That item is BAV26-01, an application submitted by Carl Allison, owner of Gateway Prescription Center, Inc. of Florida Corporation, requesting a variance as authorized under section 3.2 of the City of Lake City Land Development Regulations, as amended, providing for a variance as provided for in section 4.10.7 10.7 of the city of Lake City land development regulations to reduce the westside yard setback requirement from 20 feet to 5 feet within a residential slashoff or RO zoning district on certain lands within the corporate limits of the city of Lake City, Florida. Um Madam Chair, the purpose of the following procedure is to ensure an applicant provides a complete presentation of their request to the board prior to any testimony being provided by staff. So the applicant receives a full and fair hearing on their application and any decision by the board is based on evidence presented. All public testimony will be taken under oath and everyone subject to cross-examination. Now to accomplish this, we're going to proceed in the following order. First presentations from the city, the applicant, and any party interveners, followed by public comment, then cross-examination, any additional response by participants. If the chairman uh determines that it is uh necessary to ensure fairness, we'll then proceed to questions from the board and then hear final arguments from the parties and interveners. I'll advise the board as to law and necessary findings and the board can deliberate and vote. Uh Florida law requires the board's decision uh in quasi judicial actions be supported by competent substantial evidence presented to the board of adjustment during the hearing on the application. competent and substantial evidence is evidence a reasonable mind would accept is adequate to support a conclusion. At this time, I need to inquire of each board member individually if they've received any exparte communications involving this matter and if so to disclose them. Exparte communications are communications with uh individuals that have occurred outside of the formality of this meeting tonight. Uh starting at the end of the DAS, uh Mr. Carluchi, have you had any exparte communications?

Um, board members, you have before you propose resolution number BAV2601, which states, "A resolution of the board of adjustment of the city of Lake City, Florida, granting a variance as authorized under section 3.2 two of the city of Lake City land development regulations as amended providing for variance as provided for in section 410.7 of the city of Lake City land development regulations to reduce the west side yard setback requirements from 20 ft to 5t within a residential office zoning district on certain lands within the corporate limits of the city of Lake City Florida repealing all resolutions in conflict and providing an effective date. Thank you, Mr. Angelo. All right. So before you tonight, you have a variance. It's V26-01. It's for a parcel number 13637-0000 and is located in a residential office zoning district. Applicant is seeking an approval to um from the board of adjustments for the variance to reduce the minimum setback from 20 ft to 5 ft and a residential office zoning district. The parcel is surrounded um by the foling future land uses on the north. it's a residential office. To the east it's uh commercial general. To the south you have residential single family 2 and then to the west you have residential office and there is a map of the location. Um the parcel is highlighted there in orange there. This is the proposed site and that setback would be off to the side over here in the residential office. um building department um verification that accessory structure maintains a minimum clearance of all building uh plan review on plan uh on the building plan review. No other comments at this time. Um customer service said additional impact fees um may be uh required if the if the building will assess water and sewer services locates must be attained to ensure that the existing utilities are not obstructed or damaged. Uh, Swany River Water Management said that the permit is require a Swany River water management permit is required if the total impervious area does not exceed um 9,000 ft or will not be required if it exceeds 9,000 ft or does not exceed 9,000 ft and 4,000 square ft of um square footage of the building and um staff finds that the cons is consistent with the comprehensive plan and land development regulations. Therefore, staff recommends to approve um resolution number BAV26-01. At this time, we have no other comments.
