All right, I'm going to call the meeting of the Essex Junction City Council to order for, whatever night it is, September 9th. Any agenda additions or changes? Regina? None from me. Council? No, ma'am. Okay. We will move on to be public to be heard. Any public to be heard? Do you want to come up to the mic and just tell us your name this week?
My name is Gail Boundy. I'm coming to get some clarification and ask a few questions regarding a fence that I have put up on my property. I live at 1 Mansfield Avenue in Essex Junction, and I installed a fence according to the fencing regulations and received a letter that implied that there were some other regulations that I didn't follow that weren't in the fencing section. So this has resulted in some loss of $7,000 for my fence if I have to take it down And I've been, you know, trying to work out some things, hoping to be able to move it. I guess there were some other issues with visibility. And I've been to council meeting. I've been talking to Christopher even. And some comments were brought up. And I would like to get a few things, just questions regarding the whole situation, kind of clarified one of them. is they suggested that landscaping be installed instead of the fence. And I have a few concerns about that, partly because I have no money for landscaping. I also do all my own gardening. I am not able to maintain gardens. I'm older now and I'm cutting back my gardening. So any kind of landscaping would probably require some maintenance. But also, too, with the visibility concern that they're saying is regarding my fence, if I put landscaping up, which I'm told there's no regulations regarding that, how high they can be, where you can place them, if it would create the same visibility concern, ultimately, if down the road I'm able to do landscaping, would there be ramifications for that. If people are complaining that there's still the same visibility issue, you know, is that, is that the solution? Um, you know, my, my hope was to move the fence a reasonable amount into my property line to take care of that visibility issue. That's because there's like sort of a weird angle to the lot, which makes the fence kind of appear like in your view, as you look down the street. Um, So I was thinking that there could be some reasonable compromise. I mean, with the regulations as they are, in order to have my fence, a privacy fence, which is a six foot high solid fence, I would have to move it 20 feet into my property line. And in order to do that, I would be cutting off 80 feet by 20 feet of my yard. So I would lose the ability to have the usage of 80 feet by 20 feet of my side yard. It would also create a blank space where I would almost probably have to put a fence on the outside of that to keep people out of coming into it. And there was some... comments made that the fence is a vast expanse and there are some concerns for safety. People feel uncomfortable walking past that large space. And there was another comment about neighborliness, putting a fence up isn't like they want the appearance of neighborliness to have yards feel open. I kind of feel like, and I can understand the rationale behind that, but having such a busy expanse of my yard. I'm in a very odd situation being on that corner, incredibly busy. My front yard is public. My side yard is horribly public with all the traffic that goes past it. My backyard is public with a dentist office parking lot. And my side yard gets traveled through by every child going to ADL as they cut through my yard to go to school. So I have all of this visibility and I'm hoping to have just that one side be private. And I wanted to compromise and move it so that we don't have visibility concern without devaluing my property by moving it 20 feet into my yard.
I don't want to interrupt you, Gail, but I'm going to let, I don't know if you want to speak to this issue, Regina, but this is really... This is an issue at the staff level at this point. So I'll let Regina speak to that.
Um, yeah, so, um, I don't have the answer to your, to your question. Um, Chris Ewan is the one who has the answer to your question. He's here, but he's here for another agenda item tonight. The council does not have any role in this, in this process. Um, I believe you have appealed the, I'm going to appeal.
Yes. So I have to submit by the 15th. So I'm hoping to get some answers there, but I, okay. Okay.

They don't really have any role over land development code implementation very clearly within state statute. That is definitely not their role. It is the development review board's role. So that's the pathway. Okay.

Joe? Hi, Joe Granacci of my court. I know we're going to be discussing the stop sign, but in doing so, there's another issue that I just wanted to ask a question about. We've got a neighbor back there that their property is a total eyesore. If any of you have gone to go see where that stop sign is proposed, you can't help but seeing it. It's right on the corner of Clems Drive and West Street. I've got some pictures of it. It's not as if they don't cut the grass every week, every month, or every year. It's a very large yard, front and side. It hasn't been touched in, I'd say, over five years. It's just been let go. And I was just kind of wondering if there's any municipal codes about letting property go like that.
So we just talked about Chris, who's online. I think that's where you would want to have that conversation. You can definitely correct me, Regina, if I'm wrong, but I would reach out to Chris.

I wanted to just take a second and say thanks to Regina and Jess, because I did send a note asking questions about the Economic Development Fund and the in relation, especially because of the fact that it struck me when I was reading the agenda concerning the $30,000 that we assigned for general fund let earlier this year. But I appreciate the fact that Regina got back to me with the reference to the capital improvement tax, which is kind of a starting point for most residents in thinking about uh what that that economic development tax was about um and how some of these monies got to that fund um in looking at it what i wanted to just bring up is looking at our capital this capital improvement tax which was approved back in uh 2024 yeah 2024 um a lot of the Reasoning, justification, the usage of that particular fund along with our own lot fund seems like a huge overlap. And I'm just, if nothing else, I just wanted to point that out because maybe there is a discussion to be had in the future about really defining it with more clarity. Because I think that with such significant overlap, you can potentially use either fund for capital projects within the community. So that was it. Thanks, Marcus. All right. Anybody else online? I'm not seeing any hands. So we will open the public hearing for the proposed amendments to the municipal code chapter eight, an ordinance relating to motor vehicle regulations, enforcement for park street, striping and pine court stop sign.
So we've got Chris here. We also have a memo. It's titled 6A in your packet, but we don't have separate slides for the public hearing. So we can just talk through that memo. And as discussed at the last meeting, this ordinance change is largely being done to implement the restriping of Park Street for the bike lanes as the council proposed. voted to do on April 29, 2026. So there are proposed amendments in Chapter 8 to accomplish three things for that. It also includes adding a stop sign on Pine Court and West Street. So last meeting, we had more questions about the intent and purpose of that stop sign. It is not related to the bike lanes on Park Street project. We had just been responsive to an ask and concern about safety without a stop sign there. The city engineer took a look at that. You've got that whole analysis in your packet. And essentially, this is adding a stop sign, much like there are stop signs on the rest of the entryways to West Street all along the way. I am going to leave it at that. Chris, you want to add anything?
No, I think you covered it pretty well. There is a diagram. I mean, there's a map in the memo. It shows the location of the proposed stop sign in relation to all the other nearby intersections and the end of the road. So take a look at that if you haven't already.

What are we, can I ask a question? Yeah, of course. or what are they depicting that we wouldn't have seen when we drove by?
This is for anyone who hasn't seen where the proposed stop sign wants to go from all three angles of the T, westbound, eastbound, and northbound, to show that there's no obstructions and that the dead end is right there.
Yeah, there are just a handful of houses. at that end, essentially from the left off of Pine Court. I think there were eight maybe, maybe six, eight. It wasn't a heck of a lot.
I guess I'm way down here. I think what would have helped also is a map just showing that small neighborhood of Pine Court, Clems Drive, and the very end of West Street, just to show how very few homes there are past the dead-end sign. Pine Court's like a giant cul-de-sac, so only half of Pine Court goes that way. The other half goes to Clems Drive to get out at West Street Extension. So there's very, very few homes that would even, very few vehicles that would even be crossing that T.
Yeah, and I think if you look in Google, you can see.
Yeah, that's what I was kind of hoping to put up on the screen. But I just want everybody to know that, like, I know the bottom line for everyone is safety, and that's also my bottom line. But living there for as long as I have and raising three children that are now, you know, Graduated college and gone. And there's been no new buildings back there. If safety was an issue, you definitely would have heard from some of the neighbors, like myself, since before now. But there's been no new development back there, no new buildings. So I just don't see it. I don't see it. Just to say it only costs $30, what kind of precedent does that send to other people saying, oh, $30, we should put ourselves on a deal?

I will say that I've driven that a couple of times. It struck me as odd. And I did send you some pictures. Really, there isn't a lot of limited sight distance, I feel like. but I'm curious if their request is from a chance encounter of people that come off of Clemens Drive and just make the right turn onto West Street without stopping?
Well, reading the memo, my understanding is that basically, you know, there were... sight distances four different ways, and out of those four, one is not the minimum. And if that's the only reason that we're given for adding a stop sign, I kind of agree that it may be unnecessary.
Like, having driven it, I'm strong.
Yeah, I don't want to make, like, I don't drive, so I certainly don't want to form opinions about traffic.
I found that the sight lines at the other end of Pine Court and Clemson Drive were more inhibiting than the sight lines at Pine Court and Western.
Can I ask a question? Yes, go ahead. This came to us with a question. from a safety concern from a resident down there? That's what I was asking. Virginia, is that?

So I received the complaints originally. There was an incident where a driver going... Eastbound on West Street encountered somebody coming out from Pine Court that did not stop until they had to send their breaks. And that was actually caught on security camera footage. And that person submitted the video. It was reviewed by the city engineer. And this was the recommendation. I will note West Street. a long time ago, quite a few years ago, did not have a center line in this part, which psychologically makes it seem like it's kind of equal. Back then, it felt like it was more equal weight to Pine Court. Now, West Street has a center line all the way to the end. To me, psychologically, driving on a street like that, that does feel like it's the more major streets, and Pine Court is the street that's... that enters it and feels like it has a lower priority. But without a stop sign there, like all the other intersections with West Streets, that's not the regulatory standard.
All right. So I guess the engineer says it could use it. We've got one person saying they don't want it. We've got one person saying there's a safety issue. You investigated it. found that it could benefit from a stop sign. All the other intersections that are like it on the strip have a stop sign. The cost isn't prohibitive. I guess I don't see what the harm would be to do it. Not only that it's just $30, but it sounds like there's enough reasons to. This isn't the biggest issue we're going to be dealing with ever, but a lot of work's been put into it. It sounds like you can benefit from it. Engineer says there's guidance enough for it, but I guess I don't see that.
Yeah, I was going to say, thanks for the clarification, because my understanding was it came from a safety concern and so from a driving perspective. I would love to be able to say, hey, there is a stop sign and stop bar there. I can get behind it, I think. It did strike me as a little bit odd that the sight lines were referenced in having driven it a few times, just trying to understand that. When you come to the end of Pine Court to turn onto West Street, there are essentially six or eight houses on that dead-end piece of it. But having the request come to us, I feel like it's a pretty easy, actionable item.
I mean, I compare it to my neighborhood with Brooks and Villa.
Right.
You know, it's the same basic count for houses. It's the same kind of intersection. There's a little bit of blindness one direction, not a lot. Population around it's pretty similar. And there's a stop sign.

You know, it's kind of like, yeah.

Yeah, I just want to, what's persuasive for me here was the, the, the, The engineers note that, I'm trying to get the terms right, so Chris, please correct me. The uniform traffic devices standard says that there should be one at all of these intersections, and that this one doesn't have one because of oversight or history is, yeah, it was persuasive for me.
No, that is just a slight correction to that. The MUTCD does not say every intersection there has to have one. We haven't reanalyzed the ones that exist, but the MUTCD does talk about site distances, and this one is marginal. What I do list is the planning rationale for it outside of what the MUT city calls for. It's just different from a perspective of standardization and predictability.
Yeah, I wasn't aware that there was a safety concern. To me, even one safety complaint has been enough reason to put in a stop sign. I see something.
Uh, no, we're not, we don't have any public comment right now, but thanks for asking Joe. Um, we had the public comment in the, in the other section. Yep. Um, my, I guess my thought is that I generally. don't have a reason to disagree with an engineer who's got an engineering background and says the stop sign goes there. While I hear the comments and stuff, I do think it makes sense in this case to follow what the engineer's suggestion is and put the stop sign in. Any other comments from council? I was wondering why the person who initially asked for the stop sign didn't show up or isn't calling in. But now after hearing what had happened, there was a motorist on West Street traveling east, and the person on Pine Court didn't stop. Well, they obviously broke the law because anyone traveling straight has a right-of-way and anyone turning has to yield to anyone traveling straight. It's common anywhere. So it just seems like after this one instance happened, boom, here comes a stop sign. But I'm not, you know, if it's your decision to put it there, I think it might cause problems, but...

Yeah, at least I know now why it happened, but somebody didn't yield the right-of-way. That's why the complaint was made.

Hey, Ashley.
Good evening, everyone. All right. So I have a memo in your packet that basically discusses this ask. We originally went out for a small estimate to just to see what even the signs could possibly cost when we decided to start looking at our rebranding project and what signs and banners would cost. And so that was back in 2022, whenever we got that estimate. And based off of that, we budgeted for $14,375. Obviously, as we all know, things have increased. over these past four years. And so that, when we got our coats back, those signs and banners have increased in cost as well. In the packet, I did include that we have not completely used all the money that we set aside for rebranding project. We have about $2,350 remaining. I had budgeted that to do some professional imagery of the city, some photography for promotional material, but knowing that that is there that we could also use with this sign, I wanted to include that in this memo. We did have two sign companies in Williston, both of them that gave us quotes. Those quotes are included in here. I did make a note in here that I did think the banner cost for one of them was wrong because it was a wrong size than what we have for banners. He had quoted me a five foot banner when we only need a three foot tall banner. So I did go back to him and asked if he could revise that quote, and he did, which did bring the cost down to $2,900, which is very comparable to the other quoted amount. So we would be looking at the need between the two quotes of either the original 6,805 for the first one or the second one would be 7,400 would be the new number on that with that updated quote. So in this, I'm asking for an additional $10,000 from the Economic Development Fund, which we do have the funds for to cover that.
anything else I think that is it I'd be happy to answer any questions that you guys have any questions I have just a couple is this specificity to the number of banners that are included with the quote and then when we started rebranding The dollar figures included the original replacement of the original five entry signs into the city. I'm wondering if this is still just for those five or if we've given any thought to changing the municipal complex sign out front.
So this is for 50 banners, which was what we originally budgeted for at the very beginning. So this quote, again, is for 50 banners. And this just includes the five entrance signs. It does not include the municipality signage. That was something that was not originally included in this amount. And so if that's something that you guys would like to look at, that would be an additional cost.
As a photographer in the group, not that I was going to take pictures, it sure would be nice to have some fresh content for the price. I think we've demonstrated a need for that. Things are changing pretty quickly. We're going to have new look, new banners, new things. I think it'd be nice to... So my understanding that that's been taken out and that money's being used To help offset the overage?
That is correct. Yes, that would be that two thousand three hundred fifty would be added into that amount, which brought us up to that sixteen seven twenty five. If we, you know, obviously we're looking now at a six to seven thousand dollar increase. um, ask for what, what is being quoted right now, um, the $10,000, um, extra would cover those amounts. Um, and we could look at possibly doing the professional imagery. Um, if that's something that we wanted to, if we wanted to do the full 10,000, like I, when I got the amount back, which was today, um, I was like, well, we really could just do 8,000 instead of 10,000. So there is a little wiggle room, um, i feel like now more in this budget than what i was seeing prior to that even with me asking for the ten thousand depending on which way we went with the signs and really the signs are very comparable it's just there's it's different looks um how the materials are very similar but one's made um a certain way and another one's made us another way um so it's really just the look that we like the best um the signs are very close in cost
um and now the banners are very close in cost too so either one of these um sign companies i think are good quotes we just need to decide which style that we like the best i guess i'd say that three was probably a little low for the photography anyway so if we did if you had extra you could start at this fiscal year maybe we can put something in for the 28 budget out of the admin budget just add the hair. Um, but I think having some multi-season, um, it's a small investment, but I think it'll go a long way because that kind of effort usually lasts three or four years publications. Anyway.

No, I think it's also a great idea. That's why I originally put it in with that rebranding budget as something, because I wanted to have that opportunity to put that in marketing and on our Facebook pages and on our website. And so, yes, I still feel like it's a need, but I am also trying to be fiscally responsible. Respect that.
Thank you. Speaking of, I'm wondering... If there's a reason we were so off in our budget for the signs, I see that seems to be mainly where the shortfall was. We budgeted about just under $9,000 and work voted $21,000. So I'm wondering if there's a particular reason we were off on that estimation.
I, you know, at the time it was just trying to get a quote for what it could be. The signs, we really didn't have any look or feel of what that sign would look like. And so they were very quoting us, you know, some, some options. And so we had a big range. And so I picked in the middle. um to try to get that range um it wasn't something that we they could look at it and be like this is what this sign is going to cost at this point in time they had given me quite a big range for anywhere from i think it was a 1500 to i think seven thousand dollars and so i kind of tried to pick a middle range and that when we were just trying to get estimates um we didn't have something where we had we were going towards them and saying this is exactly what we wanted And then what was not really big factored in here is labor. And so we didn't really know if we were gonna be having to replace all the signs. We do know that we have to replace all the signs because they're deteriorating, they're made out of wood. And so they are deteriorating at the time. We did not know that they were totally deteriorating So there is quite a bit of labor that we didn't include in that original estimate as well. And so that is a factor in this. I will say that I have not talked to Ricky to see what labor that they would be willing to do. That was not a discussion that I was able to have with him. So when I got quotes, it was for full labor. So then taking down the signs and putting up the signs. Okay.
But you're saying if we have a conversation with Ricky, there is a possibility that that number will go down a little bit, Mark?
Yeah, I wouldn't say that it would go down a whole lot. But there is some wiggle room in there in the sense that Ricky and them took down the signs for us. And that means that whatever sign company we have, they're not having to take down the signs and dispose of them. Obviously, we're going to want the sign companies to put those signs in place. Just because it's part of their work. But I do say there could be some wiggle room in there for labor in the event that Ricky and them did some work. But again, I don't want to promise Ricky's going to do work or that they have time for it.
