Ladies and gentlemen, the Lake City Council has opened its public meeting and since 1968, the city code has prohibited any person from making personal, impertinent, or slanderous remarks or becoming boisterous while addressing the city council. Yelling or making audible comments from the audience, constitutes boisterous conduct. Such conduct will not be tolerated. There is only one approved manner of addressing the city council and that is to be recognized and then to speak from the podium. Hi, my name is Linda Andrews. I live at 366 Southwest St. John Street here in Lake City. And I want to talk to you about an historical building that the city owns at 338 North Marian Street. It was a bank at one time and uh it's now part of the parcel that was bought when the Millennium Bank was bought. Customer services and the the Millennium Bank building. Now I think that we should and I went to the public u property appraisers office and saw what the city owns for property. There's a lot that the city owns for property and a lot of it's not being used and some of these vacant lots out on Turner Road and other places could be sold and used to make money to build the new city hall. And I think that that historic building there would be a wonderful place to start. We own the property. We own the property in back and around and on the side. There's a big fenced in area that's kept mowed by the city. There would be a lovely parking lot for the new city hall there. Um the front of the building, the B bank building, I would consider to be the city council meeting because the front do is just too accessible. The would make other entrances to the bank as we included different areas of uh the city in there, different departments. But, uh, that would be a lovely place to have a city council meeting right in that historic building and make it a proud part of the the county and the city and, uh, our Lake City. Um, I don't know what else to tell you. It's got plenty of parking. It's it's accessible. It's yours and it's historic. And I think that you should improve it and use it and expand it and put that new city hall in the old historic building and behind it. Thank you very much.

Thank you, your honor. Good evening. I uh have a couple of comments about the consent agenda. Doesn't seem that there's any rules in Lake City more anymore about consent agendas. [clears throat] Stuff just goes willy-nilly on here regardless of the monetary amount. I'm looking at item number two is an item worth almost a million dollars. You know, that may be some change for some people, but in this day and age, that appears to be a lot of money. and why you're approving something for a million dollars on a consent agenda where the public doesn't even read them is uh is not very good for transparency. I understand that it's there. The stuff is not read by title and the title should be enough to identify objects and amounts. While you have the amount here, there's other things that could be here, but clearly with you accepting a million dollars to do something on SR47 that should be really really be on a regular agenda so people could easily get to the backup material. I know the backup material is there but people don't breeze through consent agendas. Consent agendas are for minutes and ministerial [clears throat] tasks. Your honor, if you think spending a million dollars or accepting a million dollars is a ministerial task, I would respectfully uh point you towards what went on at Florida Crown when you were chairman and the amount of audits that they had there, which is still stuff that's being straightened out. This this is wrong and it should not be there. The other thing that I'll bring up in my extra couple of seconds is these titles, well, I guess that's what you would call a title. Each one of

these resolutions is the title. I'm not very descriptive. They have extraneous words like certain findings of fact and all sorts of stuff that if you look at the way Mr. Derby did it, who was legendary in Florida and America. Just put what it was. And if you look at the way High Springs did it, where FS and Walker was their attorney and uh I guess the the chief guy over there goes there quite a bit, you would see that they don't do what you guys do here. Even though your city attorney is from Folds and Walker, I don't see you there anymore, so I guess they jettisoned you with the Jetsum and Flatsom. But nobody does that except Lake City. I have never seen titles like this and maybe you guys can instruct me different where you put extraneous baloney words instead of meaningful information that would inform the public about what you're doing. And I would say, and I'll just finish my sentence, that this has been going on for some time and I would respectfully request that you guys change it both out of respect for yourselves and respect for the citizens of Lake City. Mr. Even though you didn't put your name on it. Sylvester Warren. My address is the black community. I will first start with Noah Walker who has been a failure at every chair position you have held and most recently the destruction of career source. You sit there with the gavvel and arrogance and think you have some real power when you are no more than a figurehead. You think you are superior entitled. You disregard the constitution. The city attorney Klay Martin aid you and others on the dasis and management to violate the act of 1983 that was codified and he fails to address these violations and unethical behaviors as a mandated reporter. News flash, the real power, superiority, and color that matters in this country is green, which in comparison to me, you will be considered a welfare case. James Carter, to you, who tried to come across as a voice of reason, but your actions became hypocritical last council meeting. You asked for people to lean on the better side of angels, but you turned around and used profanity at your leisure. In the same meeting, Noah said no more cuss words were permitted, but in council comments,

you used profanity and nor thanked you. I guess being friends and golfing buddies allow you more leeway. Lastly, we thought we had a historical moment in electing the first black majority city council in the history of Lake City, Florida. However, it was short-lived and those black elected officials and black managers lied and reiged on the campaign promises to their people. This black council and management has nothing to show for how they have made their people and community better off with the 80 plus million dollar budget. That said, I present each black elected official here tonight and manager with what is called the Haywood Shepard Award coined by Dr. Claude Anderson highly recognizing black sellouts as yourselves. Thank you Mr. Mayor. Members of the council, you have before you tonight two matters that must be considered in a quasi judicial manner. Uh the first is ordinance on first reading is ordinance 2026 2349 for application AX25-07 an ordinance considering an application for voluntary annexation submitted by Lake City 47 LLC. And the second uh matter is on second reading and it is ordinance number 2025-2315 which is an ordinance amending the official zoning atlas pursuant to application Z2503 submitted by Carol Chadwick as agent for Florida First Coast Investment Corporation the property owner. The purpose of tonight's procedure as you know to make is to make sure that everyone that is participating uh receives a fair and full uh hearing on the application and the evidence presented. Uh we'll proceed in the following order. First presentations from the city of the applicant and party interveners followed by public comment then cross-examination. Uh any additional uh response by participants if the mayor allows then questions from the council followed by final arguments from the parties and interveners. [clears throat] I will then advise the council as to law and necessary findings and then the council will uh deliberate and vote. Uh while the council w uh welcomes uh comments from all persons with an interest in the proceeding Florida law requires the council's decision in quasa judicial actions be supported by competent substantial evidence presented to the city council during the hearing on the application. Competent substantial evidence is evidence a reasonable mind would accept as adequate to support a conclusion. There must be factual basis in the record to support opinion testimony from both expert and non-expert witnesses. People presenting testimony may support their testimony by relying on factual information provided by city staff, the applicant, or other information in the city staff report. Uh, at this time, I need to inquire of each council member individually if they've received any exparte

communications involving any of these matters, and if so, please disclose them. Uh, starting at the end of the DISA, Councilwoman Young, have you had any uh, expparte communications? I have not. No. Let the record reflect that each council member indicated that they had not received any exparte communications. At this time, uh if anyone's here to present information on these two applications, if you could uh stand and uh take an oath to tell the truth. Uh, council members, you know, before you proposed ordinance 2026 2349 on first reading, which states, an ordinance of the city of Lake City, Florida, pursuant to petition number ANX 25507, submitted by Lake City 47 LLC, a Florida limited liability company, relating to voluntary annexation, annexing certain real property located in Columbia County, Florida, which is reasonably compact and to the boundaries of the city of Lake City, Florida, making certain findings effect and support thereof, providing severability, repealing all ordinances in conflict, and providing an effective date. At this time, Mr. Angelo, could you please introduce, summarize, and present the proposed ordinance 2026 uh 2349 and following the presentation, should you desire, move the application and presentation and evidence.

Thank you. All right. So, this is annex or annexation 257. There we go. All right. So, this is an application um has been requested to annex in partial number 0888-1-0000. This parcel is located within the joint planning area and municipal service area um commonly known as the joint um or the cornerstone planning area. This is the joint planning agreement that we entered into with the Columbia County um that is out by the Highway 47 area. So, this is the parcel that we're looking to annex in um as a larger part of a development. And this is the highway 47 um and um I75 interchange. The city of Lake City adopted the interlocal service boundary agreement joint planning agreement area um with the Columbia County on December 15th. Um and the Columbia County adopted the um the interlocal service boundary agreement on December 18th. And therefore, S's recommendation is to approve ordinance number 20252349. And this time, I'd like to move my presentation and all staff reports into the record.

So, if you look at this map, your honor, I mean, the reason, one of the reasons I came down here tonight was to address this issue because I got phone calls about it. If you look at the map, you look all this area on the top is Lake City. This is the part that's annexed over the bottom. Does not say Columbia County there. However, uh if you look at the ordinance, it says this is being annexed into the boundaries of the city of Lake City, Florida. Mr. Martin, if you take a look at that, it's on page three of the agenda. But this is not within the boundaries of the city of Lake City as you can all see clearly by looking at the map. And Mr. Carter is acknowledging that by the smile on his face. Nobody else wants to look at the map because they don't want to be caught smiling. The city manager bites his lip. Uh it's clearly not in the city of Lake City. I'm not exactly sure and I'll have to research exactly what this stuff is. I guess what happened was there was a city planner that came to the city of Lake City and came up with this and then the county jumped on the bandwagon. None of the things have been worked out about police protection, fire protection, all those things. This is something that clearly could have been done by an interlocal agreement. And if it can't be done by that, maybe the city manager or the attorney could tell the public why. But this is clearly not being annexed into the boundaries of the city of Lake City, which it says here, and it says which is reasonably compact. And Lake City, if you look at that map,

really isn't reasonably compact. It's not compact at all. And people have been trying to straighten out the boundaries of Lake City, particularly along US90 for years. So that this is, you know, void ebonio. It's it's unless the city attorney can explain to this city council why this is in Lake City and it's not, I think this needs to be started all over again. Thank you, Mr. Loker. Thank you very much, your honor. From my understanding, this is this is all part of the ISBA that we adopted in our last meeting. It's in local service agreement and all those areas, police, fire, all that's been covered.

Thank you. Thank you, Mr. Rosenthal. All right, Mr. Martin. Uh, yes, Mr. Mayor. Uh, if mayor would like, I can uh elaborate a little further on the ISBA since this is our first annexation and some people may not be familiar with it. Sure.

Okay. Uh so uh chapter 171 of Florida statutes [clears throat] is the statute that addresses annexations in Florida. Part one of that statute is what I would consider or call the traditional methods of annexation where uh the statute requires that properties we annex be contiguous to the existing city boundaries uh as a condition of them being annexed. Uh I believe it was in the mid 201s or early 201s. I could be off by a couple of years. Uh the state legislature amended that statute and added part two to chapter 171. Part two created the concept of what is called uh the interlocal service boundary agreement uh provision. And what it allows is for a municipality in and by agreement with the county uh to delineate an area that is not contiguous to the existing city boundaries uh and uh by agreement with the county uh to uh to devise a method by which property owners in that area that's delineated can annex into uh the city. Notwithstanding that the properties are not contiguous. Uh the statute requires the city and the county to set forth the ways that the property owners in that area are going to be provided services whether it be by the county or by the city but it's done by agreement. Uh in this case uh through the months of November and December the city and the county uh went through the process of uh adopting the ordinance as required by chapter 2 of or section two of uh of chapter 171. both adopted the uh the ISBA as required by that statute and adopted it by ordinance. And uh this property is properly within the area

that is defined within that ordinance that allows the city to uh to annex properties that are not contiguous to the city limits of the city. Uh and so that that is the the the means, method and and legal basis for which the city is annexing this property. I will say that to my knowledge, we're only Colombia County uh is one of only maybe four or five counties in the [clears throat] state that is exercising this. Uh Columbia County does, Valuchia County is using it. Sumpter County is using it in conjunction with the city of Bushnell. Uh and I've heard anecdotally there may be a couple of cities in the south, but I think north of I4 we're we're the three that are doing it. Um, I've been contacted by attorneys for other municipalities in North Florida that are aware of what we've done and and they're looking at doing it themselves. So, uh, the, uh, the that that's the basis for what we're doing.

At this time, the council may discuss the ordinance, any findings of fact, uh, and adopt proposed ordinance 2026-2349, following an appropriate motion and second. Thank you, Mr. Martin. Uh, Mr. Angelo, if you could introduce, summarize, and present the ordinance, and uh, move any information into the record as you so desire.

Yes. All right. So this is the mixeduse um zoning district that we're adding in. Just as a just a real quick recap. So a mixed use is just that it's just mixing the uses into one area versus uklitian type of a zoning where you've got separate uses in each area. And so the benefit to the community is you get economic growth, infrastructure savings, um increased property values, community spaces, and land utilization. Um this is what you could see kind of in a typical mixeduse where you got residential office, retail, entertainment, um all in the same area. Um some key points to kind of take away from this is in the text amendment that you see um the maximum um or maximized residential density of 40 dwelling units per acre. Um minimum uh single family lot size is down to 3600 square feet within that uh mixeduse zoning area. And then you'll have a minimum residential non single family lot size of 7200 square feet in it. Um and then alcoholic beverage um establishment is permitted in um MU1 and MU2. And then truck and bus maintenance facilities will be permitted in um only in MU2 which is kind of an industrial and residential mixed area. And that's it.

All right. So this is LDR2504. Um so the current building height for all residential and commercial districts in the city right now is 35 feet. Um this was adopted in 2008. Um we worked with the building official and the fire chief to see what height the fire department can safely operate at. And um and we settled in at 85 ft is kind of where we settled in at. Um, so in the RMF, RMO, um, or RORO and the C, uh, C, uh, CBD, uh, zoning districts, we recommend 85 ft unless a development is contiguous to a residential single family zoning district. If they are contiguous to a residential single family zoning district, then will not be able to exceed 35 ft. So, this will help protect some of the single family zoning subdivisions and stuff like that by not having a a 85 foot tall building right next to subdivision. And um and the CGCI, CHI, and IL, and the industrial um we are recommending to go to an 85 ft and um on height. Um why is this important to Lake City? Um there are numerous buildings in Lake City that exceed this height and are currently non-conforming. Um, a lot of the hotels that we have in the area are a lot taller than 35 feet and um, we want to update our LDR to be consistent with other jurisdictions and to try to um, make as many of our structures uh, conforming. Um, other jurisdictions around the area um, building heights, Columbia County is at 70 ft. Um, Gainesville is 14 stories in special districts, eight stories in all other districts. And um, and then St. Augustine is at 60 ft. And at this time, staff recommends to approve LDR2504.
