The site is improved with a 2,879 square foot one-story single-family residence originally built in 1948 according to Miami-Dade County property appraisal records. The property is designated as a low-density residential on the city's future land use map, and the zoning classification is R1, one-family district, which is consistent therewith. A review of the city microfilm's records indicate that the property was originally developed as a single-family residence. However, the regional building permit number could not be located. The records further indicate that improvements had been made to the property over the years, including a legal non-conforming second living quarter consisting of a playroom, two bedrooms, and one bathroom, approved under Permit No. 1992-1791. A wood fence approved under permit number 2002-281 and a roof replacement approved under permit number RFR-0012A2-2023. Prior to purchasing the property, the current owner applied for a reoccupancy inspection under application number RO-001235-2025. As part of that process, a conditional certificate was issued identifying various unpermitted work on the property that will need to be legalized or removed. The owner purchased the property subject to those conditions and has since been working to bring the property into compliance. The property is also the subject of an open building without a permit violation case number BWOP-002-608-2024 for the unpermitted work. Subsequently, the owner submitted building permit number BLDR-006086-2025 to remove unpermitted partitions within the existing covered terrace at the rear of the property that includes two bedrooms, two bathrooms, a family room, a kitchen, and a wood terrace. The permit application also includes the demolition of a metal roof terrace on the west side of the property. a wood shed located on the rear of the property, and interior fences that divide portions of the lot. In addition, the permit proposes the removal of an unpermitted additional to the legal non-conforming second living quarter, including a kitchen and a laundry room, and the removal of a metal roof located at the front of the structure in order to restore the second living quarter to its originally approved configuration. As part of the same permit review process, the owner submitted a proposed site plan and floor plan seeking to legalize the existing metal roof terrace located at the rear of the main residence. Staff determined that the terrace does not comply with the minimum required street size setback of 15 feet, providing a setback of 12.41 feet. Therefore, the applicant is requesting approval to allow the existing encroachment. The proposed site plan demonstrates that the property will provide approximately 7,835 square feet, or 67.6% of pervious area, which exceeds the minimum requirements of the City of Hialeah Court of Ordinance. The proposed floor plan further shows that the main residence will maintain a layout consistent with a single-family home. The existing metal roof terrace will remain open on all sides, and the existing detached laundry room will remain on the property. The staff finds that the requested street size setback may be approved. The terrace is an existing structure that has been in place for an extended period of time and will remain as an accessory structure to the principal single-family residence. The encroachment is minor in nature, consisted of approximately 2.59 feet into the required street size setback. The terrace will remain open on all sides and does not create visibility concerns for vehicular or pedestrian traffic. Furthermore, the request does not increase the intensity of use of the property, does not create an additional dwelling unit, and does not negatively impact the neighboring properties or the character of the surrounding residential area. The approval of the setback will allow the owner to legalize existing tariffs while bringing the property into compliance through the removal of the other unpermitted work identified during the permit review process. Staff also find that the property owner has acted in good faith to bring the property into compliance since purchasing the property. I'm sorry, since purchasing the property, the owner has worked with city staff to legalize and remove unpermitted improvements, restore the legal non-conforming second living quarter to its original approved configuration, and obtain the necessary approvals required by the city. Approval of the request will facilitate the resolution of the outstanding building without a permit violation and assist the property owner in bringing the property into compliance with applicable city regulations. Staff recommend approval subject to the following conditions. One, the metal roof terrace shall remain open on all sides and shall not be enclosed without obtaining all required approvals and construction permits from the City of Hialeah. two the legal nonconforming second living quarter shall remain consistent with its original approval under permit number nineteen ninety two dash seven eight o nine and shall not contain a kitchen or any other features 3. No overnight stays will occur at the facility and all participants will be discharged on the same date as their visit. According to the applicant, no specialized medical equipment will be utilized other than the standard freezer and refrigerator for medication storage. The property contains approximately 180 parking spaces, of which approximately three parking spaces will be utilized by the employees, leaving adequate parking available for patients and visitors. A stat finds that the proposed biomedical research center is compatible with existing medical office use and their surrounding commercial development. The proposed biomedical research center will operate as an auxiliary use to the existing physician's office and will be conducted entirely within the existing tenant space.
