Thank you, Madam Clerk. Item six of today's agenda has presentations. Our first presentation is vulnerability assessment presentation by the Corradino Group. I invite them to come up. Take all the time you need. You got three minutes.
We'll make it quick. Thank you. Good evening, Jose Sanchez, Director of Streets Division, 956th Street. Good evening. As most of you may recall, about two years ago, we accepted a grant from FDEP for vulnerability assessment citywide. So we've been handling that for the last couple of years through our consultant. We jumped on that opportunity because understanding our vulnerabilities is essential for effective planning. One of the requirements of the grant is for us to provide you a summary of the presentation of our findings. So with that said, I'll turn it over to the Corradino Group. Kathy's here to do the presentation.

Good evening, Mayor, members of the Council. Tonight, we're going to be doing the public presentation for the vulnerability assessment. This is a requirement of the state. Next slide. Your project team includes members from the Cordino Group's Planning and Water Resources team, along with members from RIBIC Engineering. Next slide. The city sought and was awarded a $380,000 planning grant for the plan through the Florida Department of Environmental Protection. The project aims to comply with state statute by conducting a vulnerability assessment which will explore climate threats, assemble data on community assets, assess vulnerabilities and risks, and investigate potential adaptation strategies. The project also included public outreach sessions and stakeholder engagement. So what did the assessment find for the city of Hialeah? The two biggest contributors to worsening flooding are the intensification of storms, which is more rainfall more frequently, and the rise in groundwater. Next slide. The total project consisted of 13 tasks, the most involved of which are highlighted on this slide. These include the acquisition of background data, exposure analysis, sensitivity analysis, and the identification of focus areas. We began with a couple kickoff meetings, assembled a steering committee, and conducted several other meetings. Next slide. Task seven was the sensitivity analysis. The purpose of this was to help us figure out where the city is more sensitive to increased flooding. Next slide. Working with the city and FDP, we gathered all the data available on the critical assets shown here. The assets are broken down into several categories. We have transportation assets, critical infrastructure, critical community and emergency facilities, and natural, cultural, and historical resources. Next slide. Focus areas were selected based on exposure and sensitivity analysis and coordination with the city. The focus areas represent locations where flooding could affect essential public services, transportation networks, emergency response capabilities, and critical infrastructure systems. Next slide. Task 1 through 13 have been completed and submitted to the state. All deliverables have been approved by the Florida Department of Environmental Protection. Next slide. The adaptation plan was the final task. It is the creation of adaptation strategies and capital planning. The final plan is a comprehensive list of priority resiliency projects with the goal of reducing the risks of flooding, groundwater rise, and other climate impacts on city assets. The list of projects were compiled based upon the results of the exposure and sensitivity analysis with input from the city of Hialeah and the public. The list is made of policies, strategies, and infrastructure improvements. which can help mitigate the present and future impacts of flooding on the community next slide the final plan contains a list of over 100 projects within the 19 focus areas and city-wide projects are organized based on sensitivity rating with planning horizons based on short mid and long-term time frames next slide many oh that didn't come out sorry about that Many adaptation strategies can be implemented directly by the city through capital improvements, maintenance programs, operational changes, and infrastructure upgrades. Next slide. So what happens next? The plan establishes a roadmap for implementation. The city's next steps would be to prioritize high-risk projects identified in the focus areas, advance projects into engineering, design, and feasibility studies, incorporate resilience projects into the capital improvement program, pursue grant funding opportunities through state and federal programs, coordinate with partner agencies responsible for regional infrastructure, and track implementation progress through annual monitoring and evaluation. Next slide. The adaptation plan positions the city to pursue these funding sources by identifying vulnerable assets, prioritizing projects, and establishing an implementation framework. This slide was just a list of the grants that are out there for the city to go after. And the project was completed on time and in budget. And that concludes my presentation. Thank you very much.

This was a requirement of that grant that we pursued. We have to be updated on it, right? Right.
And this is a grant that exposes us to, gives us the ability to apply for other grants or implementation of improvements and things like that. It's something good to have. It shows us our vulnerabilities so we could plan better. I mean, there's over a hundred projects that were suggested. Some is operational, some be maintenance, some capital improvements. So down the line, we're going to evaluate, digest all that information and then implement them in our five-year plan and so on and so forth.

Yes, ma'am. Going back to the slide, I believe it was slide five that it talks about the task. And then it does like a little bit of an analysis on... different electrical stations and addresses throughout the city. So help me understand this chart really quick. It says 2019, 100-year rainfall, and basically everything on there is like yellow or orange, right? And in order for it to be that it's a sensitive flooding area, it should be in the red zones of like two inches or higher of greater like rainfall and flooding. But I see that we only, like it's subject to be red in 2070. So just walk me through that. We have no areas that have heavy rainfall of two inches or more currently, because I know that we do, but nothing came back recorded.
I think this is just an excerpt that the project itself, the plan itself has the full list of everything in there. We had just plugged this into the presentation just to get an idea of the sensitivity ratings. But the plan itself, the sensitivity analysis has everything in there. This was just like a little excerpt.
I understand, but here it's saying that nothing that was selected has two inches or more of rainfall, but then it's giving us an analysis of 2070, and then it breaks it down in like 100-year rainfall, 500-year rainfall. So if you could just kind of walk me through this understanding of what this rating chart is really rating.
So it says here, These are notes from my water division. This is what? The notes that I got from the water division. They weren't able to attend this evening. Got it. But it says here that some assets may start to be impacted by 2040 or 2070, and some may not be at risk at all. So they organized it in a way where we're dealing with first the highly sensitive ones, which are the ones that are gonna be impacted sooner rather than later. I think that's what they were trying to explain.
Correct, so then the data that was presented in this table number 10 then was the most critical of our locations throughout the city and none of them qualify as high?
No, I wouldn't say that these are the most critical. This is just a copy and paste out of the sensitivity analysis. The analysis itself has a full list. How many city assets did we actually conduct and mitigate? I'd have to get that information to you. I don't have the report on me now. I can look it up on my computer.
But all of them have been completed, is what you said? In the last chart, you said as of June 30th? Yeah, everything has been completed. Okay. Okay.
Jose, do you know if we got any readings that were two inches or higher? I can pull it up. You can look and see.

No, I don't have the information as to the rating right now, but I could forward you the report. We did consider all assets. We had a committee and pretty much it included all city facilities, parks, fire stations, everything that the committee identified that were included in the plan. In the study.
So we're calling them electrical substations? Is that what we're calling them? Doesn't matter what it is. It's just a property.
Right. There's a big list of properties. Pretty much all city assets were considered in this assessment.
Which is on the next page, the critical asset page. Is that all of the ones that are plotted on that map? On page six, I believe.

Yeah, right now we're going to digest the information. We just completed the list today. We actually got approval from FDEP, so it's very recent. We had to, this was one of the presentations on the grant requirements, so we had to do it today. Now I need some time to digest the information.
This will probably help you, us as a city, getting the grants quicker, correct? Absolutely. As far as different, look, we have an issue working with it. Got it. Okay. All right. And this is going to be for 2027, I imagine, right?
Yeah, it's an adaptation plan that we'll review. Like she said, we'll put the ones with highest priority on top and we'll seek funding, whether it's by grants, city funds.

Uh, uh, uh, uh, uh, uh, uh, uh, uh, uh. y de la orden de remover mi bote de la propiedad ubicada en la dirección antes puesta como consecuencia de la aplicación de la ordenanza 2024-013. Soy propietaria y residente de esta vivienda desde el año 1999. Es decir, hace más de 25 años. Asimismo, he mantenido mi bote estacionado en esta propiedad durante aproximadamente 18 años, mucho antes de la aprobación y entrada en vigor de la ordenanza. Durante todo este tiempo, el bote ha permanecido en el mismo lugar sin generar problemas de seguridad. Transito molestias vicendales ni violaciones previas relacionadas con su ubicación. One, two... The changes that were made pursuant to the 2024 ordinance had to do not just with boats, but also with recreational vehicles as to where exactly they could be parked within the property. Now, in regards to zero lot, that was something that was pre-existing, whether it was enforced or not. Again, you know, I can't speak to that. but Claudia could definitely give her guidance as to the application process for a variance, which is what she would have to do based on the subsection from the top of my head. I believe it's subsection F that addresses that is prohibited in the zero plot line.
Okay. It's also prohibited to have a shed in the back of the house in the zero lot.
No, I mean,
I wasn't here in 24 when, or by loss. So, but going back to zero lot, I remember being in Sony board and it was an issue because under the zero lot, a lot of people bought those properties and there was an, it's called an envelope by the developer. I forgot exactly the word that you can even have a shed on the zero lot. And that just doesn't make any sense. A lot of people bought their properties when they, You've got to have something for your barbecue, an additional roof or something, or something to put your grass cutter or whatever it is or anything, which is something that a lot of these buyers didn't know about. And I know regarding to the boats, there was a leniency that we remember as long as it's not one boat, small boat, and not encroaching into the sidewalk. So I hope it can be worked out. But I am sensitive to those zero lots properties that are so extremely limited that everybody that purchased them had no idea the limitation that they had. And as long as you're not on the sidewalk or, like I said, not even allowed to have a shed in the back of the house. And that's kind of, like, unrealistic, to be honest.
This may be, yeah, this may be, according to our city attorney, maybe something that was not revised, that was already existing whenever it was enforced. But like you're saying, this goes back a long time before that. Claudia, I guess, you know, let us know. That in particular, her property in particular, I guess, update us and let us know if that was part of the revision or it's existing, and then we can govern ourselves accordingly from there. I know that...

Claudia, I know we had a similar case like this with the three gentlemen that were here last time, but about the RV situation and the boats. Theirs was the townhouse. Since that last meeting, have we had any residents come in and, you know, apply for the variance and apply for the review of the file as it pertains under the ordinance? Have we had residents do that?
From the three gentlemen that came last meeting, I met with two. They haven't yet submitted the application, but they are in the process of submitting an application for a variance.
So when these residents are notified that their property isn't in compliance with the ordinance, are they given any kind of paperwork that speculates that they have the option to submit? I forgot it was like $500 application fee to see if they could have provided a review under their own property.
Is that something that we're giving them? Councilwoman, I wouldn't be able to answer that. That is a court enforcement process. So I will not want to give, you know, the wrong information. So I don't know. If somebody else from the court enforcement.
Alexis. Maybe. Alexis, the question was when we notified. You got to come up.

Of them having that RV or the boat or whatever that doesn't speculate within the ordinance. Do you know if when we give them that paperwork, if somewhere on there it says, hey, you're out of compliance, but you could pay a $500 application fee and we can analyze your particular property and see whether or not you could be given a variance. Do you know if we give kind of that information or no?
I don't know either.
I think they're just cited. I think it's just cited and they have to pay the $100 and that's it, right?

So is this something that maybe we want, I don't know, to include? I think that's just a regular cited notice that we give. It's a general one to give for anyone that's out of a violation, whether it's a door, it's a fence. It's not a particular one that we use for boats and RVs, correct?

So we can't write anything in there. I don't know, unless we can give them something in addition to that to let them know, hey, you're out of compliance and you could possibly apply for a variance for $500. I don't know if that's something.
Typically, the inspector may verbally tell that to the resident.

They don't explain anything to you, they just tell you, they don't give you the options. It's very difficult to find someone who can explain the options you can have and the things you can do to try to solve the problem. In my neighborhood, I'm not here to do the work of any person, but in my area specifically, there are more than 30 votes in the same type of house condition as mine. Some I've never received because I was talking to neighbors in the area. None of them. Han llamado y les han dicho que no, que pueden tenerla en el área mientras que sea un bote. So Claudia, to answer the question for Monica, which happened to me. So the gentleman, if you can get close, please. The gentleman that came to apply, he spent, I think, $2,000, a thousand. So out of the three people that were here, one of them put the variance proposal. So Monica, Councilwoman, if that proposal doesn't go through, he loses the $2,000.

I think there should be something, which is not. Last time that I, Louis, last time in the last council, I presented to an amendment, but it was very open. So I'm going to come back with a lot of departments, see what we can come up with. I motioned it and didn't go through, which it makes sense. But definitely what, there's a lot of questioning to be answered on that. But as far as the last week or two weeks ago, so somebody pretty much put a variance, $2,000 out of pocket. And if it doesn't pass, then he lost the dollars.
Through the chair, just for clarification, those fees are not directly. There are a series of other documents that they need to provide.
Yeah, but still an expense for the taxpayer or homeowner that didn't know about the credit.
So just to clarify, it is not an application fee that they pay for.
Is it $2,000? I thought it was $500.
That is what I want to clarify. So the application, if they have a violation, it's $835. But he didn't have a violation. Yes. So it's $835. Then they have to provide for something, some document that we can refer to, a survey. It costs another $600. There's other documents that they need to provide, which costs them another $800. So I understand that adds up to everything, but it's not an application of $2,000.
The variance process, there's a cost to it that there's a chance they're going to lose the dollars, which is what the law is. Which, you know, Again, we'll bring that up another time.
How much is the variance? How much does it cost to pull a variance?
It's $500 and then $325 more if you have a violation in the property, if it is a result of a violation. Right.
But then why did he... Sorry. Why would it be $2,000? Because...
They have to provide for a survey. Remember, this variance process, it goes to the property. So we needed to confirm ownership of the property, the conditions of the property, et cetera. So they need to go out and get a survey of the property. That is the only document that we ask for. And then there is a series of other notices, other stuff that they need to be provided.
Is there a way that, because I know that we have enforced that the surveys that we required have to be within six months, right?
And whenever you are doing an improvement on the property, in these cases, we have waived that condition. The gentleman hasn't applied yet, but he had it done two years ago. And we said, we're going to waive the six months issue because you haven't done any improvements on the property.
That's what I would ask. I would ask if maybe we could waive that survey. If they have one that's five, six, seven years old, I think that that's still false. If no conditions has changed. There's Google Maps. We could look at their property. We could see if they added a roof, a driveway. But I think that we should be able to be flexible. What do you think, Mary? As far as it pertains with the survey, I think being flexible with that.
Listen, I think the path forward here, obviously, we don't want this to be a reoccurring theme. I think we need to change the process from... Something that's going to put an onus on getting a variance on the property to some sort of administrative review, which is exactly what we have with the RVs. So right now, if you get an RV violation, you can request an administrative review or basically, you know, no fee. I don't think we charge for that, do we?
For the RVs, no, we don't.
Yeah, so there's no fee. You can apply. Basically, Claudia has very tight criteria of what she's looking for. If you have the access on the side, if it's not a nuisance, whatever, there's like two or three things that she looks for and then she either approves it or doesn't. And if the council wants to give us some idea of what are the two or three things you want Claudia to look for, then we can do it like that and we just forego this whole mess and just do administrative reviews. On a case by case basis, we could do that very easily. We just have to amend the. The ordinance and that that might be the best path forward. You know.
The ordinance in 24, which I might think was got the floor. You're sorry. Yeah, I appreciate that. I'm a little bit hungry. You know how they say you tell me all the time. So the ordinance in 24 that was specifically towards the RV, but what changed with the boats?
They put in all three. So the ordinance that they made was RV, boats, and commercial vehicles all together. And it's a mess. They should have done it separately. One for RVs, an ordinance for boats, and an ordinance for... Because the intent was for the RV and the situation. It was all mixed in and it was all packaged together. And then that's what you get. You get basically, you know, my fear was always that. Some people know what the rules are, some won't. So some people get enforced, some don't. I mean, it's like, it's a little hard. We have accepted certain things. The problem back then, and exactly like the mayor said, I don't understand why this was mixed and commingled altogether, is the RVs that people were living in. They were doing duplex and triplex on the RVs, and it was out of control, which is very disturbing to the neighborhood. So I don't understand why in 24 something was included here. For the boats, we've had certain regulation for the boats and accept the certain regulations, but limiting the amount should not be the issue, it's just limiting the size or where they could be at, um, is what we should focus on whatever it is in 24. I'll look at it, see if maybe we can limit and come back to a common sense about it.
Remember the rule before was pretty simple. The rule before was, it didn't really matter what property was as long as the boat was 23 feet or less, if it was going to be in the front of the house. And if it was going to be on the side of the house, it could be up to 33 feet. Didn't really matter. Anything else? Uh, it was very kind of simple rule. Um,

Just to make sure, Councilmember... Gonzalez's inquiry as to the change in 2024. Specifically, when it comes to that ordinance, a lot of the discussion had to do with the fact that the RVs were being parked behind the house, in the rear of the house, right? So at the end of the day, there was a modification when it came to a personal boat, in that if a personal boat is over 33 feet, it cannot be parked in the front of the house. Now, in regards to a boat that is less than 33 feet in length, that boat can in fact be parked on the side of the house, and it also could be parked in the rear yard of the house. So those were the modifications that were made specifically as to the boat. But the discussions that were had during the 2024 session had to mostly focus on the fact that some boats that were large in size were parked in front of the house. And that's why the restriction of being under 24 feet.
The restriction was in place already. What the mayor said, maybe there was now specifically about zero large or townhomes. Is that what got changed in 24?
That I do not know. That's what we want.
If I can come back to that. But those regulations you're telling me was in place already before. And the size was already in place before. So all I'm saying is that I don't know. It's like something got disturbed because the RVs are the problem. And now something else got included into it. So I'll leave it here. And that's my last word about it. And I'll look into it.
One option we could do is we could have, you know, because we're taking obviously a lot of time for the council meetings, is we can have a special workshop kind of thing at some point. We could just talk about this one topic and maybe look at some proposals and kind of go from there and see where everybody's...

I'm an American who was raised in Cuba. After Fidel Castro took over our property in Havana, we have been over here in Hialeah operating for over 50 years. operated in good faith with the city, and I would expect for the city to operate the same way with me. This, after all, is supposed to be la ciudad que progresa. Our tenant, William Whirling Gallardo, is operating a marble company at 1028 East 33rd Street. On February 24th, he received a violation that was issued because he would not have a business tax receipt. As a property manager, I told him that we have to resolve it because these violations do not disappear on their own. It's been a long and frustrating process. Our tenant has spent over $40,000 in trying to resolve the problem. He's hired two architects and trying to resolve the issues with the county and the city regulations. Finally, he retained Frank de la Paz, who's in back over here. Thanks to him, We've been navigating in the right direction. We have been pursuing to get compliance. I'm not here because I have ignored the violation. That's not the reason. I'm here because we did everything right. The problem is it's been taking us a bloody long time to get all of these things resolved with all the different cities. Here's the problem. We're in active compliance right now. I have asked to appear before the special magistrate to see if we can get the fines either uh wave not wave but uh delayed until we get resolved this thing over uh this process and they said no you have to resolve the issue and then you come before the city I spoke to the building department. They said, well, typically we reduce the fines. Well, that's very nice. They told me that in the hallway, but that's not a legal reason for us to be able to get a discount or a reduction. We are actively resolving this problem. It's taking us a long time. It's $100 a day fine. I don't think that that is fair that this is happening, that we're getting stuck with. uh i'd like the council to direct the staff to let us at least speak to the special magistrate explaining that we are resolving and telling you what we've been doing instead of incurring all of these fines for a hundred dollars we have done everything correct we've done what has been asked for us it's just taking a long time and as time progresses we're incurring daily fines. And I don't think that this is the right thing and it should be fair to us. And we hope that we can get a little breathing room to at least resolve the problem. Thank you.

So basically, so the council members are aware the way that our code reads, and I have to pull up the exact section, is that a violation has to be cured before it's brought before a special master for a reduction hearing. So his frustration is obviously that it's been prolonged the process of like, you know, having it cleared by the buildings department. But that's the way that our code reads as to when it is that the special master could preside over the matter. He has already surpassed the appellate time that he had in order to appeal the initial decision by the special master. So now he's at that cure phase of then going back before the special master just to reduce the cost.
What does he do then at this point? At this point, well, first of all, thank you for coming. And obviously today, casually, we're actually making huge investments in our building department to try to speed up these processes because we know they take very long time. But like the Madam Attorney said, our code, and we're fixed by it, says... that in order to go to the special master and get those reductions, obviously you need a cure first. Now it also says that based on certain parameters, you can get up to a 95% reduction on those fines. So again, what I would tell you is continue working with the person that you've hired to cure it as quickly as possible. And then know that at the end of the tunnel, you know, you do have a very high expectation. And I mean, we're on the record here that those fines will be waived, but obviously we have to go by what the code says. And it requires the curing phase to occur. So, again, we are trying to make the processes as quickly as possible. Today, we're actually, you know, doing one of those things. But, you know, moving forward right now in your specific scenario, the best thing I can tell you is to cure it as quickly as possible. And obviously, you know, this is recorded and you can show the special master when that time comes that you do appear before them. Okay. Okay.

So I first would like to know if the council would be willing to fly our flags here in Hialeah at half staff in honor of our children, whether it be nationally or just in the state of Florida when they are killed. Yeah. Basically, what this ordinance does is that I'm going to just narrow it down to this, right? This ordinance basically creates a transparent fee schedule, and Claudia could speak as to it. It lays out what exactly are going to be the costs for any fees associated with zoning and planning permits, reviews, administrative action, the city was actually providing some services where at the end of the day, the city was not charging anything during the process. So Claudia could speak more as to the details, but this is as transparent as it gets with the actual fee schedule that's attached to the actual language in the code that's been stricken and the new language that's been added.
So if you can show me some of the new language, because I only see the striked out fees. I haven't been able to really find the new fees that are going to be supplemented. Basically, exactly. That is what happened.
An applicant had to go to section by section to find the fee. So. whatever the city clerk read, it needed to be figured out in order to find out how much you have to find. Right now you have exhibit A, which is basically, it's part of the ordinance where you have exactly in one concise document, all the services and all the fees that you're going to be charged for. The increase was based in a comparison with four municipalities that we evaluated. We evaluated City of Miami, City of Homestead, City of Doral, and City of North Miami for a comparison, all the fees. Some of the fees, we didn't have a comparison. We left some the same and some other ones that were increased. So what would be like the percentage increase that we went up in fee? We were approximately between 7% to 250%.
I would love to have seen it kind of side by side of the change per fee.
We can bring that comparison if you want for the second reading. If you can, I'd appreciate it. Yes, ma'am. But you did an analysis throughout different cities to be? Yes. Yeah, we compare it basically for the similar services that we provide. Some of the services, I was surprised. I made an error. I wanted to speak on something that was on the consent agenda, but I don't know why I wrote it down like it was an administrative item. So I didn't get to speak about it. And I would like to have a quick just clarification on one of the backups. So I believe it is, I think it was L or M. So on the backup for the resolution, right? Let me see, it's resolution of the city that discusses a, A coordinator or a consulting service that we're hiring for this city hall project. It says here in the second whereas on page two that we shall not exceed $327,100 funded from the general fund for the government budget. But then in the backup, it says that their professional fees and services would be $414,000.

So I don't know. And then I saw on a separate page, which right now I don't know where it is. I don't know if it was some 300 plus 400 or if they were being quoted 414. I just wanted some clarity on that.
Yes, certainly, Councilwoman. Earlier, our city clerk did, in fact, announce on the record that that the correct amount to be reflected is the 400 and change. So after the item passed, I will be submitting to the clerk's office an updated resolution with the header and the whereas clause reflecting the amount that was actually articulated on the record.

All right. And then my second question, Mayor, is why wouldn't we put this out for like a bid? Why would we choose this company without going out and getting like a comparable cost?
Yeah, so obviously we have to spend the money quickly. So we just use one of our vendors. We actually did put out an RFQ. Basically we have a pool of vendors that we can utilize in order to make these processes more efficient. And moving forward, obviously, we're going to have really the construction contract, which will be the large amount of money. And that one will obviously go to bid through the normal process.
So this is someone we've worked with in the past.
So we have we have basically a pool of vendors. There was an RFQ process that was done recently. So we have a list of vendors now. Some of them we've used in the past, some we haven't. But it's a pool of vendors that are available as needed for these kinds of services.
And the services are, I see it's consulting, but then it also talks about furniture and fixtures. So what is it that they do exactly?
So this is only for design plans. So what we need is in order to put this out for a construction contract, we need to let the constructor know what exactly we want. So these are the plans, the architectural plans, the engineering plans, all the plans that we need in order to be able to put this out for bid and let people know, hey, you know, how are you going to quote us basically for the construction?
