Good evening. Tonight everybody is here for the first time regarding whatever violation you may have been cited for. This is your first time here. This is what they call it to be heard or the first time you're here. When your case is called, you're going to come up to the podium. You're going to state your name and your address. The chair is going to ask you whether you're guilty or not guilty. What that means is whether at the time the violation was issued, whether the property was guilty or not guilty. Not so much yourself, but the property. If you plead guilty, the city will briefly, through the assistant city attorney, explain to the board what's going on with your property. The board will deliberate and determine how many days you need to come into compliance and a per diem deadline. Fine if you don't come into compliance within the time provided if you don't come into compliance by the time provided if you're a residential property you can Be fined up to two hundred fifty dollars per diem or a thousand dollars for non-residential commercial property And if you're a repeat violator, it's five hundred dollars for residential and up to five thousand for a non-residential commercial if you don't if you run out of time and To comply up in this podium where you're going to be standing, there is a piece of paper. Please take it. It explains how you request additional time. So, for instance, if you have 20 days and it's day 18 and you're not going to comply by the 20th day, you have to request an extension of time by the 18th. If you request an extension of time before the 20th day comes and your 20 days don't expire, your fines don't start running. So that's very important so your fines do not start to run. So please take that paper after your case is complete. If you plead not guilty, the Assistant City Attorney will put on her case. You can put on your defense. Your defense is limited to the citation and the matters before the board. The board will deliberate and give you the time to comply, and if there is an applicable fine, they will advise you of that applicable fine. All orders of the board are appealable to the 11th Judicial Circuit Court of Florida within 30 days.

It's my pleasure to see you this evening. I know you have a long agenda, so to cut to the chase on this fact pattern, it is somewhat... Long and heartbreaking, the prior owner, not my current owner, but the prior owner, who I do not represent, was an elderly gentleman that's had a lot of health problems, and all these violations arose during his ownership. He ended up having to go to a long-term healthcare facility up the state, and he was not responding to the notices or taking care of his personal business because of this tragic health situation. My clients are recent owners earlier this year, and the minute they got on the scene, they aggressively worked with the city staff. They have repaired all of the repairs, and the property is in good shape, as Rachel can teach us, that we're not even allowed to come here on a mitigation until the city confirms that everything is in compliance. So it is a... an entity, a corporate entity. The general contractor is here if you have any questions. And Rachel was explaining to me that if it's a corporate entity where they don't live in the house, which we don't, the minimum is $10,000 based on the unusual fact pattern that it was the prior owner who had this health problem. And with the speed that they addressed everything, We would like to respectfully request the special relief of a $2,500 fine instead of the full amount.

The property is within the Buena Vista East Historic District, I believe. and to just provide a little bit of color, and I believe that we do have an email from Supervisor Sierra that we filed the vacant property registrations. Yes, they did. Earlier, so that part of it should be done. My understanding is it's only just the facade, and... But yes, this property also is subject to an unsafe structure case, and in order to correct that case, we're going to need to go through the building permit process, and that's going to make us go through HEP with a certificate of appropriateness and all that stuff, because the property is in the historic district and is a historic property. Just to add a little bit more color, this is a single-family home. It is owned by a charitable organization that provides care to people suffering from HIV and AIDS. And so the property behind it is occupied and operating as a care facility.

Oh, sorry, my name is Andrew Bonsignor. I'm a homeowner in the Buena Vista East Historic Neighborhood and also a member of the board which represents our neighborhood.

4412 Northeast First Avenue. I'm a property owner. So I moved in and purchased that property in 2017.

Yes, I'll be very brief. So I just wanted to point out a lot of the structures on list today have been in the state that they are since I moved in and before I moved in. So it's been almost a decade. So this has just been brought to light. So I just want to reiterate the timeline. There's been years and years and years and years of neglect and time to address these and bring them back up. to their historic standing and there's really been very minimal if nothing done on a lot of these properties which is why we are here to represent our neighborhood as property owners because these properties directly bring down the property value of all our properties as well. So I just want you Gal to know that almost all of these properties have been in this state of decay for almost 10 years now if not more. So it's not been a new thing. It's been a really, really prolonged problem that we've all been kind of trying to live with and deal with on a day-to-day basis. I just wanted to point that out.
Hopefully, like, you know, even though it's a few, just keep chipping away at them little by little. And, you know, the biggest goal of the city and the board is to get compliance first. The fines are secondary, but it's really to get the properties in compliance.
Okay, because that was kind of my question. The previous property, yeah, they boarded up the windows and they're going to paint it, then it's a contributing historic structure. So what, it just sits there and gets mold and decays more and more year after year? Because I think once that's complete, then they kind of just get a pass to just leave it as is because they're no longer accumulating finds. It's kind of how we've seen this experience, Pat.
If I may, it has a lot to do, too, with how persistent you can be in advising this to the city. Because if you just... tell them once and you drop the ball and you don't communicate again, it's gonna sit there not for 10, but for 20. And unfortunately, we don't have a very strong board that preserves these things, but keep your voice and You know, I understand exactly what you're saying, and I wish we can preserve more because we're losing a lot every day. So I'm a huge advocate for that. And be persistent, and that's all I can tell you. Send emails and drive them crazy and, you know, until you get yourself heard.

Yeah, I was going to say, and the other thing, too, is some of this stuff that, because it's in historic district, there's a process that the city has in place to even begin to repair something.
I'm well aware of the process of getting my window permits, and the paint color was like months and months.
So some of this stuff, and if they don't have the right-of-way funds and stuff like that, then it's just a process that they're going through until they can do what they do, and all we can do is what we've just done here.

I'm not sure. I mean, as far as the registration, that takes, what, a day or two. They need to paint it or pressure clean the property. So I would say, I don't know, no more than a month or whatever.

It's been just a headache, to say the least. I bought this property... intending to bring this magnificent house back to its own glory and original facade and this and that. And it's been held, to say the least. Five minutes ago, I received the pictures because I didn't even know what this was about. I had a first violation in June of last year, and I immediately, like within 24 hours, sent back to the Inspector Johnson all the pictures and everything that was repainted and graffiti and things that happened in the property that I don't even live nearby, as my neighbor, next-door neighbor, explained. All these... is about the historic district and delays. I haven't been able to get anything approved. The only thing I got approved was demo, and I immediately moved forward, not knowing that it was gonna get stuck in there, and that's why you see all the windows that way, because I never intended for that house to be in these conditions for this long. Nevertheless, I'm stuck in this situation. So knowing from the inspector, who I talked to two and a half hours ago and received the pictures five minutes ago, literally here, I can have that painted, pressure cleaned, whatever, tomorrow morning. I have a crew who can take care of it, no questions asked. Now, about the boat. When I had that violation last year, June of last year, Inspector Johnson was very clear that the vote was inside my property, not causing any kind of interference with anything or anyone.
It can't be within the first layer. So the problem is it's within the first layer. It sticks out.
