Good morning, ladies and gentlemen. Welcome to the town of Lexon Planning Commission meeting. The board is comprised of town residents who are appointed by the town council and serve without pay. This is a regular meeting and the meeting is being broadcast live on the town of Lexon YouTube channel. Speakers must sign in before 8:00 a.m. on the sign-in sheet posted by the door. Speakers will be called to the podium off the list collected. Please state your name and address and speak into the microphone. Speakers are limited to three minutes and a timer will be set. The meeting will now come to order. Uh first item is uh any deletions to the agenda. I think we're good. Uh can I get an approval of the minutes from the prior meeting of March 19th? Thank you. All right. Moving on to new business. Uh recommendation to council regarding chapter 159 signed ordinance. Jessica, good morning. The town council reviewed the planning commission's recommended amendments to the signed ordinance during the January 21st work session. Council directed staff to conduct additional research on temporary signage and requested that the small business advisory committee review the issue and provide recommendations. Staff staff has provided the planning commission with a research report on temporary signage along with the recommendations from the small business advisory committee. For reference, staff has also included the original research report on window signage and the draft amendments recommended by the planning commission in December 2024. Staff is asking um planning commission to provide a recommendation to council regarding these amendments. Okay. And uh just for clarification, what was the recommendation back from um December and what we and we're just clarifying the temporary sign ordinance. Correct. Correct. So originally we were asked to look at um the permanent wall sign window sign aotment. Um the recommendation in December was to clarify the existing definition in our existing sign ordinance for a wall sign. um to change it to include signs that are painted on or affixed to the inside or outside of the glass so as to be fully visible from off of the property. Okay. Thank you. And do we have anyone signed up to Mr. Chair? When was this ordinance? Yeah. Okay. What? We have one question from when was when was the sign ordinance originally passed? 2007. Okay. Thanks. And uh for clarification just before we um speak uh this body does not approve the sign or we're sending recommendations uh to town council.

I'm the artistic director at Villageear Theater here in Lexington. Uh we're located at 105 Kaufman Road. Um, I wanted to speak um on behalf of the theater for the sign research. I have some handouts. Can I pass them out just as visuals? Thank you. Thank you. Thank you, Jessica. Do you need another one? You need one? Um, they gave me one. Yeah, we're good. Thank you. All right. A little bit um about Villageear if you haven't. Um if you're not exactly sure, um we were the first movie theater here in Lexington. We've been around for over 60 years. This August, we'll be celebrating 65 years as a community theater in Lexington. We are the only nonprofit community theater in Lexington area. Um we are based um right behind Sonic off of Columbia Avenue away from the road. Um we have very limited um visibility from the road. So these signs help us um market um and advertise to our patrons. Um a lot of times we're not at the theater. There's not someone in the middle of the day. There's not anyone at the theater. So, a lot of times we have people that come by and we they look at these signs on our doors. It's easy access. A lot of our patrons are older, so they don't have access to social media or they're they choose not to be on social media. Um, and they also

don't um really look up the the website. So, these uh signs on the windows serve as advertising um for us. They are temporary and we change them out every season. Um so they can be affixed and removed from the inside. Um the outside parking lot is still visible. You have really great visibility inside the theater as well. And they do not cover up any doorways. Um if we were to have to seek another alternative, it would be very difficult um for us to come up with a solution for this. Um, so I appreciate um y'all taking into consideration uh the impact that this may have on our patrons and our community. Thank you. Thank you. I didn't have anyone else. I think it was crossed out. Our recommendation is to with no changes. Okay. So, you making a recommendation as is to send to council review. As is to send to council. So, no changes to the current temporary signage ordinance. We did talk about verbiage. Some of the verbiage needs to be changed. Correct. Yes. I think you wanted to change the uh portable to say temporary. Okay. On page seven. Okay. Second. Just to be clear, what is on page seven of the staff research report is not the existing

ordinance. You're saying what you want is on page seven. Do what you want to make a recommendation for the changes. The clarification on page seven. Page seven. Yeah. Okay. So, the language that is on the staff findings report, page seven. Yeah. Okay. Which was the clarification from the prior meeting. Correct. And that would also just to be clear so that we're we're sure that allows to um temporary window signage where there is not any now. Currently you are only allowed a temporary banner. This would allow for that changing to this language would allow for um temporary window signage permitted on a business window. So, they have to get a permit and they have to follow those in those requirements that are laid out in there the definition of a temporary window sign, too. So, I just want to be very clear that y'all are all okay and understand that that's what you would like. Yeah. Okay. And then in section D, yes. Change portable to temporary. Yes. Okay.
