1:05 – 3:31Speaker 6

Good evening. Everybody present is here either for an extension of time, which means you're asking for additional time, or you're here to ask for your fines to be mitigated to the lowest possible amount the board can afford. legally reduce them to. If you're here for an extension of time, please come up to the podium, state your name and address. And if you have a power of attorney, let the board know how you're related to the property. Let the board know what you've done to comply and how much more time you need. The director will have input if he has any input as to how many days he thinks you need beyond or less than what you're asking for. The board will vote and you will have your extension of time. I believe If it's still there, there's a piece of paper at the podium. If you're here for an extension of time, you probably already know how to ask for one. But in case you forgot, there's a piece of paper there. Take it with you because if you run out of time or you're looking like you're going to run out of time, you can ask for additional time. If you're here for mitigation, most of you have gotten this little chart. If not, come pick one up over here and take a look at it while we call the extension of times. This chart is what the minimum the board is authorized to mitigate to, which means they cannot go any lower than what's on this chart. So many people will come up here and say what they have to say, and that's fine, but this is as much as they can do. They cannot go any lower than what's on this piece of paper, so take a look at it and read it, just so you know when you come up. The board will make a determination based on your situation and what they're willing to mitigate to. They'll vote. I will walk around and grab a piece of paper which is your mitigation order which says how much you have to pay. When you're done, please wait for me over here. I'll bring you your order and I'll hand you a paper that gives you payment instructions on how to pay your fine. If you're here and you're not the owner of the property, a managing member of the corporation, or a licensed Florida attorney, You need a valid power of attorney with two witnesses and a notary. If you don't have one and you don't qualify, please come up and see me so we can work out either rescheduling you or setting it for another date. All orders of the board are appealable to the 11th Judicial Circuit Court of Florida within 30 days. Vanessa, the first case.

3:33 – 4:23Speaker 8

Just to reiterate a little bit of what the board attorney said, When you come up, the first set of hearings that we're going to have, you're asking for an extension of time. You're the one asking for the time, so tell us how much time you need. We're going to look quickly and briefly to the director, see what he recommends, and assuming that you've taken some kind of forward progress in attempting to resolve your issue, then you're going to get granted time. But just be specific, speak up, tell us what you need. Also, if you're having permitting issues, there's different resources that the city has, and you can look into some of those. Maybe there's a difficulty in actually getting the permit issued. There is resources available, and there's different people who can help you get that resolved. Okay?

7:41Speaker 8

And your relationship to the property?

7:43Speaker 14

I'm the property manager.

7:44Speaker 8

Okay, have you been working on the violation?

7:47Speaker 14

Yes, and I obtain everything. I don't need time anymore.

7:50Speaker 8

How much time are you requesting?

7:53Speaker 8

Well, you probably need a little bit. Director? Is she saying that she got her compliance?

7:59Speaker 22

Yes. The permits 8163 Northeast 2nd Avenue? Yes. The permits, what was the permit for? Sorry?

8:14Speaker 8

Give me one second. What is it that you have? What's the document?

8:19Speaker 14

So I applied for a CU. I found guilty in November.

8:24Speaker 17

You have the CU and the BTR? Yes. He's going to check right now.

8:27Speaker 8

You want to show it to the city attorney?

8:29Speaker 17

He's going to confirm in the system right now. Somebody had just come up to speak to him.

8:37Speaker 22

It's for Moderna? Moderna, yes. They're good. I would recommend seven days so we can go ahead and review it and re-inspect, if anything, and

8:47Speaker 14

Should I schedule with Ms. Bailey?

8:49Speaker 8

Reinspection?

8:51Speaker 22

That is correct, with Ms. Bailey.

8:53Speaker 17

Let's just do 20 days since we have spring break going on. Just do 30 days. Yep, there you go.

8:58Speaker 17

That way, make sure they get out there, do it, you get your affidavit of compliance, and you're good to go. Okay, 30 days?

9:03Speaker 8

Yeah, just to be safe. We're going to take a vote. Do we have a motion for 30 days? Second. All in favor? Aye.

Shopping Plaza Corp. Good afternoon, members of the board.

10:44Speaker 8

Good evening, sir.

10:45 – 11:13Speaker 27

Ben Fernandez, owner of South Biscayne Boulevard, here on behalf of Shopping Center Corp. We would respectfully ask for an extension of time. We've been working on completing improvements to the roof, most importantly, most recently. Working with Inspector Torres, we would ask for 120 days because there's a significant amount of work to be done before we can get the certificate of completion to obtain some of these things that we need.

11:14Speaker 22

Director, the city recommends 30 days as one permit is on hold and the other one has been revoked for the roofing.

11:22Speaker 8

Councillor, you heard?

11:24Speaker 27

We can come back in 30 days. Yeah. Okay. That's fine.

11:27Speaker 8

Do we have a motion for 30 days?

11:28Speaker 21

I move for 30. Second.

11:30Speaker 8

All in favor? Aye.

12:07 – 12:18Speaker 15

Code check, page 48, case number 79232, property address 3080 Southwest 7th Street, page 48. Code check.

12:18Speaker 18

Is this an extension of time?

12:20Speaker 15

12:21Speaker 11

Thank you. Hello. Hi, my name is Diana Liz Vega.

12:26Speaker 8

Yes, ma'am. And what's your property address?

12:29Speaker 11

12:33Speaker 8

12:36Speaker 11

They say 30 days.

12:38Speaker 8

Let's see what the director, what do you suggest? No objection. Okay. Do we have a motion for 30? Second? Second. All in favor? Aye. 30 days.

Page 9, code check, case number 94399, property address 1228, Northwest 43rd Street, page 9.

13:15Speaker 8

Good evening. Please state your name for the record.

13:20Speaker 19

Nadia Torres. Okay. 1228 Northwest 43rd Street.

13:24Speaker 8

Okay. How much time do you need, Ms. Torres?

13:31Speaker 22

The city recommends 120 there in the inspection phase of the permit.

13:35Speaker 8

Do we have a motion?

13:36Speaker 18

I move for 120. Second.

13:38Speaker 8

All in favor? Aye.

13:39Speaker 19

How many days? 120. 120. Is that good? Yes.

13:42Speaker 8

There's a paper if you need more time to come back.

13:44Speaker 19

Thank you. Okay. Bye.

14:05 – 14:17Speaker 15

Page 12, code check, case number 19428, property address 782 Northwest 21st Terrace, page 12.

14:18Speaker 8

Good evening, sir.

14:18Speaker 15

Extension of time.

14:20Speaker 8

Good evening, sir.

14:21 – 14:35Speaker 3

Good evening, members of the board. Attorney Christopher Guerrero here on behalf of the client. I have two addresses, 782 Northwest 21st Terrace, but last time I appeared, it was 2135 Northwest 8th Avenue. Okay. So... They swapped it on me.

14:36Speaker 8

The case we're here on is 782 Northwest 21 Terrace, so that's the one we'll be addressing. How much time do you think you need?

14:45 – 14:59Speaker 3

We're doing a demolition. We got approved for the permit now. My client has to vet the contractor or whoever's going to do the demolition work. She's also dealing or has been dealing with some health issues, so we are graciously asking for

15:00 – 15:31Speaker 8

additional 150 if possible so that way they don't have to keep sending me out here as they complete this project and bring it to the finish line unfortunately we're going to recommend 30 days because the permits expired okay so counselor the permits have expired and the city when they recommend 30 days that's basically because they want them to come back present themselves to the city get their permit going again so they have to re-pool the permit at this point right um I don't know what exactly they have to do to reopen the project.

15:31Speaker 17

He says it was expired, so they just need to reactivate it. The contractor goes, he's the building official, they pay the reactivation fee.

15:38Speaker 8

Would they have to start that process, get that done in 30 days? Do we have a motion?

15:43Speaker 18

I move for 30 days. Second.

15:44Speaker 8

All in favor?

15:46Speaker 8

Thank you. Yes, sir. And then there's, once you come back, you get more time, and we're pretty generous with time, just you got to keep things moving.

15:55Speaker 3

need to reactivate at this point and then ask for the time yes sir all right no problem thank you

16:26 – 16:39Speaker 15

Page 10, City View, case number CE 2021-014-7509. Is that in code check or where is that? City View.

16:39Speaker 17

City View, extension of time.

16:41 – 16:59Speaker 15

City View, CE 2021. The page? Page 10. The beginning of the book. Address 761 Northwest 29th Street. Page 10, city view.

16:59Speaker 8

Is this mitigation now?

17:01Speaker 15

Extension of time. Extension of time.

17:05Speaker 8

Okay. For 761 Northwest 29th Street, right? Correct. Please state your name.

17:11Speaker 25

Eugenia Davis.

17:12Speaker 8

Okay. Can you speak in the microphone?

17:14Speaker 25

Yes, Eugenia Davis.

17:15Speaker 8

Okay. And your relationship to the property?

17:19Speaker 25

I have a power of attorney to present the client today.

17:21Speaker 8

Okay. How much time are you asking for?

17:23Speaker 25

120. Director?

17:30 – 17:52Speaker 22

The city recommends 30 days as the permit for the demolition was expired in 2024.

17:53Speaker 8

Do we have a motion for 30 days? I move for 30 days. Second. All in favor? Aye. You have to get the permit.

18:38Speaker 17

Next case, please.

18:44Speaker 15

Mitigations now.

18:51 – 19:09Speaker 15

Page 69 in code check. Case number 63660, address 717 Northeast 27th Street, page 69, mitigation, code check.

19:13Speaker 8

Good evening, sir.

19:15Speaker 12

Good afternoon, board. Brian Dombrowski, 333 Southeast 2nd Avenue. I was going to say this is an apartment building.

19:23Speaker 17

It's ran to $31,500. So the minimum is $15,000 or it might be a 20%er.

19:31Speaker 8

And what would 20% of that be?

19:33Speaker 12

I think it's around $6,000.

19:36 – 19:48Speaker 21

$6,300. See, that's the guy right there. That's the man. He does the math. That's why we went to law school. You can't ask. $6,300.

19:51 – 20:05Speaker 8

Counselor, is that what you're requesting, the 20%? Yeah. Let me just do the, I trust everybody's math, but I'm going to look at iPhone real quick. 6,300.

20:05Speaker 17

In honor of, well, St. Patrick's Day was last week, but Dooley's Law is trust everybody but cut the cards.

20:12Speaker 8

Dooley's Law, that's right.

20:13Speaker 17

That's right.

20:14Speaker 8

Okay, do we have a motion?

20:15Speaker 21

Motion for 6,300.

20:16Speaker 8

Do we have a second? Second. All in favor?

20:19 – 20:33Speaker 17

Aye. Thank you. Thank you, sir. So everybody, that's how the 20% works that we talked about before.

20:33Speaker 15

Page 89, code check.

20:38Speaker 17

There's no 89. There's no 89, do you have an 89? No. I have an 87 and I have a 91. I have an 89 but the address is not there.

20:48Speaker 18

84, sorry, 84.

20:54Speaker 15

Code check, case number 98944, property address 570, Northwest 30th Street, page 84. Code check.

21:05Speaker 17

This is a three-unit apartment building, $241,500. It's a commercial property. For the minimum is $15,000. Good evening. Good evening.

21:23Speaker 9

My name is Ted Dames.

21:25Speaker 8

Okay, are you the owner of that property, sir?

21:29 – 21:41Speaker 9

Okay, first of all, the property's not commercial. They told me that it's residential, so I was getting fined wrong. It's supposed to be $100 a day, not $500 a day.

21:42Speaker 8

Okay, well, right now we can't hear that. What type of property is it?

21:45Speaker 9

It's a duplex.

21:47Speaker 8

It's a duplex?

21:47Speaker 9

Yeah, a house. I have it as three units. It's a house and a...

21:53Speaker 8

Is it a triplex or duplex? How many units does it have?

21:56Speaker 9

It has two units, one house in the front and a apartment in the back. Let me pull it up.

22:03Speaker 18

Isn't the Zoni TL5? P5L, let me.

22:10Speaker 8

Who all lives there? You don't have to tell me names, but is it tenants?

22:18Speaker 9

Yes, two tenants.

22:19Speaker 8

Two tenants. And you rent it out?

22:21Speaker 9

Yeah. But they told me to be commercial, it's got to be like four units or more.

22:29Speaker 17

No, ours is so it's a triplex. So if it was a triplex, our code deals with triplexes.

22:36Speaker 8

If you pull it up in the county records, what does it show?

22:38Speaker 17

Yeah, I'm going to do that.

22:42 – 22:57Speaker 9

They don't have the county records on this one. When I went to the code department, all this started was just a 40-foot fence from here to here. I've been trying to get a permit for two years. I've been down there 100 times.

22:59Speaker 9

I had an engineer. He couldn't do nothing. I had to hire Brian to get the permits.

23:06Speaker 8

Is it legal now?

23:07Speaker 9

Yes, everything.

23:10Speaker 8

What's your name?

23:12 – 23:31Speaker 5

Sorry about the gentleman Ted. We was wrongly accused of offense that had nothing to do with us. I don't want to hear about the past. Because that's what took us longer. I got it. That's why we don't feel like what was being asked for is the correct amount because he was being accused of so many stuff that he's like, look.

23:32Speaker 17

So first of all, we don't do $100 for residential properties. They get $250. So let's just start with that. If you don't show up for your hearing. You can get up to $500, but lastly.

23:42Speaker 8

We're not arguing that. We already said that.

23:43Speaker 17

This is a three unit, and this is listed as three units with the county and with the city. It's not pulling up under mine. He got it on his.

23:52Speaker 8

I saw it. If you scroll down, it was like number.

23:54Speaker 18

It's on number nine on your.

23:56Speaker 17

Where is it? Yeah. Go to the right-hand side. Right there. Got it.

24:02Speaker 17

Three units.

24:03Speaker 7

Three units.

24:04Speaker 17

So specifically under our code.

24:06Speaker 1

Three units.

24:07Speaker 17

Three units, triplex, fourplex, apartment building, and all other commercial, $15,000 is the minimum.

24:15Speaker 5

Because that's why they keep telling us it was not a commercial. But look at the county records.

24:19Speaker 17

Well, you're talking about commercial. No, no, no.

24:21Speaker 5

I understand what I'm saying. Because what I see in the record, it says everything was voided because they made a mistake. So it's a bag of four. So we don't know how to.

24:28Speaker 8

Well, that you're going to have to get corrected. Just so you know, the lowest that we can go right now is 15,000. We can reduce it to 15,000.

24:35Speaker 17

If he thinks he can go somewhere and get them to change this and certify that he has a duplex, then I suggest you. Come back.

24:41Speaker 8

We take this off calendar and you come back another day. Go to county and correct it. Do we have a motion to reset this?

24:47Speaker 18

I move to reset this case. Second.

24:49Speaker 8

All in favor? Aye. We're going to reset it, bring it back. But if not, next time you already know what you're facing, 15,000. Yes, sir.

25:08Speaker 9

So I got a question. If it came down to $15,000, do I give a percentage of that?

25:15Speaker 8

What? Right now you owe $241,000.

25:17Speaker 9

Yeah, but that's not my fault that they dragged it out for two years.

25:22 – 25:36Speaker 8

Listen, we're not going to start pointing fingers here. You're going from $241,000 to $15,000. That itself is a miracle. If you want to try to get it down less, then you need to come back with proof that it's a real duplex. I mean, you're second-guessing yourself now if you're coming back up here.

25:38Speaker 18

If I may say something, once you reset this, the amount is going to be greater. No, it's not.

25:44Speaker 17

It's complied. It's complied. Oh, okay.

25:49Speaker 8

You were pretty sure it was a duplex a minute ago.

25:53Speaker 9

Yeah, but I was sure that it shouldn't take two years to get a permit.

25:58Speaker 8

We're not talking about that. That's not for here. There's other places to voice that concern. Okay.

26:12Speaker 9

So how did they come up with this 15,000 as the minimum?

26:16Speaker 17

This is not the time for that. Are you resetting your case or not?

26:19Speaker 9

No, you say it's a standard.

26:23Speaker 8

There's a code. I'm going to read you the code. It's section 2-6. 2-817 subsection D. There you go.

26:30Speaker 17

It's on the record. 2-817 of the code. Okay? Tells you the whole thing.

26:47Speaker 15

Next case from City View Agenda Mitigation, case number CE201.

26:56Speaker 8

Page number?

27:00 – 27:26Speaker 15

Case number 201614200. And page 4, it's the same property, 45 Northeast 42nd Street. Case number... CE2001018053, property address 45 Northeast 42nd Street, City View.

27:27Speaker 8

Good evening, sir.

27:29Speaker 8

Yes, sir. Please state your name.

27:33Speaker 29

John Gilpin.

27:35Speaker 8

You need to put the microphone closer so we can hear you.

27:38Speaker 29

John Gilpin.

27:41Speaker 8

Okay, my friend.

27:42 – 28:03Speaker 17

This is a six-unit apartment building. On the first case, the lien ran to $810,250. On the second case, the lien ran to, and that was from 2001, lien ran to $65,000. The minimum for each is $15,000.

28:03Speaker 8

The $65,000 one might be a little less.

28:05Speaker 17

Might be a little less, so we're going to get out the calculators.

28:08Speaker 8

Dooley's Law.

28:09Speaker 17

Dooley's Law. $1,300. There you go. So it would be $13,000.

28:14 – 28:35Speaker 8

So, sir, you already heard, I don't know if you heard the previous exchange with the other homeowner. You have a fine of $810,000. $810,000. That fine, the board can reduce it down to 15,000, which is a considerable reduction. Okay?

28:35Speaker 29

That is for which one?

28:37Speaker 8

That is for 45 Northeast 42nd Street. The tree one or the other?

28:43 – 28:58Speaker 29

That's the tree one. Correct. That's the tree one. On the mitigation, I'd indicated that all I did was trim the tree. Yes, sir. Without a permit. And the tree still exists.

28:59 – 29:21Speaker 8

The problem is, sir, at this hearing, we don't hear any of those facts. All we're looking at is the amount that is owed, and we try to help you and reduce it as much as we can, if there's grounds to do that. The most that we can go down to is $15,000, which is a big reduction, but I don't know if you can afford that or not. Thank you.

29:22Speaker 29

Can you make it less, please?

29:24 – 29:48Speaker 8

I can't. First, it's not me, it's the whole board. We cannot because your property is a multi-family property. We can only reduce it when it's a single-family residence or maybe a duplex. So if we get you to the $15,000 on that one and the $13,000 on the other one, are you able to pay it in 30 days? Yes.

29:50 – 30:08Speaker 29

No, I would need some time. I'm 88. I'm an old state employee, inspector-like. Income is low, but I have those two properties, that property to help me in my old age, right?

30:09Speaker 29

I am a general contractor, roofing contractor, but I cannot do much work. That's all we go. So whatever you can do, I appreciate you removed the other one down to 30.

30:20Speaker 8

The other one will go to $13,000, and this one would go to $15,000. The tree would be $15,000. And the other one will be $13,000. $13,000.

30:29Speaker 29

Can you give me more time, please, with my budget?

30:33Speaker 8

We don't have the authority to give you more time, but you may after.

30:39 – 31:07Speaker 17

You could, no. I mean, so it says 30 days. You can offer more time if you want to. I mean, you can't do a payment plan. You can't do that. So you can if you give them more time understanding that it would go down to the amount your interest starts to accrue automatically. Maybe, you know, they can give you 60 days or 90 days to do it. They can't give you a you can't do a payment plan. The city's not going to do a payment plan.

31:08 – 31:32Speaker 18

Can I ask you a question? Yeah. This is the first time that we're giving anyone time to finance the fee. And I've been here a long time. It's up to you. I just wanted to... We've never ruled on any kind of payment plan. We're here to rule according to what I was instructed based on the mitigation amount. We're not here to provide time for that.

31:32Speaker 6

Yeah, I don't think we can.

31:33Speaker 18

That's not our...

31:35Speaker 6

So Mr. Chair, can...

31:38Speaker 6

Can I clarify something?

31:40Speaker 29

I will have to adjust my budget, see how I can do whatever you decide.

31:47Speaker 8

Okay, thank you, sir.

31:48Speaker 29

I beg your sympathy.

31:51Speaker 8

Go ahead, board. Go ahead, Jose.

31:54Speaker 6

Isn't it not the case that they can make a partial payment, but the penalties accrue?

31:58Speaker 8

That's what I thought, but I didn't want to say that.

31:59Speaker 6

And I want to clarify that because I was under the impression that you have 30 days. If you make no payment, it goes back to the original amount. But if you make a payment.

32:08Speaker 8

I just don't want to represent that because I want to clarify. I don't know.

32:13Speaker 17

No, the code doesn't say that. It does not say that if you make a partial.

32:19Speaker 8

I've heard it off the record and that it worked, but.

32:22Speaker 21

I think the gentleman stated he could pay it. So I would like to make a motion. Can both motions together or individually?

32:29Speaker 8

Let's do a motion on the CE-201-601-4200.

32:34Speaker 21

So motion for $15,000. Second.

32:39 – 32:55Speaker 8

And do we have a motion on... Take a vote on the first one. Do we have a second? Second. All in favor? Aye. And on the second one, which is violation CE2001018053. Motion for 13,000. Second. All in favor? Aye.

33:27 – 33:40Speaker 15

Code check, page 126, case number 132567, property address 7617 Biscayne Boulevard, page 126, code check.

33:42Speaker 17

This is a commercial property, $32,500, so it is eligible for the 20%.

34:01Speaker 8

Good evening.

34:01Speaker 17

$6,500. Thank you.

34:05 – 34:16Speaker 8

Please state your name for the record. My name is Joseph . Okay, speak up so we hear you. Joseph? Joseph . Okay, Joseph, what's your relationship to the property?

34:18Speaker 7

Owner of the property.

34:20Speaker 8

Owner, okay. The lowest the board can go on this is 6- 6,500. $6,500. Yes. Okay.

34:31Speaker 25

Even if you explain the case, I'm just telling you that's as low as we can go. So, there's really no need. Do we have a motion for $6,500?

34:36Speaker 8

Motion for $6,500. Do we have a second? Second. All in favor? Aye. $6,500.

35:15 – 35:29Speaker 15

Page 98, code check. Case number 900009790. Property address 1693 Southwest 27th Avenue. Page 98, code check. This is a commercial property. The lien went to $337,250. So the minimum is $15,000.

35:44 – 35:58Speaker 8

Good evening, sir. Good evening. Please state your name for the record. Jesse Besadre. And your relationship to the property? I'm the owner. Yes, sir. And the violations went to $337,250? $337,000. Page 98? Yeah. On 1693 Southwest 27th Avenue? Yes, $337,250.

36:14Speaker 17

Commercial property, the minimum is $15,000.

36:18Speaker 8

So you've heard what we've said. The lowest we can go on this type of property is $15,000. Okay. It's a big reduction.

36:25Speaker 8

Do we have a motion for $15,000? Move for $15,000.

36:28Speaker 8

All in favor? Aye. Wait for the order so they can get that to you. Just wait for the order so they can give it to you.

36:36Speaker 18

No, no. You need to wait right here now so you can take it with you.

36:57 – 37:15Speaker 15

Page 94, code check, case number 100, I'm sorry, 00076403, property address 1139 Northwest 22nd Avenue, page 94, code check.

37:16Speaker 17

Say commercial property, the lien ran to $256,500, the minimum is $15,000.

37:25 – 37:48Speaker 8

Good evening, sir. Please state your name. Adam Anderson. And your relationship to the property? Property management. Okay. The fine went to $256,500. The minimum that we can go down to is, or the very most that we would be able to mitigate down to, is $15,000. Do we have a motion for $15,000?

37:48Speaker 18

Move for $15,000.

37:49Speaker 8

Second. All in favor? Aye. Please wait for the order. Thank you.

38:01 – 38:47Speaker 17

Yeah, it's like I don't even know what's coming. It's only a couple more weeks left. Do we have the next case?

39:14Speaker 8

Next mitigation.

39:15Speaker 17

I don't know.

39:16Speaker 15

I'll just start calling them in order. Page 57. One second.

39:29Speaker 17

Page 57, City View. Address 1645 Northwest 55th Street. Case number 0001416. Page 57.

39:39Speaker 8

In City View, we don't have a page. Code check. Code check.

39:44 – 40:07Speaker 17

Page 57. Somebody here for that? Industrious Universo LLC. This is a vacant lot. The lien ran to $740,000. The minimum is $7,500 for a vacant lot.

40:07Speaker 8

Sir, your fine is $700,000. Please state your name.

40:10Speaker 8

State your last name.

40:12Speaker 5

Yeah, that's I.

40:13Speaker 8

And the gentleman next to you?

40:16Speaker 5

Norby Bolivar.

40:19Speaker 8

What's your name?

40:21Speaker 5

Norby Bolivar.

40:22Speaker 8

Okay. And you're here on property 1645 Northwest 55th Street, correct?

40:29Speaker 8

The lowest we can go is 7,500. It's pretty low. Do we have a motion for 7,500?

40:34Speaker 18

Move for 7,500.

40:37Speaker 8

I heard a second. All in favor? Aye.

40:40Speaker 1

Thank you, sir.

40:41Speaker 8

You have to get the order. Next case.

41:03 – 41:15Speaker 15

Page 91 from code check, case number 119185, property address 2470 Southwest 3rd Street, page 91, code check.

41:19Speaker 8

Good evening. Hi, good evening. Can you put the microphone?

41:23 – 41:40Speaker 17

This is a single family home. It's not homesteaded exempt. It ran to $26,000. So the minimum would be $10,000 or 20% thereof, but by unanimous vote, you can go all the way down to zero if you so choose.

41:41Speaker 8

Okay. Well, please state your name.

41:43Speaker 16

Jacqueline Salsinas.

41:44Speaker 8

Okay. Jacqueline, what's your relationship to the property?

41:48Speaker 16

His attorney.

41:49Speaker 8

Okay. Do you want to give us a little history on this property?

41:53 – 42:08Speaker 16

Yes. This was a rented property. It's residential, one story. And it was during COVID, the tenant went and without consent built a driveway. Immediately when the owner found out, he complied. And as of today, he's completely in compliance.

42:09Speaker 8

And is the property being sold right now?

42:12Speaker 16

Yes. It's actually sold. The money's in my trust account.

42:14Speaker 8

Okay. Can somebody remind me what the minimum was on this?

42:22Speaker 17

It's $26,000, so the minimum is $10,000, but 20% is?

42:27Speaker 17

$5,200. And you can go to zero with a unanimous vote.

42:31Speaker 8

But he's not living there right now?

42:32Speaker 17

No. No. No, it was not Homestead before.

42:36Speaker 8

How much are you holding in your trust account to cover that?

42:39Speaker 16

I'm holding, it's a holdback of 40.

42:41Speaker 8

Okay. So 5,200, if we mitigate it to 5,200, you're good.

42:47Speaker 16

The zero would be better, but it wasn't his fault. I mean, it was his tenant.

42:53Speaker 18

Can I ask you a question? Yes. When was this property purchased by the owner?

42:58Speaker 17

I don't have the answer to that.

42:59Speaker 18

Do we have that information?

43:02Speaker 17

Not the most recent purchase?

43:04Speaker 18

Well, the purchase of the land.

43:06Speaker 17

The violator? The violator, correct.

43:09Speaker 18

Mr. Felipe Sanchez.

43:13Speaker 16

Let me see if I have his.

43:15Speaker 17

He bought it in 2019 and it was a rental. Okay, so he bought it. There was no homestead exemption on it.

43:20Speaker 18

Okay, so he bought it in 2019.

43:22Speaker 8

Right, it was being rented out.

43:23Speaker 18

Yeah. Yeah, I have a motion for $10,000. Okay.

43:29Speaker 8

Okay, we don't hear a second. Motion fails. Does anybody have a motion for 5,200? I'll make a motion.

43:36Speaker 7

Do we have a second? Second.

43:38Speaker 8

All in favor?

43:40Speaker 8

Roll call. Aye.

43:47Speaker 15

Ms. Bayona? No. Mr. Arias?

43:59Speaker 8

Yes. 4 to 1. Wait, wait, wait. We have another board member.

44:08Speaker 15

Oh, I'm sorry. Mr. Fernandez.

44:10Speaker 3

Rodriguez. Yes.

44:13Speaker 15

Rodriguez. Motion 5 to 1. Okay.

44:21Speaker 8

So it passes. 5,200.

44:25Speaker 8

You're welcome.

44:39 – 45:08Speaker 15

Next case. Page. Page 106 from code check. Case number.

45:14 – 45:27Speaker 17

Case number 00065644. Address is 5695 West Flagler Street. Case number 106. Commercial property. Went to $299,000. The minimum is $15,000.

45:34 – 45:58Speaker 8

Please state your name for the record. Limei Lopez. And you're here, are you here on the property located at 5695 West Flagler Street? The current fine on the property is $299,000. It's commercial, the minimum is $15,000. The minimum fine that we can go to is $15,000.

46:11Speaker 20

I'm not the owner of the property. I'm only renting the property for a shop.

46:16Speaker 8

Right, but I would assume under his lease, he's responsible for any damage or liens.

46:22Speaker 17

Does he have the power of attorney, Jose? You reviewed it? Okay.

46:28Speaker 8

Good English.

46:48 – 46:59Speaker 20

This is something that happened prior to me renting the property, and it's regarding a lift that was there, and the previous owner did not take accountability for it, so I was supposed to finish the paperwork.

47:03 – 47:29Speaker 8

All I can tell you right now is that he's here with authority. They requested mitigation. The board is going to go to mitigation, and it's highly likely that the board's going to vote to put a $15,000 penalty fine. How he wants to take that up with his landlord, that's between him and the landlord and maybe the previous tenant. Do we have a motion for $15,000?

47:31Speaker 8

All in favor? Aye.

47:37Speaker 20

We can't go any lower. I appreciate it.

47:42 – 47:54Speaker 8

Page 54, cold check, case number 100723, property address 6250 Northwest 15th Avenue, page 54, cold check.

48:06Speaker 17

So vacant lot, the lien ran to $93,000. The minimum on a vacant lot is $7,500.

48:16Speaker 8

Good evening.

48:17Speaker 26

Good evening.

48:17Speaker 8

Please state your name.

48:18Speaker 26

Danielle Slater. I'm the attorney for the personal representative for the estate of Gene Webster.

48:24 – 48:37Speaker 8

Okay. And Ms. Slater, I see the fine went to $93,000. The minimum that we can go to is $7,500. $7,500. Do you know any history about the property or anything?

48:37 – 48:55Speaker 26

He purchased the property in 2020. He passed away in August of 2023. The first violation occurred in July of 2024. He was a resident of the Virgin Islands. The surviving spouse was in the Virgin Islands. There was no local family and nobody received notice of the violation.

48:55Speaker 8

Was there a house there? No, it's a vacant lot.

48:58 – 49:10Speaker 26

It's a vacant lot. We didn't receive notice of it until we tried to sell it through the probate, and it came up on a lien search. We immediately addressed it, and it was in compliance in February.

49:10Speaker 8

Based on the factors that you outlined, the lowest that the board can go is $7,500.

49:15Speaker 26

I would appreciate that.

49:16Speaker 8

Do we have a motion? I move.

49:19Speaker 8

Second. All in favor? Aye.

49:21Speaker 26

Thank you very much. Just wait for the order.

49:31 – 50:12Speaker 15

Code check, page 57, case number 00001416, property address 16. We already did that one. We already did that one. Okay. Page 77, code check. Case number 60507, property address 45 Northwest 32nd Street. Page number 77, code check. Case number 60507, 45 Northwest 32nd Street. This is a vacant lot, the lien rent in $10,500. The minimum is $7,500 or 20% of $10,500.

50:27Speaker 21

Which is? 5,100. Boom. No.

50:29Speaker 8

20% of... I believe you. I don't know.

50:35Speaker 21

I wanted to see if everybody was paying attention.

50:38Speaker 8

I knew it wasn't that number. 2,100.

50:41Speaker 21

2,100, yeah.

50:44Speaker 8

Okay. Good evening, sir.

50:45 – 51:05Speaker 4

How are you? Sebastian Reuter. Thank you, Board. Address is 45 Northwest 32nd. I'm here representing the corporation. I'm the register manager of the company. We have a planned affordable housing project there. Unfortunately, there was a miscommunication with the letters and the system registration of the vacant lot. We have corrected it, and we're asking for mitigation.

51:06Speaker 8

So what the board can do for you is they can go as low as $2,100.

51:11Speaker 4

Much appreciated.

51:11Speaker 8

Yes, sir. Do we have a motion for $2,100? So moved. Second. All in favor? Aye. Just wait for the order, sir. Thank you very much.

51:28 – 51:47Speaker 15

Code check, page 87, case number 109701. Property address 1811 Northeast 10th Court, page 87. And it has an add-on. Casa Vad.

51:48Speaker 8

Casa Vad. 7811 Northeast 10th, that's you. Come on down.

51:56Speaker 17

All right, this case is a four-unit building. It ran to $84,250, the minimum. is $15,000.

52:07Speaker 8

The lowest that they can go is $15,000 from 84. Okay. Do we have a motion for $15,000? Move for $15,000. Second. All in favor? Aye. Just wait for your order.

52:15Speaker 5

There's two cases.

52:17Speaker 8

That's the only one I have right now.

52:24Speaker 22

It is add-on two. Okay.

52:28 – 52:39Speaker 15

Add-on two from code check case number one. 119831, property address 7811 Northeast 10th Court.

52:42Speaker 8

7811 Northeast, that's what we just did, 7811 Northeast 10th Court.

52:45 – 53:03Speaker 17

Yeah, different case, 00119831. Case ran, it's again, four unit property. The lien ran to 52,000. The minimum would be $15,000, but 20% of $52,000 is $10,400. $10,400?

53:04Speaker 8

Yes. Okay. Do we have a motion for $10,400? So moved. Second. All in favor?

53:12Speaker 8

The other one can go down a little lower.

53:18Speaker 17

And I used the calculator while I was speaking.

53:20Speaker 18

That's the only reason why I did that quickly.

53:23Speaker 17

I'm not the numbers guy, though.

53:42 – 53:56Speaker 15

Page 102, code check. Case number 14694. Property address 1120 Northwest 26th Avenue. Page 102, code check.

53:57 – 54:09Speaker 17

This is a duplex. The lien ran to $635,000. Who's here on this one? Daniel Lima? Dania Lima, please come up.

54:11Speaker 17

$635,000. This is a duplex. I do not know if it's owner occupied.

54:19Speaker 8

Ms. Lima, do you live at the property?

54:22Speaker 8

Okay. Who lives there? It's an ALF. It's an ALF. Is this from like the hurricane time when they were doing this?

54:31Speaker 17

Yeah. So the minimum would be $10,000 since it's not owner occupied or By unanimous vote, you can go down to zero. It is an ALF.

54:42Speaker 8

Does anybody have a motion?

54:44Speaker 18

I move to zero.

54:46Speaker 8

Do we have a second? Second. All in favor? Aye.

54:52 – 55:41Speaker 15

Add on three from code check, case number 14622, property address 260 Northeast 58 Terrace. They also have another case, right? I'm sorry, what's the page number? Add-on three. It's an add-on three, and then from the city view, it's just an add-on case number CE 2020 015262. Address 260 Northeast 58 Terrace. What's the page again? Page? Add-on. Add-on. All right.

55:43 – 56:14Speaker 17

This is... I'll do both of them. This is a vacant lot. It was always vacant, just so you know. So the minimum for both is $7,500. For the code check case, which ends in 622, it ran to $567,000. And for the... City View case, which ends in 262, the lien ran to $449,250. Again, the minimum was a vacant lot is $7,500.

56:15Speaker 8

Good evening, Councillor.

56:16Speaker 7

Good evening. Thank you.

56:18Speaker 8

Thank your name for the record.

56:19 – 56:31Speaker 7

I'm Frank Woland. I represent Dr. Tina Miranda, who is the owner. She could not be here today. She's in Georgia and Kentucky.

56:32Speaker 8

She has you here, so she's good.

56:34Speaker 8

She has you here, so she's good.

56:36 – 57:13Speaker 7

Well, yes and no. It depends on your ruling. I will respectfully tell you that she does have a real hardship She is a physician. She was working at the VA when this all started during COVID. And then her mother came down, her very elderly mother, 87 years old, and had a stroke. So for the past three years until her mother died about a year ago, she was her mother's continuous 24-7 caretaker.

57:14Speaker 8

So not to interrupt you, but these are both vacant lots, correct?

57:17Speaker 7

It's just one vacant lot.

57:19 – 57:45Speaker 17

It's a vacant lot with two separate violations at two separate times. So prior, well prior, one is from, one is from, let's see, mid 2020 for failing to maintain it and having junk and garbage on it. And then the other one, give me a minute, I'll find it. That's a much more recent one.

57:46Speaker 8

So it's like almost a million dollars in fines.

57:50Speaker 7

I understand that.

57:52Speaker 8

The lowest that we can go, I mean, just to cut to the chase, is we can go as low as $7,500 on each one.

57:59 – 58:22Speaker 7

is it if it if it pleased the board perhaps they could be consolidated um as one and uh i really do think this is a hardship and she did not have the ability financially and practically to deal with it the problem is is when we're trying to qualify it as a hardship and go into the matrix

58:22Speaker 8

It's not a single-family residence. It's not a duplex. It's just a vacant lot. So we can only go so low. It's a vacant lot.

58:31 – 58:48Speaker 17

And the answer in terms of consolidating it would be there's no legal basis to do that. You have two separate cases at two separate and distinct times. It was uncared for at one point, and then it was complied again, and then it was allowed to fall again uncared for and then was complied with.

58:49 – 59:11Speaker 7

I thought that the... The situation was because there was a modular home which was on the property. When the property became vacant, basically the neighbors used it as a dumping ground, and she could not control that. So I don't know if because there was a home on it, perhaps it could qualify.

59:11Speaker 17

No, there was not a home on it.

59:13 – 59:25Speaker 8

When the violations happened, there wasn't. It was a lot. I understand. So do we have a motion as to the violation ending in 622? Do we have a motion for 7500? I move for 7500.

59:26Speaker 8

All in favor? Aye. And as to the violation ending in 262, do we have a motion for 7500? I move for 7500. Second. All in favor? Aye.

59:36Speaker 7

Thank you all very much. Thank you, Ms. Julie.

59:38Speaker 8

Thank you for coming.

59:41 – 59:53Speaker 15

Code check page 118, case number 87114, property address 1243 Northwest 61st Street, page 118.

59:53Speaker 17

Good evening. A four-unit building ran to $214,000. The minimum would be $15,000.

1:00:00Speaker 8

Please state your name for the record.

1:00:03Speaker 10

Lina Mears Portello.

1:00:05Speaker 8

And your relationship to the property?

1:00:06Speaker 10

Property manager.

1:00:08Speaker 8

Okay. You're aware that the fine is $214,000 right now?

1:00:13Speaker 8

Okay. The lowest that the board can go is to $15,000.

1:00:19 – 1:00:34Speaker 10

I understand the minimum amount, but I would like to request an exception because there was a mistake that was made on the city's end that impacted the issue. I printed one of the emails, if you allow me to share it with you.

1:00:36 – 1:00:51Speaker 8

We can't go lower than $15,000. If you want us to start at $240,000 and then we hear your arguments, you know, maybe we land somewhere in between $100,000. I'm just saying at this time we could offer you the $15,000 because that's as low as we can go.

1:00:51Speaker 10

And if we take that today, is there a way to explain the case further later on?

1:01:01Speaker 10

Will this be definitive?

1:01:03 – 1:01:38Speaker 8

This is definitive. What I'm telling you is that even if you made the very, very best arguments that you could make, you can't go lower than 15,000. Okay. That's as low as you can go. You're welcome to tell me all the arguments you want, but maybe they give you $20,000 because they don't like something that happened along the way. I can tell you that generally blaming the city is not a successful argument to mitigation. So if that's the basis of how you think you're gonna reduce your fine, I would just take the lowest amount that's available.

1:01:39Speaker 8

All right. Do we have a motion for 15,000?

1:01:41Speaker 18

Move for 15. Second.

1:01:42Speaker 8

All in favor? Aye.

1:01:50 – 1:02:20Speaker 15

City View, page 25 and page 28. Page 25 is case number CE2019019506. And page 28 is CE2017-015827. The property address is 2048 Northwest Miami Court. City view page 25 and 28.

1:02:20 – 1:02:40Speaker 17

This is a commercial property. The case for 506, the lien ran to $441,750 for the case ending in 827. The lien ran to $659,750. The minimum for each is $15,000.

1:02:41Speaker 8

Good evening, sir. Hi, how are you, sir? I'm doing well. What's your name?

1:02:43Speaker 7

Gonzalo Martinez.

1:02:45 – 1:03:11Speaker 8

Mr. Martinez, so you have about a million dollars in violations. On the first violation, there's $441,750. On the second violation, it's $659,750. The properties are commercial, so the lowest the board can go is $15,000 on each violation, okay? Do we have a motion on violation 602019019506 for 15,000?

1:03:11Speaker 18

I move for 15. Second.

1:03:13Speaker 8

All in favor? Aye. And on violation number CE2017015827, do we have a motion for 15,000?

1:03:23Speaker 18

I move for 15. Second.

1:03:24Speaker 8

All in favor? Aye. Just wait and they'll give you the orders.

1:03:28Speaker 18

Thank you. Thank you, guys.

1:03:45 – 1:03:56Speaker 15

Code check, page 35, case number 140175, property address 2343 Southwest 17 Terrace, page 35. It's an extension of time. That was on code check? Hello? Code check. Good evening.

1:04:13Speaker 2

Okay. Okay. How much time does she need? Or more. Go ahead and translate for everybody. Okay. Okay.

1:04:38Speaker 20

I would need 90 days, maybe more if I can have more because I've had a lot of problems. And if I'm able to get more, I would appreciate it.

1:04:51Speaker 8

So, and does she know how, there's like some assistance for her maybe if she needs help getting her permits and things like that? What does she need, a permit?

1:05:01Speaker 17

Clear up the exterior. So she had a failure to maintain the exterior of the property.

1:05:05Speaker 8

Oh, so she's just got to clean it up.

1:05:06Speaker 17

It's in disrepair, so I'm not sure. I'm putting the pictures up.

1:05:12Speaker 20

I need to fix the property.

1:05:14Speaker 17

I have 90 days. Does she have permits?

1:05:17Speaker 22

I'm looking at it now. One second.

1:05:22Speaker 17

This is the one where they did a demo in the back, but they didn't finish.

1:05:25Speaker 8

Oh, my goodness. She lives there?

1:05:27Speaker 17

Yeah, there's a front, and this is the back half.

1:05:32Speaker 17

Yeah, it's the back of the property.

1:05:33Speaker 8

She lives here?

1:05:34Speaker 17

Right, so the front is fine. This is what happens to the back.

1:05:40Speaker 20

Yeah, the damage is on the back of the property.

1:05:44Speaker 8

She's probably going to need somebody to, like, got to get a contractor or something, right?

1:05:52Speaker 17

Okay, so they had somebody submitted for a process number, but they haven't paid anything and they haven't uploaded anything, right?

1:05:59Speaker 22

Tell her. They submitted it yesterday.

1:06:05Speaker 20

They haven't paid?

1:06:07Speaker 17

It's not paid yet.

1:06:10Speaker 8

They didn't pay for the permit?

1:06:12Speaker 17

No, no. Once you do it, then you pay like $200, I think, or something, and then it got it clear and everything else.

1:06:21Speaker 20

You can do 90 days, and then she'll come back, and we can see where she is. I will contact the contractor, and if anything, I will pay for it.

1:06:29Speaker 8

Okay. Okay. We're going to give her a vote for 90 days, or maybe the board gives her more. I don't know. But explain to her also there's a paper if she needs more time.

1:06:38Speaker 21

Motion for 120. Do we have a second? Second.

1:06:42Speaker 8

All in favor? Aye.

1:06:48Speaker 15

Page 110. Are you going to vote?

1:06:53Speaker 8

We did already. We already did. 120 days. 120 days.

1:06:59 – 1:07:14Speaker 15

Thank you very much. Have a good afternoon. Page 110, code check mitigation. Case number 48502, property address 7001, Northwest 15th Avenue, page 110.

1:07:16Speaker 17

The apartment building, the lien ran to $67,000. The minimum is $15,000 or 20% is $13,400.

1:07:30Speaker 8

And this is 7001 Northwest 15? Yes. And there was 10,000 what?

1:07:37Speaker 17

No, the minimum is 15,000. It's 67,000. The minimum would be 15,000 for commercial property, but 20% under the code would be 13,400.

1:07:50Speaker 8

Good evening, sir.

1:07:51Speaker 8

Please state your name.

1:07:54Speaker 8

And your relationship to the property?

1:07:55Speaker 21

I am the property manager.

1:07:57Speaker 8

Okay. The fine went to $67,000. The board can reduce the fine to $13,400.

1:08:05Speaker 21

I would truly appreciate it.

1:08:07Speaker 8

Do we have a motion?

1:08:08Speaker 18

I move for $13,400.

1:08:09Speaker 8

Do we have a second? Second. All in favor? Aye. Thank you. You just have to wait for the order.

1:08:19 – 1:08:30Speaker 15

Code check, page 122, case number 18. 00009748, property address 1458 Northwest 69 Terrace, page 122.

1:08:30 – 1:08:48Speaker 17

This is a single family home. It did not have homestead exemption. The lien ran to $156,000. The minimum would be $10,000 or down to as low as zero with a unanimous vote.

1:08:49Speaker 8

Good evening, sir.

1:08:50 – 1:10:05Speaker 28

Good evening, Board. My name is Mark Aladef. On behalf of the owner, my address is 119 Biscayne Boulevard, North Miami, 33181. We are respectfully requesting a reduction in fines to zero. This was a purchase through foreclosure by my client. They closed December 30th. They immediately started work to erect a fence and clean up the property. The fence was breached at one point, and then they had to repair it and clean it up again. We are currently under contract because, well, let me backtrack. There's the violation that we're here for now, which is for the cleanup, and then there's also some unsafe structure issues with the property, which we're not here for today. However, we've found someone to purchase the property And they're going to handle all of the unsafe structures and permitting parts, provided that we are able to get through today and clear this up. As you can imagine, there's not a lot of money in these kinds of deals. So, you know, we're trying to reduce this as much as possible.

1:10:05Speaker 17

If you put up a fence, though, you need to have a permit for that.

1:10:10Speaker 28

Yes, they did.

1:10:11Speaker 17

There's no permit in the record for a fence. So you might want to take care of that before.

1:10:19Speaker 21

Chair, quick question. Can I ask a quick question? Of course, sir. Your client knew the violation existed when they bought it in foreclosure?

1:10:28Speaker 28

They knew that there were issues with the property. I frankly don't think that they investigated it. And you said they're selling the property now? Yes.

1:10:38Speaker 21

How much profit are they making?

1:10:41 – 1:11:10Speaker 28

Well, I'll tell you exactly. They paid $135,400 for it at auction. The contract is for $205,000. And during that time, there's, of course, fees and closing costs that they're required to pay. They've already paid money, carrying costs for the last few months, cleanup fees. So they have some money into it. There's not a lot of juice to squeeze here.

1:11:11Speaker 21

Make a motion for 10,000. Second.

1:11:14Speaker 8

All in favor? Aye.

1:11:25 – 1:11:57Speaker 15

City View, case number CE2019000124, page 31, property address 2901 Center Street, Unit A, page 31, City View, case number CE-2019-00-0124, 2901 Center Street, Unit 8. This is a single- Wait, is that City View?

1:11:58 – 1:12:13Speaker 17

City View, yeah, page 31. This is a single-family home, homestead exempt. The... Lean ran to $197,400. The minimum is $5,000 or 2-0 by unanimous vote.

1:12:14Speaker 23

How are you, sir? Good evening. I'm good. How are you guys? Good.

1:12:16Speaker 8

What's your name?

1:12:17Speaker 23

Alan Sasson, 2901 Center Street.

1:12:20Speaker 8

You live there?

1:12:21 – 1:13:01Speaker 23

Yes, sir. I've been there since 2000. All right. When I had the issue with the city, I immediately came here, actually, and went to go take care of it. I was never told as an owner, I was not able to complete this on my own until after COVID. Once COVID came around and I was told that I had to have a contractor, I hired a contractor and from the contractor till maybe six months ago, it took from 2021 to six months ago with a contractor and architecture, a structural engineer to get everything done and completed. So I'm hoping, you know, it cost me a lot of money to get it done. And I was hoping we can get it below the 5,000 board.

1:13:01Speaker 8

Um, The gentleman lives here in the property. It's his homestead. We have the ability to go to zero.

1:13:08Speaker 18

I move to zero. Second.

1:13:10Speaker 8

All in favor? Aye. Thank you. Yes.

1:13:13Speaker 18

Thank you very much.

1:13:21 – 1:13:43Speaker 15

Thank you. Page 130 from code check, case number 00009805. Property address 2970 Southwest 9th Street, page 130, special appearance, code check. Which is the address again?

1:13:44Speaker 18

2970 Southwest 19th Street.

1:13:48Speaker 8

And what is this going to be, a release of lien or something?

1:13:51 – 1:14:17Speaker 17

I guess they're asking for a partial release. This is a property violation was for fence and driveway. Case is from 2023. No activity or action has been taken to bring the property into compliance. The lien is running. No permits applied for. And they're seeking a release for another property.

1:14:18Speaker 13

Good afternoon, members of the board. Christy Estevez-Puentes on behalf of the homeowners.

1:14:23Speaker 8

Can you speak up a little bit, please?

1:14:24Speaker 13

Let me look. Is that better?

1:14:26 – 1:14:39Speaker 13

Okay. Okay. Christy Estevez-Puentes on behalf of the homeowners. This property is owned by Angela and Maria Redesia. This is only Angela's homestead property. She's resided there since going on title in 2021.

1:14:39Speaker 8

When you say this property, which property?

1:14:41Speaker 13

The subject property in the city of Miami.

1:14:43Speaker 8

So that's 2970 Southwest 19th Street.

1:14:45Speaker 13

Yes, I know it does get a little confusing. I apologize.

1:14:48 – 1:15:53Speaker 13

Maria Redesia owns and lives in the city of Miami Springs property, which is 510 Lee Drive. She has never had a homestead exemption in the City of Miami 2970 property. Unfortunately, Jesus, her husband of 68 years, passed away last August, and he was the one that was, to my knowledge, handling these matters, and the family relied on him to take care of these issues. I do understand that we still have the underlying violation, and of course, we're not here to mitigate the lien amount. What we're here to do is sell the Miami Springs property. Now that Ms. Maria Valdecia is an 85-year-old widow, she can no longer live on her own. She needs to move into the city of Miami property, but we cannot sell that property without getting a partial release. This is under contract. The sale date is set for April 3rd. We have a draft closing statement. All of the net proceeds, which is over $100,000, are going to be used to fund the project to bring the Miami property into compliance. And we're talking about offense.

1:15:53Speaker 8

Let me ask you, when you say to fund the project, is that you already have a contractor retained?

1:15:58 – 1:16:45Speaker 13

We do have a contractor quote. They've already done that. They've also gotten a survey recently for the property. It's only a few weeks old. They have not formally retained the contractor because, again, we need the funds from the City of Miami Springs property. I do have a draft settlement statement. We have earmarked a line item, $10,000, for the contractor directly from closing to the contractor to begin the project. Also to note, the contractor's... quote, is $7,500, but we've earmarked $10,000 just because other things can arise, of course, and we don't know what that might be. But aside from that $10,000, there's still over $100,000 that will be left, and those net proceeds are going to be used not only to comply the property, but also to, when we come back here, to mitigate the lien amounts.

1:16:46Speaker 8

And for her to live there.

1:16:47Speaker 13

And, of course, for her to live there. She'll be living there with her daughters.

1:16:50Speaker 8

She has to make it her homestead property, too, before she comes to mitigation. I'm not giving legal advice.

1:16:55Speaker 13

No, of course not. And she will. And it is homesteaded for Angela.

1:16:58Speaker 17

And I did speak to council prior. She did send documents and everything showing all of those things in the documents that she's relating to you now. So I have seen all of that.

1:17:07Speaker 8

Based on council's representation and the city having reviewed the documents, I think it would wise to release the Springs property.

1:17:15Speaker 18

I move to release the document.

1:17:17Speaker 8

Second. All in favor? Aye.

1:17:19Speaker 17

And the address is 510 Lee Drive.

1:17:22Speaker 13

Yes. Correct? Yes, 510 Lee Drive in Miami Springs.

1:17:25Speaker 17

Just email me in the morning, but I'll work on the release, so you'll have it in the morning. We will record it, though. Thank you so much. Appreciate it.

1:17:42 – 1:17:53Speaker 17

We're calling them out of turn, but okay. Now where are we? No, we have people here.

1:17:54Speaker 17

Is anybody waiting to be called?

1:17:57Speaker 8

And no absentias? We're good, right?

1:18:01Speaker 17

No, that's it then. We just have people here just hanging out. Okay. Okay.

1:18:04Speaker 8

Is there something we can help you with?

1:18:06Speaker 17

Does somebody think they have something on the calendar? Are we having happy hour? No?

1:18:12Speaker 7

Nothing? Okay.

1:18:13Speaker 8

Have a good evening.
