Uh, this is a case 2613. Um applicant maximum top off um uh requested action to reszone property from R30PUD that's high density residential planning development to R six uh single family residential. So, as you can tell from the vicinity map here, it could have been or a little bigger. Up there in the northwest part of the city off 24 highway is this location. So, as you can see from the notification map, it's a lot that's uh one block or not one block, but one lot south of 24 highway. And this indicates all those properties along Pawthorne and Overton that are within 185 ft of um western location. So reason being for this um reszoning um there's a the property as you can see by the uh turquoise rectangle is zoned um high density residential. It has a legal non-conforming single family home on it uh that um the applicant is wanting to repair and reoccupy. So you can see that what's um in the surrounding neighborhood, although there's some um multifamily, it's located a little bit up the road to the northeast and to the southwest. Basically, all the properties around there are single family in use. Um
whether they are zoned um R30Ps um or partially um R30P and R12 or of course the neighborhood far to the south is entirely R12 mostly single family homes. However, um comprehensive plan envisions this entire area for uh residential neighborhood land uses. Property was platted as Evston Park additioned in 1885. Uh the home sets on lots 21 and 22 of block one of Evston Park. This is a area of the city that was annexed in 1961. Um in ' 65 we got zoning and it was uh designated R4 for highdensity residential. Um it's remained that zoning this entire time when our new UDO was passed in 2009. Of course, R4 became R30 and that explains the current zoning. Uh, property characteristics. This is a 6,970 square foot lot with a house that's about 623 square ft. And of course, like I said, it's been vacant and lost its u legal non-conforming status. It has a single uh wide uh gravel driveway has not been maintained and has also lost its uh legal non-conforming status. Of course, it will have to be paid. Um the p driveway leads to what is now a dilapidated twocar garage. As far as the characteristics of the neighborhood,
these houses are all little bungalows. this pre-war World War II era on on lots of various sizes. Um, and as you can see, it's uh like some improvements sidewalks this area as well. So, you can see um this is northbound on the left looking toward 24 highway and then uh southbound um on the right there. Um, staff recommends approval of this free zoning and I'll take any questions you may have.

I believe it was a a dangerous had been on the dangerous building list, if I remember correctly. Um, but um they are wanting to rehab the house. They have a permit and permits frozen until we get this resing resolved.
And basically the reason why nobody's ever looked at this before for the R30 because looks like most houses are single residents here. What you show going up and down the road? Yeah, it's it's um the in the past it was envisioned that this area would maybe develop denser than what it has. Um, of course, if you're familiar with um some of these uh areas along 24, we have some commercial areas up in the northwest side of town that, you know, have the within 400 ft or whatever of the rideway, you have um commercial. On this page, you have a sort of corridor, a swath of of multifamily that's 400 or so feet off the rideway. So that's why you have all these lots around there. They're half 30 and half are 12. Now, something like this, should the city be looking at redoing this for the future before they come to problem? Because it goes like to me there's a couple houses maybe they burned down. They wouldn't be able to rebuild. Correct. Yeah. So that this could be a candidate. Yes. For for a city initiative resing one here candidate.

Yes, this is an application for a short-term rental approval to property at 371 South Scott Avenue. The property is located in southwest Independence. So a notification area map as required by city code zoning district map of the subject site surrounding properties showed that the subject sites surrounded by single family subdivisions of similar age characteristics. This parcel is approximately 15,000 square ft in size. County records show the development was constructed in 1955 and encloses approximately 1,000 square feet of living area. The driveway can accommodate up to two cars. It's a single call driveway. The operator does plan to prevent guests to use the garage. So, the rental does comply with the parking standards under city code. It's a picture of the front facade and looking down Scott Avenue towards 37th Street and looking north we can see that neighborhood similar characteristics inside. It's a floor plan of the short-term rental showing uh two bedrooms on the main level and a parking plan of the subject site. Um so paid driveway allows parking vehicles. Here's a vicinity map for the nearest short-term rentals, the proposed short-term rental that's outside of that 50 limitation required by city code
and staff do recommend uh approval of the short-term rental. Looks like I did not include a total of basement. So, so there are two bedrooms in the basement level as well. You'll see the packets and those bedrooms. Staff have confirmed they have problems windows and there's actually a residential building for this house as well. It's just associated.

Um, nothing other than uh it went from a quite the eyesore, I believe. Um, not only that, but it was a high crime house from what we had heard. Um, sitting out this fully remodeled, spent a lot of money. uh pulled all the permits and now we intend to be a good neighbor running a short-term rental. I've got a couple others or I had a couple others. I've got one other in city. I as far as I know never had any complaints on it. All right. Thank you very much. Wait just a moment. There might be some questions for you. Oh, sorry. Commissioners, any questions for the applicant there?
Yes. Commissioner, do you plan on making the driveway wider in the future? Maybe. Uh, we don't have any plans. Um, because you're you're trying to rent it out to four bedrooms. Usually we have at least one parking space per bedroom is what we're asking and you only have three, but you're putting one on the street. That's why I lean towards not a pool because there not enough parking spaces. I mean, yes, you are going to get garage, but most people probably won't park in that garage. It looks like it's probably a 7 by about what? 7 by 15 drive for sure. I think it fit anything except a big truck,
right? So, um that's that's where I'm leaning at. That's it's not enough parking. That's why you plan on putting parking. I don't know. I don't know what the he had learned to do. I saw the tree there. I know it's to the left side. You got the picture left side. And I have to show you the properties. So my opinion is need to have at least two cars attached to the driveway the fast and four bedrooms. That's where I'm at.
Would that put us at five? So two, four in the driveway. Yeah, that put you uh we don't count the street. I mean, you can count the street, but I don't count the street because I don't know how wide the street is there. If it's wide enough for car parks on either side, plus a trash truck or fire truck in the middle, I don't know the width of the street there, but um that's what I would recommend. At least have two more at least four spots if you want to do them out. I don't know what to lay on the backside. They say you do have any grass to get windows for the bedrooms in the basement. Yes. Okay. But that would be my headstone right there. It's not that far. What would you say about that?
Well, I'm not the complete decision maker. I partners on this. Uh so I can't say yes, we'll put a drive. I can't say that right this second. I can't I uh I'd have to I mean I'd have to see what it took, what the bid, what the bid look like, what we have room for. I know there's a tree on the there's a tree on both sides of the driveway, but I mean it's poss it's defin there's room. We can put them there. I just uh can't make that good by myself. Sean, I'm going to go ahead and um have staff remind the commissioners what the parking rule regulations are.
So, I did work with the applicant on this. Um, so just to refer to the plans, the garage is about 11 1/2 ft by 23 ft. So the dimensions can accommodate up to one standard size vehicle. Um, but your your concerns are are noted. Um, the the driveway uh does have enough length to accommodate uh two vehicles without encroaching into the right way. Then of course uh city code does permit uh street parking uh in this case city staff do allow up to one one street parking space uh towards their their required their minimum parking requirements. Beyond that it is the commission's prerogative to make any further requirements or recommendations question.
Yeah. Um since it's on a corner of a lot, we got two streets. Got two lots or one. It's just one lot. Um so it's a space in city street for the water because there's two centers here. That's how we've applied the the uh parking uh street parking standards. But the short-term rental code only allows on street parking. So whether it's either straight It wouldn't really matter. It's just okay. But I'm going to clarify it currently meets with this parking plan required.

So, this is a case by applicant Daniel Robinson in action for a short-term rental at 280 South Vermont Avenue. Um, as you can see from the star there, it's not too far uh from Chile and in the Sterling area to the northeast of that. Um, so we're talking more specifically uh in the block in the middle of the block just north of 29th Street on the west side of Vermont Avenue. And you can see the uh surrounding properties on here in the notification map that are within 185 ft that got notification. As far as a short-term rentals go that are in the vicinity, um the closest is way down by Chris 31st Street as you can see on this map zone map here. Um the the area question is right like I said 20 properties on R12 is single family all around there. Property characteristics. This is 164 of the Inwood View. um a 29 a 29,000 square foot um property or lot with a dwelling that's about,700 square ft uh building uh facade composed of all white siding. It's a
single store story but it has a twocar garage. Um the main floor has master bedroom with a bathroom. Uh two additional bedrooms, a bathroom, living room, kitchen, dining area, laundry room, two bedrooms, and then um a twocar garage. Uh the basement could not be accessible to the guests. So there's it looking at the the one car rideway going up the hill and then leading to that twocar garage that's off to the right hand side of the house. So the property um has must address of course all of these items uh indicate that they will be installing a noise monitoring device. Uh they've indicated their uh trash removal um that is a ua trash service which will be collected on Mondays. Um as well as they'll need to put their rent checklist up and uh get their safety inspections. um the parking plan which they provided we will look into momentarily here. So this is uh Vermont Avenue right in front of that driveway there. You can see the driveway on the right there looking actually it's on the other side. Um it's across the street but this is northbound in Vermont and then southbound. So, here's um their
drawing showing their bedroom out front and and the their participant um same floor uh bedrooms and master bedroom and a twocar garage. And then the escape plan. And then the parking shows uh the driveway from As you saw from the picture, it's a they've got a wide area up by the garage and then it narrows down to very long single car driveway. Um staff recommends approval of the short-term rental with conditions um of note number four and number five be limited um to eight adults 10 um persons total and then the maximum number of veterans obviously are full on park given keep those numbers. So,

Come in out of the weather and clean up. I've dragged mud through the house. Um, yeah, it's a nice property, renovated well. Look forward to renting it out. Have you had any short-term rentals prior? No, I have a couple long-term rentals. Um, one in Kansas City, one I no longer have. Um, but I'd like to try a short-term rental.

Right. This is another application for short-term rental approval. The property at 17101 East Berry Lane. The property is located generally south of 23rd Street on the east side of 291 highway close to schedule. It's a notification area map as required by city code. uh zoning district map of the subject site and surrounding areas shows the commercial district along 291 highway in residential neighborhoods on the east side of 291. Aerial imagery of the property in question. The property is approximately 28,500 ft in size. County records indicate that the dwelling was constructed in 1938. encloses approximately 1,250 square feet of living area and the property is supplied with a twocar wide driveway providing ample parking for vehicles. Here's a picture of the front facade. Uh to note, there is a gravel approach uh to the driveway. The applicant has submitted a a permit application to uh pave that portion of the driveway referred to as the bridge. Some street level imagery uh showing intersection here looking northwest to 291 highway and looking northeast into the residential subdivision. This is a three-way intersection. So, here's a a street level image looking down.
It's a floor plan of the subject site showing uh three bedrooms on the main level. Here's a floor plan of the garage and basement. It's a split level house. So we got stairwells uh going the main level and then the the base parking plan for post short-term rental shows that twocar wide driveway and an additional garage for two units as well. The closest short-term rental is west of this location along road. So there's no concern about density restrictions here. City staff, do you recommend approval uh this application to standard recommendations? And that concludes staff's presentation.

Well, we're business partner. company name was gentle and homes and like our name mentioned our goal is to provide gentle peaceful homes for our guests so that we can improve the neighborhood, help people enjoy the Kansas City area and improve independence. We're both local. I've I actually live six minutes away from the from the property. So, I'm part of the community. that care deeply about the community of um making sure that it's a peaceful community where our guests can learn to appreciate independence and can study area more and we can help the neighborhood look better. We both care a lot about improving independence and we connected to that. Um we mentioned that it doesn't look like the same house. Um so it's had quite a bit of updates recently to improve it. We've also done quite a bit of updating the the driving room's actually just completed today. So, it's still drying, but it is way down. So, we're trying to make it look.
And what about the stairs that Commissioner Bash was asking about? Stairs. Well, it was in the picture like if you look between the trees. Are there stairs there now or? Yeah, I'm just But there wasn't Nope, it was just kind of a Yeah, we recently got his house, so we It got the stairs on us. I think we're we're looking at a picture of 2024 and didn't have stairs. Okay, just the wall.

My name is John Scope. I live at 289 Baker Road. on the house lot uh directly across the street from uh the applicants here. So, um I actually really like Joey and Bella. They've been really nice people. They've done an amazing job in the basement of the house. It looks great compared to what it has been. That said, I do not appreciate the idea of it being a short-term rental. We've already had a couple incidents um in the last month um that put a sour taste in a lot of the neighbor's mouths. Um, it's a really nice, quiet neighborhood. A lot of older couples surrounding myself and in this house here. Um, haven't had an issue, single incident at all in the neighborhood in the two years that I've lived there until they started renting a short term. Um, may I ask a question?
Yes, sir. So, we're here to approve the applicant's request for short-term rental, yet they've already been leasing it out for short term. Is that against the policy? Yeah, I'll let the staff address that. Yeah. So, that would be a a code violation.
Okay. So, that's one thing. Um the very first incident that we had occurred on March 6th. It was a Friday evening. Um I came home and there was a huge and I mean massive party occurring at that house. over 25 or 30 cars surrounding my entire property and the neighboring properties. Um, I couldn't believe it. Like I was a gas jaw drowned. I mean, we've seriously never had any incidents like this in the neighborhood uh since I lived there 2 years. Um, there was high school age, I assume, kids coming in and out of the house, going into their cars, which are parked outside of my property, smoking, drinking, doing whatever they're doing. Um, I have a nine-year-old daughter that lives with me in that house. I don't like the thought of there being random people in and out of that house constantly. There's already been incidents with that. I mean, there's different cars there every day. There's different people there every day. I don't know who's working on that house and who's staying there. It's it's a cluster. Um, another incident occurred uh couple of weeks ago or last or Friday, March, I'm sorry, Saturday, March 14th. Um, there was a couple staying there. They had two dogs. Um, there was a neighbor riding his bike through the neighborhood. The couple opened the door. Their gigantic dog came running out of the house, barking at the biker, chasing him up the street. Again, I have a nine-year-old daughter that lives with me there. I don't want to risk coming outside again to somebody that I don't know who's staying at that property. Um, just generally I I don't like the idea of it being a short-term rental. We have that mentioned there was a short-term rental close to lease on the road that's not even close to that property. Um, we have some other long-term rentals in the neighborhood. Fine. We don't have issues. Um, I like knowing who is
standing next to me, especially having a young daughter to live with me. Um, those are kind of my my great. Thank you. But if you'd like to uh I guess would anyone else like to speak in opposition?

Um and again I will say the maintenance and the upkeep and things great improvement over what it was. Um but I have to rude to this gentleman that they have been running the steps out. I walk my dogs in that neighborhood 6:00 in the morning and there are always a variety of cars early in the morning. So it's already being rented out. The fact that they didn't know that they installed stairs and things like that tells me that they're not truly knowing what's going on at their property. That's a concern. But again, I'm a single woman. I lived in this neighborhood four years ago. Part of the reason I bought the house in the neighborhood I did is because it is older folks or long-term folks. Mine was one of the few houses that did not for sale at the time and things like that. I've got neighbors who've moved in the same neighborhood now for 15 to 20 years easily a couple more even longer than that. I moved there because I wanted that stability. Where I moved from Le Summit, that entire neighborhood turned into rental property within the course of 15 years. And it was no longer safe for me to live there. I moved here to be 70. If you start putting short-term rentals in, I don't think I will feel that way anymore. There's also an issue when it's not rented, that house is vacant. We already have a homeless camp up the street by the school. Who's to say that the homeless aren't going to find out this house is vacant and come down and start moving into this property? One one thought I want to share is that I think a lot of the neighborhoods in Independence are in transition and this neighborhood it's kind of on its way up. I'd say um the house across the street from this one prior to being purchased was kind of the the thing they call the nuisome house. A lot of people keep the company coming and the neighbors were really grateful when the house was stabilized and improved and uh when this house has been improved just working to make it better. Yeah.
Can you please address uh parties prior and not being uh in code please? Yes. I mean we completely understand your concern. Make sure you talk to us.
Sorry. Understand the concern of the neighbors. And we also when we found out about that were livid and I wasn't thinking cameras. We've now installed four cameras, motion sensor detectors. We installed kind we already had a noise monitor detecting system, but we went we went for extremely high tech one that will alert us consistently even close to pushing um out noise levels. Um we've also added additional security measure measures with our staying. So we now only use some states that are have been have positive reviews from this people that they stayed with. If they haven't stayed with allow them to stay, we emphasize this three times. once at booking, once the day before check-in, once the day of check-in. We're now also only allowing two cars on the property just to make sure that there's no on street parking. The party that did happen, the guest had told me that they had two guests that were going to be staying there. And so, they violated our code. um If we do come like if it comes to our attention that guests are violating policies, the security cameras are noise sensors. If we see more than two cards that they have notified us about, then we're going to if they have more than two cards, they can reach out to us about that and put them in the garage. I don't want more than two cards on my house. We can make that very clear. I also want to mention that when they get these messages, they also have to reply to us like, I confirm that we've read these and we've readed these policies. So, it's very clear if we if it comes to our attention that they're violating these policies. I mean, I live six minutes down the road. You know, I'm going to reach out to them that because they violated the policies, they're going their reservation is canceled. They're not allowed to be there. Yes. So we advise applicants of the process to obtain uh business license to operate which which does require planning commission approval uh prior to obtain business license service. So so that information is is available and provided to any applicant. I do want to address the operations of a short-term rental prior to obtaining the permit. I do want to apologize. So, trying to get some more information uh about this property and running into a little bit of tech problems here, but uh so whenever an application does come in to community development, the department does pull police reports on that property. Uh I don't have the exact date uh when the application applied. Um we could refer to the exhibit in your packet. Um so if you refer to the first attachment in your packet the application indicates the date uh February 4th the top line you see so that'll be the first exhibit in your packet after the the stat this is an excerpt from a third party application portal that operators will use to upload their documents. So, our records show on the 4th of February that an application was submitted for short. At that time, uh, city staff again would have pulled police records, uh, checked the, uh, status of of the of the short-term rental. Um, at that time, we did not notice or note any operations, no no reports. Uh so in this case we we wouldn't have advised the network you know to to discontinue
operations because we weren't aware say that operator was operating without a permit and there was a complaint uh submitted to the city at that time the operator would receive a provisional order in accordance with city code to discontin operations. So, so there are processes for uh short-term rental operators operating without the permit to um to go through the enforcement um process. Unfortunately, in this case, this is a case that um sort of flew under the radar,

I didn't get their contact information until the day before this party took place. So I I literally met Joey the and Dan Bella actually at the same time the the day before. So but they've been renting us out forever and I mean seeing all these people come and go. I didn't know who was who. Then they showed up looking professional and I'm like this I was like this has to be the owner or the property manager or somebody. So I took my chance, walked outside and said, "Hey, who are you guys?" And kind of started the conversation and then the very next day this party happens.
Yes. Um yeah, before so we started renting I think was it midfebruary? Can't remember but before that we had a lot of people coming in and out you know for the decor and things like that. So that might have been some of the you were seeing. You guys were definitely renting it out because it was hard stay overnight. So, and I can concur that they were overnight. Yes, I have. I was going to say I talked to a couple of others across the street from me and they wanted my store to me which they're older. So, the short-term rental operator still is required to comply with all the use standards. So, they still have to have their fire inspection. They still have to have the rental ready inspection. um they still have to meet the parking requirements. Uh all of those reviews are done administratively without planning commission approval and the city grants them a temporary business license for six dates to operate during that window from June 1st to July 3rd.

So there is a revotion process that can occur if we continue to get notices of violation. Because we say it's how many times three three well no just three complaints
that can trigger the notification. So and it doesn't have to be a police report per se. It could just be all in staff and get those complaints and if it's become obvious that that is indeed the case of this happening, we can we can issue notification process that comes through just sort of in place for incident or place of time.
So it is two or more offenses in a threemonth period. Alternatively, if the short-term rental operator has violated or is currently vi violating any provision of this chapter that significantly endangers public health, safety, and/or welfare, city staff will bring the applicant, the operator back before the planning commission for a revocation uh proceeding. So, so in that case then the planning commission has the final say whether or not to revoke the the uh approval for the for the user.
