Item 1: A petition to consider approval of a Variance for a reduced front yard setback on Parcel 1127102001, located in the SE1/4 of the NW1/4 of Section 27, T79N, R27W (Adel Township) zoned RE-1 (Suburban Estate) for Casey Tierney.

The applicants, Casey and Kim Tierney, seek a variance from Chapter 45.11: RE-1 Suburban Estate District of the Dallas County Zoning Ordinance for relief from the required front yard setback for an accessory building, for property located at 28278 Prospect Ave, Adel, Iowa. Walnut Hills Plat 2 was subdivided in 2022 and the existing home was built in 2024. The house sites about 100' from the Prospect Road right-of-way. The applicant proposes to construct an accessory building to the west of the house ~30' from the west right-of-way line of Prospect Ave, a variance of ~20'. Required Setbacks: Front Yard Setback (Prospect): 50'; Proposed Setback: ~30'. Side Yard Setback (north): 15'; Proposed Setback: ~200'. Side Yard Setback (south): 15'; Proposed Setback: 250'. Rear Yard Setback (east): 50'; Proposed Setback: 150'. Review by the Dallas County Engineer is pending. Deed owners within 500' of the subject property were notified of the public hearing before the Board of Adjustment. In addition to the direct mail, notice was placed in the Dallas County News, as well as posted at the Dallas County Administration Building Notice Board. Staff do not make recommendations regarding variance requests. The Board, before making any decision in a specific case, shall review the Dallas County, Iowa Standards of Variance Review.
