CA2026-04 [CODE AMENDMENT] The City of Marietta hereby gives notice that a public hearing will be held to consider the proposed amendment to the Comprehensive Development Code of the City of Marietta, Division 712, Supplementary Use Regulations, Section 712.04 Home Occupations, Paragraph C., to explicitly prohibit alcohol manufacturing as a home occupational activity. Budget Amendment to Receive Donation for Elizabeth Porter Mural Repairs

Motion to approve an amendment to the Fiscal Year 2026 General fund budget to receive sponsorship donations in the amount of $21,200.00 for Elizabeth Porter from the Cobb Community Foundation for mural repairs and painting.

Tree Replacement Fund - 278 N Marietta Pkwy

Motion to approve an amendment to the FY26 Tree Preservation Fund budget to receive and appropriate a payment of $9,845 from Cobb Dental LLC for tree removal from city right-of-way at the corner of Cole Street and North Marietta Parkway.

Adoption of Proposed Budget for FY2027

Approval of an Ordinance adopting an Annual Budget for the fiscal year beginning July 1, 2026 and ending June 30, 2027, for the various funds of the City of Marietta and enacting the tentative Ad Valorem tax levies for said fiscal year for support of the City of Marietta governmental operations and other public purposes, and debt service obligations.

Motion to approve the final plat for new, public roads and infrastructure for a 35-unit (16 attached and 19 detached) residential development accessing Saine Drive and Roberta Drive (Z2021-14) to be known as Nottingham. Ward 2B.

FY2027 City/BLW Pay and Classification System Documents

Motion approving an Ordinance adopting the City of Marietta and Board of Lights and Water Position Allocation Charts, the Compensation, Position Classification, and Career Development Plans for FY2027, with changes to take effect on July 1, 2026.

Marietta Pension Board - Ex Officio (Acting Fire Chief)

Appointment of Acting Fire Chief Joe Pacheco to the Marietta Pension Board (Ex Officio) beginning on June 1, 2026, until a permanent Fire Chief is appointed. This position is reappointed with each successive council. Acting Fire Chief Joe Pacheco votes in the absence of the appointed Fire Representative.

Delk Street Speed Control

Motion authorizing Public Works to proceed with the traffic calming process for Delk Street from East Dixie Avenue to Hawkins Street and waive the 2-year waiting period due to the extenuating circumstances of the trail completion, increased pedestrian activity in the area, and the warrants being met for the speed study. Ward 1A

Proposed 2028 SPLOST

Motion authorizing Public Works to proceed with the list of projects for the 2028 Special Purpose Local Option Sales Tax (SPLOST) and to submit the final list to Cobb County for inclusion on the November referendum ballot. Council Member Goldstein discloses that members of his family and/or entities owned by himself and/or members of his family own properties along Atlanta Street from South Marietta Parkway to the Square. 2028 Proposed SPLOST Intergovernmental Agreement

Motion to approve the 2028 SPLOST Intergovernmental Agreement, with Cobb County, for the use and distribution of proceeds from the 2028 Special Purpose Local Option Sales Tax, with the understanding that the total distribution to the City will be appropriated as shown in Exhibit B (estimated disbursement schedule projections), estimated to be $78,227,427.76. Public Hearing Council Member Goldstein discloses that members of his family and/or entities owned by himself and/or members of his family own properties along Atlanta Street from South Marietta Parkway to the Square. Council Member Goldstein will abstain from this portion of the item dealing with the Atlanta Street project.

Municipal Electric Authority of Georgia (MEAG) Voting Delegates

Motion to approve a recommendation by the Board of Lights & Water to approve Carlyle Kent as the voting delegate and Ron Mull as the alternate delegate for the MEAG election.
