Whereas a delay has occurred under the contract between the Town of Lakeville and Phoenix Fabricators and Directors LLC, dated October 2, 2023, and whereas in lieu of being assessed liquidated damages under the contract, the company has offered to complete certain additional projects to benefit the town's waterworks at no cost to the town. In August 21st, 2023, the Town Council and the Town of Lakeville adopted bond ordinance number 202308, authorizing the issuance of the Water Works Taxable Revenue Bond Series 2023. For the improvements and extensions to the Water Works, the Water Works being defined therein as the Town's Municipal Water Works Utility System. And whereas the bond ordinance authorized the issuance of the bonds for the Lakeville water system in the amount of $9,500,000 and the sales of the bonds was successfully closed September 29th, 2023. I'll make that motion. I will second. All those in favor? Aye.

And the certificate that Jacqueline signed should be attached to that.

So this is just showing that we're moving the money from one thing to another to be able to okay the...

It's not really moving it even, it's just saying if there's money left over... Yeah, we know there's there, we're using it for this.

And if we're using it for an allowed purpose, we would have to pass it this way because we've already approved it on their end as well. That was the big... That figuring out was the closest estimate of what was left. Right. Was what it was waiting on. We have a couple more things from the DLZ, but they are here to explain that.

So with the water tower project, we had a general contingency built in. So that way, if there was any small changes that had to be made, there was a small pool money that could be used.

One of the changes we are making is we're at inviting the logo facing the town, the east side. So we got a quote for that and everything. It's within the money we have available in the general contingency allowance. So it's just to authorize to use the funding that we already have built into the contract to pay for that.

Yeah, explain this one. Sure. So since the projects came in under budget, you know, we have really good contractors working on the projects.

They've done a good job.

So about, it's about three quarters of a million under budget right now. So SRF wants us to look at, you know, there's other projects that we can do.

You know,

Tom's got to do a percent interest loan on all of this.

So we applied to SRF, did a preliminary engineering report last winter, and they approved it for a couple additional projects to be completed, you know, that are needed. And then some of those, so we did that report.

We designed a couple of those already. Some of them was the replacement of the water valves at the treatment plant. I'm working with peerless on upgrades to the SCADA system. So it's everything, the communication is better for Joe on the phone and then you can see what's going on. You know, remotely being able to sensor everything. And then there's more distribution type projects. So there's water main replacement projects that there's some small Niagara water mains that are going to be replaced to improve water quality. And then there's a plastic stretch of water main that's in the ground now that's not standard.

So that's going to get replaced as part of that. So we've been doing those designs on that.

Those projects will bid later on this winter, kind of in December. And then the projects will be awarded in December, January, right, completed by August of next year. um the supplemental agreement would be to decide to apply for that uh in the report to complete the design and survey and all that but to be clear all of those projects are what they just approved those two things that they have yeah that's right yeah correct this is for the engineering and then just and then just for like the inspection of the projects that's right so yeah this is the engineering side right those projects that were

So for people watching online on Facebook, I'm just going to run down some of the things that this will cover. So it covers the development of the preliminary engineering report, amendment number one, a survey, design of hydrant replacements, design of Lake Street water main and abandonment of water services within adjacent alley. Design of Grand Street water main and abandonment of the water services within an adjacent alley. Design of Lake Street water main replacement. Design of water treatment plant valve replacement. Coordination of water treatment plant filter media replacement. And SEADA system upgrades not funded through the SRF program. permitting of water infrastructure improvements, bid-based services, construction administration, period construction observation, and professional labor standard services. This will just help us cover things that were not covered before, since we have access money from the water project. So all of those towards anything water, basically. I guess we'll go ahead and ask to go ahead with the DLZ list of additional projects. I'm going to ask for a motion to go ahead and okay. We just okayed everything else. We just did it. Then we go the following year from 28 to 29 as 1830 per home. And then in 29, it goes up one more time to 1939. And that's just with increases per inflation, I would suppose, right?

You know, like whatever our... Yeah, your current contract had a 4% increase years one, two, and three. This has a 4%, a 5%, and a 6%. Okay. Things have changed a little bit. And that is trash and recycling like we're doing now. The only thing we did different was we put in that we would include one 30-yard roll-out box for your spring cleanup. That's nice. Jack and we talked about that a little bit and maybe controlling that a little bit better. So just a little added value there for you guys.

Thank you. Very nice. So I heard that we, I did read that we had a complaint. I read through all of that. Yeah, this is some of that HOA.

Yeah, so I was, so I wasn't in uniform today until, um, meeting. So tomorrow when I'm in New York, I'll go over there and talk to her and just explain the process. Every lot in there is sold now. They are well beyond where they can form their own HOA. So I'll explain that to her.

It's really time. We waited for them to do that for a long time.

So yeah, they would have to, but there's several of the residents that do not want an HOA. So there's a couple of them that do complain a lot, but when it was brought up to them, that they could form an HOA because they were past that 80%. They did not want an HOA.

It's the types of complaints. The things that are going on are actually HOA issues and not actual talent issues on our book. So, yeah. Okay. Let's see. So we're ready for Joe. All right.

All right. We did get all of our, the tower mains reconnected and everything and redone. Put a new hydrant up on the hill. So that is all complete, tested and good. So we're done there. One thing I wanted to, I missed on this. We did also get the hydrant replaced behind the tilted table a couple of weeks ago. So that one is all, they just threw that in under there. So that one is complete. We did on, I think it was Monday, May 22nd, we started, we did two of the filters and got the, for that week, we got the new media in and everything. And those tested fine and they're back online now. The other two were kind of, may not be until all the restoration is done, asphalt and everything is complete down there. They're going to be starting concrete sometime this week, I believe. So trying to get in to do that. It'll probably be a bunch of that before we get those. Unless something changes and we're able to get them scheduled in earlier.

I know Jacqueline sent out, her generators sent out an email a couple weeks ago. And nobody responded.

So basically what has happened is Banner, they installed them. They've serviced them. So Banner has sold out. They've stolen to another. And the guy that was coming down is the only guy that's ever done anything

Yes. So we signed a contract at the beginning of the year for two services on a generator, spring and fall, to come in and check them. With them selling out, they never came in and did the spring one, but sent me a bill or an invoice for both spring and fall. So I said, no. I said, we're already half the year. Send me an invoice for the fall one and we'll skip the spring one. Well, so I got a new invoice, but it's now still higher than for, instead of cutting the bill in half, it's still higher. So that kind of irritated me. So Bridge, which is the one that was let go from Banner, he is still doing He's still certified under Cummins to do these. And that was my question, was he's going to be doing this, he would be doing it on an individual basis. I know we did it 1099-4 probably, but is there anything else that would not, he would be able to do these?

Would there be a guide to me? I don't think it makes a difference as long as he's licensed.

Yeah, he doesn't have a company name. He's just going to be doing it as a site.

This is an annual renew every year. I have not renewed it. They sent me an invoice, but I didn't sign it because it's more expensive for one service than for two. And then Rich got a hold of me and said he will still do them at what they were charging us, but I wanted to make sure the board was okay with that.

We're, concrete's, concrete's coming for, they haven't been in to seed anything yet, so it's, it's drunk grade. Right. But they're, they're supposed to be starting to get all the concrete in. Okay. I don't believe they have a date yet on painting. I don't believe. No. So, That's what's next. Thank you. Everything's coming along, but we're kind of locked off on the one drive because it's all dug out. I've been driving around every week to see what else is different over there. It's getting there, but with all the water and everything else, it's slowing everything else up also. The last thing I got is on the fire department water. Okay. I'm frustrated now. After our last meeting, I had a call from one of the guys was here, right? Ron. Ron. To come over and talk to him at the fire station that he was going to be doing all of the... Splits. Splits, everything. So I went over there. Kelly was there. Uh-huh. At the same field, we all gotta work together, which I agree, we gotta work together, but it seems like it's only the town wants to work together. So everything, I didn't bring any of this up at the last meeting because I thought we could work it out between the fire department and the utilities, but obviously not. I'm just gonna say everything that has been going on and then we can rebut whatever we want.

But the one slip here that didn't get turned in originally, but then got brought in and, you know, I asked about it, you know, they put 700 gallons down for usage, but there's 2,000 gallon port of tank and a truck that's sitting there full and they're filling their tanker. To me, that's 2,000 gallons, but it's 700. Okay. I explained to you why that's 700. This is, let me finish. Then we flushed hydrants on May 12th and 13th. So it would have been May 13th. They was up at the Union Hall. And a week before, they used the hydrant up there again because we found their equipment up there that they left. No slip. June 5th, got a picture of the truck at a hydrant that was sent to me. okay no slip for the hydrant uh june 25th another that we were hooked to a hydrant no slip okay i i don't understand why we can come over and fill a parade slip out be in the parade but we can't turn in a water slip to the water department i do not understand that so this is i understand i'm bringing it to you guys i'm hearing you so That's all I've got to say about it.

Welfare check on Miller Road. An assault at Clearwater Trailer Park. Overdose, State Road 331. Rollover crash on Shively Road. A disturbance at Potato Creek State Park. Suicidal person, State Road 931. Crash on Pierce Road. Disturbance on Miller Road. Traffic hazard, Pine Road. Alarm at Hoosier Tire. Domestic battery in progress that was up at Roycroft. A medical assist on Stanton Road, a welfare check on Stanton Road, and then a fight in progress on Lucinda Street. We had one assist to North Liberty Police Department that was a domestic on Ruble Street. Had a total of 13 reports for the month. We had two assisting outside agency reports, one domestic battery, three driving while suspended, two crashed. reports, death investigation, criminal information, DUI, theft report, fraud report. Of that, we had six arrests, one arrest domestic battery, three arrests for driving while suspended, DWS, one DUI and one fraud. Had a total of 12 tickets written for the month. Of that, had two local ordinance violations. Um, did have a very successful and eventful 4th of July, despite all the rain on Saturday. Um, and already received lots of good compliments on the parade. A lot of people were especially talking about what we'll build marching band. Three groups from the school being in our parade. A lot of comments about how many people were there and everything. So we only had one incident at Newton park. Uh, that was just right before the fireworks where I called up there for extremely intoxicated. individual that was threatening other people there and I did have to make an arrest on that. Um, and then the other thing, and I don't have it on that, but the one thing we will need to do, we will need to have on, uh, Saturday, August 15th. Um, we will need to block Harrison street from Michigan street to South main street. Approximately from two o'clock to 7 PM. Um, Lakeville Brew Crew, Always Wagging, and Vinyl Lid Light and Shop Kennels will be helping out with a fundraiser for Kids for Canines on that day, which would be from 3 to 7 p.m. What date was that again? Saturday, August 15th. Okay. So Lakeville Brew Crew is going to be donating from beer sales. We're going to have silent auction items. Of course, food as well, which will be at-will donations. There'll be some, Dr. Lisa Booth, she's a veterinarian, she'll be there talking about canine CPR, first aid. It's a not-for-profit that she does, and she donates the medical kits to police departments, canine handlers. Always wagging, had gotten one when she came to get the training. She donates for the fire department for specialized equipment.

So that'll get Saturday, August 15th from 3 to 7 p.m. it off right there at Michigan Street. So that will allow people to actually walk back to Portland. Okay.

It was a fun day, and I think everybody seemed really happy, and I think, like, for me, with everything going on in the world, everybody seemed stressed, that it was nice to see everyone coming together for a common good feeling day, right? Like, it was great to be an American on that day. I think that's great. So, anyways, thank you to everyone, including all the people at home that came out, and all of the businesses that came and included themselves. And wow, at Michael Ridge campground, the amount of golf cars that we had. And so thank you very much to everyone from the bottom of my heart. And I know Lori really worked her tush off. We have a price on that. So she's working steady. We, she did recap the resurface, the trails behind the barn. Really a nice, nice job. We used fine fillings, fillings for, it's a real smooth, there's no big rocks or anything anymore. It's just like a carpet almost. You know, that's all done. So she's moving on with her stuff. EDC, I don't have much. Patrick probably knows about. We're concerned about the building downtown. Okay. The old fire. I mean, the old car dealer. Right. Working towards that. We're working towards doing something to the dairy bar. I don't know if the sisters ever get together to do something. Okay. On that. Okay. down by the hills, a lot across the street from the hills, all mowed. It's looking really nice. We're getting ready to build a couple picnic tables down there that people can maybe utilize. So we'll be figuring out how to keep them from getting sold. But the hill, we're struggling to find somebody to mow the grassy hill. We had so much rain in the springtime, it washed out some of us. We had to do that. So we'll find somebody to do that.

Fire chief, do we have anything?

So last month we had a total of 37 runs, 21 medical, two fires, two electrical hazards, four motor accidents, and three fire alarms. And then last month we did the hot dog days. We served roughly 300 hot dogs to the public for free. We wasn't asking nothing from them. It was just, you know, The hot dogs were donated to us. That's nice. Some other stuff was donated to us. So, you know, we put it out for free. And this Saturday, we're having cars and coffee at the firehouse. So if anybody wants to bring their cars, trucks, bikes.

I have a machine called a tone patcher. I don't know who's in charge of the street department here. Do you know what a tone patcher is? I got your cards and stuff, but I was on vacation. be driving a few times on the way home when I see all the cars that went to work today. It's an asphalt emulsion machine that takes tack material, it's called AE90, and shoots it with number 11 limestone. You can rebuild the shoulders of the road, broken, allocated areas, and potholes. It's a permanent fix, and you can drive on it immediately.

A lot of your counties and your states own them because it costs $100,000, $120,000.

I grew up here in La Paz, Lakeville, so I'm just trying to up off the town and save some money because a two-foot pothole costs me a hundred dollars to fill. Where, you know, you got a guy growing up getting hot necks or cold patched and then bringing it back and then compacting it and then it's just, it's a fraction of the cost. It's still just permanent. So where at in the past did you have it under your, can you remember it? Yeah, it's right across the, from the church downtown.
