Public notice of the meeting including the meeting agenda has been posted the required length of time in the lobby of the county administration building and on the county website and the news media was notified of the meeting place and time. Um, welcome everyone to the Lancaster County Planning Commission meeting. Uh, please make sure that you've turned off all of your electronic devices and please abide by the meeting rules. Uh, we would ask you to please remove your hats and no profanity and please do not interrupt other people when they are speaking. Signup sheets were provided at the entrance to the room. Is there anyone who has not signed up to speak that wishes to speak? Okay. All right. So, very good. So, you will be called when we get to that relevant item um agenda agenda item. Next item on the agenda is a special presentation, capital improvement plan project ranking. Good evening, commissioners. Um, before we begin, uh, earlier in the month, you were distributed a ranking worksheet. Just wanted to show hands if everyone has that with them. If not, I have extra copies. Um, need one. Absolutely.
Does anyone else? I don't think this one the ranking. Thank you. Email. It was an email asking everybody to review it and be ready. I'm sorry. Okay. I did a lot of That's all right. Uh the way that this exercise is going to be structured tonight, you'll have time to do that between um my presentation now when I return after the four uh non-consent items on agenda. So, you'll have time. We'll do the actual ranking exercise after you have time to fill it out.
Okay. So, like I said, Josiah Park, budget analyst with Lancaster County Budget Office. Um, I'm also here to facilitate again that ranking exercise for you for the coming fiscal year. So, on the agenda tonight, we'll briefly recap the capital planning timeline as well as listing all approved and new capital requests for the FY2026 2027 fiscal year. The requested action for tonight's meeting is the following. to receive information on the CIP and project requests for the upcoming fiscal year, which you now have to complete and submit the commission's individual ranking sheet sheets during the following three agenda items. I'll tabulate those and create a consensus priority list based on the individual commissioner's rankings. Following those agenda items, you'll receive that consensus list back. Basically, all of your rankings put together as just a starting point for discussion. Using the consensus ranking, you'll be asked to vote to recommend a list of 10 priority projects to send to county council for consideration um in their ranking exercise for this upcoming fiscal year. Uh and then you'll be asked to then vote to recommend that county council add new projects to the 10-year CIP list. Um those include projects that were not on your 10 top 10 priority uh ranking list today. So if something is not um on that priority list, it would still be going to county council and asked to be put on the CIP in an unfunded uh status. The information in this presentation is identical to that which was presented to county council last week at the April 15th budget workshop. And all projects, including those that are currently in progress, are included in these slides. The ranking exercise the planning commission will engage in will only include those projects that are new submissions, approved but unfunded or scheduled to begin in FY27. We'll get into why that is. First, a little bit of background on the capital improvement plan. Uh as a government, one way we foster a thriving community is to build and maintain
infrastructure to deliver public services. As part of this process, residents, county staff, and other boards and agencies assists the county council in identifying problems and needs related to infrastructure. County council then identifies priorities, in this case, capital project needs, sets the agenda or selects projects as priority, and appropriates funding for the project. County staff staff implements and manages the projects through their life cycle, manages the dollars, and reports out on their project status. The main instrument council can utilize in this effort is the capital improvement plan or CIP. It is important to understand, however, that it the CIP is only a planning tool. So, council is not committed to the funding sources and amounts as identified in the CIP until those dollars are appropriated yearon-year as part of the annual operating budget. However, there are future operating budget implications when a project or piece of equipment is completed or purchased, such as utility and maintenance costs, especially in the in the um case of facilities. The CIP is amended each year as part of the annual operating budget development process and the revised CIP ordinance uh was adopted in June of 2025. That's the one we're currently operating under. There are variety of ways to fund capital investments and these include borrowing through a general obligation bond or similar instrument, taxes and fees through a millage rate or impact fee, and the appropriation of cash savings. projects or heavy equipment with a 10 $100,000 or greater value or with a useful life of more than one year are considered eligible for identification and possible inclusion in the CIP. So the the question I received last time which was a great foundational question. What is a capital asset? The definitions can mean a lot of things in in this case for the CIP the 10ear CIP it is that definition. So anything over $100,000 in value that has a useful life of over one year. Again, these funding for these projects can come from a multiple multitude of
sources such as special revenue tax, millage impact fees, fund balance or cash savings or the use of borrowing. The annual CIP process begins with department directors, council members, and others reviewing existing projects and evaluating the future capital needs of the community. Departments then submit capital project requests which are then reviewed and compiled by finance staff. These requests are also evaluated for likely one-time and recurring cost requirements by supporting departments such as information technologies, IT, fleet maintenance, and building maintenance staff. Separately, the planning commission uh for this year and the county administrator review and rank by priority all capital project requests for the upcoming fiscal year. New for this fiscal year, the planning commission also suggested two projects for inclusion on their ranked list, and you'll see those in a moment. These rankings are then provided to county council before the presentation of the administrator's recommended budget uh this year which will take place on May 6th. County Council and then in similar fashion evaluates these priority lists and considers them in the process of identifying new capital projects for inclusion in the 10-year CIP as well as identifying those projects by adopting the CIP ordinance as part of the annual operating budget or ordinance. To select projects receiving funding for the next fiscal year, county council adopts a capital appropriation as part of the county's operating budget. Again, no financial commitment is made for projects on the 10-year CIP until they are funded through the operating budget. Funding sources are likewise identified at that stage by county council. Finally, capital projects are carried out while ca county staff and others manage and monitor their progress. Okay, so like I said, this is identical to what county council saw last week. Uh we have 41 total capital improvement plan projects uh that are for council review this budget cycle. These you'll im immediately see are more than what
you have in front of you. The reason for that is the balance the ones that are not on your sheet are already in progress. So rather than have you rank projects that are already in progress for funding, it's the uh feedback I was receiving from uh this body made it seemed like you wanted to be more involved with the new projects that were going to be recommended. Um, and for that purpose, I wanted to make sure you had that ability. So, we have 41 total capital improvement plan projects for council review and 26 approved projects scheduled for funding in the FY2627 fiscal year. These include projects already in progress whose funding must be reappropriated each year. 15 new projects are listed for funding consideration. And with those 15 new projects paired with the seven un approved but unfunded projects make up the project list that you as planning commissioners will rank tonight. So the ones that you are ranking are the new and then the ones that are scheduled but have not started. So they're scheduled for FY27 but have not started yet and thus don't have dollars attached to them. And then those without funding sources. So the ones that are approved on the plan but either have were not appropriated in their scheduled year or have not been given a scheduled start yet. and because of that they don't have funding associated with them. So we're going to briefly just kind of go through and click through these projects here. Like I said, some of these are already in motion like our ERP um enterprise resource planning project. We can see a couple of projects for fire services and EMS. We have parks and recreation, the annual IT hardware replacement program, road maintenance, road paving, patrol vehicle replacements, and a few for solid waste. These are
ones that are either in progress or are scheduled for FY27. Now, we're going to see the new projects. These are ones that were submitted either by yourselves or by department directors. So, in similar fashion, you can see that there's a spread across of across our departments um including a fire training center and riverchase development agreement fire station. the two projects received from planning commission as well as fire dispatch um parking lot repair at the sheriff's department, things of that nature. So, our next steps in this process is to collect those ranking sheets from you. Um and I can give you a few moments to to fill those out as you wish and then tabulate that consensus priority list for um our commissioners to discuss. The commission will then make an amendment as they or make amendments to the list that they desire. So you can you can take that consensus list as is. I believe last year we made one or two modifications to it and then you voted on it as is. You can completely come up with something new. This is just a jumping off point for you. Uh the one request I would make and it will make sense when I say it. Um, let's make sure that we have the station, the fire station 3 station and fire engine travel together.

Wherever they land. Um, I don't think I need to say that fire station needs an engine and an engine is not very much use without a fire station. Okay. And then again, budget staff will present this uh list to county council on May 6th as part of the um interim administrator's recommended budget. So, getting back to our exercise, uh this shows the ranking sheet as was distributed um to you either today or um whenever that email went out. Uh the finalized list will be similar with projects weighted by consensus to create a top 10 priority list. Again, your list can contain as many as you like. Again, this is just a jumping off point u for the sake of u of brevity. This will be brought back for discussion after the following three agenda items. I just ask that if we are going to ask questions, we can do it now. Um I would just like to have those sheets from you before you start your non-conent agenda so you're not distracted by what you need to be focusing on and I can get that done for you.
Y'all have any questions? I do. um how much weight does this carry this exercise that we do?
So this list is paired with a almost identical in terms of exercise list that the interim county administrator will will carry out and then be presented to county council. County council is the one it's the only body who can actually appropriate dollars for these projects. So, as an advisory body, I think that's actually a good deal of importance. Um, because you're basically saying from y'all's experience and work your collaboration, this is what you think the community needs. I agree with that in theory, but I guess my question is it's a great theory, but how much attention to what we do is paid and how much weight and the reason I'm asking is the number one item on this is for the airport for the stainless steel tanks. I don't think that landed on anyone's and it says is now an approved project scheduled but unfunded and we decided that I can only speak for myself. Uh it I don't believe anyone voted for that but we felt that it was not something that really benefited the residents of Lancaster County. Um a lot of people who have planes use the airport. I don't know how many in this room have their own plane that they keep out at the airport. Um, I'm not one of them. Um, and a lot of businesses use it, which is great, but I just was kind of dismayed to look right now and see that's on this list when it didn't make any importance to us. So, it just made me think this is a lovely exercise and I don't mean to be too sarcastic, but I just wondered all this time that we're spending on it, does it really carry any weight? So if it's simply the matter of its position on the paper, more or less that list is alphabetized.
So it's not necessarily its top priority, but mainly that it's where it falls. Um if it comes to why it's still on the list, it's a 10-year CIP item that was adopted back in 2021 as part of the 10-year CIP um document. It has not been funded since then. So whether or not it's a high priority, I can't answer. Unfortunately, that's outside my scope, but I can tell you simply that council will receive this as part of their agenda packet uh ne on May 6th. Um what they plan to do with it, I I unfortunately can't say.
I was just just it is the top of the list only because of alphabetics, but I was just dismayed to see it along with fire stations and EMS and so forth. um gas tanks being put into the airport for a million dollars versus fire engines and so forth. Right. So, thank you. I had a good question.
I also had a um question um on right after Commissioner Lou's question. So um while it didn't make our list at all uh but it is approved and scheduled for start already in 27. So based on the way that I ranked cuz I didn't rank any like the whether or not it's scheduled for start didn't matter to me. I went with urgency. So I don't care about if it's already scheduled to start in 27. My ranking looks like does it have to do with health? Does it have to do with safety? Does it have to do with protecting lives? So that's the way mine were ranked. I'm I guess my questions are with the CIP bucket notices or the you know comments that are made here. What weight does that also carry?
So I I can't answer what council will decide. Unfortunately, that's well outside my scope. What I can say is that was scheduled for FY27 when this was adopted in 2021. That's why it's still on the list now. So, in terms of what exercise you guys are doing tonight, I think you did exactly right. Fill it out based on on your conscience on what you think the community needs. That's I think your function as an advisory body and I think that would be perfectly suitable. I should have asked this, but so I've I have a lot of like scratches. Can I have a new one just so I can give you a clean? Absolutely. Sorry. Like I went back. I'm going back and forth like did your homework
and just and just for making sure we're on the same page. Um one will be your first priority. 10 will be your, you know, your bottom priority. You can go beyond that if you wish. Um but I would prefer we keep it to 10 at least for the the consensus so that it's even. So then you can jump on, add, remove whatever you need from there. But absolutely. I also have a filled mine out earlier. Actually, I filled mine out last week. So I ranked all 24 projects. You can just ignore anything, Pat. I appreciate you. Thank you very much. Thanks. And I just wanted to say that you're you've said it twice now that this was beyond your scope. That was a very polite and professional way of saying above your pay grade.
Yes, I like it. One one thing I'd like to Is it okay if I ask? Yes, ma'am. Yes, ma'am. Um, where it says uh funding source just normally because I I really don't know. Um, the animal shelter is a big thing with me and and I see the project is 120,000.
So, where does that come from? I mean, does does organizations just maybe donate it? Do where does that money come from? So for the purposes of planning, it likely would not come, and this is again very close to the edge of my scope, would likely not come from donations as such. However, the county can fund projects in a multitude of different ways. So they can be things like the capital project sales tax that we have currently. We have projects in in progress that are using those dollars. Um it could be uh taxes, it could be through general obligation bond, it could be through borrowing, it could be through fund balance, which is what we have in cash savings right now. Part of the council's adoption of the budget ordinance, operating budget ordinance, is saying we want these projects to have funding for FY27, which is next year, and we're identifying these funding sources for them. Until they do those two things, those projects don't move forward.
Gotcha. Okay. And and if you will notice, all but what two of these projects say no funding source identified. Only two of these have actually been funded. I would I would just clarify only two of them have had funding sources identified. Identified. Yes. Yes. Sorry. Yes. I'm sorry. That's they they've had funding sources identified but they still have not even been funded yet.
Right. And when those come forward, they could be they there could be another funding source identified for their use. Um it it really just depends on what county council decides to do with the operating ordinance. Any more questions? Has everyone completed with their rankings?
No. I'm I'm sorry. I will, but I'm just frustrated. If the commission needs some more time to fill these out, I can come up between one of your items on the non-consent agenda. I don't want to delay them our our meeting tonight more than I need to. What you need? Not to put anybody on the spot, but I want to make sure you have as much time as you need. Absolutely. Absolutely. So y'all uh please pardon the delay here, but it's another important thing that we have to do down there. So you can pick them up. When you said putting the Indian Land Station and the fire engine, should they be ranked the same number so that we actually only have nine?
So, I would I would just recommend that you put them in sequence. Thank you. Um, and what I will do when I bring up consensus list is I will just say, "Hey, this is they probably will not land on the same place just because of how the math will work, but I'll identify those and say, "Hey, could we just move either this one down here or this one up here?" Just so they're together.

Yeah. And just to let the county attorney know, I sent them all as separate emails. I did not do it in mass. Thank you, sir. All right. Um, uh, next item on the agenda is public hearing items for recommendation to council. The, um, first item on the agenda is CU 2026 0168 Muhammad Recuse me.
Oh, I'm sorry. Before you start, yes, Miss Hson um is going to recuse herself. So, let's give her a second to leave the room. And Jennifer, I believe you have a form for her to sign.
Laura has Okay. Excuse me. Thank you. Give her a hand. Yes. Pull that down just a smidge. I'm not quite as tall as Josiah. Madam chair, commissioners, thank you for having me. This first case in front of you is a conditional use. And you've got your aerial uh view of the the map there that shows the subject parcel that's highlighted in that teal line. And uh you've got the address parcel ID. It is currently zoned LDR. The request for this conditional use is a place of assembly uh which is allowed in that zoning. It just requires a conditional use permit. There it goes. So that's your aerial view of your zoning map there. So you'll again see that subject parcel highlighted in those teal lines. It's surrounded by transitional districts of of LDR, MDR, NB, which is neighborhood business, and PB, which is professional business. And then there's your future land use map that shows that your subject parcel is in within the growth area, uh, FLU. And so the application for a conditional use, we have to look at the UDO provisions in chapter 9 and then application procedures in chapter five. And so both of those are attached to your staff report for your review if you'd like to or to your packet if you'd like to review those. Um, and those items have been met. And then you've got your chart there that shows you your surrounding zoning
districts as well as your how the parcels are used in the area. Well, it might not be. We're here. Okay. So, you've got a site photo there. And then the TRC has reviewed uh this conditional use request. Uh no departments had any issues uh with the proposed use. They did have some uh assessments in terms of the site, but those would be addressed um at a civil site submission if the use permit was granted. Um and then the water sewer district was included on this TRC review of the use. However, they provided that no review was needed at this time because no change that would impact the utility was being proposed. Um, and so in reviewing the chapter 9 and chapter 5 provisions that have been met and the TRC review staff recommends approval and there is a second photo and I'm here for questions and I believe that the applicant is here. The applicant is here as well for questions.
All right. Um, thank you um Dr. Kirsten. Um, staff I mean um commissioners, do you have any questions? Uh, Commissioner Tinklenberg would like to start off. Thank you. Um, I want this to be for the record um, in its entirety. I have a staff report correction. For the sake of full transparency and in continuing to serve in this role with honesty and humility, I now have a difficult matter to discuss. I ask that you please allow me to finish. It is unfortunate that I'm having to address what could have been a very simple correction by our county staff in the staff report. However, after days of trying, and because it is already part of the public record, it must now be addressed in its entirety. Last week, while preparing for this meeting, I noticed an error was made by the planning staff on page 78 of our report, which states, "Commissioners Tinkllinberg and Richards requested information regarding prayer schedule and how the facility will call to prayer regarding bells and other noises that could affect the surrounding residential community. Given the controversial nature of this agenda item and my understanding of the religious laws and regulations involved, I was very careful about what I did and did not say during our workshop meeting on April 2nd. I did not make this statement. What I did ask about was the frequency of youths as it relates to impacts on the surrounding community. An entirely standard question that I would ask regardless of the type of conditional use being requested. The lack of care demonstrated in the staff's decision to include this statement is deeply concerning and may rise to the level of defamation. The staff was negligent in failing to verify the accuracy of the information or recordings and in not considering the potential harm and implications of including such a statement. I take false statements about my reputation very seriously and it is unacceptable that
this was allowed to reach this point. It is unfair to the applicant that I must rise this issue at this time. It is unfair to the community here tonight that we are beginning this meeting under these circumstances. And it is unfair to us as commissioners that we cannot rely on staff accuracy even when we are acting in good faith and effort. For those reasons, this matter needed to be addressed. It is also unfortunate that county staff whom we should be whom we should be able to work with collaboratively chose to handle this error in this manner and do nothing. This rises serious concerns and diminishes confidence in the ability for certain staff members to perform their duties competent competently to produce accurate reports and to support decision-making with integrity. It also raises broader questions about true leadership, responsibility, and accountability or lack thereof. This concern is not based solely on this single occurrence. It must also be noted that last month another significant error occurred when a published staff report included incorrect information about permitted uses under our UDO within a zoning district. That information was presented as fact and could have improperly influenced voting decisions. Accuracy and the responsible stewardship of information from our UDO should be the minimum standard of our staff. I strongly urge staff and leadership to implement improved redlinining and peerreview processes moving forward to prevent issues like this from occurring again. It's my hope that going forward there will be fewer errors of this nature requiring public correction and that staff will take the opportunity to make necessary and meaningful improvements. No county volunteer acting in good faith should have to contend with this level of ineptitude from staff nor be placed in a position where their integrity and reputation is questioned. This is simply unacceptable.

Um I would also like to since I was also mentioned in that um for the record I would like to say it was actually I'm the one who brought up about call to prayers and stuff and actually um um Dr. Dr. Willis corrected me and said you rem reminded me of what the ramifications were. So I withdrew that request. I have several Muslim friends. So I reached out to them to find I'm just not familiar with the Islamic faith and I don't know how their services work and so it was just to have information purposes to understand the process. So I got wonderful information from all of my Muslim friends and I feel like I can make an informed decision now. So that's my two cents for the record. Commissioners, any other comments, questions?
I I would like to agree. I also noted on page 78 that it was a very targeted comment about commissioner. Like I don't ever remember getting a staff report with any of our names in it. I felt like it was targeted and because the information was incorrect just I felt like it did not need to be there. It was of no regard and so it was like pointless to have that information there. It just seemed like it seems like we're spending way too much time having to pull back and forth a tugofwar before we ever actually get to the real decision making process for the people here for the people who live in Langster County. I don't know. It doesn't make it doesn't make sense to me and it doesn't feel um like due process.

My name is Angelo Tilman and I my I'm with AllPro Development and uh, we're at 3557 North Sharon Emity Road, Charlotte, North Carolina 28205. And this is Mr. Man. My name is Abdul Banan and I live in 580 Brook Haven Drive, Fort Mill, South Carolina.
And the reason Mr. Manan his uh party reached out to us, we do a lot of churches and and with churches, you have to have buffer zones, you got to have plant, you got to have trees planted, you got to meet the silver requirements. As far as like the call to prayer, there will be no outside audio speakers on the mosque. And basically uh they just want to have a place to worship. In Lancaster County there's not a mosque. The closest mos is in South Charlotte. And we all know that when we worship excuse me excuse me. Would the public please refrain from interrupting the applicant?
And and they just want to have a place to worship with their family and friends. You know it's only like 40 or 50 people that's going to be members. We're asking for parking for All right. If y'all cannot control yourselves, I'll have the security officer escort you out. Please be respectful of the applicant. If you signed up to speak, you will have your chance to speak then. So, we're doing parking for 100 people, but it's going to be 40 to 50 people. They'll be me mainly once a week, and that'll be on Fridays, Friday afternoon.
And uh and so, like I said, it's it's no outside speakers. We'll do the tree planting, whatever we need to do to do buffer zones and we want to get input from the community cuz we want to be good neighbors and whatever concerns they have, we'll address them. Whatever concerns the planning department have, we'll address those. And like I say, they want to be good neighbors with the community. So your concerns are important, you know, to them. They just want to have a place to worship with their families. That's all. You know, any concerns you have, if you get up and speak your concerns, we'll do what we can to address your concerns. Sir, would you please address the commission and not the audience? Thank you.
And basically any concerns that the neighbors have, if they they have a concern, we'll do all we can to address the concerns because like I said, they just want to have a place to worship. I do have a I'm sorry, I was slow to speak, but um, so you know, um, of course we welcome our neighbors. We welcome the use of, uh, the property in compliance with neutral land use standards. Um, you said that you expect 40 to 50 members initially, right? That's not I mean you can't you can't
we're doing we're looking for like maybe future growth or if they have an event. So we did 30 parking spaces. It's uh one parking space for every four people. And I did talk to the fire marshall about the space and everything. So we do want to have additional parking because when you have a church sometimes you have events where you invite people and you don't want people parking on the side of the road. well you know have you talked about traffic patterns and all of that good stuff
I think as far as like traffic patterns that's addressed by DOT and when we give DOT occupancy. Usually, if a traffic analysis is required, they ask for it. And they do do, I'm pretty sure they have a formula for like 30 cars to be going up and down the road. We did reach out to DOT about the commercial parking for the church off the street. But he said that we didn't have to worry about that until it was approved by city council and then we have to get a driveway permit. We reached out to DOT, the fire marshall, planning. We reached out to everybody and we did hire a civil engineer to make sure all the civil requirements were met. And the civil engineer actually reached out to the planning department before we did the application to make sure that the property could could do what was required civily by the state of South Carolina.

I received um a package um of 24 emails from citizens in the county um specifically commenting on this. Um, thank you whoever in staff gave me a synopsis of this instead of me trying to have to read through all of this. I greatly appreciate it. Um main the main concern was traffic and noise and um a non residential zoning used for that piece of property. Um negative impact on uh property values, negative traffic impact um with the proposed school coming on Harrisburg Road, negative impact to EMS, fire, emergency and other safety services, negative impact with overflow parking on the street. So that is that package of emails, but that's a synopsis from the 24 people that submitted um an email. Um so um as I said uh we'll not consider ourselves in public hearing. I live at 11187 Harrisburg Road. I'm approximately a quarter of a mile from the the uh property. And I would like to elaborate on what Mr. Connor said about the cemetery. Uh the people who own the property that sold it to Mr. Pettis who is the prior owner of these folks. He actually owned the property and he said there is his name is Buddy Pettis. He sold it to Bill Pettis. He is was his brother and he said that there is a cemetery on this property to the left of the residence. Thank you for considering the comments uh that I'm going to make on behalf of the community for the mosque at 10935 Harrisburg Road in Indianland. According to the South Carolina Department of Transportation, the last traffic count in 2025 was an average of 7,300 vehicles on this Harrisburg Road. The traffic on Harrisburg Road is already overburdened. The mosque on the northern end of Harrisburg Road has traffic backed up on Fridays and they have hired a police officer to stop traffic to allow them to exit onto our residential road. I noticed the license plates predominantly are from North Carolina. Cars are also or used to be parked on both sides of the road on Fridays. I understand that there are multiple accidents there. We question how the sewer is going to be handled for this many people because there is no public sewer on Harrisburg Road. Would the residents that would be affected by the already heavy traffic on this road please stand?

Karen Columbus, 319 Berg Circle, Fort Mill, South Carolina. My church is very close to Harrisburg, very close to where this mosque is being planned to be built. And um the reason why I object to this mosque being built is because of how I believe it will affect the community because of their idea I their belief system and ideology. So I would like to quote from their Quran some of the things that exist in their belief system. Quran 2:es 191, slay the unbelievers wherever you find them. Quran 3:28, Muslims must not take the infidels as friends. Quran 385, any religion other than Islam is not acceptable. Quran 5:33, maim and crucify the infidels if they criticize Islam. Quran 8:12 terrorize and behead those who believe in scriptures other than the Quran. Quran 8 verse 60 Muslims must muster all weapons to terrorize the infidels. So it continu continues to say Quran 9:30 the Jews and Christians are perverts fight them and Quran 474 do not hanker for peace with the infidels behead them when you catch them and then Quran 9 verse 123 make war on the infidels living in your neighborhood so that's my concerns. Michael Pelleter. My name is Michael Pelier. I live at 87417 Edson Court, Lancaster, South Carolina in Indian land. Um, my concern is over this particular piece of property is from my background. I have been working uh with Muslims and uh I have lived in their communities. I come from Michigan. I come from the areas that are that were where I was raised and where I was uh where I lived in Dearbornne and in Ham Tramik where the Muslim communities have taken over. They started out with building a single mosque. Then they did their call to prayer. Then they broadcasted their call to prayer. They drove down the property values and basically uh drove the community that lived there out of it to the point where now Dearbornne is under Sharia law and it one of its mosque members uh attempted to uh attempted to harm the children of a uh Jewish school in West uh West Bloomfield Township. He drove his truck through the building and lit it on fire. It was directly connected to a mosque. It was directly connected to the mosque in Dearbornne. My concern is this. I've lived in these communities. I've worked with these men uh that are from the Muslim faith and I don't have anything against their
kindness about how their generosity is, how they treat their families. I'm not concerned about that. I don't I'm not concerned about how they worship. What I am concerned about is the fact that when they come in, they come in as wolves in sheep's clothing and they say that they're going to do everything that they're going to do and then all of a sudden, oh, there's this turn of events. And my concern is I came here from there because I wanted peace in my life. And as a Navy veteran, I fought hard for that. As a business consultant, I've been all over the world fighting for it and I don't want to fight for it one more time while I'm in my home. So, I would prefer that the commission decide to go against this and I think that my neighbors would greatly appreciate it. Thank you very much.

And that timer up there reminds me of my childhood when I was sitting at the table and my mother would said, "We're going to start the timer and if you don't eat those LMA beans by the time the timer goes off." But anyways, um I have a couple concerns here. So I'm older than I look. I graduated from college in 1978. And ever since 1979 came around and the sha of Iran was given the boot and they killed all the Marines in Lebanon, nothing good has occurred. Nothing. And please correct me if I'm wrong that had to do with the Muslim and the Islam law and its uh issues across the world. Nothing good has occurred here. Nothing. Um, the gentleman spoke about Dearbornne. It's an issue with outpopulate, create a government, move in. But here's my legal concern. And I don't know if we have any attorneys here that can speak to this. They may not be qualified. But the concern is that this mosque, I know right where it is. I drive by it every day. The concern is that um I'd like to see this tabled until we can get our legislators to look at banning Sharia law in the state of South Carolina. Governor Ronda Santz just

Governor Ronda Santis on April 6 just signed into legislation uh banning a Sharia law because of a couple of particular things. They want to make sure that women and children are protected. We don't know what Christians may be influenced to come into this mosque, be taken under their wing and influenced to the point where boy, I don't know. Well, this is a whole new thing. And they could be overrun with emotion, um, influence, whatever you want. But we need to make sure that constitutional law stands above all. Number one, protect the American citizen. Everything is great until it's not. And it doesn't matter what it is. It could be this. It could be something else, but we don't need any more um Islam. Nothing good has come from it since I got out of college. Nothing. Correct me if I'm wrong. Any questions. So until we have Sharia law, we I can contact um my legislators and get this in front of this the legislation here in South Carolina to get something on the docket to ban Sharia law or any of its um whatever. Um then uh table this, cancel it, wait till we get that to to provide protection for women and children and Americans here. and we insist on instilling congressional law and not allowing the potential for here's the big problem. This piece of land, these five acres, what's going to stop them to saying we are going to go ahead and um try to make this a

Good afternoon, commissioners. My name is John and I live at 9748 Black Horse Run Road in Indian Land. I got six points I want to bring up to the council. This is what I ask you to think about, not religion. Because in America, where I fought for it, three times in Iraq, one time in Afghanistan, we allow all religions here. That aside, my problems with the mosque where it is proposed to be is the current zoning, low density residential. When they purchased that property, it was low density residential. They did so with the forethought that if you want to have a place of worship, you would have to change the zoning. They knew what they were buying. That that area is meant for houses and residents, not places of worship. An existing structure. I saw on the the chart over there that according to Lancaster Water District, no review is needed. With the existing structure, does the mosque plan to tear down the house and rebuild? If so, you got to add new structure. and therefore a review will be needed. Hearing the gentleman speak earlier, they want to put in 100 parking spots. Can we really afford more traffic on Harrisburg Road with 100 parking spots? What if it grows? What if it goes to a thousand parking spots? Can we afford that? I didn't like the ride down here from Indian Land. Took me a little bit. Why pick a spot as a place of worship in between two existing homes? Where I live at, I live near a bunch of homes. And if somebody were to put up a church, a mosque, whatever, where my neighbor's house was, I'd be pretty upset. I live where I live because I
live there and I want to live there. If I want to go to a place of worship, I'll go there. It's not for my neighborhood. Has a change to property values? Has a study been completed, conducted, or even thought about this? Places of warship will affect property values. I'm also worried about traffic concerns. Like I mentioned, traffic's already bad enough on 521 where I live at in Indian land. Can't imagine the traffic that's going to happen in Harrisburg. Lastly, and this is probably the biggest question I have because quick Google search doesn't really tell you much. Who is Waxlin Investment LLC? Who's funding this? Hello. Um, my name is Martha Ray. I'm nervous. and I live uh at 11507 Carolina Acres Road. And um my concern um about this assembly is the traffic. Um, I moved on Caroline Eric Road about 8 years ago and I have two beautiful dogs that I walk and it was so lovely every day to walk those dogs and just have a few cars, you know, as a cut through because Carolina Acres Road is between Barberville and Harrisburg. And it was so lovely that that's why I bought the house is because I would have a place that I could walk my dogs. I still walk my dogs, but it's very dangerously now because the traffic is 10 times or maybe 20 times what it was in Harrisburg. Oh Lord, that's something else. Uh if you've ever driven into Pineville on a Friday and you come up to the moss that is taking place, um it's very disturbing. And one of the reasons that I saw that it was very disturbing before they hired or the sheriff's department got involved is they had personal people directing traffic. And the personal people of the mosque would let the people of the mosque go in. But the people that were traveling Harrisburg that were just bystanders, they made us wait. They made us stand and wait for these people to go into the mosque. And I don't know this is fact because I've not checked it, but I've been told there's over 2,000 to 4,000 cars that pass in there on a Friday. And I believe that because it's a lot of traffic. Um, you know, we're just asking you to help us make our community safe. And by making our community safe is controlling
the traffic. You guys did a wonderful job of taking the intersection of Harrisburg and Barberville and putting new traffic lights in and putting new turn signals in and that has been tremendous and we I thank you for that. You know, that has helped so much. So, if you will just politely consider that this particular property and the people around it that you keep this a neighborhood and these people can live their lovely lives and not have to worry about something outside of that. Um, I want to start by saying we want to be good neighbors, too. And I think we've been good neighbors to everybody who has moved into the Harrisburg Road area in the past 10, 15, 20 years. We've seen substantial growth. I have lived there in this particular area for almost 30 years. I'm a lifong Indian land resident. So I've seen all the growth. I've felt all the pain and I've paid all the taxes that go along with it. So um I think it's important though my faith stands on its own. So how I believe about their religion and my religion is irrelevant here. I want to speak to facts. Okay. So, I'm going to start by saying strictly uh focused on this particular property for the intensity that's being proposed. My primary concern is the traffic and safety on Harrisburg Road. Um this road is not designed to handle a high volume with regular gatherings. Um the traffic coming in and out of there is dangerous. Um I've seen it with the neighborhoods. Um the mosque that is there now currently is about 1.8 8 miles between this particular location and with the neighborhoods and the mosques that are there, pulling out of Macalpine Circle onto Harrisburg is like playing Russian roulette and it is not safe for our families or our friends who try to come and visit. I am also concerned about the parking. I travel this road for work and for religious purposes. I mean, my church is in route coming back and forth, and I do that multiple times a week. And there are very few times that I do not sit in
traffic on this road in this area or see horrible accidents. There is something else that we've not considered. It's not been spoken about tonight, and that is a new school that is opening up just north of the mosque that presently exists. We're going to We don't even know what that impact's going to be. We can only imagine. New drivers, young drivers, unskilled drivers. I think we're putting our families and our neighbors at tremendous risk when we bring the flow of traffic greater than what it already is. I think that we need to halt further commercial, business, church, whatever they want to call it, even housing developments. We've got to pause and take a break and let our community catch up. Hi, Don Cummings, 9674 Black Welder Road, Indian Land, South Carolina 29707. Uh, as far as the mosque being built, it doesn't matter if it's a mosque or a church. But I want to tell everybody here when they are talking about traffic, they are not wrong. You guys have reszoned a house at the corner of a black welder and 160 has a church, a Chinese church. There is a church less than a football field away. Anytime they have services because of the lack of parking spaces, because it's a home. What was that? If you just lift it up a little bit, it's there. That better? Yes.
Because it is a home, they don't have much parking. They have a driveway, which results in taxis, Ubers being lined up on Black Welder, which is barely a two-lane road. So, when you have these cars lined up and you're trying to get out and people are trying to get in, it causes a problem. It has caused accidents down there. Had I known about that one, I would have been here just the same as whether it's a mosque or whether it's a church of any kind. We are already overwhelmed. Like one of the reasons I wasn't able to sign the papers, I said just traffic getting here was 4550 minutes. When I bought my house, I I moved from North Carolina over to here because it was closer to my job. I am less than seven miles from my job. 2019 through 2021, it took me less than 15 minutes to get there and back. That time now takes 30 to 45 minutes to go seven miles. I travel on Barberville Road where the school is going, where we have the Chinese church right almost across the street on the corner from the light. You have the school going up. You have other churches put up and now they want to put a mosque. We cannot take anymore as a community. I have been begging I, you know, I reach out to different people with Facebook groups. I think that we need to incorporate Indian land so we have some control because you guys are just allowing everything to go up because somebody put in an application. At some point, somebody has to say no. And I think that's why a lot of us are here. We can't take any more churches. We can't take any more schools. We can't until the infrastructure itself is fixed. We are building on a broken system that is going to continuously get worse. We haven't even figured out how to time the lights on these roads where we have quadrupled the traffic. You go from one red light to the next red light. I come off a black welder road, I
make a left and a right to go on to Barberville just to get to that light. Takes 10 to 15 minutes because I can't get across the traffic. And then when you get into the middle lane, now you got to figure a way to get in it. We're we're overwhelmed and we are begging for this to stop. I think the whole community would agree. Whether it's a mosque, another shopping center, if it's deemed for a home, it should be built for a home. End of discussion. Thank you for your time.

Lancaster County is a community deeply shaped by Christian values, values of human dignity, equality before God and law, liberty of conscience, and self-governance under a secular constitution derived from we the people. Our county's rich heritage reflected in its Amish, Menanite, Evangelical, and other Christian traditions. As stewards of our community's character, we must thoughtfully consider whether reszoning this land for a mosque aligns with these foundational principles. A mosque functions not only as a place of worship, but as an institution advancing Islamic teachings drawn from the Quran and the Sunnah. These teachings assert the supremacy of divine Sharia law, a comprehensive system encompassing governance, family relations, and Islamic societal norms. Quran 5:44 for instance states those who do not judge by what Allah has revealed are among the unbelievers underscoring that ultimate sovereignty belongs to Allah rather than human legislation. In contrast, Christian informed Western tradition as embodied in America's founding documents affirms that legitimate government derives from the consent of the governed with rights endowed by a creator yet protected through secular law that applies equally to all. This framework upholds equality of persons as in Galatians 3:28, liberty of conscience reflected in the voluntary nature of faith in the gospel where authority flows from the people under a constitution that separates a classical from political power. Empirical patterns in regions from substantial Muslim populations illustrate these doctrinal tensions. Pew research surveys across dozens of countries show that majorities of Muslims in many areas favor making Sharia law the official law of the land,
including 99% in Afghanistan, 91% in Iraq, 84% in Pakistan, 86% in Malaysia, and 82% in Bangladesh. In parts of Europe, studies document integration challenges, including higher rates of certain crimes among non-western immigrant groups. broader or beyond these broader considerations, there are important secular planning reasons to deny this resoning request. The proposed site, as many people have said tonight, at 1093 Harrisburg Road, lies in a low density residential area surrounded by single family homes. Converting it to a place of assembly would introduce inconsistent land use generates generate increased traffic flow on Harrisburg Road, especially during pre peak prayer times. And creating parking demands that the limited on-site provisions may not adequately address, potentially affecting neighborhood safety and character. An existing mosque just 1.8 miles north on the same road has already raised similar traffic and safety concerns for residents. As we heard tonight, we can and should uphold religious liberty for all peaceful citizens while pro prudently safeguarding the distinct values and planned characteristic that defines our community. I respectfully urge the board to vote against this recommen recommendation of resoning. Thank you.

Trisha Hunt. Hello, my name is Trisha Hunt. I live at 10879 Valley Hills Drive, Fort Millian Land, South Carolina. And that address is at Patterson Plantation, which is which is in sight of this property. There are 10 homes in that community. I also speak for the homeowners association in that community. We at this time cannot already get in and out of our community as it stands. There was a traffic light installed right down Harrisburg Road which is making the situation even worse. The lights aren't timed correctly. The traffic backs up all the way past Valley Hills Road where I live. Um so that's one thing. and in agreement with the traffic situation and the area is residential. We've known the people or the man that owned all of that property at one point and he made it conditional on all those acres. Um all that land is five acre properties and no other thing could be built on that and that's a different discussion. Um, but aside from the traffic and the residential, um, the biggest thing that I think that has not been brought up is the security that this causes, the security risk that this causes. And I work in the high security environment with ASUS and with the Department of Defense. As a matter of fact, tomorrow at this time, I will be in Washington DC at Quantico speaking with the Navy on concern on security risk. And I can tell you that religious
assembly areas, but and especially mosques are our risk and our targets for them saying that they want to be good neighbors, etc. we had any any information on how they intend to secure not only their property in the mosque but also the the residences nearby because if people are going to go and try to terrorize that mosque in any way, whose property are they going to go through to do so? If the mosque does things like um perimeter security fences, um ballards, um any kind of intrusion detection systems, etc., that's going to leave our property at even more of a risk. And so, I would like to bring that up. The high security risk this brings to a residential area, it's not been addressed to us at all. Um, also when this notice was given out, I did call the county. Nobody on Valley Hill drives or a lot of other people didn't receive it. We got that notification from neighbors passing it to other neighbors and that's why we're all here. My name is Adrien Kroger. I live at 11183 McFalls Drive, Indianland, South Carolina. I'm reading from the site Islamic Valley.com. There are approximately 5,000 Muslims living in Charlotte, North Carolina. A significant number of these Muslims live in South Charlotte where there is no permanent mahed with enclosed vicinity. Recognizing this gap, South Musala was established in 1995 in a rental miniature golf space to have Friday Kutaba prayers. Since its establishment, South Masala has moved to three different locations due to the terminations of lease and community growth. Community growth. This led to our current development of a permanent Mahed and associated other facilities. The work of this permanent Islamic community center in South Charlotte has now begun with the purchase of a 4acre land to serve Muslim facilities residing in South Charlotte. The address listed there is 1048 Gant Road, Fort Mill, South Carolina, which is off Harrisburg Road. A gentleman who spoke to you earlier today started off what he was saying, saying there was no current mosque to serve the Muslim community. According to this website, there are 5,000 Muslims who are being served by this mosque, which is less than two miles away from the Kwan. discussing people have already discussed the traffic issues. I'm not going to beat up a dead horse. There is there is currently a facility to serve them. It does currently cause traffic issues. Is it going to get any better? The second question I'd ask you is, can you trust someone who comes up here and has a falsehood to start off the rest of their presentation? He said there would be no more spaces. There would be no call to prayer. However, he also said there was no current mosque. If you can't trust the very first thing out of his mouth, what else can't you trust? Would you trust me if I told you there was no Walmart on 521? If I told you that there was no Chick-fil-A on 521, would you believe anything else I said? I asked the board please deny this

I was not at the workshop meeting as I was out of town. So, as soon as I got back into town, I drove past the property because the uh even with all the great support materials from staff, you can't tell what anything looks like until you look at it with your own eyes. And as I approached the area in this uh residential area and saw this property between these two houses, I just immediately said this is not a location for a place of assembly. And therefore, I could not vote for it because it just is not suitable for any place of assembly in the middle of a neighborhood.

Um I'm fully aware of the traffic we experience in Indian Land, especially on this road. Um, I'm also concerned knowing that in the future, um, there's a potential school to be built adjacent to this property and I'm not, um, I just don't think that it fits with what we already know is coming to the area or the existing area.
Um, I agree with the other commissioners. Uh, I don't think it's a good location. uh it's incompatible um with what's suited there right now. It I think it's an awful lot to ask um to go from a low density rural area to um 100 parking lots on a 4 acre with a potential of growth of that. Um I just think it's incompatible with the with the the growth area. I mean because there is no room for growth. um the concern of the cemetery, you know, before that's even looked at. I mean, that is uh huge.
Um that needs to be looked at before it even moves on in my opinion. Um to make sure that that is or is not there. Um and also um what the other gentleman brought up about the uh Charale law, you know, I mean I think that that should be something that we could the constitution and the potential growth of the low density. Okay, this is what I got wrote down. The low density residential area. When I did the calculations on it in the in the area that we have, it would be like 20 20 cars per acre, you know, and it's just too much. So, um, it basically would be suited at a different location.
Yeah. I wanted to make comments. So, and I said this at the last county council meeting in 2005, Clemson Institute did a residential fiscal impact assessment study along with strong Thurman Institute of Government and Public Affairs. They told us that Lancaster County could not sustain this kind of growth financially and or otherwise in 2026. We are living this in real time. It is not good. I totally hear what everybody is saying about traffic, about roads, about And listen, I I'm I'm not This has nothing to do I love people. I'm that that's not the issue. The issue here is overgrowth. It is sewer, traffic, infrastructure that we are just not in a place that we can continue to sustain, you know, overdevelopment. That's that's where I stand.
Anyone else? Right. I'd like to make uh my comments. I I have a question for staff. Um you said that Lancaster County and sewer did not have to on this. So is is there public water and sewer on Harrisburg Road
for this parcel? I'm not I'm not sure because they advised the reason that they gave the no review needed was because this is strictly a review of the conditional use permit. Of course, if that permit was granted, they would go into the civil construction drawing stage. And then, of course, the water sewer district would be a part of that review and they would have to meet whatever conditions that the district imposed. And is there any credence to a potential cemetery on this piece of property? I'm not familiar. Okay. Like I those are my two questions. So, thank you. Yeah. Yeah. It won't. Yeah. If it's septic, it's I don't know if it can handle the capacity of they're wanting sed would assess that. Yes, like I said, yeah, that's that's for later down the line.

Um I would just like to comment. Um I've heard what y'all said. Um I have actually several Muslim friends. Um I reached out to them and questioned them about because like I said, I'm not familiar with the mosque and how it works and how the the services work and how many they have. But I reached out to them and all three of them told me that every Islamic worship center in the Charlotte area is overcrowded and has traffic problems. It's not all the time, but on the couple of the really really high holidays y'all have that it's it's it's it's a problem. So, and um I've looked at where this area is is I I also went and drove by the area. I made sure I went at like a peak traffic time just to see what the traffic was. And this is a very heavily congested area. It is almost primarily residential. Um my church is literally a couple of blocks from here. We have residences on three sides and then we have the Lancaster County High School track on the other side of our church. And those things actually influence us. Um there's a Hispanic family that lives directly across from our church that on Sunday mornings they celebrate and they plow play loud music and we hear it inside our church. So sometimes it's not just the church adversely affecting the community. Sometimes the existing community just living their normal lives are going to affect the church. And this doesn't matter whether it's a mosque or a Baptist church or a Lutheran church or or whatever it is. And so I tried to look at this from all the different angles and and see it from different viewpoints. And I just don't think um this is a good location to make a a a place of worship in this heavy residential area. So, like I said, try to do my due diligence, but I just I don't think it's a it's a good fit for this area for a lot of reasons. It's not going to be good for the neighbors. Um it's going to negatively impact traffic, which is already bad in this area.

It's currently zone GB. It's surrounded by transitional districts MDR and GB and rural districts uh MH which are manufactured home. Your chart there of course shows your surrounding zoning districts as well as the way that they're currently being used. Uh this application of course has UDO provisions and procedures that are detailed in chapter 9. Those are attached to the packet if you'd like to review those to to confirm that those have been met. The red outline is the property he is he would like to acquire from the owner who lives um to the northwest of him which is Paws in the Panhandle. Both Mr. Freeman and Pause in the Panhandle made the application together. Let me look at this. Is this going to work? Mara, can you

So, there's the the zoning map showing the relative zoning. Mr. Freeman's parcel again on Flint Drive is zoned medium density residential. The parcel for owned by Paws in the panhandle behind him in green is zoned LDR and just north of that in the gray is the main Paws in the panhandle parcel which has GB commercial zoning. The green parcel there owned by Paws in the Panhandle does not have road access. So in your packet, the photographs that I included were of Mr. Freeman's property because there is no access to either post a sign or take a photo of the property in green. The LDR property is currently vacant and wooded and they're not asking for reasonzoning of the entire parcel. Mr. Freeman has engaged a surveyor to create a survey which the proposed plat is included in your packet. He has taken the necessary steps to have that reviewed. Um, we cannot confirm and approve the plat to conjoin the property until this this application. And if this application is approved, we did have a question about the tail end of the green parcel being cut off. We did require as part of the minor subdivision application that pause and the panel owner provide a statement that they can provide access to that piece if needed through their their general business parcel, but also in they informed us that they are looking to sell that parcel to Langster County Water and Sewer District as part of their requirements for this water and sewer extension to Shiloh Woods, which is nearby to the west. So that that question has been answered through the minor subdivision process um approval

Y if you'd like to single out certain ones you would not like on that list, you may do so.
That's what I'm thinking. I'm I'm not comfortable with just saying yes, I would like to see all these on the list because I don't agree with some of them being on the list. I I understand completely and I from what I understand in years past that's just what the process has been so that they've been in consideration but again you may do what what I guess I don't want to dilute my first vote adding the other ones to ones that I seriously question I said it's a suggestion if y'all want to just submit these 10 we will just submit these 10 I mean that is what I would like to that was that was the motion that I made out of six and it is that's the motion that I made and it's been voted and accepted so we would have to amend the motion.
Oh, no. I I I support yours and just because I feel strongly about some of these, I didn't want to just say, "Oh, yes, let's tell them, okay, we want these on there, too." As one one commissioner, there are some that I just Right. Right. And just for clarity sake, this would not be a part of the motion and the vote you've already taken. Right. Okay. This is a separate um Okay. separate recommendation which would drop those projects into the category with the pre so the projects that you saw this year that you saw last year. Yep. They did not re receive appropriate appropriated funds. They were they still exist in an unfunded state. You're essentially just taking the the balance of those projects and adding them to that unfunded state. Yeah.
If you if you recall when we looked at the list, a lot of them were on the list last year and they were on the list the year before. So, it's just kind of rolling them over, hoping eventually that they will get funding and some of them I just don't agree. They're not rolled over if we don't do this vote or am I So, they would not be recommended to be rolled over. I see. It would still be a county council action to add them to the tenure CIP in any state. All right. Let me ask him a question first. Um, the fire rescue, I just want to ask this. uh the Riverchase Development Agreement Fire Station and then the other fire rescue is fire service training uh county training center. Yes, ma'am.
The one is in one the the first one is just is in Riverchase, right? And then this one would cover the whole county. Right. So the the the county currently as I understand it and Mr. Player unfortunately is not here to explain this project to you and this was his um kind of his brainchild. the county would have its own fire training center for county uh for use county use but right now it it's not to my knowledge there's not a fire training center I cannot say what fire trainings are done in in the county currently okay that's very important too maybe in future but that's very important well they might be they're probably sending them to other they might be other counties they might be
that that's my understanding but again I I can't say to what degree it's a little far, but I've done work at the Meckllinburgg County Fire Training Center and it's awesome. I know. Mr. Excuse me. Uh, Administrator Willis has a comment. I I have not spoken to Chief Nicholson and exactly, you know, all the details and everything, but from the pictures and general discussion, what they're looking at is a live fire training center. So, it gives training for them and gets rid of a piece something on my property that I don't want. But I've already harvested the old heart of pinewood out of it, though. So I meant we're back on trying to get things going again and get it moving forward.
