Seeing that it's one o'clock, I call this meeting of the Building Standard Appeals Board to order. Can we do the roll call, please?

Here. before we get started there's procedures that i have to read for the record for each matter considered by the board there will first be a staff presentation followed by a presentation from the project applicant then discussion by the board both staff and the applicant have the right to a rebuttal presentation prior to the closing of public hearings Public comment on all matters on the agenda will be taken during agenda item six. All public testimony will be limited to three minutes per person. All public testimony must be presented to the board at the podium. The three lights on the podium next to the microphone will indicate the amount of time remaining for the speaker. The green light will be turned on when the speaker begins. The yellow light will come on with a soft bell ring when one minute is left or remaining. The speaker should be completing the testimony by the time the red light comes on with a final bell indicating that time has expired. Any testimony that references race, religion, ethnicity, economic status, national origin, or any other classification protected under state or federal law in a derogatory manner shall be deemed irrelevant and will not be considered by the board in making its determinations. In accordance with section 11 of article two, the appellant and the department will each have 10 minutes to present their position. The department shall present first, then the appellant will present. Each party will then have three minutes for a rebuttal. The department will present its rebuttal first, then the appellant may present its rebuttal. After the rebuttal, board members may ask questions of either party. The board will then close the hearing, discuss the appeal and deliberate on the appropriate action. Now we will proceed with the approval of the agenda. Are there any changes to the agenda? We are now going to take public comment on all matters. Would any public member of the public like to speak on items on continued or new matters? If so, each speaker has three minutes. Please identify the item you will comment about at the beginning of your comments. Do we have any public comments? Seeing none, we're moving on to continued matters. of which we have none. So we are into new matters. It is item 8A, actions pertaining to Fresno Code enforcement case number E26-04602 concerning 2220 North Weber Avenue slash 1827 West Clinton Avenue and the notice and order issued on April 9th, 2026. Staff.
All right, good afternoon board members. As you heard, we are here for the progress hearing for a matter that came before you on June 2nd. It is for 2220 North Weber, AKA 1827 West Clinton. Is it going to cooperate? You know, that traditionally helps.

I didn't turn it on. There we go. So at the end of this progress hearing, the board members will have three options available to them. One would be to determine that in this two month interim, the appellants have not made substantial progress towards correcting what was outstanding. And therefore, under the Fresno Municipal Code, the permitted fees and fines get doubled. The board could determine that appellants have made substantial progress, but need a little bit more time to get to the finish line and continue this hearing to a later date. Or board members could determine that the appellants have fully corrected all outstanding issues, close the case, no further action necessary. So this is a refresher. So I'll just glance through it because I know we've had a previous progress hearing, but this just reiterates the process that if something is outstanding at that first hearing, a progress hearing is set between 30 to 60 days. We're at that 60 days long, as long of a time as possible for appellants. And then they make those determinations. This is the Fresno Municipal Code section in full in case you want to look back at it or reference it. Now going into this particular case. So when we had that first hearing two months ago, it was based on a notice and order where there were seven violations in the notice and order. The board ruled that at the time of the notice and order, all seven were present, but only one was still outstanding. Six of them had been corrected since the notice and order was issued. The only one that was outstanding as of June 2nd was the exterior siding that had been replaced without permits. Okay. So where that violation stood, and there is a error in this, because May comes before June, so apologies on that. When we had that hearing on June 2nd, the actions that had been taken to correct that outstanding violation were that one, on April 27th, appellants had applied for two presiding applications. And two, they had then had an inspection occur on those two presiding applications on May 13th. Unfortunately, both failed. Since the June 2nd hearing, there have been no actions notated on either of those applications. Inspector Amparo checked one more time this morning just to have the latest available updates for you. There are no additional permits or applications that have been placed in city records, the two that the two pre stucco applications that are in city records, there's no there's no sign that additional inspections have been requested that there have been emails conferring on the matter, phone calls conferring on the matter, as far as inspector and power could find May 13 was the last action taken at all. Therefore, based on that, the city would recommend that the board members adopt the first option, which is to determine that no substantial progress has been made in curing the violations and ordering the double of the fees and costs. Ashley Atkinson, Assistant Director, serving as your secretary for today. Just a couple of things to share. As you all know, Eric Frampton's last day with the city was earlier in July. We do have a recruitment out for a new building services manager. So encourage you to take a look at the city's personnel website. for that announcement if anyone would like to share it with your networks that would be appreciated in the meantime we have entered into a contract with for one of their staff members to serve as our certified building official because we don't have anyone in the department with that certification right now, including, of course, myself. So we have hired William Hayes. He goes by Bill, and he will be serving as secretary with that certified building official certification and sitting in this seat for meetings going forward. He is not available today, but he should be here for the next meeting.
