You might notice Andrew Hockensmith is not here tonight. He's taken a position with Olive Branch. I wish him well, new position over there. I know that in the past, the board has kind of asked for more brief presentations. So I've kind of done an executive summary. We can go in depth into the report whenever you guys want to, but figured I'd just give a executive summary and we can go from there.

All right, so for case 2026-90, it's a request from LaBelle with Allen and Hochul. PLLC for an approved site plan revision at 1005 Kirkendall Lane for the DeSoto County School of Career Tech Center West. Revision is for a new 10,500 square foot building on the existing Tech Center property. The parcel is approximately 51 acres and already contains two existing structures. The proposed building would be north of the existing buildings and include expanded parking area. As noted in the staff report, the property is zoned PUD with adjacent properties along Kirkendall Lane, zoned PUD and AR. The proposed building appears to comply with the required setbacks and easements, and the proposed architectural materials are consistent with the existing buildings on the site. Staff reviewed the site plan for compliance with applicable design parking pedestrian safety requirements proposed parking area generally conforms the required standards and the plan includes pedestrian safety improvements such as a marked crosswalk and expanded sidewalks however the ada parking spaces adjacent to the proposed building are shown as nine feet wide while the minimum requirement is 10 feet because the site plan appears to meet all the applicable requirements, the exception of the ADA parking spaces widths. Staff recommends approval of the site plan on the condition that ADA parking spaces are widened to 10 feet.

I do. I know we have 10 feet on here, but ADA minimum for a van is 11. It's 132 inches. So can we just take that into consideration and maybe have it change to 11 instead of 10 for the van accessibility?
Sure. That can be part of the amended motion or however you guys want to put it. That's just what our city standard was. But if you want to make it 11, that's something you can do as part of the motion.

All right, moving on to our next case. Case number 2026-080 is the final plat for Sage Creek Phase 1. And I will once again turn this over to our planning staff for their report.
All right, so these next two cases are Phase 1 and Phase 2 for Sage Creek. So case 2026-80, press for approval of the final plat for Sage Creek Phase 1. The property is located north side of Goodman Road between Willow Point Drive and Allen Drive. It's currently part of the Sage Creek PUD. Approval of the plat would allow Phase 1 of the development to be recorded and divided into 32 individual single-family residential lots along with the associated streets and infrastructure. It's noted in the staff report surrounding zonings include Willow Point PUD, AR, and R10 zoning to the west with AR zoning to the north and the east. Because the property is already within the SAGE PUD, primary issue tonight is whether it meets the subdivision standards of the city. Staff reviewed the plat for compliance with requirements related to streets, easements, drainage, block and lot design, and public facilities. Based on that review, the plat appears to conform to all applicable standards and includes the necessary layout to support the first phase of development. Because the plat meets the applicable subdivision requirements for development within the approved PUD, recommend approval for the plat phase one.

concerning the plat I Do the the plot that shows how it has the cove and that's in here, is there, has anything been ran by like with the fire department stuff to ensure they can get fire truck in there and get in and out appropriately? Because of where this is, chances are if there's a fire, it's going to come from 301, and they have the really, really big fire truck, the big, long, 100-foot ladder. So are they going to be able to get down this road and be able to manipulate in and out around that cove, or is that going to be an issue? Has that been talked about or addressed?
i know previously like that is we have gone through the planning departments that they've had their review and am i correct to say that fire department has looked at it too as part of the review yeah and the the street streets standards that andrew that we passed earlier this year um those were kind of based off of what the sage creek street design was going to be so that was all done in concert with the fire department and They'll be able to get into the code just fine.

All right, so very similar to the previous case, but this is for phase two. Properties north of Goodman Road between Willow Point Drive and Allen Drive. Part of the Sage Creek PUD and identified by three separate parcels currently. Approval of the plat allows phase two of the development to Be recorded and divided into 46 individual, single family, residential lots along with the associated residential streets and infrastructure. And the staff report surrounding zoning. Like, before is low point P. D. A. R. R. 10, then in the West, they are to the North and East. Property itself is within stage P. U. D. So tonight we're just. seeing if it applies to the subdivision standards. Staff reviewed the plat against the city's subdivision requirements for streets, easements, drainage, block design, lot design, public sites, facilities, and open spaces. Based on the review, the proposed plat appears to conform to the applicable requirements. The submitted plat also shows the residential lot layout and street connections to the Will Point neighborhood to the west. um because the plat appears to meet all the apple subdivision design standards and we facilitate the second phase of development in sage creek pud staffer man recommends approval of sage creek pd phase two all right thank you for that do we have any questions for for our staff do we have any questions for the applicant then bring them up

All right, thank you all. All right, on to our next case, case number 2026-089. This is a rezoning at northeast corner of Highway 301 and Church Road. And once again, I will turn this over to our planning staff for their report.
This case, 2026-089, request from Bill Sexton to resend the property to the northeast corner of Highway 301 and Church Road from AR to C4. Surrounding properties are zoned AR and are generally rural residential in character. Applicant states site's location, major intersection along with its size and nearby residential growth makes it suitable for commercial use. Key issue is that the 2003 future land use map designates the area for medium density residential rather than commercial. and however staff notes in the report that the map is outdated there will be a new one coming soon and does not necessarily reflect current conditions as it's all still rural residential rather than medium medium density residential. There's also a lack of nearby commercial zoning. While there's no commercial properties on Church Road west of Highway 51 and the nearest commercial property is about a mile north of there at Nail Road. So this request, if approved by the planning commission of the board, could establish a new commercial node in an area that could be seen as underserved. But if it is approved to C4, then all of the applicable permitted and conditional uses within C4 are something that could potentially go there. And it's a long list of things. So that might be something that the applicant can speak to about what future use it might be. But if it is zoned C4, that is any of the things in the list.

That was something that was... aspirationally going to be done this month prior to Andrew's departure. So soon is relative in that sense. It will be as soon as I can put it all together with Orion, the consultants that we've been working with to put it together. So in the next couple months, I want to get it done as soon as possible.

My concern is what? Mr.. Simcoe mentioned about what would be going there in the future I know you can't maybe can't give me an exact answer But maybe some ideas of what are going there. I am in agreement that that corner is Needs to be rezoned something more beneficial. Yes to the city Yes, sir. But then again, it needs to be beneficial to the city. Sure as well.
Absolutely I'm representing the landowner as a broker so once hopefully if this board will see the foresight to have this rezoned As it should be because we met all the requirements for the rezoning then we plan on opening the market and see what's available. But we can't do that. We didn't want to put the cart before the horse. Yes, sir.
And I was just trying to get a general idea.
Yes, sir. Because it's a list of, what, a couple hundred things that could actually go there? Yes. But, you know, we still have to bring it back.
And it could be used for some things that would be very beneficial to that community and the surrounding community, not just the citizens of Horn Lake, but people that come out of Udor, people that come up out of Tunica and walls and things like that. I mean, that could be a very important corner. To develop yes, sir. I'm an agreement with yes, sir. Thank you.
All right any other questions for the applicant I Do so you don't have anything in? Plans to save right now. This is just to try to get it something going and developing so We have lots of empty retails around here. We have lots of empty buildings. People are leaving. We have plenty of spaces. So we don't have a plan of what's going to go there, but we want to rezone because we think it might be beneficial, but we don't know, but we don't really have a plan. I'm trying to think how to say my question without it sounding rude. So we rezone this and we have a whole list of anything and everything that could go there and then something happened in it back out and then we could get potentially anything and it'd be something that could backfire seriously. So we don't, but no, No plan in place on what we would like to develop or anything right now?
Well, just like this gentleman said earlier, we would like to have something there that's going to benefit not only Horn Lake but the community and the county as well. So, again, we don't want to put the cart before the horse. As I said earlier, we've met all the requirements. That property has met all the requirements for this rezoning, if you look at the area. And I understand what you're saying about the – the vacant buildings and and things of that nature but that's primarily in this area that that's a non-served area out there where we're talking about this particular property so it's not like we can just wave a magic wand and have somebody put a commercial building there we have to see what the market is going to dictate for that location
I've also been told that there's talk of wanting to put a medical dispensary out that way and which also falls under C4 zoning. Is there any plans for wanting to look into that?
No, ma'am. Not at all.

Right. So currently if someone, if this were to be rezoned and approved by the board, then someone comes in the next day trying to apply for a gas station there, they currently would not be allowed to do that because of the moratorium. Once the moratorium is lifted, when the study is finished, which they're currently working on, I spoke with them today, it would still, the board could act on whatever they want to do with that use, but that would be an amendment to the zoning ordinance if it would change from a conditional use as it is right now.
