Yes, this is case number 26476, an application for short-term rental approval for the property located at 630 North Sioux Avenue. That property is located on the west side of Jones Road, south of Bunshu and north of Salisbury in the Farview Heights subdivision. Up on the slide is a zoning district map showing the surrounding subdivision and the zoning classification. So the site is surrounded by single family zoning districts and the homes were built approximately the same time period and they have similar characteristics in age and design. The particular property, is approximately 7,840 square feet in size. County records indicate that the dwelling was constructed in 1977 and encloses approximately 900 square feet of living area. It consists of split level architecture with a two car tuck under garage for two vehicles. Here's a picture of the front facade showing that split level architecture. and a street level view looking northbound down Sioux Avenue and southbound. See the neighborhood consists of lots that are approximately 65 feet in width. They have, again, similar characteristics, age, and design. Here's a floor plan showing the three bedrooms for guests. parking plan showing the two-car garage and additional off-street parking in the driveway and The application complies with the separation requirements required by city code so there are no short-term rentals within 500 feet of the application tonight Staff does recommend approval of the application with the standard conditions for approval. So there's three bedrooms, two adults per bedroom for a total of six adults. That concludes my presentation for tonight. If you have any questions, I'm available.

So I'm Marshall Bear, I'm the father of Isabella, she's out of town right now. So they are being very careful with doing their best to comply with everything. They have a lot of security cameras that are going up. They have active noise monitoring technology. They are actively monitoring those alerts. The people that are managing it, they live about six minutes away, so just in case something goes on, they can take care of it. They want to make sure that they're very much on top of it. The guests are very carefully screened before they arrive. They have to have two instances where they sign agreement to all the rules, which are no parties, no events, registered guests only, no unauthorized visitors, no smoking, quiet hours, maximum two guest vehicles, no street parking, but I guess it's okay. Exterior security cameras in operation and immediate removal for serious violations. So they're taking that very seriously. And, um, yeah, so they want to make sure that, uh, that they're, that they're complying with everything as best possible.
I did hear that they, uh, operated during FIFA.

I would love to hear some feedback. How did that go?
Oh, they've got, um, it went well, as far as I understand. Uh, they got five star reviews and, uh, waited until they got the business license until they started operating that. It went well. There was one, uh, small issue with the, grass not being mowed in time, they switched lawn care companies to make sure that they were consistent with that. So they're taking care of that.

So the owner is... She's a manager of the property. Okay. She's renting the property and then renting it out in turn for short-term rental. So she's doing long-term rental and renting it out again for short-term rental.
So Isabel rents it right now?
Yes. So she rents it in order to have the ability to run the property. So she doesn't own it. And then she rents it out through Airbnb.
So Gerald's the one that owns it?
Gerald, I'm not sure who Gerald is, but it sounds right.
Staff, help me out here. Can they do a rental on top of rental?
So this application is simply for the operations of a short-term rental. Whether or not the property owner permits subletting a property to other individuals, that would be the prerogative of the property owner. So The application was submitted by Isabella with Gentle Landing Homes to operate a short-term rental at the property. So that would be the decision that you make tonight.
Well, then my question is going to be, so the owner doesn't have to approve?
The owner has agreed to that. They were very careful to make sure that there was perfect understanding.
Okay, so the owner does agree to it then. Okay. I mean, it's a rental on top of a rental. I wouldn't like a house if I only got rented out like that. So that's why I'm trying to figure out what the deal is.

Can I ask staff, did you know that the property owner approved it?
So on the application, Gerald Warren Brock was listed as the property owner. However, our contact has been with the applicant Isabella so it was our understanding that you know the property owner listed on the application was in approval of the operations of a short-term rental and Isabella was a representative for the the property owner on this application but I personally have not had contact with Gerald myself
So what's the city stand on that? I mean, they don't care.
Yeah. Again, this is a land use question. So, you know, it's a, the prerogative is up to the property owner and the, and the applicant. It'd be similar to a commercial tenant operating a business. There's a property owner that leases out a commercial space to a tenant and, you know, whatever business the tenant operates out of the commercial space, you know, that would be the negotiations or a lease agreement. It would be a civil agreement between those two parties.
Sir, I'm not trying to submarine this. I'm just trying to find out why the city isn't more actively involved in finding out if the property owner is okay with it. Is it because... Is it because legally it's not your problem?
Ultimately, when the application comes in, they do have to list the property owners. As Gabe mentioned, it's really the applicant's responsibility to make sure that the property owner is okay with that if that's part of their lease agreement. Again, we don't manage that civil interaction with that.
Well, I just am a little surprised, but what do I know? But that's why I'm asking questions from the attorneys. Like saying, yeah, that's okay. Right?
Yeah. I think the analogy to a commercial space is a good one for understanding how this works. It would be, if it's against the lease agreement that she has with the property owner, then that would be a civil matter between the property owner and herself. rather than involving the city in that private civil matter. We're just regulating whether or not she's operating a short-term rental and making sure that she complies with our requirements that are set out in the city code.
Okay. And I'm just remembering back to our last meeting when somebody was trying to do that, and the HOA board came in and said she can't do that because it's against the bylaws. So I guess as long as you guys feel comfortable with... Just taking the word of somebody for that, that's okay. Like I said, I'm just clarifying. I was just a little surprised.
Yeah. The HOA bylaws, policing that agreement also is the private matter. That's not necessarily the city's responsibility to make sure that every single property abides by their HOA bylaws. That's, again, the private matter between the property owner or the person running the short-term rental and the HOA. similar to the property owner and the tenant who's running the short-term rental in this case.
So I'm assuming in this process there's a line on the application that says the property owner is okay with you doing this.
I would defer to the city of what the contents of the application is. I've seen the documents in the packet, and I see that the property owner is listed, but I don't see that it says affirmatively they consent.
Okay, well. I think it would be a good question to ask, just to make sure you have no liability. Well, yeah, he said that. But they didn't ask.

Good evening, I'm Teresa Johnson. I have lived at my home since 1999 during the entire time time the property at 630 North Sioux has been a rental and There have been ongoing issues with both tenants and mainly the landlord Now there is a proposal to turn this property into a short-term rental. I strongly oppose that request I The property is already not being properly maintained. It is not being taken care of as a long-term rental. I have serious concerns it will be maintained any better for a short-term rental. I'm also concerned about the impact this will have on my neighborhood. A short-term rental next door could reduce the value of my property and make it much more difficult for me to sell my home in the future. I chose this neighborhood because it's a residential community, not a place with a revolving door for short-term guests. I have photographs showing the current condition the property and I would like for you to consider them as part of your decision. Please do not approve this request for a short-term rental. I respectfully ask that you protect the character of our neighborhood and entrance of the residents that are there year-round. Thank you.

No, different tenants. We've had domestic violence. We've had people changing oil out in the driveway with a large barrel collecting the oil. We've had domestic abuse and police there. The property needs some help.

Oh, I'm sorry. They did come out that night later on about 8, 9 o'clock with four girls and a man. They all had weed eaters, lawnmowers, and they mowed up until it was past dark.

Sure. Marshall Bear again. So my daughter has recently acquired this contract to rent this home. So she's very new with this. So anything that's happened in the past is irrelevant. Short-term rentals I don't think are going to be changing oil in the driveway. They are doing their best to make sure that they keep on top of landscaping, and they want it to be as attractive as possible for their advertising and the satisfaction of the guests. And so they're keeping on top of the landscaping that way. If there's anything that's not how it should be looking, they're doing their best to make sure it does look good. They want to be as compliant and as possible with the city and also making sure that everybody's happy as much as possible. So yeah, they're doing their best to do that. So anyway, everything that was mentioned, all the violence, abuse, would have been in the past and irrelevant for today.

Uh, she's had it for, I think about two months or so. Oh, she's only had it for two months rental. Maybe three. I'm not sure exactly, but yeah.
So in other words, she's rent, she rented it to rerented it right off the bat.

Okay. So that's what she planned on doing. Um, I guess it's total furnished inside, correct? Yes. Okay. I'm, I'm, it's, What does she think is going to happen now that FIFA is gone? Does she plan? I mean, this neighborhood doesn't seem so far out there. I guess I don't get short-term rentals way out that way. So I don't understand. Does she plan on it working?
Yeah, she's hoping to rent it out as an Airbnb.

Oh, yeah, I haven't been there for a month or so. So I'm not aware of the tree. But if that's an issue, they'll take care of it. They definitely want to make sure that it looks good.

No. We did receive a call about the tall weeds at the property. So we notified the applicant and they agreed to go out and do some yard work. So I assume that was the response. Sounds like same day they were able to make it out there and clean it up.

Staff, she's a renter, so... If the short-term rental thing doesn't work out, can she go back to leasing it out as a long-term, or does one exclude the other, or are they mutually, how does that work?
So if there's a business operator who's leasing out a property for periods of time longer than 30 days, they would obtain a landlord license, and in this case, it could be a sublet agreement where, you know, There's an agreement between the landlord and, in this case, maybe you could consider it a property manager or some lease agreement. So that's completely within the possibility at this property if they could change their business operations and sublet it out to a tenant for periods of time longer than 30 days.
Staff, can they have both licensed at the same time?
So there have been previous cases where that's been permitted. There is a case, must have been a month or two ago now, that there is a property owner, in that case a property owner, who leased out the property to, I believe it was insurance claims. So, you know, families that were suffering a loss of their home. And so they were, you know, staying at a rental home or that particular home for longer than 30 days. And so they were operating that property in that way. And they also requested approval for a short-term rental. And Essentially, a short-term rental is a period of time less than 30 days. So the landlord and tenant code does not apply to the operations of a short-term rental because that occupant hasn't established that legal tenancy. So there is precedent. for that if they do choose to discontinue short-term rental operations. The requirement would just be that they obtain a landlord license.
But we would never know that.
The city does have business license compliance officers in the regulated industries division so while you know we may not catch every landlord that's operating without a license we do have city staff that that work daily on on obtaining compliance from from property owners and landlords okay my question would be then if she's running a short-term rental we're getting tax money from it correct That's correct.
And if she doesn't rent it out, when they go to a landlord, we get no tax money. So you should be able to see if she doesn't pay any tax money. Is that something we look at or is that something we don't do? I don't know.
Not typically. The transient guest tax collected from short-term rentals is self-reported from business operators. So that's something that business operators should be doing on a monthly basis. However, that's not typically how city staff are encountering business operators or people Those are generally handled on a case-by-case basis for rental properties and independence. Okay.

One thing I would make a comment here is that on a short-term rental versus a long-term rental. They do seem to keep the upkeep better on the outside because they want it to look good. That's the only thing I can tell you about on the short-term rental. I mean, yes, you don't know what people are being rented there or do that, but that's just a gamble you're going to take even on a long-term rental. And you said this house has been a rental for 26 years, 27 years, so you never know what you're going to get. So that's just what my opinion is on it.

All righty. This is case 26477. The same applicant, Isabella Bayer with Gentile Landing Homes, is requesting short-term rental approval for a property at 17101 East Berry Lane. This is a property on the east side of 291 Highway, south of 23rd Street, north of Hidden Valley Road. The properties in this subdivision were developed in the 50s, and it's a neighborhood that's zoned single-family residential and abuts a commercial corridor along 291 Highway. The particular property in question is comprised of two tax parcels that total approximately 28,500 square feet in size together. county records indicate that the dwelling was constructed in 1958 and the dwelling encloses approximately a thousand two hundred and fifty square feet of living area it's a similar construction to the previous application so it's split level architecture and with a tuck under garage And here's street level imagery looking northwest towards 291 Highway and south. Here's a floor plan for the proposed short-term rental showing three bedrooms, the main level. And the parking plan showing the two-car garage and the off-street parking in the driveway. And lastly, proximity map showing the nearest short-term rental. So to the west across 291 Highway, there are two existing short-term rentals, and this application complies with the 500-foot separation requirement required by city code. So staff do recommend approval of this application with three bedrooms and a maximum of six adult guests. That concludes my presentation.
Okay, now that we know that this is actually a business model where somebody has a business, it sounds like they've gone to different landlords and said, hey, I'll manage your short-term rentals. And then they come up with an agreement. It kind of makes more sense now. But has this one been operating with FIFA or anything before going through this process?
And the commission probably remembers this case coming up back in March. At that time, the business operator had been operating without a permit in violation of city code. And at that point in time, the commission recommended that the business operator obtain approval during the FIFA World Cup. because that is an administrative approval and is permitted by right for that 60-day window. So in that case, the business operator did follow through with that FIFA World Cup temporary short-term rental permit. So they have been operating for the past year. Approximately 60 days under that temporary permit have been, you know, complied with all the use regulations, got their noise monitoring device, fire inspection from the fire department. So just like what you had asked, yes, they have been operating under a permit this time.

Yeah, so it does appear to be a local entity, and the property owner listed is Lonnie Bernard New Earth Properties, so a local LLC that owns several properties around town and just like with the previous application, an agreement between the business operator, Gentle Landings Homes, and the property owner. Okay.

Hello again. So Marshall Bear, 19315 Mulkey Road. So, yeah, so there was an incident, as you all know, might remember from last time, there was an isolated party incident. And that was before they had security cameras installed. So, again, they want to make sure that they're following everything as best as possible. They weren't at the beginning. They were not aware of the specifics with the business license. They're very sorry for not following that. but they want to make sure that they're doing their best to follow that. So with that party incident, the police were never called. No one was injured. It was a single isolated incident, and nothing similar has happened since. They have a lot of all five-star reviews since during the FIFA time. And so once they learned about the mistake that they made, They're changing the practices. They're making they're being very careful to comply with the city's requirements Following the hearing they waited until they had the short-term rental license before operating then they did operate during that period So what's changed they put exterior security cameras up for to look at the front entrance the driveway the backyard and the rear entrance and The management receives motion alerts, and they're reviewed within minutes. They also invested in some pretty good, expensive noise monitoring technology, and so they're on top of that. There was one instance where a guest came, and they were there, and they were told that they could have either five or six, I forget what it was, but they noticed that there were two extra people, and they contacted the guest, and they did not leave immediately and so Airbnb contacted them and I think within 12 18 hours they were gone so they're making sure they want to make sure that the rules are being followed again they live just a few minutes away from this home so they can take care of things very soon the maintenance the same company they switched to a different landscaping company to make sure that the The landscaping is being taken care of quickly. Guest screening. Airbnb verifies the guest identities, but then they also do their second screening where they look at guest history and anything. Anybody that doesn't have a good review, they're not accepted. And they have been rejecting people because they want to make sure that there's no issues. If the guests say that they want to have a birthday party, they say no. They want to make sure that there are no parties. And the guests do not receive a door code until they have acknowledged multiple times the house rules, which no parties, no events, registered guests only, no unauthorized visitors, no smoking, quiet hours, maximum two guest vehicles, no street parking, exterior cameras are in operation. So they're being very active with enforcing the rules. And they've had a good experience so far. So that's pretty much it.
Since they were before us before, do you know if they've had any conversations with the neighbors now?
With the neighbors? I believe they told me they were going to bring cookies to everybody, but I don't know if that actually happened.

Yeah. They did want to have a good relationship with everybody. So I don't know what ended up happening, but I know they talked about doing that.

Yeah, I don't think maintenance of the grass has been an issue at this location. I'd say it was that one time. At this location, I don't think it's been an issue. But they're also making sure that they want to They want to follow the noise ordinances and the timing, the quiet hours. Okay.

My name is Jackie Davis. I'm at 1700 Baker Road in Independence, 64057. So I don't live directly on Berry, but Baker and Berry are interconnected. So I am also objecting to a short-term rental in my neighborhood. I was going to say, for me, it's a safety factor. I was going to say I'm a single woman who lives by myself. I don't... I understand that they had the short-term permit during FIFA time. FIFA finished on the 11th. The house has been rented at least four times since then that I have taken photos of. So I don't know how long you extended that FIFA period after the games were stopped, but it has been rented out at least four more times. Maintenance-wise, yes, this house looks much better since it was taken over. I give them full credit for that. However, I was here in March. There is a giant pile of gravel in the driveway. Yes, you can still get two cars in the driveway, but that giant pile of gravel has been there since March that completely blocks at least one of those garage doors that prevents off-street parking. There are two parking spots on the driveway, still yes. So if that's a requirement of the city, that's being met. But it'd be nice if that giant pile of gravel was also taken care of and the rest of the maintenance was done on the property. I was going to say the one side backs up to a large period of woods, which your overhead showed they also own that property. It is very overgrown. I don't know. Even on the street, I was going to say, not just them, the folks on the other side, it's so overgrown that it's not even two car lanes wide getting up and down Barry to where it interconnects with Baker, and it's very dangerous. I walk my dogs up and down that street, and I have to be very careful because the cars coming up and down can't necessarily see you. it would be very nice if they would continue to do the rest of the maintenance that needs to be done in that area because that is their property. Those woods are theirs. They own it. It needs to be cleared out.

So in this case, um, Staff in community development did go out there. It was not me personally in this case. The concerns are noted, and we'll certainly submit a service request and have a code officer take a look at the property. If there's any property maintenance violations, we'll get those addressed, absolutely.

Here is a recent photo of the front facade of the property in question tonight. They weren't permitted to do so As for the yard work that is a major project and the city has already informed us that they are tearing out all the yards and all the sidewalks It's supposed to happen on 4th of July. I guess it's been pushed back a little bit Like I said, I'm not against a short-term rental I think it's Actually probably preferable than a long-term tenant that we might not get along with you know the they've had a lot of guests so far None of them have been unruly. They've all been fine Was a little bit disappointed that we were not told that you know no introduction the house previously was Kind of an eyesore so we saw it being you know redone happy excited Previous tenant didn't have trash service for years. They do. So, I mean, just we're not against it necessarily. But last week, I assume my neighbor finally noticed the sign in the yard, and she is very against it, as is there's a It's a really small space. You see the pictures. I share the front yard and the lady over on C is basically her back. It's like just kind of tucked in there between our two yards. She's against it for different reasons. She has spoken with other neighbors around She actually wanted to sign a petition to officially stop it. She did. She convinced, I would rather advocate for my neighbors who are against it than someone who came in and didn't file the proper permits. So we did collect four petitions, which got us up to 19%, just shy of the 25% threshold that we would need to have pushed it to the council. So, again, not completely against a short-term rental in general. If Mr. Glazer's information was correct that they did not have a permit at all, I do find a problem with that. I think that, you know, it's pretty obvious that you can't just start a business in a neighborhood without letting the city know and, you know, Other short-term rentals are paying fees to get the application, submitting their taxes to the city. They didn't do that until Airbnb was notified that they were operating without a permit. Then a day later, they filed for their permit. Had that not happened, I'm sure that we wouldn't be here right now and they would probably still be operating illegally. And that's it. Thank you.

But we filed this application at the end of April, beginning of June, and there was nothing rented until... until the middle of FIFA. The difference between a landlord license and the short-term rental, and we've discussed this already tonight and in the past, but... The short-term rental operations require a separate business license. Typically, that is addressed after the planning commission hearing and also requires remitting transient guest tax. That being said, those taxes, there's a variety of ways to pay those transient guest taxes, whether that's through a booking platform that has an agreement with the city or or self-reporting that revenue and making payments directly to the finance department. So in this case, city staff are confident that, you know, unfortunately the bookings that have taken place did get canceled. fell under the radar. In this case, again, we're confident that the business operator can comply with the requirements of the city code.
So to clarify, they had a long-term rental? Yes, there is an active landlord license. But did not realize that didn't cover FIFA and kind of just move forward?
That's my understanding.

So as you can tell from our notification area map, you can see the surrounding homes around the Lexington Avenue area there south of and west of Cedar. So this is an area that's zoned R12, two-family residential, although the dominant home usage around there is all single-family, although there's a large community organization, the Northwest Communities Development Corporation, that's across the street to the east. So the lot is... 6,532 square feet in area. The residence, a small home, 916 square feet of living area. The property was platted in 1965 as a two-car driveway that can accommodate four vehicles at least, and one vehicle could legally park on the street as well. So this is the home looking at it straight on here from Cedar. Floor plan here. As you can see, two bedrooms, it's a small home, two bedrooms in the back of the house by the back door. You have a combo living, kitchen, dining area by the front door and a shared bathroom there between. It's not far from Phelps south of 35th Street over toward Lee Summit Road There's a notification area actually it's closer to 33 9th Street as well so You can see the area around the vicinity that was notified within the 185 foot radius. This is a neighborhood that's overwhelmingly around it, zoned R6, dominated by single family homes. Of course, all the neighbors around it are single family homes. This property, it's 8,276 square foot in area or the lot. Residence has 960 square feet of living space. The property was platted in 1960. That's a two-car driveway that can accommodate up to four vehicles, and of course it's got a garage as well, and one vehicle could park in the street. Additionally, this property, according to your staff report, is going to be listed as an Airbnb. The applicant informed me yesterday they plan to expand that to also VRBO. So they are going to have two platforms on which they are going to advertise. So here is the floor plan for the home. You can see one primary bedroom there with its Lone bath for itself and then a common bath for the two other bedrooms and a combined kitchen and dining room and a living room on the top portion of this bi-level home. This is the bottom portion. About half of it is garage as well as the utility area and then a rec room bedroom down below. The fire evacuation plan shows how they simply get out of the front door in this central bi-level stair situation here going out to the front. And this evacuation plan, this is an image actually of the one that Handed you before the meeting that is updated to show the emergency fire Window that's there on the north side of the house And again, here's the parking plan with the two-car garage and a driveway big enough for four vehicles and There we go. Very sensitive. So as far as nearby short-term rentals, there's quite a few to the south. They're along the 39th Street corridor, but it's outside of the required distance. One up. toward Nolan Road, two toward Lee Summit Road, and two immediately to the south around the 39th Street area, and then one up by the railroad tracks up by 35th. So it's no problem just to run over there if I need to, if anything should come up. Essentially, we decided to get into this for the World Cup, but we are in it for the long haul, so we want to keep going. My regular job, I work as a scientist in drug product stability, and my mom is a He also has some long-term rental experience in Blue Springs and Lee's Summit. So we're kind of leveraging everything she's learned in the past. But essentially, we've complied with all the regulations and everything listed on there. We've got multiple smoke detectors, carbon dioxide detectors. We've got the rent eye for the noise monitoring. We do have the ring camera outdoor just for the front door monitoring. We have also asked our guests to do no street parking. And then I might need to clarify, Brian, with you the number of guests. My understanding is we're limited to 10 by the law. So that's kind of what we were going with. But we might have only put eight on the application. So I don't know if we'll have to do anything to fix that. But we do have the four bedrooms. And I think it's two adults per bedroom. And then my understanding is I think kids under five don't count on that. So that is kind of where we would imagine the 10 would come from. We are trying to gear toward families, and we have activities and stuff for children to do, so that's kind of our target audience.

Not so much because it is typically all handled through the app, so you don't really have a lot of interaction with Some of our recent guests have been a little bit more chatty to where we've got to talk to them a little bit. But for the World Cup, we actually had a lot of, I would say, international guests. And I actually think most of the people that stayed with us, I think the language was probably primarily Spanish. and then the app would translate it for us. So I think we did get a lot of international guests. I know we had, like, somebody from Chile, and I know we had some Argentina fans. So I'm not exactly sure, but there wasn't a lot of interaction with the actual World Cup guests.

Well, we're hoping, I mean, we still want to do the short-term rental for the foreseeable future. Um, but yeah, we're kind of trying to target families. I think it's a good location being, you know, less than 15 minutes away from a lot of stuff around, you know, even Kansas city or at least downtown Lee summits, not that far away. Um, so I think we're mostly just trying to target, uh, I mean, sports fans. We do have some people who've come to, for either like Royals games, um, we've got some reservations for that. Or again, like families just wanting to come to the area. We've had some people from Wichita, you know, they were coming down just to kind of get away for the weekend, so sort of like a getaway.
One applicant really impressed me when she said they really rely on the kids' sports games coming in. I know we've got the squirrel softball fields down there. It's not too far on Lee Summit Road, so they get people. Tournaments are coming in from out of town. I don't know if you've got to look into that.
Well, that's a good idea, marketing maybe for more of the tournaments and that sort of thing. Right. It's not something we've really looked into, but it's definitely something we'd be interested, so for sure.
I mean, this looks like a nice home for that application.
Yeah, and it is nice because, yeah, it's right there on Lee Summit Road and 39th Street and 70 Highway, so it is quick access to a lot of different directions.
