED MYSELF AND DOWNLOADED THE FINAL, FINAL, FINAL VERSION. SO I'M NOT TOTALLY SURE.

THROUGH THE CHAIR. YES.

SO THERE'S NO LANGUAGE IN THE CODE THAT REQUIRES THESE ITEMS that they have to go before the board before they go to City Commission. There is language, of course, that is within your purview and power to review and make recommendations. So, again, you guys can request or recommend that the winning bidder or the top-ranked bidder come before this board, but that's not something that can be required.

What's the specific language that created this board? It was created by... Francis Suarez, with help from Greg Bush. Doesn't it state that important items pertain to Virginia Key Park be brought to this board?

No, not in that.

Do you mind reading it to us?

Do you want me to read you the purpose, powers, and duties? Okay.

Particularly as it pertains to administration bringing items to us before it goes to the city commission.

That language isn't in there. So the language that's in there concerning items before city commission, the trust has the power to issue a written report that is made available to the public and make a presentation before the city commission by the board's chairperson at least once per year making recommendations regarding any or all of the foregoing matters and related issues and concerns, all of which relate to Virginia Key. And then the other item is to serve in an advisory capacity to the city commission and recommend any changes to city laws, rules, regulations, practices, policies, or to help the city better promote the restoration, reopening, and success of Marine Stadium and Virginia Key. I don't see any language here that specifically states that something has to come before this board or the city commission can consider it.

What you just stated was in order for us to make a recommendation to the city commission, we have to see the item before it goes to the city commission. I'm just paraphrasing what you read to us. In order for us to have a recommendation or an opinion, we need to see the hard copy of what's going to city commission.

That can be recommended and requested, but it can't be a requirement because this board is an advisory board.

Well, ultimately our recommendations are only going to be considered as advisory or recommendations, but we can't make a recommendation to city commission if we don't see an item that Before it goes to City Commission.

And that can be part of the recommendation.

We still need to see the item before it goes to the five commissioners. Or we're just making a recommendation after the fact. Yes, Ms. Lewis.

I would like to move that we recommend to the City Commission that in order to fulfill the purpose for which it formed this board, that the city manager be directed to pause the presentation to this board prior to the presentation to the city commission. of the proposal that comes with the recommendation of the advisory committee for the design, renovations, and programming in partnership with the city for the management of the Marine Stadium and the Flex Park.

So let me try to say that a little bit better.

We would recommend to the city commission that it direct the city manager to send to us, for our advice, the entity that is recommended by the committee to be the manager of the Marine Stadium and the Flex Corps.

In addition, through the chair, in addition, the Office of Capital Improvements, they have a page, a landing page there where it talks through all the capital projects for the city of Miami that we're doing with budgets and renderings and different stages and project updates. Okay. Will this be released to the public or this is something that everyone that's in the public that want to find out? of all the activity that's going on in Virginia Key, they have to go look up or is this something that you guys automatically send out to the residents?

Information is uploaded as it develops through the process. If something's in the cone of silence, we generally don't advertise until we're able to do so per the procurement code. Okay.

Okay. I can answer some of your question there. I take out information on what's going on with the Black History Museum to all the different organizations that I belong to out in the city of Miami and other areas of Dade County. So I bring the information on what's going on. I directly talk to Christine King and with her staff and with the person that's over that museum on Virginia Key. So I do bring out information and let people know what's going on at different meetings and stuff like that.

Well, I go to organizations tomorrow. If you come to Charleston Hadley park organization, I'll have the director for the museum. That'll be there. And I'll be the one that's hosting.

I would also like to give you an update on what's going on with the restrooms on Virginia Key.

That would be great.

Okay, what they're doing is they're rehabbing the restrooms. They've started from the east side of Virginia Key, and they've worked on a few of them on the east side. They're working their way up to the west side. If you see a porta potty by one of the restrooms, that's because they're usually rehabbing that restroom, and it's not going to be where people can use it. So they have a porta potty by it so people can use the porta potty. Like I said, they're going to the west, so it's going to be a little wild the way that they work, a little slower than what it should be. But they're trying to get them all done. They have some that have roof problems, and that's the reason why they may have shut some of them down, because they have a problem with the roof.

Thank you for the update. Stephen, do you want to provide a little update on the proposed tree ordinance?

Sure. Thank you, Peter. And I would like to say, piggybacking Carrie's comments regarding historic Virginia Key Beach Park, I was out there this weekend, and the front field that perpetually floods in the summertime looks like they're remediating and elevating that area with sand and sod. So I thought that was... COMFORTING PROGRESS. AND TREMENDOUS WAS OUT THERE AND THEY WERE GOING THROUGH SOME OF THE HABITAT AND REMOVING INVASIVES AND I JUST THOUGHT IT WOULD BE GREAT IF MAYBE OUR BOARD RECOGNIZED TREMENDOUS FOR THE WORK THEY'RE DOING ON VIRGINIA KEY. So I want to maybe put that on the agenda for next month. As far as the Miami trees matter most, we're still looking at April 24th as the commission deciding, the commission passing this egregious ordinance that has more than... 30 items in it that will diminish our tree canopy in the city of Miami. They have had several town halls. They have supposedly amended the ordinance. We've gone through the ordinance, and there's virtually nothing substantive in the ordinance that changes the impact on our canopy. And that's my update.

Thank you very much for being so involved in that. And you said April 24th is the?

Correct. And I will add, if anybody in your community, there's different districts, different neighborhoods, please come to me because all the districts and neighborhoods are going to be affected by this ordinance.

And Steve, is this for first reading?

This will be for first reading, correct.

I know it's been on the agenda a few times.

It's been deferred a number of times.

Thank you very much. Any board members have any comments on anything pertaining to Virginia Key Park? Mr. Evans, anything to add from your directorship of the Parks Department?

At this moment, the only capital project that's going on right now, not only, we always have a lot of things going on, but I know the new restroom facility building, Office of Capital Improvement project, I know we're still trying to gather all the funding needed to move it forward. So that's all really to report on Virginia Key at the moment. Still active, bike trails, beach, kayak area, water sports area.

What's the status of the boat ramp, the new boat ramp that was under construction?

There's not one in the Virginia Key North Point Park that's under construction.

No, just a little bit west of Marine Stadium. The boat ramp that was under construction.

Good evening. Okay. The question is, what is the status of the ballroom? Okay. The ballroom has finalized construction. So it's 100% constructed, but we cannot open it yet because we need to comply with the mitigation that the Florida Department of Environmental Protection has laid out. So usually they set up conditions for you to be able to use the projects. And this is one of the conditions that we currently have that until the mitigation is executed, we cannot open the facility to the public.

How long do you think it'll take to satisfy the requirements?

So our initial mitigation for this project was to remove the early vessels and do a survey of the bottom of where the vessels were and mitigate for those seagrasses in those areas. We had to change the mitigation because it was... What would be the word? It was very difficult for us to identify derelict vessels, remove them, and then have a medication that would be conductive to the mitigation that we needed to provide to FDEP. FDEP suggested that we look at a different mitigation. And the mitigation that the city of Miami is looking is called propeller scar restoration. So when a boat enters in an area, a propeller scar restoration. So when a boat enters into an area and they scar the bottom of the bay and they remove the seagrasses from those areas, what we're doing is that we are planting seagrasses on areas that have been affected in that way. Now, the time frame, I will have to say for us, approximately, it could be 15 to 30 weeks.

I just have a question. Is that for the boat ramp you said? Yes. Mitigation, prop scars? For seagrasses. For seagrasses that were in, seagrass, I guess you had... Okay. Thank you.

I do. Lorraine, the impacts were from boat propellers previous to the boat ramp itself, or it was from the installation of the boat ramp itself that the seacrest was impacted?

Yes. So it was for the construction of the project. So each and every project, Everything that you have impacted, that's what you have to mitigate for.

I just wanted to make a clarification as to the last resolution as I was preparing my notes. I believe Ms. Lewis specified that the resolution would be for the presenter, the top-ranked proposer to make a presentation to this board before the city manager makes his recommendation. However, and and that's that may be wrong. So it was before it's considered by City Commission Okay, I just the reason I asked the question is Before the city manager makes his recommendation the proposal is exempt and it's still under the cone of silence so would have to be between the time that it is recommended and Either before City Commission or before the City Commission takes action on the item. Okay.

Absolutely. Staff is kind enough to be here this evening. Would you like to hear from Lorraine?

Lorraine, could you give us an overview as far as some of the other projects and what the status is?

So for the stadium, we already discussed on that, and it's in kind of silence. The bull run, we already discussed it. The mangroves that we mitigated next to the stadium, we continue to monitor them and send a quarterly report to DERM on the mooring field. Andrew, do you have an update on the mooring field, quick update?

ON THE MOORING FIELD, I BELIEVE THERE WAS SOME DISCUSSION AROUND THE HOLIDAYS AT THIS BOARD MEETING ABOUT THE MOORING FIELD AND WE'RE STILL WAITING ON REVISIONS FROM THE ENGINEER SO WE DON'T HAVE ANY UPDATE THERE.

THE BASING TRAIL WAS COMPLETED. THAT HAD A GRANT AND WE ASKED ALREADY FOR FULL REIMBURSEMENT TO FDEP.

IS IT OPEN TO THE PUBLIC?

YEAH. Cool. Yeah, no, the trail, I think, I'm not sure if it was Monty or Steve that went to the ribbon cutting for that one. And then we moved to the historic Virginia Key Beach Park, and the county accepted the business plan. And I know that Appley is working with the city attorney's office and with the county attorney's office to get a draft of the agreement to be able to allocate the funding for the $20 million, the 15.5 GOB and the $5 million CDT for the stadium. And we have also requested assistance to the City of Miami Procurement Department in drafting an RFP to get a designer for the museum. On the landfill, we have a meeting for next week. We tried three times to meet with U.S. Fish and Wildlife to have a pre-consultation with them in regards to the Florida bonneted bat. We have been unsuccessful. So we're going to continue to move forward with the team in regards to the concepts. I invited you to the meeting next week so that you can be part of it. We also have invited the village of Cubiscayne, and staff from our commissioner for district two, Alexandra, I think you have all met her from previous VCAP meetings. And am I missing one? I think I discussed all of them. Yes, that's it. Okay, thank you.
