Do you swear to translate from English to Creole, and Creole to English to the best of your ability?

1:16Speaker 1

1:25Speaker 1

Okay. Thank you very much.

1:32Speaker 14

Roll call. Mr. John Connell.

1:37Speaker 14

We have a quorum. Mr. Chair, I got an email this afternoon from Member Galan. that he won't be able to attend tonight. If we can get an excused absence.

2:05Speaker 10

Do we have a motion? So moved. Second. All in favor? Aye.

2:09 – 4:25Speaker 18

Good evening. Tonight everybody is here for the first time regarding whatever violation you may have been cited for. This is your first time here. This is what they call it to be heard or the first time you're here. When your case is called, you're going to come up to the podium. You're going to state your name and your address. The chair is going to ask you whether you're guilty or not guilty. What that means is whether at the time the violation was issued, whether the property was guilty or not guilty. Not so much yourself, but the property. If you plead guilty, the city will briefly, through the assistant city attorney, explain to the board what's going on with your property. The board will deliberate and determine how many days you need to come into compliance and a per diem deadline. Fine if you don't come into compliance within the time provided if you don't come into compliance by the time provided if you're a residential property you can Be fined up to two hundred fifty dollars per diem or a thousand dollars for non-residential commercial property And if you're a repeat violator, it's five hundred dollars for residential and up to five thousand for a non-residential commercial if you don't if you run out of time and To comply up in this podium where you're going to be standing, there is a piece of paper. Please take it. It explains how you request additional time. So, for instance, if you have 20 days and it's day 18 and you're not going to comply by the 20th day, you have to request an extension of time by the 18th. If you request an extension of time before the 20th day comes and your 20 days don't expire, your fines don't start running. So that's very important so your fines do not start to run. So please take that paper after your case is complete. If you plead not guilty, the Assistant City Attorney will put on her case. You can put on your defense. Your defense is limited to the citation and the matters before the board. The board will deliberate and give you the time to comply, and if there is an applicable fine, they will advise you of that applicable fine. All orders of the board are appealable to the 11th Judicial Circuit Court of Florida within 30 days.

4:37 – 4:52Speaker 14

First case is an add-on. Case number CE-202-0009-106. Property address 490 Northwest 47th Street. This is a City View case add-on.

4:58 – 6:21Speaker 12

Call. 490. This is a mitigation. It was originally set for... What is it? for two weeks, but they had a closing coming up, so our request was to move it up. We did move it up. This is a single family home, and I will pull up the file on it that... Do we have a page number or anything? It's the add-on. The lien total reached $433,750. It's a single family home. It's not currently occupied. So the minimum is $10,000 or to zero if you agree by a unanimous vote. I know that in the process of doing these repairs, the owners had to stop and start doing permits on more than one occasion. It is a very old case. It was complied a while ago, but it only recently was complied in the system, so the lien was higher. I'll let Council do the rest.

6:22Speaker 10

Good evening. If you could just state your name.

6:25 – 8:13Speaker 4

Yes, sir. Thank you, Assistant City Attorney Rachel Dooley. My name is Paul Savage with Law Offices at 200 South Biscayne Boulevard, Miami, Florida. Thank you, Mr. Chairman and other board members. It's my pleasure to see you this evening. I know you have a long agenda, so to cut to the chase on this fact pattern, it is somewhat... Long and heartbreaking, the prior owner, not my current owner, but the prior owner, who I do not represent, was an elderly gentleman that's had a lot of health problems, and all these violations arose during his ownership. He ended up having to go to a long-term healthcare facility up the state, and he was not responding to the notices or taking care of his personal business because of this tragic health situation. My clients are recent owners earlier this year, and the minute they got on the scene, they aggressively worked with the city staff. They have repaired all of the repairs, and the property is in good shape, as Rachel can teach us, that we're not even allowed to come here on a mitigation until the city confirms that everything is in compliance. So it is a... an entity, a corporate entity. The general contractor is here if you have any questions. And Rachel was explaining to me that if it's a corporate entity where they don't live in the house, which we don't, the minimum is $10,000 based on the unusual fact pattern that it was the prior owner who had this health problem. And with the speed that they addressed everything, We would like to respectfully request the special relief of a $2,500 fine instead of the full amount.

8:15Speaker 10

Okay. Is your client selling it right now?

8:21Speaker 4

Are they what, sir?

8:22Speaker 10

Are they selling the property right now?

8:24 – 8:39Speaker 4

No. They have rebuilt, repaired, and otherwise brought the property into compliance. Okay. If my client wants to tell me what their immediate plans are. Sure.

8:42Speaker 16

I can't hear you, sorry.

8:45Speaker 4

The gentleman I'm about to speak is John Liu. He's the contractor on the site. Go ahead and speak.

8:50Speaker 10

I'm just asking, what are they using the property for now?

8:53Speaker 9

Right now, the property is vacant. The plan is to actually sell the property.

8:59Speaker 10

Okay, because I thought the city attorney said that there was a... A situation that it had to be set quick because the property was being sold.

9:07Speaker 12

Right. That's correct. And they are planning on selling it. Eventually. Yeah, they have a, no, no, they have a closing.

9:12Speaker 10

Do you have a closing coming up?

9:13Speaker 9

Oh, no, no. Oh. No, it's not even listed on the market or anything like that. I mean, the plan is eventually to sell it.

9:19Speaker 10

That is correct. Okay.

9:20Speaker 12

Well, we moved it up because I was told there was a closing.

9:24 – 9:35Speaker 10

So our floor on this one, just so you know, as low as we can go with mitigation is 10,000. Okay. and I understand that your client was a subsequent purchaser.

9:36 – 10:09Speaker 4

Okay, hold on a second. Let me just explain, hold on. Let me just explain the disconnect about the closing, et cetera. The closing that was referenced in our communications to your office has to do with the closing that already occurred of my client purchasing the property and the immediacy of the issue was that there are monies held up as part of that closing that need to be released and fund this poor prior owner gentleman who needs this money in his care facility.

10:09Speaker 12

Understood, so it's to close out the original one.

10:12Speaker 10

The escrow file. And how much did they hold back in escrow?

10:20Speaker 4

For the record, he answered over $200,000.

10:25 – 10:38Speaker 12

That's right, and you know what? That did refresh my recollection. That was correct when he said it was to finish the closing from the other one so the money could go to the gentleman. Okay, got it. Because that goes to the prior owner, right?

10:48Speaker 10

And is that in the escrow agreement that it goes to the nursing home?

10:59Speaker 10

So he's requesting mitigation to $2,500, but that would require a unanimous vote.

11:08Speaker 16

I have a question when you're done.

11:10Speaker 16

My question to a council is good afternoon. When was this property purchased by your client?

11:17Speaker 4

I was looking at the property appraiser. It looks like it was indicated January of this year.

11:24 – 11:51Speaker 16

January of this year, 2026. May I ask you what the purchase price of this property was? Which is public record, but I can't look it up. It's a single family home. How many rooms and how many bathrooms? Oh, it's demolishable? So I thought you said it was fixed and repaired.

12:01Speaker 16

You're not demolishing it. The structure still sits. You repaired it to come in compliance and you bought it. It was sold for $466,000.

12:07 – 12:18Speaker 12

It's a 3-1 and it is a 6,270 square foot lot. Okay. And it's on a corner. There it is, right up there.

12:22Speaker 16

Yeah, I understand. I am ready to rule on this, and my motion is $10,000.

12:30Speaker 10

All in favor?

12:32Speaker 4

Thank you very much.

12:48 – 13:02Speaker 14

Okay, next we will start with the to be heard. Next case is page 86, code check agenda, case number 00147418, property address 44 Northeast 42nd Street. That was page 86? Page 86. It's 4400.

13:12Speaker 16

Right? Northeast? 44 northeast. No, 44 northeast, 42nd.

13:17Speaker 12

Okay, got you. No problem.

13:19Speaker 10

Grupo Cuadro. Grupo Cuadro.

13:31Speaker 12

He's coming. He's just been, he's covering me.

13:33Speaker 4

Sorry, I was just doing the paperwork of your last adjudication. Sorry.

13:42Speaker 10

You want to go ahead and state your name for the record again?

13:46Speaker 4

Yes, my name is Paul Savage with Law Offices at 200 South Biscayne Boulevard, Miami, Florida, on behalf of the respondent.

13:53Speaker 10

And, Councillor, you're here on 44 Northeast 42nd Street? 44 Northeast 42nd Street, yes, Chair. Okay, and you're going to plead guilty, not guilty?

14:02Speaker 4

We plead guilty.

14:04Speaker 10

Okay, let me just hear from the city what you need to do, and then you can let us know how much time you're seeking.

14:10 – 14:40Speaker 25

Good evening, Co-Compliance Inspector Francois, North Office. So with this property, I received a complaint that it wasn't being maintained, and when I arrived at the property, I did notice that several windows were exposed to weather and conditions, and the property seemed to have mold or dirt on it, and it needs to be repainted. He has taken care of the windows. All of them are boarded up now. The only thing left is to paint the building.

14:42Speaker 16

What's left, I'm sorry?

14:44Speaker 14

What's left? Paint.

14:45Speaker 16

Oh, the painting. They just have to paint it.

14:50Speaker 19

The city recommends 120.

14:55Speaker 10

Do we have a motion?

15:00Speaker 16

What is the city recommending?

15:01Speaker 10

They said 120. Is this a single family home?

15:04Speaker 16

Okay. I move for 120 and $250 per diem. I'm commercial. Guilty.

15:11Speaker 10

All in favor? Aye. 120. If you need more time, you come back.

15:15 – 15:29Speaker 4

Thank you very much. And I just want to, as the inspector recited, we did chew away at most of all the violations, which the inspector told you. And I just want to make sure everybody knows that. And I thank you so much.

15:29Speaker 12

And it is a single family home. I just wanted to say that. It's not occupied, but it's a single family home.

15:35Speaker 10

There's no homestead or there's no... No, it's not occupied.

15:39Speaker 10

That's in like the Wynwood area, right?

15:43Speaker 4

We'll be sure and get to the painting and we'll report to you, sir.

15:46Speaker 11

Okay. Thank you.

15:53Speaker 4

Okay. Okay. We'll be sure and report back to the inspector on that painting. Thank you. Thank you. Thank you, Mr. Chavez.

15:59Speaker 11

We didn't need to do a 150 on that one.

16:04Speaker 12

No, it's not occupied.

16:08Speaker 12

They're not occupied or if they're rentals. I think it's one of those ones that they're building.

16:12Speaker 16

250 per diem, that's what I said.

16:14Speaker 4

They're building all kinds of things. Okay, you're good. Okay, thank you so much, Chairman. Appreciate it.

16:22 – 16:35Speaker 14

Next case, page 52, case number 00096460, property address 966 Northeast 80th Street. Page 52.

16:36 – 16:50Speaker 3

Good evening, sir. Good evening. Armand Gill, owner of 966 Northeast 80th Street. Okay. And are you pleading guilty, not guilty? I am pleading guilty. I think I had a meeting just recently just requesting an extension.

16:51Speaker 10

Okay. Let's just hear from the inspector and then see how much time they recommend.

16:56Speaker 15

Inspector Bailey, North Office. We have a fence without a permit.

17:04Speaker 12

Is that all that's left? That's it. Okay, how much time?

17:07Speaker 15

Have you applied for the?

17:09Speaker 3

Sorry, can you repeat that? I didn't hear.

17:10Speaker 15

Did you apply for the permit?

17:12Speaker 3

Yeah, I don't know if you guys can see, I'm working with an architect's firm, and they're fixing everything up. I think they submitted plans, they were rejected, and it's currently under revision.

17:23Speaker 19

The city recommends 120 as they are in the afternoon correction phase.

17:26Speaker 3

So it's just a defense that's left?

17:29Speaker 3

That's it? Oh, okay.

17:31Speaker 16

I have a question, sir. Do you reside at the property?

17:36Speaker 11

I'd like to make a motion. Guilty, 120 days, $150 per day.

17:42Speaker 3

All in favor? Aye. And then for request for further extension, it's that unsafe property. See that piece of paper?

17:49 – 18:08Speaker 12

Thank you so much. That's it right there. Make sure. And the one thing I didn't say was you have your little smartphone because it's smarter than you and me. So... You get 120 days, you know, give yourself a reminder in 100 days. Do I already have my affidavit of compliance? Whatever. If you don't, then go ahead and request your extension of time so you don't forget.

18:09Speaker 3

Thank you, ma'am.

18:21 – 18:36Speaker 14

Next case, page 126. Case number 00070356. Property address 1279 Northwest 29th Street, 29th Terrace. Page 126.

18:37Speaker 10

Good evening.

18:39Speaker 29

Good evening, sir. Hugo Benitez with professional address at 800 Brickell Avenue.

18:49Speaker 10

And the property address?

18:51Speaker 29

The property address is 1279 Northwest 29th Terrace. With me is the owner. Okay.

18:58Speaker 10

And at the time of violation, was the property guilty?

19:03Speaker 29

We're declaring ourselves guilty with an explanation.

19:07Speaker 10

Very good, sir. Let's just hear from the city inspector what needs to be done.

19:13 – 19:27Speaker 24

Good evening, Board. This property was sited for or completed without a finalized permit. However, they already obtained a permit. They do have it in revision right now. They're going to need some time. Okay. Director, how much time?

19:27Speaker 19

Let's see if she will allow it. How much time you? The city recommends 1.20 as they are in the revision phase.

19:34Speaker 10

So the city's recommending 120 days.

19:36Speaker 16

I have a question, if I may. I see here illegal units not complied. Are they illegal units?

19:44Speaker 24

Once they comply with the demolition, then they will comply with the illegal units.

19:49Speaker 16

But there's nobody living there?

19:51Speaker 16

Okay. Thank you for the clarification.

19:53 – 20:28Speaker 29

No, their plans are to fully legalize the structure. They had to go in front of the unsafe structures board in order to get permission to pull the permits. Now they're fully permitted. They had a set of comments. The comments have been addressed, so we're ready to go. Hopefully the 120 days are enough. I think we can get another extension by following these procedures. If they're not, the unsafe structures board has given us 270 days. We understand that this is a different deadline.

20:29Speaker 10

You definitely have the right to request an additional extension.

20:34Speaker 29

Fair enough.

20:36 – 20:48Speaker 16

I'm ready to rule on this. I rule guilty, 120 days, $250 per deal. Second. All in favor? Aye. Thank you.

20:48Speaker 10

Thank you, board.

20:55Speaker 14

Next case, page 95. Case number 00147425. Property address 163 Northeast 48th Street, page 95. Good evening, sir.

21:14Speaker 20

Good evening, board members. Alex Uribe with office at 2800 Ponce de Leon Boulevard.

21:20Speaker 10

And at the time of violation, was the property guilty? Guilty.

21:25Speaker 10

Let's just hear from the inspector and then see what we can do.

21:29Speaker 25

At the time, I received a complaint about the property not being maintained when I arrived.

21:36 – 22:10Speaker 12

Again, the windows weren't properly- Let me just say, the property is only here for facade and fair to register. vacant structure it is not here for demolition by neglect all right that that was already voided is that correct correct so and I believe there is somebody from the area historic area is is here I don't know if he want and you want to listen to him afterwards that's up to you but this is only here for facade and failure register the structure

22:12Speaker 10

And how much time do you think it'll take to get that done?

22:16Speaker 25

I've spoken to them. They said they can get it done as soon as possible. I don't know how much time.

22:23 – 22:35Speaker 12

They will have to go through certificates of appropriateness, depending on what they're doing. So anything they do on the properties, given where it's located, is going to have to go through HEP, correct, Council?

22:35 – 23:41Speaker 20

That is correct. The property is within the Buena Vista East Historic District, I believe. and to just provide a little bit of color, and I believe that we do have an email from Supervisor Sierra that we filed the vacant property registrations. Yes, they did. Earlier, so that part of it should be done. My understanding is it's only just the facade, and... But yes, this property also is subject to an unsafe structure case, and in order to correct that case, we're going to need to go through the building permit process, and that's going to make us go through HEP with a certificate of appropriateness and all that stuff, because the property is in the historic district and is a historic property. Just to add a little bit more color, this is a single-family home. It is owned by a charitable organization that provides care to people suffering from HIV and AIDS. And so the property behind it is occupied and operating as a care facility.

23:41Speaker 12

The cluster there has been used by the ownership concept house, correct? I saw that.

23:47 – 24:06Speaker 20

That's correct. That's correct. So they understand they need to... To fix this property, it's going to take a little bit of time because of the historic nature of the property. So we'd ask the department to consider that in its recommendation.

24:09Speaker 16

I have a motion.

24:11Speaker 16

My motion would be 180 for $250 per dam and guilty. Second.

24:18Speaker 20

All in favor? Aye. Thank you very much. Have a good evening.

24:31 – 24:46Speaker 12

Next case page. Did you want to ask to say something about that? Yes or no? Well, no, no, it's not me. You need to go up. I don't give you the permission. You have to go up there and you have to request it from the board, the chair, the board through the chair. Hello. Over here.

24:48 – 25:04Speaker 23

So we are here representing the Buena Vista East Historic Board. We're both members and... The last two properties that have been discussed, I just wanted to give you a timeline. Like, I moved into my home in this area in 2017.

25:04Speaker 16

Can I ask, I'm sorry for your name, because I don't know who you are.

25:07Speaker 23

Oh, sorry, my name is Andrew Bonsignor. I'm a homeowner in the Buena Vista East Historic Neighborhood and also a member of the board which represents our neighborhood.

25:15Speaker 10

What is your property address?

25:17 – 25:28Speaker 23

4412 Northeast First Avenue. I'm a property owner. So I moved in and purchased that property in 2017.

25:29Speaker 10

If you could limit the comment to three minutes.

25:31 – 26:31Speaker 23

Yes, I'll be very brief. So I just wanted to point out a lot of the structures on list today have been in the state that they are since I moved in and before I moved in. So it's been almost a decade. So this has just been brought to light. So I just want to reiterate the timeline. There's been years and years and years and years of neglect and time to address these and bring them back up. to their historic standing and there's really been very minimal if nothing done on a lot of these properties which is why we are here to represent our neighborhood as property owners because these properties directly bring down the property value of all our properties as well. So I just want you Gal to know that almost all of these properties have been in this state of decay for almost 10 years now if not more. So it's not been a new thing. It's been a really, really prolonged problem that we've all been kind of trying to live with and deal with on a day-to-day basis. I just wanted to point that out.

26:31 – 26:45Speaker 10

Hopefully, like, you know, even though it's a few, just keep chipping away at them little by little. And, you know, the biggest goal of the city and the board is to get compliance first. The fines are secondary, but it's really to get the properties in compliance.

26:45 – 27:07Speaker 23

Okay, because that was kind of my question. The previous property, yeah, they boarded up the windows and they're going to paint it, then it's a contributing historic structure. So what, it just sits there and gets mold and decays more and more year after year? Because I think once that's complete, then they kind of just get a pass to just leave it as is because they're no longer accumulating finds. It's kind of how we've seen this experience, Pat.

27:07 – 27:50Speaker 16

If I may, it has a lot to do, too, with how persistent you can be in advising this to the city. Because if you just... tell them once and you drop the ball and you don't communicate again, it's gonna sit there not for 10, but for 20. And unfortunately, we don't have a very strong board that preserves these things, but keep your voice and You know, I understand exactly what you're saying, and I wish we can preserve more because we're losing a lot every day. So I'm a huge advocate for that. And be persistent, and that's all I can tell you. Send emails and drive them crazy and, you know, until you get yourself heard.

27:51Speaker 16

And your neighbors, too.

27:53Speaker 11

Yeah, I was going to say, and the other thing, too, is some of this stuff that, because it's in historic district, there's a process that the city has in place to even begin to repair something.

28:04Speaker 23

I'm well aware of the process of getting my window permits, and the paint color was like months and months.

28:08Speaker 11

So some of this stuff, and if they don't have the right-of-way funds and stuff like that, then it's just a process that they're going through until they can do what they do, and all we can do is what we've just done here.

28:18Speaker 23

Okay, so keep on it. The squeaky wheel gets the oil. Keep bringing it up, up, up, up. Okay.

28:24Speaker 16

Have your neighbors participate. The more, the merrier.

28:27Speaker 12

But I would meet with the historic preservation officers at the city.

28:32Speaker 11

Correct. Okay, I think it helps push up those.

28:34Speaker 16

Thank you, and thank you for coming and voicing your opinion.

28:44Speaker 14

Next case, page 76, case number 00119244. Property address 529 Northwest 46th Street.

29:05Speaker 11

What was the page?

29:12 – 29:31Speaker 18

76. 76. This case is going to be heard in absentia. They came to speak to me earlier. The owners have deceased. It's in the estate, but they have not opened the probate. So these are the siblings or the children of the owners, but they have no standing because it's still in the estate.

29:34Speaker 10

Okay. Were these beneficiaries under the will or are they named in the probate?

29:38Speaker 18

They haven't even opened a probate, so I can't tell you. I don't even know their descendants from what they've told me.

29:44Speaker 16

That's going to take you years to resolve.

29:48Speaker 12

Well, it may not take years. If there's only one asset and it's intestate and there's the kids, they go down, they file.

29:57Speaker 10

Okay, let's not give advice on probate matters. Let's, okay.

30:00 – 30:17Speaker 12

So, it's not necessarily yours. Inspector, can you please state your name for the record? Good evening, Inspector Troutman from the North Office. Did you cite the aforementioned property for failure to maintain the facade? Yes, I did. Okay, and then you sent notice according to the information provided by the Miami-Dade property appraiser?

30:17Speaker 15

That's correct.

30:17 – 30:58Speaker 12

So you put together pages 1 through 36? Yes. All right, and as we go through this, this is your proof of mailing, posting. It was also sent certified mail for the summons for today, and obviously family members are here. Here again is your affidavit. This is the deed. You have the property appraiser report showing it's the estate of. Yes, that's correct. The signed certified mail. Hold on as we get through it. Like doubled up in here. All right. And we'll move it. So this is the property, is that correct? That's correct.

30:59Speaker 12

So it needs to be cleaned up, pressure washed, painted.

31:02 – 31:37Speaker 15

Painted, cleaned. They have a roof damage, window damage, paint. I want to expand on, I was talking to the daughter and the mother, who's here, and his brother. We have funds to get the property repaired. I spoke to them about it. One of the biggest situations we have is just the deed information and signing over some paperwork so the city can disperse funds to get the property repaired. And we have a bit of

31:39Speaker 12

Well, they can't do that until they get ownership of the property. Yes. And is there a unit in the back?

31:47Speaker 15

It is a unit, but it's legal. Everything on the property is legal.

31:50Speaker 12

Everything else is illegal? It just needs to be fixed up?

31:52Speaker 15

Yeah. The vehicle has been removed since. But yeah, it is blighted and it needs to be repaired.

32:00Speaker 12

All right. This time the city seeks to admit pages 1 through 36.

32:05 – 32:17Speaker 12

Time the city rests. Would ask for a finding of guilt. 180 days to start and $150 a day. You guys living there?

32:17Speaker 16

Yes. I move as stated.

32:23Speaker 10

Second. All in favor? Aye.

32:25Speaker 11

Do we want to hear from them?

32:26 – 32:39Speaker 10

So yes, we do. So out of the group, who has the best idea of what's going on with the property? Okay, so if you want to step to the microphone and state your name.

32:43Speaker 28

My name is Rufus Talbert. I'm the grandson of the people that own the house.

32:48Speaker 10

Okay, so you're the grandson of the people who died? Yes. Okay, so what's going on with the property a little bit?

32:54Speaker 28

Well, I have, when it's all coming in, I'm going to have to get it painted. You know, I got to work on the roof.

33:01Speaker 10

Okay, so they gave you an extension. Yes, ma'am. You heard?

33:06 – 33:17Speaker 10

You got to kind of try to start getting the property in order. And is that your sister? It's my sister and it's my mother. Okay.

33:17Speaker 12

All right. Also, I'll give them my card so that they can go ahead and contact us with respect to the other options they have from the city.

33:23 – 33:38Speaker 10

So you're going to have some resources, some assistance may be available. And then if you need more time, as you get the ball rolling, you take the paper and you come back and ask for time. But try to reach out and see what resources the city can offer you. All right, thank you.

33:38 – 34:01Speaker 16

I have a recommendation for you, if I may. You can go to the courthouse yourself, and you can open up the probate yourself. It's on the second floor of the Miami-Dade County Courthouse. You can call, and they're only open a certain hours. They will help you. fill out the documentation. But all of you should go because you all have to put your information. It's a lot of documents.

34:01Speaker 28

All right, thank you.

34:02Speaker 7

You're welcome. Appreciate it.

34:10Speaker 14

Next case, page 44, case number 00147462, property address 1275 Northwest 55th Terrace, page 44.

34:30Speaker 10

Good evening, sir. Hi, how are you? I'm well. Please state your name.

34:34Speaker 26

My name is Jorge Rojas, address 1275 Northwest, 55th St.

34:41Speaker 26

And your relationship to Boaco?

34:44Speaker 10

To our owner. To the owner. Okay. Is the property guilty or not guilty at the time of violation?

34:52Speaker 26

It is guilty. Okay.

34:54Speaker 10

Let's hear from the inspector what needs to be done and then how much time we can help you with. Yes, sir.

35:00 – 35:26Speaker 6

I'm 1275 Northwest 55 Terrace, Inspector Anderson, Code Compliance North. I cited the property for failure to maintain exterior. It's dirty, it has a lot of mold on it. I also cited it for overgrown lot. They cut the grass, but it also needs to be registered. So right now there's two violations that's outstanding. They comply with one.

35:29Speaker 12

How much time do they need?

35:31 – 35:43Speaker 6

I'm not sure. I mean, as far as the registration, that takes, what, a day or two. They need to paint it or pressure clean the property. So I would say, I don't know, no more than a month or whatever.

35:48Speaker 19

Director? The city recommends 60 days.

35:54 – 36:05Speaker 10

The city's going to recommend 60 days? If you need additional time after you've made some progress on the property, you can come back and ask for additional time.

36:06 – 36:22Speaker 26

We're trying to demolish the property, and we submitted the drawings to the city. It's been Dade County approved, waiting on the city to approve. Last thing pending is landscaping. I don't know what's taking them so long.

36:24Speaker 19

They are in the demo phase for the permit. However, those violations can be corrected almost immediately, at least one of them. The city recommends 60 days.

36:35Speaker 10

Yeah. So they're saying, you know, work on the open violations, and then you keep working on the other issues. Okay. Do we have a motion?

36:42Speaker 16

Move for 60 days. Guilty, 250 per day.

36:45Speaker 10

All in favor? Aye.

36:46Speaker 12

Take the piece of paper that tells you, sir, you got it? Excellent.

36:58 – 37:09Speaker 14

Next case, page 88. Case number 00147421, property address 4400 Northeast First Avenue. Page 88.

37:13 – 37:24Speaker 12

This case is only for the boat and the failure to maintain. The demolition by neglect is not a valid violation at this time.

37:26Speaker 10

Good evening.

37:27Speaker 5

Hi, Robert LeMay, owner of the property.

37:30Speaker 10

Yes, Robert. Was the property guilty at the time of violation? It was. Okay. Let's hear from the inspector what we need.

37:40 – 37:53Speaker 25

With this property, it just needs to be painted. The concrete wall on the side, the fence needs to be, I mean, not the fence, the boat needs to be removed. And as I stated, the property just needs some painting also.

38:06Speaker 12

You already have permits processing?

38:08Speaker 5

To say the least.

38:11Speaker 12

Yeah, I'm trying to remember, but I believe it's...

38:15Speaker 5

So it's been four years in the making.

38:18Speaker 12

This is the one I thought it was, yes. I have... Because I spoke with Sean Smith... And Ken Kamala... From HEP about this property last week, yes.

38:28 – 40:21Speaker 5

It's been just a headache, to say the least. I bought this property... intending to bring this magnificent house back to its own glory and original facade and this and that. And it's been held, to say the least. Five minutes ago, I received the pictures because I didn't even know what this was about. I had a first violation in June of last year, and I immediately, like within 24 hours, sent back to the Inspector Johnson all the pictures and everything that was repainted and graffiti and things that happened in the property that I don't even live nearby, as my neighbor, next-door neighbor, explained. All these... is about the historic district and delays. I haven't been able to get anything approved. The only thing I got approved was demo, and I immediately moved forward, not knowing that it was gonna get stuck in there, and that's why you see all the windows that way, because I never intended for that house to be in these conditions for this long. Nevertheless, I'm stuck in this situation. So knowing from the inspector, who I talked to two and a half hours ago and received the pictures five minutes ago, literally here, I can have that painted, pressure cleaned, whatever, tomorrow morning. I have a crew who can take care of it, no questions asked. Now, about the boat. When I had that violation last year, June of last year, Inspector Johnson was very clear that the vote was inside my property, not causing any kind of interference with anything or anyone.

40:21Speaker 12

It can't be within the first layer. So the problem is it's within the first layer. It sticks out.

40:28Speaker 25

Sticks out? It's in the first layer, and it shouldn't be within public view.

40:34 – 40:49Speaker 12

Right, see? You've got to screen it. That's what the inspector... And then you see where the front of the house is right here? That wall. And it sticks out past that. It can't stick out past that, and it has to be screened somehow. Which is fixable.

40:49Speaker 5

I could have pushed it back at least four feet.

40:51Speaker 12

That's an easy fix.

40:52 – 41:37Speaker 5

Exactly. Nevertheless, I just want to make sure that everybody understands that I'm... so respectful of everything and everyone. And if that would have been the case six months ago, eight months ago, I would have done it back then, no questions asked. Now, it seems like I have to remove the boat of my property. And by the way, I had the house in the corner, so I have two fronts. I had a fence put in there for safety of everyone, and that was stolen. There was a police report. obviously, because I paid over $4,200 for that fence that was stolen. So it's one thing after another, but I'm here to proceed.

41:37Speaker 12

In order to paint it, make sure, you have a meeting with HEP, right? Are you the one that has, do you have a hearing with the HEP?

41:47Speaker 5

With Ken, you mean?

41:49Speaker 12

Right, well, no, do you have any kind of hearings before the HEP board?

41:52Speaker 5

Oh, no, no, no.

41:52 – 42:08Speaker 12

Okay. Okay. Before you paint anything, you need to make sure whatever paint you're going to use, you're allowed to use. Depending on where you're located, I'm just, even if you say it's going to be the same thing, you call them. Check, make sure. Just to be sure.

42:08Speaker 5

Perfect. I'm given the option of pressure cleaning the whole thing, right? To remove the moldish color.

42:16Speaker 12

But it still may require you to paint it to make it not look like it's just pressure clean with cement, right? So that's

42:24Speaker 5

It doesn't matter to me. Whatever it means.

42:29Speaker 12

Check with Ken or Sean.

42:38Speaker 16

Your motion was 60, you said 60 days recommendation, correct?

42:41Speaker 19

I recommend 90. Oh, 90? I move for 90 days, $250 per game. Second.

42:53Speaker 10

All in favor? Aye.

42:54Speaker 16

Remember, move the boat. It has to be behind the wall. Past the wall. It cannot stick out of the wall from the house.

43:02Speaker 12

And not on the grass.

43:03Speaker 5

Understood. Right where it is, there is space to push it back. 100%. Count on that. It's going to happen tomorrow. I'm going to send the pictures.

43:11Speaker 12

Well, you're going to have to screen it, too, so you might need to get something to do that. And it has to be covered.

43:19Speaker 12

It's going to have to be screened, yeah, from view. Okay.

43:21Speaker 5

Oh, okay, okay, I'll figure something out. Since I don't have a defense anymore. All right.

43:29Speaker 5

Thank you. Good luck. Thank you.

43:39 – 43:57Speaker 14

Next case, page 121, case number 000, sorry, 00004472. Property address 127 Northeast 11th Street. Good evening.

43:57Speaker 8

Good evening. Mark Aladef, 11900 Biscayne Boulevard, North Miami, Florida, for the property owner.

44:06Speaker 10

And at the time of violation, was the property guilty or not guilty?

44:10Speaker 10

Okay, let's just hear from the inspector.

44:13 – 44:26Speaker 7

Good evening, Inspector Uriarte, Cook Compliance Central. This is a case that it's a parking lot with no CU, no VTR. But it's not 121. It was cited in 2022 and it's still operating like that.

44:31Speaker 16

Excuse me for a second. We don't have this on page 121 in our books.

44:36Speaker 17

No, I have it. I don't have it. It's the middle of the page towards the bottom.

44:42Speaker 16

Oh, okay. I'm so used to seeing it on the top. Thank you. Sorry. What's the business operating there?

44:49Speaker 7

A parking lot.

44:50Speaker 12

Okay. So since 2022, they haven't, have they applied for anything?

44:55 – 45:26Speaker 8

No, yet. No, that I know. No, we've applied for a CU. So my client took the property over in, I think, October, November of last year. There was a previous operator that had been there that had been operating as a parking lot and apparently did not have a CU. And so my client has now applied for the CU. I think last, as of yesterday, it passed pre-screening and they've submitted plans and a survey, but I don't.

45:26Speaker 12

Does the striping have to be redone?

45:29Speaker 7

The striping actually is erasing by, you know, rain and things like that, but it was striped.

45:35Speaker 12

Was it legally striped? No, no. They pull a permit. Right, that's the problem. So you've got to redo everything on this place.

45:44Speaker 8

Yes, right, right.

45:46 – 45:58Speaker 12

And until you do that, you know, your CU and your BTR are going to be in the back burner while you're doing your other stuff. Have they started their permit application yet?

45:59 – 46:12Speaker 19

Yes, I believe so. The permit application has been canceled. So they haven't paid or they've missed inspections. The permit is right now inactive.

46:15Speaker 8

Do you know, sorry to ask, but when was it made inactive? One moment. Give me one second.

46:50 – 47:09Speaker 12

What was this one for? The BD25. So BD25, which is the only one we have, would have been for a sign. So nobody's applied for anything to deal with the pavement, the striping, or anything else for a parking lot.

47:09 – 47:25Speaker 8

I believe they, I know that they applied for the CEU, and I believe that they're waiting to get feedback as to what needs to be done to the physical property, whether it's striping or... Well, all of those things, because the striping's illegal, so...

47:26 – 47:44Speaker 12

And the pavement itself looks in poor condition. So they're probably, and I don't know if when it was even originally paved, it was legally paved. So they probably, this guy right here is who they need to talk to. I don't know who they're waiting to speak to, but he's right here. This is their guy.

47:44 – 48:06Speaker 8

I understood. Unfortunately, they haven't done anything else. I've only been recently involved. We have spoken a couple of times in the past week to try to get myself up to speed on what's going on. And I do know that they've applied for the CU. They're certainly going to do whatever work is required to get the property into compliance and to operate it as a parking lot.

48:08Speaker 16

I have a question for the inspector. Yes, ma'am. Inspector, are they still operating since the day of the violation of February 9th, 2022 as a parking garage?

48:18Speaker 7

They're still working.

48:18Speaker 16

They're still working. So they've been three, well, it's been four years working. Four years. without taking care of the problem.

48:28Speaker 7

If I may say, I think it's May 14, 22.

48:34Speaker 12

And his clients bought it in October, November, and continue the... Well, they should not be operating.

48:41Speaker 7

The violation outside storage, that one is compliant. That one, they clean, that the lot is clean.

48:47 – 49:15Speaker 16

Yeah, but the parking lot should not be operating at all. So my motion is... for this parking garage to stop working, because they have been working for four years, and they don't even have anything in the system, and my violation per day would be $500 per diem, and I'm being nice, because it should be $1,000. That is my motion.

49:17 – 49:29Speaker 12

You're trying to issue a stop work order on them? Yes. I don't know that the board has the authority to do that. Well, they have to stop functioning because they're not... Well, I don't know that this code board has the authority to order a business to stop operating.

49:30Speaker 16

We used to do them before here in the board. I don't know if it's something new now that we can't, so...

49:35Speaker 10

Yeah, let's just stick to what our authority is restricted to. Through the chair.

49:41Speaker 12

I don't know if your council wants to respond.

49:44Speaker 8

I agree with you completely. Well, hold on. Through the chair. The board doesn't have the power.

49:48Speaker 12

Not you, sir. I wasn't speaking to you. I was speaking to the board's council.

49:52 – 50:06Speaker 11

I'm sorry. I just have a question for the chair. So it looks like They want to be compliant. At least they want to get in work. So how much time are we recommending? Because I'm just going to make a motion to give them 120 days to get the works done.

50:08Speaker 16

How much more time have you given them? Five years? Four years? I mean, how much more time? And they're collecting and making money, and they're not taking care of the problem.

50:17Speaker 11

You haven't given my client. Hold on, hold on. Sorry. I'm just trying to get information so we can kind of move this.

50:24Speaker 16

Is there a residential neighborhood next to this? What is next to this?

50:27 – 50:38Speaker 19

Let me answer the question one second. I'm sorry. Thank you. The issue I have with issuing the 120 is that they haven't started anything. I would recommend 30 days so they can begin the process. Okay, thank you.

50:39Speaker 11

I appreciate the clarity on that. Do we have a motion? Yeah, I'll make a motion for 30 days, $250 per day.

50:45Speaker 16

Well, I made a motion, so you have to say that my motion died. It died.

50:49Speaker 11

Nobody seconded it. Okay, go ahead with your motion. My motion will be for guilty, 30 days, $250 per day. Seconded.

50:57Speaker 8

I'm sorry, to clarify, is the 30 days to admit the application or to actually get started?

51:03 – 51:41Speaker 10

Well, your 30 days is to cure the violation. Now, you have the opportunity to come back here before the board. I think we have a fairly good memory, being that it's going to be in 30 days, we'll see you again, that it's going to be tough to come here and ask for an extension of time if nothing's done. I think the standard would be more liberally applied. If you come in and you've pulled the permits and the ball is rolling, then I think that may be a crack in the door to getting more time. There's no guarantee. Your only guarantee is that you could ask for more time. But I would say that that's a suggestion.

51:41Speaker 11

And excuse me, Mr. Chair, can I amend my motion? Yeah, no, I want it to be 500. I realize this is a business, so I want to make sure.

51:50Speaker 10

So the motion's amended. 30 days, $500 a day thereafter. Do we have a second? Second. All in favor? Aye. And I'm sure we'll see you in 30 days.

52:00Speaker 8

We will do. Thank you very much. Have a good evening.

52:11Speaker 14

Next case, page 98. Case number 00027143. Property address 2810 Northwest 25th Avenue. Page 98.

52:27Speaker 10

What was the page number?

52:28Speaker 11

I'm sorry. 98. 98.

52:35Speaker 10

Good evening. Buena.

52:37Speaker 6

Sorry. Good evening.

52:44Speaker 13

My name is Marlene Mayorga.

52:47Speaker 10

You're going to have to translate for her.

52:50Speaker 13

My niece. Okay.

52:51Speaker 10

Marlene Mayorga.

52:55Speaker 13

My name is Marlene Mayorga, and I would like for my niece to represent me.

52:59Speaker 10

Okay, what's the niece's name?

53:02Speaker 13

Melissa Garcia.

53:04Speaker 10

Okay. Hello, Melissa. Good evening. Do you live with your aunt?

53:11Speaker 27

I do, yes, yes, I do.

53:12Speaker 10

Okay, speak close.

53:14Speaker 10

Speak close so we can hear you. Yes, okay. You said you live with your aunt?

53:17Speaker 27

I do live with my aunt.

53:18Speaker 10

Okay, do you know the property address?

53:20Speaker 27

2810 Northwest 25th Avenue.

53:22Speaker 10

Okay, and at the time they received the violations, do you know if the property was guilty at that time?

53:27Speaker 27

Guilty, yeah.

53:28Speaker 10

Okay, so and I guess you guys are going to ask for some time to get things fixed?

53:31Speaker 27

We do need an extension, yes.

53:32Speaker 10

Okay, so let's hear from the inspector what you need to get done.

53:35 – 54:01Speaker 15

Good evening, Inspector Troutman, North Office. I inspected the property. I met with the ladies. They're very nice. And they do need more time because they have a pending finalization. on their building permit to bring it into compliance. They knew only two or three more inspections left and the property will be in compliance. So they would need more time. I would say 90 days to be sure. Is this a duplex?

54:01Speaker 10

90 days is what you think?

54:04Speaker 16

Is it a duplex? I'm sorry? Is it a duplex? Is this property a duplex?

54:08Speaker 15

It used to be, but they legalized it through the building department. So they removed all illegal units. Everything is now in compliance with architectural plans.

54:19Speaker 16

Right, I see owner mailing out his $2,800, and then I see the property that was in violation is $2,810.

54:27Speaker 12

It's two units now or one unit? It's one unit. It's one unit. You're living there.

54:31Speaker 27

No, no, we're not.

54:32Speaker 15

Oh, they're renting it? No, it's vacant. Oh, it's vacant. They renovated the entire property.

54:37 – 54:53Speaker 12

And are you going to be moving back into it once it's fixed? Yes. Okay. I don't know if that affects what you guys want to do. Yeah.

54:53 – 55:04Speaker 19

Okay. That will be consistent. The city recommends 120, as they are also in the permit inspection phase. So it'll be 120, 150 a day.

55:05Speaker 16

No, 250, they don't live there. It's vacant. I thought she said she lives with her. No, she does not live there. They're not living there yet.

55:10Speaker 15

They're going to be moving back in once the permits are finalized for renovation.

55:15Speaker 12

They can't live there right now until it's done. Got it.

55:17Speaker 17

Motion for guilt, 120 days, 250 thereafter. Second.

55:21Speaker 10

All in favor? Aye. So you have 120 days to get the work done. But if you need more time, there's a paper so you can ask. Just make sure you ask for the time before the expiration.

55:31Speaker 27

Okay, thank you. Thank you. Thank you.

55:38Speaker 14

Next case, page 69. Case number 00148978. Property address 770 Northwest 55th Street. Page 69. Okay.

55:54Speaker 19

Good evening.

56:02Speaker 10

Good evening.

56:04Speaker 26

Good evening. Yes, sir. My name is Salim Agosti, the pastor of Bethany Baptist Church of Miami.

56:13Speaker 10

Yes, sir. And you're here on 770 Northwest 55th Street? Correct. All right. And pastor, who's with you?

56:21Speaker 26

I have the engineer with me.

56:23Speaker 10

The engineer?

56:24Speaker 26

Yeah, he's going to talk on my behalf.

56:26 – 56:37Speaker 10

Okay, that's what I was going to ask. And what's his name? Carlos Rowe. Okay, Mr. Rowe. Very good. So at the time that the violation was issued, was the property in violation?

56:39Speaker 10

Yes, okay. Let's just hear from the inspector and then see how much time you guys need to get things done.

56:45 – 57:17Speaker 6

Inspector Anderson, Code Compliance North. I cited the property for failure to register vacant structure and also for... failure to maintain the exterior. I had to close the initial case because the property changed owner. And I opened another case with the new owner for the same violation. They have registered the property. The only thing left is for them to the exterior of the property. They need to pressure clean it or repaint it. Okay.

57:19Speaker 12

You guys have an active demolition permit?

57:22Speaker 28

I applied for it, waiting for the landscape department to just approve it.

57:26Speaker 12

The tree people.

57:27Speaker 28

Yeah, the tree guys, yes. Okay. I've been trying to demolish it since last October. So as soon as we comply, then I'll demolish it.

57:35Speaker 12

So you're waiting for environmental, and then you'll move forward with the demolition.

57:39Speaker 19

Yes. The city recommends 120 as they are in the corrections phase.

57:43Speaker 11

And this is a church, correct? Yes. Okay. I'll make a motion for guilty 120, $150 per day. Second. Second.

57:52Speaker 10

And that'll be, 120 will be sufficient to get things going.

57:56Speaker 28

Yes, if we get the permit.

57:57Speaker 11

Yeah, and if you need more time, you can always come back.

57:59Speaker 10

All in favor? Aye.

58:01Speaker 28

Thank you, board.

58:16 – 58:32Speaker 14

The last case will be heard as an absentia. It's page 10. Case number 00146469, property address 719 Northwest 79th Street. The tenant is here, but the property owner is not here.

58:33Speaker 18

Also, if you're in the audience and you have not signed in, your case is not going to be called.

58:43Speaker 10

Good evening, Inspector. Good evening. Please state your name for the record.

58:46Speaker 15

Inspector Bailey, North Office.

58:48Speaker 10

Okay, city, if you want to proceed.

58:50Speaker 12

We will. Inspector, did you cite the aforementioned property for failure to have a certificate of use as well as a business tax receipt?

58:58Speaker 12

All right, and you put together pages 1 through 33 for tonight's hearing for the board, is that correct?

59:02Speaker 15

That's correct.

59:02Speaker 12

All right, and what we're showing here in these pages, the NOV, which went to the owner of record pursuant to the property appraiser as well as the registered agent for that corporate owner, yes?

59:13 – 59:24Speaker 12

And the NOV as well as the summons were sent certified mail to both of those people? as well as the property was posted for both the original violation as well as the summons for today, correct?

59:25 – 59:52Speaker 12

And that's what we're showing here, proof of the certified mailing as we go through. You did an affidavit of posting as well as mailing the property yourself. Here's our showing who the registered agent is, which is who it was mailed to, the warranty deed. Then we have the property appraiser report obviously showing that. It's a commercial property because we're here for a CU and a VTR. Hold on a second. Here we go.

59:52 – 1:00:06Speaker 15

So this is the business? Right. It's a barbershop. Yes. That was sent over to me by the business department. It was not a proactive case that the business was operating without a VTR CU.

1:00:06 – 1:00:17Speaker 12

How are you doing? All right. I don't want to have those other things on the tabletop. But all right, at this time, the city would seek to admit pages one through 33 into evidence?

1:00:18Speaker 12

Proof of the posting, everything else, right. Have they applied at this time for their CU?

1:00:25Speaker 15

I didn't see an application on file.

1:00:30Speaker 1

You got anything?

1:00:34Speaker 15

You see it, Frankie?

1:00:38Speaker 12

You applied yet?

1:00:40Speaker 12

Okay, recently?

1:00:42Speaker 22

Yes, I paid the $500 fee and I'm waiting on the expression.

1:00:45Speaker 12

Okay, he's going to check right now.

1:00:52Speaker 15

Under what address? Under the same address, 719?

1:00:54 – 1:01:11Speaker 19

Yes, 719 North East 719 Street. What does 2742 mean? Is that, or is that just? Yes.

1:01:11Speaker 12

I don't know what the bay numbers are.

1:01:13Speaker 19

The application was submitted in January.

1:01:15Speaker 12

Okay, all right.

1:01:19Speaker 19

The city recommends 120 as he is currently working on the process.

1:01:25Speaker 11

Guilty, 120 days, $250 per day.

1:01:30Speaker 10

Second. All in favor? Aye.

1:01:33Speaker 11

Thank you. Yeah, take that paper if you need to do an extension.

1:01:45Speaker 29

That's it. Everything else is absentia, and Rachel, you're up.

1:02:07Speaker 11

We have a lot. 20.

1:02:09 – 1:02:20Speaker 12

So we have 20. Now, hopefully, somebody will come up and be like, no, that one already complied. But until that happens, you're not going to time me, are you?

1:02:20Speaker 11

Yeah, you had a record before of like a minute and 45 seconds per absentia case. So if you want to keep with that, we'll probably be able to do that.

1:02:30Speaker 12

I do think we do have some. It may slow us a little bit. We do have some witnesses. What's up? I see the hand going up over there.

1:02:36Speaker 14

Page 38 complied.

1:02:38Speaker 12

Page 38. Yes. See? Already down to 19. See how that works? Yeah.

1:02:45Speaker 11

Less than 30 seconds.

1:02:47Speaker 12

But we do have some residents who are here to testify on, I think, one or two of the cases.

1:02:53 – 1:03:12Speaker 12

So I'm going to call that one up first so that they're not stuck here. It'll be Inspector Francois, page 50, 3200 Northwest 3rd Avenue, case number 00143630. Inspector, can you please state your name for the record?

1:03:13Speaker 25

Inspector Francois.

1:03:14Speaker 12

Do you cite the aforementioned property for work without a permit that is the metal fence installed at the property?

1:03:20Speaker 25

Correct. All right.

1:03:21 – 1:03:33Speaker 12

And you put together pages 1 through 27 for today, which includes the notice of violation as well as the summons, which were sent certified mail to the property owner as well as the property being posted. Is that correct?

1:03:33Speaker 25

That's correct.

1:03:34 – 1:03:57Speaker 12

And then located within this composite exhibit A is the proof of mailing, proof of posting, photographs of the posting, Miami-Dade property appraiser report, the deed. USPS information, and then we get to, there's no, we have a 2025 incomplete application and nothing else, is that correct?

1:03:58Speaker 25

Correct, they do have a application and review as of now.

1:04:04Speaker 12

Okay, and then is this the fence?

1:04:08 – 1:04:19Speaker 12

Okay, so it's the metal fence put around the property. All right, at this time, the city seeks to admit pages one through 27 into evidence.

1:04:21Speaker 25

Admit it. Admit it.

1:04:22Speaker 12

Do you have any contact with the owners?

1:04:25Speaker 25

Yes, that's her in the picture. I only spoke to her that initial day when I was issuing the violation. I haven't heard from her since.

1:04:39Speaker 17

Yeah. Too bad, otherwise I wouldn't. Yeah.

1:05:00Speaker 16

I'll ask you the question.

1:05:02Speaker 12

Sir, can you please state your name?

1:05:04Speaker 2

Julian Mancinelli.

1:05:06Speaker 12

Okay. And where do you live in relation to this property?

1:05:10Speaker 2

I own the neighboring property, 3210 Northwest 3rd. Okay.

1:05:14Speaker 12

Okay. And is that this property with this metal fence here? I'm just asking.

1:05:19 – 1:05:31Speaker 2

Yeah, that metal fence is encroaching the entire property. You can see the pink line on the pavement. That's where the boundary of the property is. We have submitted surveys. We have a permitted fence to be installed.

1:05:31Speaker 12

And so right now, are you trying to pull permits, but you can't because this particular one is encroaching?

1:05:37Speaker 2

The permit is approved, which is waiting to be installed. We need the neighbor. We offer help. to remove those items, and we have no response from them.

1:05:46Speaker 12

Okay. At this time, the city would ask for a finding of guilt, three days for compliance, $250 a day thereafter. That is, $250 is the maximum per DM fine.

1:05:57Speaker 16

This is homesteaded. Huh? The property is homesteaded. Right, so $250,000 is the maximum. Okay. I move as stated.

1:06:03Speaker 2

Is there any way we could shorten the times for compliance? It's three days. Three days?

1:06:07Speaker 15

Yeah, three days.

1:06:08Speaker 2

I want a second. I'm sorry. Go ahead. Second.

1:06:10Speaker 11

Vice Chair. Important information. Madam Attorney, you said it has homestead. In our book, it says it doesn't.

1:06:19Speaker 12

Oh, I didn't say that. She asked me if it had homestead.

1:06:22Speaker 11

So it does. No, but in our book it doesn't say it have homestead.

1:06:28Speaker 12

Well, it's a single-family home, residential property. It's a residential property, so the maximum is $250.

1:06:35Speaker 11

I was on the wrong page.

1:06:37Speaker 16

And the reason I'm saying $250 is... And they do have homestead exemption.

1:06:39Speaker 12

I was on the wrong page.

1:06:42Speaker 16

Okay. Thank you. Appreciate it. that he was trying to get someone. They're not willing to cooperate, he's willing to help.

1:06:49Speaker 17

I don't think we voted yet. We didn't vote. We didn't vote. All in favor?

1:06:58 – 1:07:29Speaker 12

Good luck. The next one we're going to will be page 18, Inspector Bailey, 8217 Biscayne Boulevard. Case number 00148252. Inspector, can you please state your name for the record? Inspector Bailey, North Office. Did you put together pages 1 through 31 for the above case for failure to register the property, failure to maintain, and for graffiti?

1:07:30Speaker 12

Okay, and right now all that's left is the failure to maintain and graffiti. Is that correct? For the 82s, it's vacant.

1:07:39Speaker 15

Vacant. No, 8217, the vacant.

1:07:46 – 1:08:00Speaker 12

Okay, it's only... All right, you have it cited for a register for a vacant structure, graffiti on property, and fair to maintain the lot. Okay, everything is complied, but the vacant. The vacant structure?

1:08:01Speaker 12

Oh, okay, I had it the other way around. Oh, yeah, sorry.

1:08:04Speaker 20

Oh, okay. You're killing my time. He likes to time me.

1:08:08 – 1:08:19Speaker 12

All right. So you sent the notice of violation as well as the summons certified mail to the owner of record as well as the registered agent pursuant to Sunbiz, is that correct?

1:08:20Speaker 12

And also posted the property with both the NOV as well as the summons, is that correct?

1:08:25Speaker 12

And here we have the proof of ownership, the deed, Miami-Dade Property Appraisal Report, USPS tracking, mailing, and this is the property, is that correct?

1:08:36Speaker 12

So it's all been cleaned up, but they just haven't registered it as vacant.

1:08:41Speaker 12

All right. At this time, the city seeks to admit pages 1 through 31.

1:08:46Speaker 12

Evidence having been admitted, city rests. As for a finding of guilt, three days for compliance, $250 a day thereafter.

1:08:54Speaker 16

Move is stated.

1:08:55Speaker 10

Second. All in favor? Aye.

1:08:57 – 1:09:10Speaker 12

Our next one will be Inspector Hallman. Page 20. 1252 Northwest 33rd Street, case number 00148491.

1:09:11Speaker 21

Inspector, please state your name for the record. Inspector Hallman, Central Office.

1:09:16Speaker 12

You put together pages 1 through 21 for tonight's hearing?

1:09:19Speaker 21

Yes. All right.

1:09:20Speaker 12

And you cited the aforementioned property for failure to maintain as well as failure to register the lot. Is that correct?

1:09:27 – 1:09:38Speaker 12

And you sent the notice of violation as well as the summons certified mail to the owner pursuant to the property appraisal report, and you posted the property... as well for both the original notice as well as the summons, is that correct?

1:09:39Speaker 12

And within this file is your proof of notice, your mailing, as well as the property appraiser report.

1:09:47 – 1:10:09Speaker 12

All right. And this is the property in particular, and it's vacant, correct? Yes, it's just a lot. At this time, the city would seek to admit pages one through 21. Admitted. Evidence having been admitted, city rests. As for finding of guilt, three days and $250 a day thereafter.

1:10:09Speaker 16

Move is stated.

1:10:09Speaker 10

Do we have a second? Second. All in favor? Aye.

1:10:13Speaker 12

All right, we're already moving on to page two. Inspector Anderson.

1:10:17Speaker 10

Do you know how many we have?

1:10:20Speaker 12

We have 15 left. 15 left?

1:10:22Speaker 10

I'm going to just go to the restroom for a minute.

1:10:24 – 1:10:38Speaker 12

Okay. We got the vice chair taking over? All right, page 33, 1595. Northwest 60th Street, K00132822. Inspector, can you please state your name for the record?

1:10:38Speaker 6

Inspector Anderson called Compliance North.

1:10:40Speaker 12

Did you cite the aforementioned property for work performed without a permit for the fence that was placed on the property?

1:10:46Speaker 6

That's correct.

1:10:46Speaker 12

Okay. And you put together pages 1 through 59 for this violation, yes?

1:10:53 – 1:11:26Speaker 12

Notice of violation as well as a summons was sent certified mail to the owner of record as well as their registered agent. Is that correct? Yes. The property was posted. And within these pages, we have your affidavit and proof of mailing, as well as copies of the NOV, the summons that was sent to everybody, the USPS tracking numbers, and past permits that were available online. Is that correct? That's correct. All right. So we will get to... There's a series of emails with Public Works.

1:11:27Speaker 6

Yeah, because it was a dispute between the two property owners as the... who the portion of the property belonged to for the fence.

1:11:35 – 1:11:50Speaker 12

Okay. Hold on. I'm going to get there. Everything doubled up. All right. So this is the property, is that correct? Yes. Which is the fence that we're discussing?

1:11:51Speaker 12

The brown? Uh-huh.

1:11:57Speaker 12

At this time, the city seeks to admit pages 1 through 59. Admit it. Evidence having been admitted, city rests as for finding of guilt. Three days, $250 a day thereafter. Move to state it.

1:12:07Speaker 11

Second. All those in favor?

1:12:09 – 1:12:22Speaker 12

Aye. Same inspector, page 366955, Northwest 15th Avenue. Case number is 00146679. Inspector, please state your name for the record.

1:12:22Speaker 6

Inspector Anderson called Compliance North.

1:12:25Speaker 12

You put together pages 1 through 52, and you cited this property for failure to maintain their lot. Is that correct?

1:12:32Speaker 6

The only thing that's open is the failure to register. Everything else is complied.

1:12:37Speaker 12

All right. Well, this is only for failure to maintain, so then this case is...

1:12:41Speaker 6

Which case? 00146679? Yep. Let's see. We got a ticket.

1:12:48Speaker 12

Hold on. Yeah, it's only for failure to maintain.

1:12:59Speaker 12

This case for that. So it's complied?

1:13:05Speaker 16

What happened to the vacant lot? There we go. Because the vacant lot is in our books.

1:13:11Speaker 12

Well, this is a failure to maintain.

1:13:13Speaker 16

There's a second violation.

1:13:14Speaker 6

And the failure to register is not in that case?

1:13:17Speaker 12

It wasn't noticed for that. It's not noticed for that, so if it's not noticed for that, it's not being heard for that.

1:13:22Speaker 6

Because I know I had two separate cases for that same property.

1:13:26Speaker 12

Well, I might not be at that one yet. Wait, let me see. Two separate ones. Hold on. Wait, wait, wait. Maybe I pulled up the wrong one. Maybe I pulled up the wrong one.

1:13:35 – 1:13:46Speaker 6

The one I'm talking about ends in 6679. All right. 6679 is overgrown. and failure to register. 6955.

1:13:46 – 1:14:32Speaker 12

It's not in. I only have case number 147296. Okay, I'll check it in the computer. Why don't we just pass this one? But the rest of these are yours and then we'll do the other ones and then you can check this one and we'll come back to it. Because I think this is just the one where you had to upload the other case, but it wasn't uploaded. Remember you uploaded the wrong case?

1:14:32Speaker 6

Yeah, I'll check it.

1:14:34 – 1:14:53Speaker 12

Because this is the 296 case. So we don't have the correct one uploaded for tonight. Your next case is going to be page 41, 1513 Northwest 69th Terrace, 00141342. Please state your name for the record.

1:14:54Speaker 6

Inspector Anderson, Code Compliance North.

1:14:56Speaker 12

You issued this violation for free to register the lot as well as for outside storage of miscellaneous debris, material, and equipment?

1:15:04Speaker 21

That's correct.

1:15:05 – 1:15:46Speaker 12

All right. And you put together pages 1 through 32, which show the notice of violation that was sent to both the owner and the registered agent, certified mail, as well as the summons was sent to the owner and registered agent, certified mail. Is that correct? That's correct. We have your affidavit of posting and mailing as well as the quick claim deed. USPS tracking. Here's the, actually what comes back saying there's no register on the property. Blurry, but gets the point across. So, there we go, that's better. Is this the condition of the property?

1:15:47Speaker 12

Is it still maintained in that manner?

1:15:49 – 1:16:00Speaker 12

All right. This time the city seeks to admit pages one through 32 into evidence. Evidence having been admitted, city arrests as for finding of guilt, three days, $250 a day thereafter.

1:16:00Speaker 16

Move as stated.

1:16:21 – 1:16:44Speaker 12

Go to the next, you don't have one. Inspector Francois. Yeah, he's going to help you upload the one. It's just, sorry, the last one's just, the property has two cases. One is for next month or something. It just, we're going to fix it so we can hear that one. Page 47, 1641. That's for next month.

1:16:53Speaker 25

1641 Northwest 13th Court. That's set for next month.

1:16:56Speaker 12

Reset for next month. Next one, page 50. Let's see, we heard that one already.

1:17:04Speaker 25

That one was closed because the registered agent wasn't notified. Yep.

1:17:10 – 1:17:36Speaker 12

All right. Then, since that one was reset, let me call Inspector Bailey so we keep this in order. Inspector Bailey, page 58, 437- Northeast 75th Street, case number 00095005. Inspector, please state your name for the record. Inspector Bailey, North Office. Do you cite the aforementioned property for work without a permit and failure to have a certificate of appropriateness?

1:17:37Speaker 12

All right. In this particular instance, you put together pages 1 through 44, yes?

1:17:42Speaker 12

And the NOV as well as the summons for tonight were sent... certified mail to the owner of record, as well as the property was posted both times, correct?

1:17:53 – 1:18:24Speaker 12

All of a sudden, you're smiling at me. I'm like, did I do say something wrong? The document shows your affidavit of posting and mailing, your proof of mailing, the USPS tracking numbers, the property appraiser report, and now we'll get to... The good pictures, I guess, right? So in this particular case, they put up this fence, is that correct?

1:18:25 – 1:18:39Speaker 12

And they do not have a permit for this fence, and it's located in a historic district, and therefore it has to be approved by HEP, and they need to get a COA, is that correct? That's correct. All right. City who seeks to admit pages 1 through 44 into evidence.

1:18:40Speaker 12

Evidence having been admitted, city rests as per finding of guilt. Three days, $250 a day thereafter. No, well, yeah, $250.

1:18:48Speaker 16

I move as stated. Second.

1:18:51Speaker 10

All in favor? Aye.

1:18:51 – 1:19:08Speaker 12

All right, Inspector Bailey, another one, page 61, 443. 75th, let's see, 443 Northeast 75th Street, case number 00095005. Can you please see your name for the record?

1:19:09Speaker 15

Inspector Bailey, North Office.

1:19:11 – 1:19:35Speaker 12

All right, looks slightly familiar here. Did you cite the aforementioned property for Fay to have a certificate appropriate and work without a permit for their fence? I did. Okay, and it's the neighbor. It is. Okay. You put together pages one through 49, which has the NOV as well as the summons that was sent certified mail to the owner of record and the property was posted with the NOV as well as the summons for today. Is that correct?

1:19:35Speaker 15

That's correct.

1:19:36Speaker 12

We also have the warranty deed, the proof of mailing from the postal service, as well as the property appraiser report showing the owner.

1:19:47 – 1:19:59Speaker 12

And here's their suspiciously looking familiar fence. Similar-ish to their neighbor, which looks lovely, but they need to get approval and a permit. Yep. Correct. All right. At this time, the city seeks to admit page 1 through 49.

1:20:00Speaker 12

Evidence having been admitted, city rests as we're finding out guilt. Three days, $250 a day thereafter.

1:20:05Speaker 16

Move is stated.

1:20:06Speaker 10

Second. All in favor? Aye.

1:20:09 – 1:20:33Speaker 12

No, I think I just need to update. You uploaded it? Frank. There he is. All right. We're going to recall page 36, 6955 Northwest 15th Avenue, 00146697. Inspector, can you please state your name for the record?

1:20:33Speaker 6

Inspector Anderson, Code Compliance North.

1:20:35Speaker 12

Hey, did you cite the aforementioned property for failure to register? That's what's remaining, correct?

1:20:40Speaker 6

That's correct.

1:20:40 – 1:21:00Speaker 12

Look at that. Like a sieve. All right. And you sent notice to both the... Corporate owner of record as well as a registered agent via certified mail of the notice of violation as well as the summons for tonight. Yes. And we have your proof of mailing and affidavit of posting here for both of those. And the lot was posted as well. Is that correct?

1:21:00Speaker 6

That's correct.

1:21:01Speaker 12

All right. Here's the picture of the same lot again for said failure to register. At this time, the city seeks to admit pages 1 through 20.

1:21:11Speaker 12

Evidence having been admitted, city rests as for funding of guilt, three days, $250 a day thereafter.

1:21:16Speaker 16

Move is stated. Second.

1:21:19 – 1:21:36Speaker 12

All in favor? Aye. I apologize for the mix-up. We'll do your next one. Inspector Anderson, page 71, 1379, Northwest 55th Terrace, case number 00148055. Can you please state your name for the record?

1:21:36Speaker 6

Inspector Anderson, call Compliance North.

1:21:38Speaker 12

You cite the aforementioned property for work without a permit, that is, windows and doors. That's correct.

1:21:44 – 1:22:17Speaker 12

All right. You sent the notice of violation as well as the summoned certified mail to the owner of record as well as their registered agent. Is that correct? Yes. And you posted the property for both of those, of which we have copies of the notices that were sent, your affidavits of mailing and posting, copy of the Sunbiz report, copy of the property appraiser report, copy of the deed. as well as USPS tracking, is that correct? Yes. All right, and here we have the global inquiry, which is iBuild, which does not show any active permit. We have something in review finally for repair and remodeling.

1:22:18Speaker 6

Yeah, they have a process number.

1:22:19Speaker 12

Which would seem to be related to windows and doors. Yes. But has obviously not been issued yet and wasn't issued at the time the work was done.

1:22:27Speaker 6

That's correct.

1:22:27Speaker 20

Any contact with the owner?

1:22:30Speaker 12

All right, so here is the photograph so you can see. You had no access to the inside, is that correct?

1:22:37Speaker 6

No, I haven't been inside.

1:22:39Speaker 12

At this time, the city seeks to admit pages one through 41.

1:22:43Speaker 12

Evidence having been admitted, city rests as for finding of guilt three days from $50 a day after. Move is stated.

1:22:50Speaker 10

Second. All in favor? Aye.

1:22:53 – 1:23:09Speaker 12

And I skipped Inspector Francois on page 67. I apologize. Probably because I had Skittles. Page 67, address 420 Northwest 45th Street. Case number 00147996. Inspector, please state your name for the record.

1:23:09Speaker 25

Inspector Francois.

1:23:11Speaker 12

You cited the aforementioned property for failure to maintain the property that is overgrown grass and maintaining it on a regular basis?

1:23:18 – 1:23:29Speaker 12

Is the violation still outstanding? Yes. Okay, just checking. You sent certified mail, the notice of violation as well as the summons for tonight to the owner of record as well as their registered agent, is that correct?

1:23:30Speaker 12

And you also posted the property with both of those notices, yes?

1:23:34 – 1:23:55Speaker 12

And in pages 1 through 40 is your proof of mailing, copy of everything that you sent, photographs of your posting, copy of the warranty deed, copy of the Sunbiz report, copy of the property appraiser report, copy of the tracking information as well, yes? Yes. All right. Well, let's get to the pretty pictures. All right, so this is the property, is that correct?

1:24:00Speaker 15

Let's see, and it's overgrown.

1:24:02Speaker 12

This fairly and accurately depict the property on a regular basis?

1:24:05Speaker 12

All right. Have they come in to do anything on it?

1:24:08Speaker 25

No, I haven't heard anything from anyone. Okay.

1:24:10Speaker 12

At this time, the city seeks to admit pages 1 through 40 into evidence.

1:24:15Speaker 12

Evidence having been admitted to the arrest as for a finding of guilt, three days, $250 a day thereafter.

1:24:20Speaker 16

Move as stated.

1:24:21Speaker 10

All in favor? Aye.

1:24:23Speaker 1

Thank you. All right.

1:24:24 – 1:24:42Speaker 12

Next one's going to be Inspector Troutman on page 78. It's going to be 2130 Southwest 27th Street, case number 00019797. Good evening, Inspector.

1:24:43Speaker 15

Good evening. Can you please state your name for the record? Inspector Troutman with the North Office.

1:24:48Speaker 12

All right. Do you cite the aforementioned property for work performed without a permit as well as illegal units?

1:24:53Speaker 15

That's correct. Are both violations still outstanding? Yes.

1:24:57Speaker 12

All right. You sent both the notice of violation as well as the summons for today to the owner of record certified mail and Posted the property on both occasion. Is that correct?

1:25:07 – 1:25:28Speaker 12

Yeah within pages 4 through 1 through 58 you have Copies of all of those mailings and proof of the posting from your affidavit as well as the photographs at the end Is that correct? Right and you pulled all the records as it related to building-wise, and you didn't have any permits for what type of activity on the property, if you can explain.

1:25:28 – 1:25:39Speaker 15

The work without a permit in an illegal unit is a pavilion that has a washer and dryer installed and also an illegal unit in the back.

1:25:40Speaker 12

All right. Any contact with the owner?

1:25:44Speaker 12

And what did they say?

1:25:46 – 1:26:05Speaker 15

They were saying that they had an issue before with the violations. That's how I was able to find the copy of the summons where they had work without a permit encroachment. But the complaint that I specifically was talking to them about is the work without a permit. The pavilion, which is right here.

1:26:05Speaker 12

The one with the way outside streetlight. Yes, yes. The super bright thing? Yes.

1:26:10Speaker 15

Okay, can you all see that?

1:26:12Speaker 12

That it needs to be legalized, yes. All right, so that's the issue for that.

1:26:20Speaker 12

We have this in the back here, which is supposed to be what?

1:26:24 – 1:26:56Speaker 15

Well, it was supposed to be a single-family home, but they were taken aboard before, and everything is in compliance. So the only thing that hasn't been brought into compliance was the pavilion. The back area? The pavilion, and when you scroll down, you're going to see that they have created an inclusive pavilion, created a washer and dryer, and it looks like they also have a unit in the back of the pavilion. All right, hold on. They created another structure, another living unit.

1:26:56Speaker 12

That's not the pavilion, right? Not yet.

1:26:59Speaker 15

All right, hold on.

1:26:59 – 1:27:22Speaker 12

Let me get that. Right there. So part of it was cut off, and we now have a door entry to it. Yes. Right here, with locks on it and everything else. All right, at this time, the city seeks to admit pages one through 58.

1:27:25Speaker 12

We ask for a finding of guilt, three days for compliance, 250 a day thereafter. Move is stated.

1:27:32Speaker 10

Second. All in favor? Aye.

1:27:34 – 1:27:55Speaker 12

All right, next one with Inspector Troutman. For... Let's see, page 80, 2332 Northwest 21st Terrace, 00054116. Can you please state your name for the record?

1:27:56Speaker 15

Inspector Troutman, North Office.

1:27:59 – 1:28:12Speaker 12

Do you cite the aforementioned property for work performed without a permit, no certificate of use, as well as failure to obtain their BTR? That's correct. Okay, in this particular case, the work is a built-in cooler that they put in the warehouse.

1:28:12 – 1:28:43Speaker 12

Like a walk-in cooler. All right, pages one through 77 contain all the documents that are related to this file, including the notice of violation as well as the summons for tonight that was sent to the owner of record and their registered agent, yes? And those notices were all sent certified mail and the property posted each time, is that correct? So we have copies of all of that, copies of your affidavit of mailing and posting, as well as copy of the USPS tracking information. We have the warranty deed, property appraiser report, the SunBiz report showing the registered agent,

1:28:45Speaker 15

And we have it twice, just in case. Let's see the first time.

1:28:52Speaker 15

Because it was reset. Yeah, it was reset a couple times.

1:28:56 – 1:29:12Speaker 12

And then you can't get code check not to redo it. All right, so here's the property itself. We're getting so close. They signed for their receipts. Here we go. All right, so this is the property, yes?

1:29:13Speaker 12

All right. Inside the warehouse. Is this our cooler? That's a built-in cooler. All right.

1:29:20Speaker 5

Looks like something you pull the big truck up into and then you throw it out.

1:29:26Speaker 12

All right, so that's what they need to legalize.

1:29:28Speaker 12

All right. Any contact with the owner?

1:29:31 – 1:29:42Speaker 15

Yes, I have, but not recently. When we spoke, we met out at the property. I explained to him what needs to be corrected, and I haven't seen any permits pulled. I haven't had any more contact.

1:29:43Speaker 12

All right. At this time, the city rests as for finding of guilt. Three days, $250 a day thereafter. Move as stated. Second.

1:29:49Speaker 10

All in favor? Aye.

1:29:50 – 1:30:14Speaker 12

Aye. All right. We'll go back to Inspector Francois. Page 90. The address is 151 Northeast 42nd Street. Day 00147417. Good evening, Inspector. Good evening, Inspector. The violation moving forward tonight is for facade only, correct?

1:30:15Speaker 12

Okay. At this time, you cited the, did I ask you to state your name first?

1:30:21Speaker 25

I can't remember. No.

1:30:22Speaker 25

Sorry, Inspector Francois.

1:30:23Speaker 12

Okay, you cited the property for several violations. The one we're going forward tonight is for failure to maintain the facade of the property structure, is that correct?

1:30:34 – 1:30:47Speaker 12

All right, and in pages one through 54 contains the documents related to the property, which is the notice of violation as well as the summons, which was sent certified mail to both the owner of record as well as their registered agent, is that correct?

1:30:48Speaker 12

And both of those documents were also posted on the property as required by the city code, correct?

1:30:54 – 1:31:23Speaker 12

All right, so we have your affidavit of posting here. We have proof of mailing through the USPS tracking numbers that we have. Here's proof that they registered it more recently. Property appraiser report. The CEMBIS report for the registered agent. And then we'll get to the warranty deeds. So this is the property itself. Obviously, it needs to be repaired. Is that correct?

1:31:23Speaker 12

All right. Do the photos still fairly and accurately depict what the property looks like today in the structure? Yes. All right. This time the city seeks to admit pages 1 through 54?

1:31:34Speaker 12

Evidence having been admitted, city rests as for finding of guilt, three days, $250 a day thereafter.

1:31:40Speaker 10

So moved. Second. All in favor? Aye.

1:31:42 – 1:32:00Speaker 12

All right, now we're going back to Inspector Anderson. We're almost, we're getting close. We're getting close. And it's still light out. Page 100, 1280 Northwest 60th Street, case number 00148053. Inspector, please state your name for the record.

1:32:00Speaker 6

Inspector Anderson, Code Compliance Northwest.

1:32:02 – 1:33:19Speaker 12

All right, you cited the aforementioned property for work without a permit, which is for the resealing and restriping of the parking lot, is that correct? That's correct. All right, put together pages one through 44, and located therein is the NOVs and summons for tonight, which were sent certified mail to the owner of record as well as the registered agent, yes? Yes. We have copies of those mailings, your affidavit of posting, USPS tracking numbers. In here, we have the deed as well as the sum business, for the registered agent your emails discussing the issue with the property owner yes yes and let's see you have the permit showing it's still not pulled has it been pulled as of today they have a process number they're just still an applicant Corrections right okay And I'll get to just reset once, so it takes time. So this is part of the area here where they... Yeah, that was a before picture, how it looked before. And then we have the resurfacing with the new striping. Right. All right, this time the city seeks to admit pages one through 44.

1:33:20Speaker 12

Evidence having been admitted, city rests as for finding guilt, three days, $250 a day thereafter.

1:33:26Speaker 10

All in favor? Aye.

1:33:28 – 1:33:39Speaker 12

All right, and we own four more. Page, Inspector Anderson, page 103, 6943, Northwest 15th Avenue.

1:33:40Speaker 6

That's complied.

1:33:41 – 1:34:04Speaker 12

Look at that, three more. Come on. Right, I'll skip to your last one, and then I'll do Tiana's last two. Page 117, 1430, Northwest 59th Street. Case number 00148667. Inspector, please state your name for the record.

1:34:04Speaker 6

Inspector Anderson, code compliant to north.

1:34:06 – 1:34:19Speaker 12

You cite the aforementioned property for parking on unimproved, let's see, it's for failure to register and debris. Is that what remains? Yes. All right, it was originally cited for more violations, but currently just those two are pending, yes?

1:34:20 – 1:35:17Speaker 12

All right, and the notice of violation, as well as the summons for tonight, went out to the property owner's certified mail, as well as you posted the property, is that correct? That's correct. And in pages 1 through 30, all of those documents are contained, copies of your notices, proof of your affidavit and posting, as well as copy of the deed and the property appraiser report. That's correct. and also the mail-ins you had confirming the property was not registered, yes? Yes. All right, so let's just get a picture of the property. So we do have, here's the debris that's on the property itself. There's garbage all throughout the front and backyard of the property, is that correct? Yes. All right. And then we have debris on the side. At this time, the city would seek to admit... PAGES 1 THROUGH 30 INTO EVIDENCE.

1:35:18Speaker 12

EVIDENCE HAVING BEEN ADMITTED. CITY REST. ASK FOR FRIEND AIM GUILT, THREE DAYS, $250 A DAY THEREAFTER. MOVE AS STATED.

1:35:24Speaker 10

SECOND. ALL IN FAVOR? AYE.

1:35:27Speaker 12

PAGE 130 WILL BE RESET AND NOT HEARD. WE HAVE TWO LEFT WITH INSPECTOR HALLMAN.

1:35:34Speaker 16

WE LEAVE THE BEST FOR LAST.

1:35:36 – 1:35:47Speaker 12

ALL RIGHT. PAGE 115, 1700. Southwest 9th Street, 00149192. Inspector, please state your name for the record.

1:35:47Speaker 21

Inspector Hallman, Central Office. All right. I did the lowest one first.

1:35:52Speaker 12

You cited the aforementioned property for being vacant, blighted, unsecured, and failed to register a vacant structure.

1:36:00Speaker 12

And both those are still outstanding?

1:36:02Speaker 12

All right, notice was sent to the person that was listed as the owner per the property appraiser and the address provided therein, yes?

1:36:09 – 1:36:27Speaker 12

That notice was sent both the NOV and the summons certified mail, of which in pages one through 28, we have copies of both the NOV as well as the summons, your affidavit of posting and mailing, copies of the USPS proof of mailing.

1:36:28Speaker 12

Claim the property appraiser report and pictures.

1:36:32Speaker 12

So this is the current condition of the property. And at this time it's still not registered, correct? No. All right, this time the city seeks to admit pages one through 28.

1:36:44Speaker 12

Evidence having been admitted, city rests as for funding three days, $250 a day thereafter. How much was that? $250.

1:36:53Speaker 16

This house is still people living in there.

1:36:55Speaker 21

There's squatters in there.

1:36:57Speaker 16

I know. They're selling drugs, too. This property was before us already, and it's a drug house. It's a big problem that we have in our neighborhood. Move is stated.

1:37:08Speaker 11

Second. Second.

1:37:11Speaker 12

Huge problem. And last but not least, a few pages beforehand, we're going to... We need to finish the vote.

1:37:18Speaker 17

All in favor? Aye. All in favor? Aye. Anybody else? Aye.

1:37:20Speaker 12

1:37:40 – 1:37:51Speaker 12

There it is. All right. Page 109, 3365 Southwest 37th Avenue, case 00133473. Inspector, can you please state your name for the record? Inspector Harmon, Central Office.

1:37:51Speaker 21

You cite the aforementioned property for failure to maintain as well as failure to register the lot? Yes.

1:37:56Speaker 12

All right. And both of those are still outstanding?

1:38:02Speaker 12

She says hesitantly.

1:38:05Speaker 21

I believe they registered the lot as far as the trash still.

1:38:10 – 1:38:23Speaker 12

We'll check on the proof of registration right now. When you initially cited the property, and this is in pages 1 through 54, you sent notice to the owner of record as well as their registered agent of both pending violations. Is that correct?

1:38:24Speaker 12

And then for the summons as well for tonight?

1:38:26Speaker 12

All right. And that was done certified mail and you posted the property both times to make the owner aware. Is that correct?

1:38:33Speaker 12

We also have the affidavit of posting for both of those things. We have a copy of the property appraiser report, the SunBiz report, as well as the deed, USPS tracking numbers.

1:38:45Speaker 19

The last time it was registered was in July of last year. So it's good for a year. All right.

1:38:50Speaker 12

So the registration is now complied. So we'll only move forward on the failure to maintain. So we'll get to those pictures.

1:39:03 – 1:39:18Speaker 12

When we get there. Oh, there we go. Look at that. So they've got it covered with that nice black covering, so it's hard to see through. But is that how the fairly and accurately depict what it looks like? Yes. All right. This time the city seeks to admit pages 1 through 54.

1:39:20Speaker 12

Evidence having been admitted, city rests as for finding of guilt. Three days, $250 a day thereafter.

1:39:24Speaker 16

Move as stated.

1:39:28Speaker 16

And that's it. Good night, everybody.

1:39:34Speaker 10

Meeting adjourned.
