Good evening, ladies and gentlemen. Thank you for attending the Hubbard County Planning Commission Board of Adjustment meeting for Monday, July 27th. Bear with me while I read the meeting procedure. All persons in attendance at the Planning Commission Board of Adjustment, the PCBOA meetings are expected to comply with the following meeting procedure. Thank you in advance for helping make this a manageable meeting. Copies of agenda item materials are available for public viewing on the table located at the back of the meeting room. These materials are not to leave the table so that others in attendance may also view them. Please turn phones to vibrate or off during the meeting and conduct any sidebar conversations outside of the meeting room. Interruption or other interference with the orderly conduct of the PCBOA meeting will not be allowed. Defamatory or abusive remarks are always out of order. Disruptive persons will be removed from the meeting. The chair may terminate a speaker's privilege of address if after being called to order the speaker persists in improper conducts or remarks. Written material concerning agenda items must be submitted to the Environmental Services Department by 3.30 p.m. on the Wednesday immediately prior to the meeting date. Written materials will not be accepted after this deadline or at the meeting because the PCBOA will not have sufficient time to review them prior to the meeting. Such material must state the agenda item for which it is being submitted and the name and address of the submitting party. The Planning Commission business is conducted first followed by the Board of Adjustment business. The chair will call the meeting to order and explain the meeting procedure. The chair will read each agenda item into the record and ask the applicant to come forward to the presenter's table, state his, her or their names and address for the record and explain his, her or their request. The PCBOA will then discuss the agenda item with the applicant. The chair will then ask for public comment on the agenda item and to facilitate an orderly efficient meeting there is a three minute speaking time limit per speaker per agenda item unless the chair allows the speaker additional time. The chair may terminate the speaker's privilege of address if after being called to order the speaker persists in improper conduct or remarks. When the chair recognizes a speaker, she or he may approach the audience podium and microphone, state his or her full name and address for the record, and write such on the speaker log, and then share his or her comments. The audience podium microphone must be used by the recognized speaker because the meeting is recorded. A member of the public may not donate his or her speaking time to another speaker.

If the written comments have been submitted to the PCBOA, please do not read them aloud during the meeting as they are already part of the record and copies thereof have been given to the PCBOA. After everyone wanting to speak on an agenda item has done so, the chair will close the public comment period on the agenda item. No further public comment will be taken after this point. The chair will give the applicant an opportunity to address issues raised during public comment. The PCBOA will then continue its discussion on the agenda item and the chair will entertain a motion on it. The PCBOA will make a motion to pass, deny, or table the item. Once a motion is made and seconded, the PCBOA will develop findings of fact for conditional use permit and variance applications and then vote on the motion. Once a vote is taken on an agenda item, the PCBOA will move on to the next agenda item. Meetings commence at 6 p.m. and continue until all agenda items have been heard or until 10 p.m. No new agenda items shall be considered after 9.45 p.m. The PCBOA may, at its discretion, continue an item that is on the floor at 10 p.m. Any remaining agenda items shall be continued to another date or time, preferably the immediately following Tuesday at 6 p.m., and no further public notice will be provided for such a meeting continuation. The applicant is requesting a variance from Section 704.1H.2 of the Shoreland Management Ordinance from the 100-foot minimum lot width requirement to make a nonconforming lot into an improved lot. This is can just for the record. The the the nonconformance that that forces of variance is the fact that that screened in porch, not the cabinet itself, but the basic screened in porch doesn't meet the 50 foot setback correct correct and it's 1955 so that's illegal nonconforming.

Yeah, our request is to amend the variance that was approved last fall to switch out cap structure D with structure E. I can go further into explaining the rationale if you'd like.

So prior to doing the variance, we never inspected, we didn't do any work on the structures. So after the variance was approved, we started to look into structures even a little bit more, realizing that the structure itself would need probably more significant repairs to the foundation than we were anticipating. We wanted to switch from from that structure to structure D to structure E. Structure E is closer to the water, but it is a smaller structure for a little bit of benefit to the regulations.

I believe the assessment at the time was that in order to get the proper footings, we'd have to go into the ground, which would probably get to the water table pretty quick. I'm not an environmentalist. I don't know the answer of where the water table is exactly, but the floor of the basin is probably three feet above the water, I would think. But we'd have to go pretty deep, I would think, to get the right footings in place, if that makes sense.

That being said, D is three cabin, or three bedrooms, E is two, it's smaller, which would suggest less occupancy in the facility. The shoreline there is all buffered with vegetation. I'm looking for reasons why this might be reasonable, even though it's very much in conflict with what a guest cabin should be. Looking for input from my colleagues here.

Allowing cabin E to remain is a reasonable trade-off since cabin D is unusable. Cabin E is smaller, two bedrooms versus three bedrooms in cabin E. The condition that Cabin E can not be expanded or rebuilt except meeting requirements. These trade-offs make up for it being close to, is in harmony with the intent of still, and still be in the shore impact zone.

The Shoreline Management Ordinance Draft also includes language to grant the Planning Commission final authority on interim use permits. So we can go through the draft and review them and make any edits as you see. It doesn't look like we have any edits until number 5. Did anybody review them and have any questions or comments?
