All right, Hoover Planning and Zoning Commission work session for the September 8th meeting. Cases continued from August 3rd meeting S072624 Preliminary Platte for Inverness Point Drive Subdivision Jennings Reserve. This was continued also from the July meeting. But this is zoned E2 single family estate district. It's located at Inverness Point Drive in Inverness and the purpose of this preliminary plat is to create eight residential lots. Staff recommends approval contingent on the applicant agreeing to address minor MS4 comments. Any questions? I believe there's a cul-de-sac to have the fire access and then one down there. I'm not certain... I believe the existing cul-de-sac was utilized to do that, but I need to look at the application. The plans, which, sorry, I should have brought my iPad. How about, would you mind if I circle back to that in a few minutes, if that's acceptable?
Yeah, absolutely. My name's Wade Lowry. I'm with the Engineering Design Group. What's your last one? the existing Inverness Point Drive kind of comes to a hammerhead dead end, right? And that's not acceptable per Hoover zoning ordinance, or subdivision ordinance. And then we extend out of that cul-de-sac a private room with a cul-de-sac at its end to serve as fire, bus, and service equipment turnaround.
Okay, so we've got a public access to the first one and then a private access.

If it's acceptable, we'll wait on the conditional use case number two until Matt gets here. And that one was continued from August. But if it's okay, we'll just move on to the preliminary and final plots. The first one is S092627, the final map for a resurvey of lots 4, 5, and 6, block 28 of Shadesville. This application was continued by the applicant until next month. All right, to SO92628, the final map for Kastner Resurvey. This application is zoned R1, single family residential, and it's located at 2136 Kent Way off of Alford Avenue in Bluff Park. The purpose of this plot is to combine four lots and part of an already vacated alleyway into a single lot. Staff recommends approval upon the submittal of the signed MILR. Next is S092629, Final Map for Foothills at Blackridge, Resurvey of Lots 351 to 353. This is Zone PR1, Planned Single Family. This is located in the foothills at Blackridge, Phase 3B on Blackridge Circle. The purpose of the plot is to combine three existing lots into two new lots, and staff recommends approval. I'm keeping on going. S092630, final map for mineral trace industrial site. This is owned to PI, planned industrial, located at the corner of Stadium Trace Parkway and Fleming Parkway. The purpose of the plot is to subdivide four lots from acreage. Staff recommends approval contingent on the submittal of a final signed mylar, providing written authorization from the downstream property owner, US Steel, granting permission for a temporary construction easement for stormwater improvements on private property. Due to existing flooding downstream of the proposed subdivision, No building permits can be issued for these four lots until the construction of the downstream stormwater improvements are completed by the applicant. The applicant anticipates construction of completion of the downstream stormwater improvements between the fall break for the school system, those happening between October 9 and October 13.
Could you, just for the benefit of everyone, describe those downstream improvements and why that timing is proposed the way it is?
Yes, the proposed improvements by the developer would be to improve the upstream receiving inlet structure on the upstream end of the ditch. On the pipe structure, there's a pipe that goes under Fleming. The pipe is parallel to Stadium Trace Parkway. The upstream end of that will be improved to allow more water in. And then downstream, on the downstream end of Fleming Parkway, we're still going parallel to Stadium Trace Boulevard. There's an existing ditch, and it meanders from private property into public right-of-way. And the lack of capacity of that ditch causes flooding at that intersection of Stadium Trace Parkway and Fleming Parkway. And so city code allows the city engineer to add additional improvements if there's a known flooding issue. And so due to this known flooding issue, we're asking, well, let me back up. We propose to the applicant adding additional stormwater detention for at 100 year volume with a lower release rate of a two year release into the system. And the applicant came back and asked if they could instead improve the capacity of that downstream ditch. And that's what we're going with. based on they've submitted a land disturbance permit and engineered design for those. And so the reason for the condition is we do not want to have that additional impervious area build upstream of this downstream issue. We don't want a building permit, we don't want any impervious area until that downstream can accept that water. All right, and next is the S092631 preliminary map for Everleigh Phase 4D. This is zone PUD planning and development. The subdivision is located on the north of Phase 4D of Everleigh on the north side of Everleigh Parkway and to the west of Linton Drive. The purpose of the plat is to subdivide 91 lots and one common area lot from acreage. Staff recommends approval contingent on the following to be done at the time of permitting. The developer's engineer must provide an as-built survey and provide an engineer's certification confirming that existing Everly Pond 13 was constructed as designed and functioning as intended. Next, clarify the amount of impervious area draining to existing pond 13. The submitted narrative shows 22.6 acres and previously submitted drainage calculations for existing pond 13 shows 21.528 acres of impervious area. As part of the as-built survey and engineer certification for Pond 13, the engineer needs to identify what the correct impervious area is. As part of the as-built survey and engineer certification, an inspection needs to be performed to identify any maintenance needs on Pond 13. Any required maintenance on Pond 13 that are identified from the inspection need to be completed as well as having that certification and as-built survey approved by the city engineer before the permit can be issued for Everly Phase 4D.
No, I was just saying that that's all those cases that you've got, we're waiting on Mac.
There he is. all right one thing on the case i just read mr martin Okay. On the Everly case, I left off a condition. Thank you to Mr. Miller. If the pond, if the existing pond 13 is going to be used during construction of 4D, the engineer needs to provide calculations showing that the post-development peak discharge can be conveyed and will be less than the pre-development peak discharge during construction. Sorry about that.
And the note here says, references pond 19. You said pond 13. So are there two different ponds? One is, comment one is about pond 13.

Yes, ma'am, thank you very much, Ms. White. No CO can be issued for the lots in this sector until Everleigh Parkway is finished and subject to an approved final plat. Easements for the utility service for the townhomes are to be added on the final plat if they cross the property boundaries.
All right, the next item we have is a pre-zoning application for the Ritchie family located at 1701 Valpar Drive. There was a portion of their property holdings that remains in unincorporated Jefferson County and they are looking to annex that particular track into Hoover City limits. The E2 zoning that is proposed is in line and in sync with the property that is currently within our city limits. Long term goal is to have the property annexed, zoned E2, and eventually consolidate the holdings into a singular track of land. Comprehensive plan supports low density residential development in this vicinity Any questions I can. Let's see. Conditional use case C-0726-14. This is 900 Concourse Parkway Community Center. Proposed for the planned office district at that location. The staff, of course, has reviewed this application, and we do not recommend approving the conditional use. Should the Planning Commission desire to formulate a positive recommendation, staff recommend the following conditions, that the easement located across the building footprint should be vacated and any utilities therein relocated prior to approval of the site civil plan, and two, that the applicant revise the traffic study to incorporate all proposed uses for the site and should make all improvements recommended by said study. And then finally, that the site would be developed in substantial conformity with the conditional use plan. Central to staff's recommendation here is the guidance that we have from the comprehensive plan. It supports employment center, office, light industrial development in the vicinity. And this proposed use is not fit amongst the highest and best uses within the future land use section of the plan. And we have not had any additional information come in from the applicant regarding those particular suggested conditions that staff placed on it, should the Planning Commission make a favorable recommendation? So the traffic study has not been updated, nor has the easement issue been fully fleshed out at this phase where the community center is slated to go at 900 Concourse Parkway should it receive approval.
And have we heard from the applicant what their intent is?
I had a chance to speak with representatives of the applicant last week and informed them that the case was still pending, that there was one more continuance available to them should they request such continuance and remain on the Planning Commission docket. The applicants are looking at other potential locations for this facility. So I would not be surprised if we had another conditional use application coming in in the not too distant future. But as far as whether or not they were going to continue or withdraw this case, that was undecided at the time I spoke with the applicants.

Our first one is Subdivision Case S0726-24. This is the Inverness Point Drive Subdivision, Jennings Reserve, it's their preliminary plat. Our applicant is Jordan Huffstetler, Property Owners Act and Development Corp. The zoning is currently E2, Single Family Estate District, and their request is to develop eight residential lots. I believe we have some staff comments. Would you like to let us know what those are?

Yeah, good evening. My name is Jay Henderson. I live at 2500 Inverness Point Drive. My home is one of the two houses whose driveways are on the only road leading into the new development. I believe once finished, the new development with its eight houses or homes will be a great asset to our neighborhood and for our home. However, I have a few questions concerning the time between now and the completion of the neighborhood. My first question is, when will the project start? Give all of them? I've got about 15. You want me to go ahead? I mean, I don't know if you'll remember the first one. Okay. All right, when will the project start? Have you done so boring to determine the depth of the rock? How much, if any, blasting will be done? Our home is older, built in the 1990s, and we are concerned the blasting will cause damage to it. Number three, the developer purchasing the property. Is the developer purchasing the property from the current owner? When the new area is being developed, who will be the developer? Who will be the owner? Number four, our home is below some of the development area. What is the plan to keep mud and debris from flowing into our yard, both our yards? David Winstead is the other homeowner. Also, to keep it off the road between our and the Winstead's homes. If the road is muddy, it will flow down into our driveway and our house. Number five, do you have a BMP to keep the stormwater from flowing into our yard and home? Number six, the road between our house If the road between our homes in the neighborhood is damaged by the construction vehicles coming into the neighborhood, whose responsibility is it to repair the road? Will this be a repaving or a patchwork? Number seven, I'm concerned about construction noise and traffic. What time do the crews start and finish each day? Number eight, to the city, is there any plan or can we request a three-way stop sign at the corner of our side road in Embrace Point Drive? Cars come flying past my house. I have a Porsche that I sit out frequently. The other day, just the day before yesterday, a motorcycle came flying down the road, and it was at least 50 miles an hour. And I tell you what, that was scary. I have grandchildren, too, that play in the yard. So anyway, we request a three-way stop sign at the corner of our side road in Emory News Point Drive. Cars do come flying by our house with additional traffic in and out of the side road. It could be dangerous. There have been times I have almost gotten hit. coming out of my road. My driveway goes out to that road going into the development. We have a sprinkler system, number nine. We have a sprinkler system. And several times when work has been done, mostly at another neighbor's area, Scotts Clemmer Road, the trucks turn around in the road and smash my sprinkler heads. I've had to repair them several times. We're concerned with even more construction trucks going in and out. This could be a consistent issue. Is there a light? Number 10, will the community be gated? If so, where will the gate be? Our concern is, is it as close to our house cars could line up to get in and block our driveway. In other words, they stop and cars will back up. Our road is right there where the entrance will be. I realize this shouldn't happen, but I have been to events in gated neighborhoods where someone pulled up and didn't have a code and couldn't get their host or many cars were backed up. We don't want our driveway blocked. I don't know if it's going to be gated or not. But anyway, that does conclude my questions.
Okay. Thank you. You can be seated and I'll have the applicants come up and answer some of these questions. I don't believe all of them are necessarily associated with the project that we're actually approving, but we'll get your answers on most of those.
Jordan Huffstetler, I'm the applicant. Do you need my address or 5529 Parkview Circle, Birmingham, Alabama, 35242. When will we start? Really kind of hinges on approval here, but once we have approval here, we'll finalize construction plans. And I mean, I'd love to start as soon as possible, but we've got to... run through the process with City of Hoover. Question two was soil boring for rock and blasting. We have not done soil boring for rock. I mean, there's not gonna be any blasting. There's the road. The road profile is, I mean, a little minor excavation and building up a little bit, but this is just not the type of development where, I mean, that's more trouble than it's worth to us. So we're not gonna be doing that. The current owner is the developer. We've been the owner, my father-in-law's been the owner of the property since I think 93. We own the development company and we'll be developing it ourselves. As far as your concerns with BMPs off the road of the property, I believe that your property is just to the north of the Stub Road right there. And so, I mean, it's a low-density subdivision. The largest lot in the subdivision has roughly 200 or 300 feet. It's kind of a flag lot. That'll serve as their private driveway. As I recall, the grade from where their driveway will sit kind of goes up before it drops down to your property. I mean, we'll have BMP plans as part of the development. The owner, whoever purchases that lot, will also have to do BMP plans for the city of Hoover as part of the building permit on their lot. So there's going to be very little going on right there at that property. I don't know exactly what they'll do with their driveway, but, you know, they're passing through there, their build site is, I mean, 600 feet, 700 feet from your property. So I'm not really concerned about the things that you're rightfully concerned about. And again, on your question five, we'll have BMP plans as part of this that we have to deal with. Road damage, I mean, you're talking about the Stub Road. I don't know that I can really, I mean, I believe, will we be required to have a bond on our stuff?
You will? Yeah. And so that's more associated with the city and what their requirements are, but yes.
We'll have to have a bond on our stuff to Construction noise and traffic. Good news is it's, you know, low density subdivision. There's eight lots. We're selling the lots. We're not, you know, people will be able to get building permits and build them at their, you know, at their timing. So, you know, our development is pretty low impact. You know, I mean, this is a, you know, three to six month, I'd say six month development on the horizontal work, the roads, the infrastructure, all that kind of stuff. You know, we're dealing with a small handful of subcontractors. So, I mean, I can't, you know, mean it's as low impact for a development of 35 acres that you can that you can have and then I You know, unfortunately, I don't know if this is either a good thing or a bad thing, but all the houses, we don't anticipate that they'll be built at the same time. I mean, it'll be as homeowners are ready to take it on, and each homeowner with their builder will have different times for their crews. But, you know, I mean, typical construction hours are, you know, 7 to 5, you know. So... Three-way stop sign. I'll leave that for you guys.
Yeah, that's not, you'll have to get with city staff to discuss that. That's not associated with this project, so. You could speak to them after the meeting and get a phone number and you could probably call them or discuss it.
Good thing on the sprinkler system, you know, I think what you're talking about, because I have turned onto that road and done my three-point turn and turned back around before. I think that's probably the situation you're running into. We're putting a cul-de-sac at the end of that stub road before the gate. And so I think the behavior of most people will be to, instead of doing a three-point turn right in front of your fencing and all that kind of stuff in your yard, go into the coal sack, turn around and come back out. So I don't think they'll be backing on to Inverness Point Drive anymore from that location. And then I think your last question was gated, cars backing up. It will be gated, but again, it's a lot subdivision. Traffic in and out of there is gonna be pretty minimal. And I mean, that is a cul-de-sac. That cul-de-sac also acts as a staging area for vehicles that might go in or out of there. So I just, I have a tough time thinking that'll back up enough to get. At the end of the cul-de-sac. Yeah, it's right there.
There are actually two gates, right? One to the lot eight, the 11.5 flag lot?
I believe so. I don't know if it's on the plans, but I... It's shown on the plans. It's on the plans, yeah. I mean, that's... I would... That was my plan. I don't see it right there, but I would do another gate going to the flag lot. I think that that buyer will expect it. I think it's drawn. Yeah, you're right. So yes, there will be two gates. Most of the traffic for seven of the lots will go through the gate straight off the cul-de-sac, so. Well, I'm sorry. So there will be one gate that serves the private road for lots one through seven. Yes, sir. Right at the due end of the cul-de-sac. Right. Right there. So the western edge of the cul-de-sac, that gate will serve seven lots. Okay. Where his clicker is right there. So there will be a gate right there. And then there will be another gate around the cul-de-sac clockwise at the 12 o'clock position. There will be a gate right there for that, for lot eight. My name is Charles Winstead at 2444 Inverness Point Drive. I'm just curious, below the first cul-de-sac, how is that structure going to work? Is that a detention-retention pond? Above ground, below ground, how does that?
That is an underground stormwater detention system. So it would not be visible from the ground. It collects all the water runoff from the street infrastructure as an underground facility. And then discharges to the south and west. To the south and west is where its discharge goes. It's private. privately owned, privately maintained.
Yeah, my question is, is it going to be a septic tank or sewer?
No, it's stormwater, nothing to do with sanitary.
So what will each house have? In other words, will it collect into a... Oh, I'm sorry.
I thought you were still talking about the underground system I just talked about. Each house will be connected to the public sewer system through an extension.
Where is that sewer extension?
It will come down Emberness Point Drive and into the subdivision through the roadway.
Okay. When that happens, the road will be... under construction or dug up, my driveway and his driveway, we won't have access to our homes.
That is not, that's not possible. We wouldn't be allowed to do that.
Okay, so you'll let us know when that happens.
Again, some of these are getting into city requirements of the contractors as they're constructing and when the utility companies come in. So it's really not concerned with these guys. But if you see issues during construction, I recommend you call city staff. That'll be your quickest way to get something resolved.

Are you aware of these conditions that have been given by the staff?
Yes, ma'am. I just have one I'd like to request a change to. And that is the condition of requiring the off-site stormwater work to be completed before building permits are issued. The reason I'm asking is twofold. I mean, we're planning to perform the work. It's not a question of performing the work. It's an offsite problem that exists. And I saw it firsthand in 2021 during the floods we had and because that area needed improvement. So there's an issue in existing city right-of-way and then on U.S. Steel's property. We've gained permission from U.S. Steel to make these improvements. Our site plan that we've submitted actually reduces the water runoff and all the storm events, 2, 5, 10, 25, and 100-year storm. And the reason we're asking is really just responsibility for the students that are there. I mean, there's... between 50 and 100 kids that walk every morning and walk every evening. And while we're hoping to complete work during fall break, the reality is we will not complete it during fall break, which is October 9th, 12th, and 13th days. What I don't wanna do is delay This is all economic impact for the city. There's jobs going to be created. There's economic spending here from a commercial standpoint. And we may not finish this work until the Christmas breakfast there because we're trying to be responsible and perform the work while kids are not actively walking back and forth along the sidewalk. What I don't want to do is be tied to a building permit when I've got businesses who want to locate on all these sites now and be delayed for that reason. When I think we're trying to approach it from a responsible standpoint, the city still has the protection that The original plan on the permit was to withhold COs if this work is not complete. It's not that we don't want to complete the work, we just want to do so responsibly. As part of the engineer's certification and as-built survey and inspection needs to be performed to identify any maintenance needed on pond 13. before the permit can be issued for Everly Phase 40, any required maintenance on Pond 13 needs to be completed, and the engineer's certification and as-built survey must be approved by the city engineer. If Pond 14 is gonna be used as a sediment basin during construction of Phase 40, At the time of permitting, the engineer must provide supporting calculations to show that the post-development peak discharges will be less than the pre-development peak discharges during construction. No COs are to be issued for lots in this sector until Everleigh Parkway is finished and subject to an approved final plot. Easements for utility services for the town homes are to be added on the final plat if they're crossing the property boundaries.

A very brief summary is On the west side of the development, there's an existing pond, Pond 13, that was built with Phase 4. And the city engineer is asking us to... do an as-built and a certification on that to show that it's working, and if there's any maintenance required to do that maintenance. What's north on the screen that you can't see, there's a new pond, Pond 19, that's part of this phase that will be built, and they're asking for some additional calculations for how the pond will function during construction. And we're working on the parkway now, the parkway extension to Ross Bridge. That's also a requirement of a previous phase, so we're working on that. And the last one, we're not having any multi, we're having two-unit townhouses, no multi-units. There won't be any easements that cross lot lines that they're asking about.
There was a question also about confirming the impervious area that was drained into Pond 13.
I think it's my bad writing. There's... We are not increasing the capacity, the impervious area going to Pond 13 in excess of what it was designed for. There was a previous submittal, and I probably just didn't explain it very well, but the short answer is we're not increasing the impervious area with this phase over what the capacity of existing Pond 13 is. Pond 13 was built knowing this was coming. And so I just need to do a better job explaining and another map to go with it as a part of our construction permitting To show that we're not overtaxing pond 13.

This request is to pre-zone this property to be E2, which is a single family estate district. Mack, I'll let you give an explanation as to what this is all about.
Sure thing. So when the owners acquired their property, it came in two different tracks, one with the primary residence on it, 1701 Valpar, and the other track is addressed at 1526. The smaller 1526 track is approximately .15 acres in size. Records indicate it is still an unincorporated Jefferson County. All of this was brought to light when the owner approached, or their contractor approached the city for a building permit to to add on to the house and ran into some issues with setback requirements given the current layout of the land. And so the applicant has submitted a petition to annex. the 0.15 acres to the rear of their holdings. And this particular application in front of you is a pre-zoning to the E2 estate residential district, which is in keeping with the zoning for the portion of the property currently in the city limits. Should the annexation petition and the pre-zoning be approved by the city council, next step would be a consolidation of those holdings into a singular lot before pursuing a building permit for an addition. Staff recommends approval. This is a cleanup item in our estimation.
