Municipal Council - Special Meeting

So the state code is limited to 180 days. If you were to extend it, then it becomes a, whatever, 360-day moratorium. So I think it's limited to 180 days.

But Craig, if we're doing it for the establishment of code to help regulate the creation and where data centers might be within the city of logan and what the regulations might be surrounding them that only has to go to the planning commission which is the first stage by the end of the 180 days is that correct yeah that's right you're discussing pending ordinance rule so an application that was submitted after the time

We began a process to amend code. We'll have to apply with the current code. It could be considered under the- No, no, no, no.

What I'm saying is when we write new code in this six-month time period, even though it's a six-month moratorium, it can go to Planning Commission at the end of that six months and it's still pending until it goes through that process.

So we can get eight months. So yes, it would extend longer than 180 days if we have ordinance in the hopper.

This is a public hearing, so we are gonna open up to public comment. I do wanna make a couple notes in addition to our typical public comment rules. Obviously, for those of you who are familiar with this, you're welcome to come to the microphone, state your name, please take three minutes or less. I do wanna make sure that we're keeping our comments pertinent to the moratorium on data centers. We have tentatively scheduled a meeting for July 28th at 5.30 p.m. that will be held in the, community conference room just across the lobby. And that will be a time for anyone who wants to, to come to an open house. It won't be a public meeting like this. It'll be a meeting where you can come and share your thoughts and write down notes and share sticky notes. Staff will be there. They do a wonderful job at running these meetings. So I'm going to let them run that meeting, but it'll be a chance for you to come and share your thoughts or concerns or ideas about how you feel about data centers and how you want them to look at Logan. Today we're just having comment on are you in favor or not in favor or have concerns about the moratorium, the 180-day moratorium. With that, I'll open the microphone and the public is welcome to come and make any comment if they'd like.

My name is Gail Hansen, and I live in Logan. And I want to reiterate what I said before, that I appreciate the transparency with which the council generally conducts its business. My feelings about the moratorium are that it seems to me that it is necessary partly because of the creation of the MITA board. and because of the shenanigans that have happened in the conduct of the MITA board. And I just wanted that to be part of my concerns. I am in favor of a moratorium, and I am in favor of well-considered regulation on data centers within our city limits.

i'm josh smaller from logan i'm in favor of the moratorium um this is a good gesture good first step hopefully we can get other cities on board other councils maybe even the cash Cash County Council to start doing this because we got to protect this place with cash value. The whole valley we can't afford to have 1 of them here. There's just no way we've got too much development as it is. Water uses as increased dramatically and. a data center would destroy Cache County.

Cache County's already put in a moratorium.

The county did it, but it's only an unincorporated county. The county did a moratorium last week, but it's only for unincorporated counties, so it doesn't apply within Logan City limits. but I had a great conversation with them about it and they went off and did it, which I think is great. Any other comments? Seeing none, we'll close the public hearing and bring it back to the council for any further discussion or a motion.

I'll second the motion. I just want to say that I want to thank our new intern for sending us some very helpful information to get the discussion, kind of the thoughts going. And I think there's enough questions that we need to answer as a council to move forward with something else during the moratorium. So that's why I support this.

And Russ and Mark. in light and power has already started both light and power rate adjustment proposals and land development code they both started outlining it but it'll take us a few months to get that together and get some public input right paul does have a role a little bit a little bit of a water roll yeah so do we just wait for you guys to present go talk to them okay i know i've already had numerous conversations with russ about it they love talking to us i know they do don't they Why do you think they're sitting back there? Yep, so all four of those gentlemen back there, and obviously Craig can help out as well. Okay. Rich can...

But as they, what they will do is, that's why we're having an open house on the 28th, so we can gather more public opinion on what might be in the ordinance, and then we... we might have another one before we put the ordinance out to Planning Commission, which is where it would start. Okay.

And then we go through the Typical Process Planning Commission and then us. Okay. Both allowing public comment.
