CP25-001, V26-001 & ER25-007 (Administrative Hearing): Conditional Use Permit to allow the construction of a utility facility, including two enclosed above-ground pressure regulators, a control unit cabinet with a signal antenna, approximately 160 linear feet of perimeter fencing eight feet in height with two swing gates for site access, and a 18-foot-wide driveway, and a Development Variance to allow construction within the front, rear, and side setbacks of the R-1-8 Single-Family Residence District and the construction of perimeter fencing exceeding the standards for R-1 Residence Districts, on an approximately 0.037-gross-acre site located 30 feet easterly of the terminus of Skyview Drive (unaddressed parcel on Skyview Drive) (San Jose Water Company, Owner). Council District: 4. CEQA: Exempt pursuant to CEQA Guidelines Section 15303 for New Construction or Conversion of Small Structures. Dropped and renoticed from 1/28/26.

Staff recommends that the Planning Commission take all the following actions: 1. Consider the exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines Section 15303 for New Construction of Small Facilities; and 2. Adopt a Resolution approving, subject to conditions, a Conditional Use Permit to allow the construction of a utility facility, including two enclosed above-ground pressure regulators, a control unit cabinet with a signal antenna, approximately 160 linear feet of perimeter fencing eight feet in height with two swing gates for site access, and a 18-foot-wide driveway, and granting a Development Variance to allow construction within the front, rear, and side setbacks of the R-1-8 Single-Family Residence District and the construction of perimeter fencing exceeding the standards for R-1 Residence Districts on an approximately 0.037-gross-acre site.

Council District: 1. CEQA: Exempt pursuant to CEQA Guidelines Section 15301 Existing Facilities.

Staff recommends that the Planning Commission take all the following actions: 1. Consider a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines Section 15301(a) for Existing Facilities; and 2. Adopt a resolution approving, subject to conditions, a Conditional Use Permit and Determination of Public Convenience or Necessity to allow the off-sale of alcohol (Type 21 – Full Range) within an existing approximately 53,350-square-foot tenant space for a future grocery store (T&T Supermarket) on an approximately 9.00-gross-acre site, located at the eastern corner of the intersection of Saratoga Avenue and Campbell Avenue (1600 Saratoga Avenue).

Council District: 7. CEQA: Exempt pursuant to CEQA Guidelines Section 15301 for Existing Facilities.

Staff recommends that the Planning Commission take all the following actions: 1. Consider the exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines Section 15301 for Existing Facilities; and 2. Adopt a Resolution approving, subject to conditions, a Conditional Use Permit Amendment to allow the timely renewal of a previously approved permit (File No. CP20-012) for an existing monopole telecommunication tower 63 feet in height, including associated antennas, radios, and equipment, on an approximately 3.49-gross-acre site.
