Corey, do you want to start with any sort of staff report? I know this is the first time that the Planning Commission in a long time has dealt with a flat hearing. So if you want to, I think we've got some prints here, if you want to go through with the staff report, please.

Okay. So yeah, like you said, it's been quite a bit of time since we've done this before as a county, and definitely will be the first time that you all have gone through this process. So I've been working in the last month or so doing, sifting my way through this whole process. And so hopefully you got my email that gave you some education materials behind that on kind of what you're looking at and this whole process in general. But for everybody, just so that we're on the same page, plan commission is responsible for reviewing subdivision applications to determine if they comply with our subdivision control ordinance here in the county. So we make the decision on the primary plat approval. And so we can approve, approve with conditions, do a continuance or a flat out denial of a project. So when we say primary plat, that approval, that establishes basically the blueprints or the layout of the subdivision to make sure it's appropriate. It will then be kicked to a final stage or a final plat. approval where all detailed engineering and approvals have to be submitted and are double checked before anything is constructed. That's typically done by the PLAT committee, which we will have to resurrect here at some point soon. So the Plain Commission has been provided a copy of the PLAT. That's this beautifully bound document that you see here from HWC Engineering. on that one. And so that one shows the proposed layout, internal street networks, access points for the subdivision, etc. So it gives us a good basis of what that layout or blueprint should be for the subdivision. So just a basic synopsis of the project here. You'll see in your drive, you do have a staff report and all the relevant materials are there should you wish to look at that. But in general, this request is for a primary platform for a nickel plate crossing, which is a proposed 109 lot residential subdivision located on County Road 800 South and County Road 200 West. So South County 800 South, I believe is School Road there. The property is currently zoned R1 residential and has received variances for lot size, setbacks, and floor area. Those were approved, I believe, last April. Public water and sewer are available and we'll supply the subdivision here, and the layout is generally consistent with our comprehensive plan. The primary issues identified during the review process was access to the subdivision. The Highway Department is opposed to any access onto County Road 800 South due to safety concerns and has recommended that all access be limited to County Road 200 West. The Highway Department also indicated that they will not assume maintenance of internal subdivision roads, so a condition has been included requiring the developer to establish ownership and maintenance responsibilities prior to that final plan. A drainage report was submitted showing detention ponds in compliance with stormwater standards. Final design will be reviewed at the final plat stage. All reviewed agencies have been provided or have provided comments except for our county engineer, which we don't have anymore, or at least it's not filled. So all those agencies provided comments and no objections were received from the health department. Soil and water indicated that erosion control permitting will be handled through IDEM. That's the stormwater management side of things. Based on staff's review, this proposal meets the basic requirements for primary plat approval and staff recommends approval subject to the conditions outlined in the report. So you'll see there that I did include 12 conditions for approval. tonight and so i'm happy to walk through any of those if anybody has questions or if anybody has questions in general at this point i do know we have friends here from hwc who are happy to to lend any helping answers as well great um anything from hwc you want to add modify withdraw

No, we won't be doing that. Brian Stump with HWC Engineering with me tonight is Kyle Eichhorn with HWC, the engineer in front of the property. And we appreciate all the time that staff has put forth into this. And yes, it is a big project. And as we move forward, I think overall we're in general agreement about the items in the staff report and the conditions with the exceptions of items one and two, which are the not allowing access on 800 South. That is our primary access into the community. in speaking with Mr. Watson about his concerns on safety. They identified that nothing was dealing with the requirements of the creation of the development itself, but in terms of speeding that's happening on the road right now. Now, we believe that that is mostly more of an enforcement issue and not an issue that's brought about by the potential subdivision here in the area. We'd be happy to use the entrance there on 800 to have a patrol car out there to handle the speeding, because that would be one of the ways that that would be, that condition would be addressed or concern would be addressed. But we do have an issue with losing our main access into the nature on 800.

So the assumption is that with the annexation, Bunker Hill will assume those roads. Do you know for that annexation, I know that there's some work that's being done on it. Will any part of 800 South be a part of that annexation then? Or will 800 South remain the property of the county?

But clearly, as far as the annexation may take place in phases just because of the continuity requirements in state law. Yeah, so the normal process is this will get annexed into the town before we record the final plan. And then the language on that final plan will be a deed of dedication of the right-of-way. to the town as well as an acceptance by the town of the right-of-way and the improvements there.

So if there's conditions that are put on it and we still have things to work out like access, desal lanes, this annexation stuff, is there still room to handle some of that before the final plat or is this the... Is this the last time that changes are made to that?

Typically, I mean, correct me if I'm wrong, but typically I believe you should try to avoid that at the final plat stage. That should be hammered out at least right now in the primary plat stage, especially when we're talking about entrances and exits there. The final plat stage is more the actual details of was the road put in correctly with, I don't know, what levels of aggregate, all those kind of different things.

Yeah. And then on the entrances and road cuts, I know that the county highway has made an objection to it, but is that at the discretion of the county highway or is that the commissioner's mark? Who has the legal authority on that?

If we approve the plat, then essentially we are saying you can do that, connect to 800 South and put that entrance there. the highway can get their input, give their suggestions. It's up to essentially this body to take that into consideration and say, no, we think it's fine to connect it beyond ourselves.

I guess I will say at the end, I mean, if this stays in the county, let's say it doesn't get annexed before the final approval, commissioners do have a say of, no, we're not going to accept this or accept the dedication or accept it whatever part of the road connects to 800 South.

Getting it more of an enforcement issue than The road itself, I drive that road twice a day back and forth to work, and I've seen an officer checking speeds once in the past year. I can only think of once since I started taking that route. And then there's also the option that it's that close to the highway that could speed limits be reduced as part of it. Do you get past that or past Elm Street? I don't know. But I had kids not even stopping at the stop sign, pulling out of the high school in front of me, almost hit me last week.

Looking at what we did in May, it was a very, very busy month. We did issue 57 permits, which was a 68% increase from that time last year. That 57 included one addition, one carport, five decks, one demolition, one dwelling, five electric, three fence, three garage, a gazebo, a pavilion, six pool buildings, one pool, two remodels, 25 roofs, and a sign. You do have one AG permit that has been requested tonight that you'll be hearing. We did close out 29 permits, issued seven split applications, or processed those seven split applications, assigned two new addresses, did one stop work order, and then did have that major subdivision primary plat application come in. Looking at revenue side of things, we did bring in $7,119. BZA has six variances applied for and then one special exception. One of those was old business from the previous month. So 17 contractors did register. which was an increase again. On the unsafe building side of things, we had six complaints that came in. All six of those turned into unsafe cases, bringing us to a, I don't know if this is a record high, but near record high of 47 active cases present. So I will turn it over to Brooke for the violation side of things.

During the month of May, 24 complaints were submitted, resulting in 22 new violation cases. I was also able to resolve 15 existing cases, bringing our current total to 136 active violation cases. This is a 27% increase compared to this time last year, and respectfully, I would prefer if we didn't keep making this kind of progress. One violation case was referred to our attorney, bringing the total number of cases in his hands to 27. A total of six violation fines were issued, amounting to $475. Additionally, two liens were assessed for unpaid violation fines, totaling $295. We received one violation fine payment in the amount of $100. No partial judgment payments were received and no liens were released during the month. The majority of the complaints that were received involved trash and unlicensed or dismantled vehicles, which continue to be our most popular concern. We also received a couple of complaints regarding tall grass and weeds, as well as two complaints concerning the use of campers as a residential dwelling. All in all, it was another productive month, and it's safe to say that there is no risk of boredom in the planning and zoning department.

Yes, looking at expenses, it does look like we had quite a few. A lot of those are from variance reimbursements that we had for the newspaper ads. We did have the truck in for an oil change. We did pay out Mark twice since I've seen you last for a lot of work that he's been doing, getting Brooks violation cases in process with the courts. So you'll see that there. And then one of the other things that we did pay out that was unusual or just out of the normal for us was the second payment for the comprehensive plan invoice. That was $6,765. The rest of that were normal bills in there, cell phone, gas. We did have a title search in there. It's been a minute since we've had one of those on there. So overall, if I'm taking out some of that money that we had held over for the comp plan update. We've at present spent 36%, 36.14% of our budget. So we have a healthy percentage remaining moving into our following months.

Yeah, so it's been nice. Comprehensive plan has started moving out of that data collection, initial data collection phase, and we're starting to move into putting some of those building blocks together for the plan. So between September 15th of 25 and February 28th, TSW did provide an update there. So they sent out steering committee letters, coordinated planning documents, completed analysis of demographic and physical conditions of Miami County, prepared an outline for the comprehensive plan. They did the first online survey and coordinated the promotion materials for that, prepared for and facilitated the first steering committee meeting in December, and then created press releases and flyers and promotion materials for the first public open house, and then had that first open house in February. That was kind of their quick update. And then we just had, I think it was two weeks ago, the second steering committee meeting. And so things are moving along. We will be out at the fair. I think that's on Monday, 22nd, I think might be the date, gathering more materials and just suggestions and feedback from the public on what they would like to see in the next 10, 15 years. So comprehensive plans moving forward. I'm excited to start working on it.

I'm sure you guys know her, but anyway, it was hard to get communication back, but she ended up handing me off to her assistant. And I think her name was Jennifer, but I may be wrong on it, but they've been very helpful to try and get something going on that I'm waiting for them though it's gone back and forth that she's been I've provided the information regarding the property and um well everything that they've asked for anyway so I'm awaiting them to come back I have not received that yet but I'm expecting that uh that was that was in your email they emailed me as well we were all in that one so that one came in what was that from Jennifer was that her name Jennifer uh sure um yeah it was the same day so like it was No, this has happened since then. This was a phone call. This was a result of a phone call. Okay. That wasn't really that. It was just a phone call where she was asking questions about the property and about the different things. Okay. So anyway, okay. Regarding financing, you've been working really hard on that. But one of the problems I told you about before was I didn't know who my banker was because Jones retired at Farmers. But I Finally, after a three or four trips down to the river branch dinner, I finally found out who my banker is and where he is. And so I did not meet him yet. However, I did talk to him finally yesterday morning and he set a time for Friday, 1300 hours, one o'clock in the afternoon. Then we're finally gonna sit down and talk about financing all this regarding, because it's all part of the farm anyway. There's three other sources going on. There's an appraisal going on on Friday also on my house, on my home property. which has no mortgage, and so that one would be another source for the money. The recycling stuff, regarding all of that that ties back into IDEM, I've been in lots of communication with Mark Boyer and Debbie down there, Toby Pike, and I had a long conversation with her actually just today, and she's doing a workup for me with a quote for all of the things that she's going to have to supply after now. She had a good long conversation with me, finding all the little nuances, and that That has to do with sizing and also the special requirements, which we're working through. So I'm expecting that anytime.

So I did budget in $125,000 for that. with the caveat that we could take it out now, we could try for it, or take it out at the behest of council. The other thing then you will see, I did add a new line item of $700 for a Beacon Schneider GIS user licensing. If you remember, we are in the process of, we're transitioning from Elevate, our current GIS system to Beacon. And that's been the last year that we've been trying to do that and had a lot of problems in the past. But two weeks ago we had a meeting and Beacon said that in order to move forward, we all as departments are gonna have to have a licensing, so that would be $700 to get one license to make any changes there. So overall, looking at our budget, what I have put together would be $406,202, which is about $104,005 increase from last year, or 34% increase. I know I probably made you cringe there, brethren.
