I'm here. Thanks. That's okay. All right. Uh, looking at our agenda today, looks like we don't have any me minutes to approve. Uh, so seeing none, we'll move to citizen comments. So, this portion of the agenda is reserved for any members of the public who would like to address uh, the planning commission on any topic that is not related to any items on the agenda tonight. If you would like to address the planning commission, please come forward. sign in and state your name before your comments. Okay, seeing none, we'll move on to the public hearing portion of the meeting. Um, there are two public hearing public hearings on the agenda tonight. Before opening the hearings, I'll ask the city attorney to review the public hearing process.
Thank you. Tonight's hearing will be pursued to the quasi judicial hearing procedure set out in 1977. At the start of each hearing, commission members will be asked to disclose any expart communication, conflicts of interest, or bias. The applicable substantive criteria for this hearing will be addressed in the staff report. Testimony may be in oral or written form, but must be directed towards the criteria outlined in the staff report, comprehensive plan, or the city's land use regulations. Any issue raised must be accompanied by statements and evidence sufficient enough to allow the commission and parties an opportunity to respond. Please note that failure to raise an issue, including a constitutional issue, by the close of the hearing, will prevent an appeal to the land's Court of Appeals. Thank you. You're welcome.
All right, we'll go ahead and open up the first public hearing. Planning file A-26-01. It's a proposal to annex the property at 2015 Stotill Road and designate the residential mixed density zoning. So first I'll ask is there any conflict of interest exparte communication or bias to report. Okay seeing none I'll turn it over to staff for the staff report. Thank you. First up is annexation A2601 to annex uh the property at.7 acres on the corner of Airport Road and Stotzill Road. The address is currently um is addressed as 2015 Stoultz Hill Road and it is in our comprehensive planned and re residential mixed density. Around this existing tax lot is zoned residential mixed density as well as some mixture of some county properties to the south. It is contiguous to the city limits both on the east and west property lines. And the applicant has indicated they will annex with the current zoning, the comprehensial mixed density. So this is just annexation. All public utilities are in the road both in airport road and Stoultz Hill Road. And that is all I have. If everyone anyone has any comments or questions. No questions of staff. All right, there are no questions. I'll go ahead and open it up the public hearing and welcome the applicant to come forward and provide testimony.
Good evening. I'm Brian Bandetta, Udell Engineering and Land Surveying, representing the applicant. Um, based on Miss Olsen's staff report, I really don't have anything further to add, but I would just offer myself to answer any questions if you had any.

um, yeah, if you can go ahead and sign in and state your name, please. Okay. So, okay. So, mic's on. Um, I was just curious as uh what the applicants intentions were with the property. I mean, I guess it's to leave it as residential. Um, if anything was looked at as flood plane wise, um, as there is drainage that goes through the property. So, um, and if there, um, was anything I I believe I should have got a I'm in the same subdivision and that, uh, future construction on the property could um, could affect my drainage is is what I'm worried about. So, I'm a little disappointed in city and county that I believe I received no notification.
So, it was I just happened to uh see a Facebook post about this um that I was able to attend tonight. So I believe I uh did not receive any uh and I and I talked to a neighbor, an elderly neighbor. Um and I don't believe that they received any notification from city or county. You want me to handle part of this? Yes, please.
So the the part the first part I I can't answer the the notice part. I I assume um there's requirements as far as the notice. Um but as far as the annexation itself, the first step is to one if somebody is entitled to and has a a right to annex, they make an application and that's the first step and that's the only thing we're dealing with today. So the question of annexation and and sometimes they you know what they're going to do with the property and but they don't aren't required to tell us or nor are they required or or
We've had multiple instances in the last two and a half years where we have had to um ask people to move their cars from blocking our driveway and it's been a it's been an issue. So, um, even like construction workers just working on it lately, they've they were completely parked in front of our driveway blocking it. No one was in the truck. They were already working. Like, they just block our driveway. And it's just it's just a huge concern cuz there's there's not a lot of places to go. And when there's seven there's going to be seven houses, which equals about seven families, which we all know equals at least about 14 cars. It's it's just really concerning for the safety of the street and the neighborhood and when you think about like emergency vehicles coming through and all sorts of stuff like that. So getting to work on time if my my driveway is blocked. So there's a lot there's a lot that is uh concerning here for us. So yeah.

Good evening again. Um, speaking uh to to the parking concern, u very valid concern in the neighborhood. Um, the development code requires that each one of these detached single family houses and I would emphasize it's not multifamily. They're detached single family houses. They will all be built with a garage and they'll all have an additional parking stall at at minimum in front to meet the code. So each one of the on-site lots will have two parking stalls off street to provide the parking for the the development. That' be a total of 10 parking spaces for the five units being constructed. Any further questions?
For the attached town homes, what does that look like? Uh it would be very similar. So, even though they are attached um from the street, they'll look almost identical. They'll just be attached. They'll have a garage at minimum. They'll have a single car garage and then they'll at minimum have a parking space in front of that garage.
There's double parking on both sides. Is that is that correct? Parking on both sides of the street. This the street is wide enough for parking on both sides. Correct. It does meet the city's code for that. Come up. All right. Thank you. All right. Thank you.

I just had I I don't know if I have to come up here, but I just had a question about the uh like the driveway and going into like the flag lots because we're directly across from it in the frame or whatever. Doesn't make sense to us right now. Like I don't know if it's backwards or since we're directly facing it, they've already started
what faces north or the direction of orientation. Okay. where wherever they're saying the driveway is. I would just like more clarification on that because Ryan, I'll put I'll put it up on the screen and you can walk through it for everybody. Ryan, if I put it up on the screen, you could walk it through. Yeah, we can. Why don't you go ahead and open the hearing back? I'll go ahead and reopen the hearing for a rebuttal from the applicant. I think Shannon, one of the sheets shows all the driveway curb cuts. I didn't put that in the presentation, but I can go get it out of the Oh, I can. So, I I think I can explain without the drawing. So, there's a 14t flag strip. In that flag strip will be a 12-oot driveway. Both of the lots that are on the north end will share that driveway. So, they'll both be entering and exiting from that one common driveway approach. The other three lots in the front off of Mary will have individual driveways. Well, excuse me. One will be shared and one will be individual. There it goes. Sorry.
There we go. There's a picture. So on the east side, there's one shared common driveway that'll serve lots four and five. Then lots one and two are set up to have a shared driveway. And lot three will have an individual driveway. That's they're they're putting foundation in right now. That is a different to the east of this property. They are. Yes. Is the road coming Mary Street is at the bottom, correct?
Yes. Okay. So, right now they're building they've already put the rock down and they're put a foundation on the left side. That's looks to me like right now that's their driveway, right? Nope. That has that property being developed currently has nothing to do with this development. completely separate property. So the one right now that's those two town houses on a separate piece of property and this this driveway will be this driveway will be immediately to the west and adjacent to them or east, I'm sorry.
We currently have a building permit for a piece of property to the west of this development that is not a part of this development proposal tonight. It is town homes that were through an admin staff review separate from this development.

So feel that the decision criteria has been met. So for emergency personnel to access lot five, they would have to back down that driveway, right?
The fire department did provide comments and it does meet their spacing requirements. They would not drive down that driveway as within 150 foot of the road. So they after 150 foot then they would need a turnaround but they did not provide any condition of approvals for this development. It meets all of their fire code. Okay. Thank you. I I think what you're also looking at there is you're looking at lot five up there. It it just shows a lot, right? So it's going to function a lot like lot four will. So, you're going to come into it and you'll probably likely have room to back up and go out forwards. Oh, okay. Would be my guess.
It's hard to tell from that. I guess if it meets all the criteria, I'm ready to um make a motion. I move that the planning commission approve the proposed subdivision S-26-01 application and sign the draft order of approval incorporating the findings and conditions of the approval presented by the staff.
