The Hancock County Area Plan Commission approved the June 8th meeting minutes and voted to continue a hearing item due to public notice issues. The commission also received an update on the Data Center Siting Citizens Advisory Committee and directed staff to begin drafting an ordinance based on the committee's recommendations. Additionally, the commission approved an amendment to the zoning text to simplify public notice requirements and approved an expansion of a TIF area.

All right, good evening. We'll get our meeting started here this evening with the July 28th meeting of the Hancock County Area Plan Commission. We ask that you please turn off your cell phones and any electronic devices. Our first order of business this evening is the adoption of last month's meeting minutes. Well, actually not last month's meeting minutes. We didn't meet, so it would be the May. It's actually June 8th. Yeah, the June 8th meeting minutes that were submitted electronically.

Yeah, two abstains. As far as our roll call, we have a full board this evening. I'd like to advise everybody that your testimony this evening is recorded and taken under oath. We request that anybody wishing to speak only do so when called upon. We ask that you face our attorney to my left and be sworn in before speaking. All persons speaking will be asked to give their full name for the record, spell their last name so that we have accurate meeting minutes, and please speak directly into the microphone. Our planning director will give a staff report and then the petitioner is given 10 minutes for their presentation and that's followed by 10 minutes collective for any remonstrators. We offer five minutes to any government officials that would like to speak and conclude with five minutes for petitioners rebuttal. Our attorney will give each party a two minute and one minute warning as the time is expiring. SO IF YOU GO TO THE BACK OF YOUR PACKET WHAT YOU HAVE. IS TWO DOCUMENTS. ONE IS CALLED DATA CENTER QUESTIONS, LABELED OB2, AND THE OTHER OB2 IS THE COMPILED EXECUTIVE SUMMARIES OF COMMITTEE MATERIALS. so this is related to the citizens committee of data center siting that's been meeting to try to learn about data centers and how they would fit and work in our county and they have that committee has met several times four four times now and we got to the point where there was a we've had Two speakers, we've listened to a lot of different testimony, we've read a lot of articles, and we got to the point where we needed to start compiling some information. And so these two documents, the second one, the compiled executive summaries, So we appointed a subcommittee of the committee. So we called it the scribe committee for just for a catchy name, I guess. But what they did is they compiled all of the discussions sort of as a quick executive summary so that you, the planning commission, can kind of read through there and see what was talked about. If you haven't been watching the meetings online and see kind of I guess generally what the topics have been and what the material has been focused on. From that, the scribe committee pulled from the meeting minutes and from various recordings and things, I don't know what all they looked at, but they generated a list of data center questions. And so what we were kind of getting at, as you know, we passed a overlay district ordinance a few months ago, and that ordinance has... SOME CONSIDERATIONS AT THE TOP OF IT THAT HAVE TO BE ADDRESSED FOR ANY OF THESE OVERLAYS TO BE APPROVED BY THE PLANNING COMMISSION AND BY THE BOARD OF COMMISSIONERS. SO TO KIND OF ENHANCE THAT, WHAT ARE THE MAIN TOPICS? AND SO THAT WAS THE CHARGE OF THIS SCRIBE COMMITTEE WAS TO PULL TOGETHER THAT LIST OF QUESTIONS. which they did, and it was discussed at length last evening at the meeting of the committee. Then today, Ms. Willard and the committee tried to kind of shore that up a little bit and put it into this form that you see here. And I'll go ahead and let you talk about what you've got here.
Sure. So just a note on the compiled executive summaries. We did a character count limit. We prioritized those materials that were publicly posted to the site. And I would say that throughout the scribe committee as well as conversations for the advisory committee, the Purdue professor's presentations were widely referenced if you're looking at something that she wanted to look at specifically. Just a couple of notes on navigation for the data center questions. This is the really small font, but it's in small font so you can see some of the changes that occurred during last evening's discussions. This is a living document, so we do think that if we have additional meetings, there might be opportunity for amendment. Another note, you'll see at the very end, there are two sections that reference a community benefit agreement and economic considerations. Those are usually best handled by an advisory committee, such as the economic development experts or tax authorities. Although we compiled that information, we did not think it'd be appropriate to give a lot of opinions. And I do think there's a lot more in the CBA and economic development that is presented here. But it's not planning and zoning related. And so we did put that into more of an exhibit with kind of an ask for help. So just as the committee was convened to advise the Planning Commission on the technical matters, which I'll make a couple mentions of in a moment, it would be nice to have some help on the economic development The other part that I think you'll see is the themes that came up as a suggestion. So process themes are things that we might already address today in our ordinances. But I think the question becomes, are they sufficient? Setbacks, notices for meetings, where are things posted? So some of those items were brought up in all the presentations that we saw or reviewed, and we thought it was appropriate to put in the data center questions, but we might already have an answer to it within the work that we do. So the second theme that is important to note is denoted with LOI. So the ordinance that was recommended for passage from this commission and sent to the commissioners did mention a letter of intent. And what we've done is we've categorized everything that might be included in a letter of intent. And think of these as just basic questions. These aren't answering the questions. They're just basic questions. I guess if you look at them in detail, they're not basic. A lot of those. And then the last thing I'll mention in the last column is that last night's meeting had identified a couple of things that the advisory committee might want this group, the planning commission, to consider or to... FLESH OUT FURTHER OR TO ANSWER GIVEN THE EXPERTISE OF THIS COMMISSION, AND SO THAT'S IN THE FINAL COLUMN. IF YOU SEE SOMETHING WITH A STRIKE OUT, YOU MIGHT NOTICE THAT THERE'S SOME COMMENTS, IF IT WAS DUPLICATIVE OR MOVED TO ANOTHER SECTION, JUST TO BE ABLE TO REVIEW THOSE A LITTLE MORE EASILY. SO THAT'S HOW YOU WOULD NAVIGATE THIS DOCUMENT, AND THINK OF IT AS A COLLECTION OF ALL THE TOPICS THAT IMPACT A DECISION FOR A DATA CENTER.

So we do want to let that be a consideration and think about that. But this timeline that she put together, obviously July 27th was last evening, which was the meeting of the committee. And then this evening, the plan commission is receiving this information, receiving it more as a... UPDATE AS TO WHAT'S GOING ON AT THIS COMMITTEE SINCE IT'S A COMMITTEE OF THE PLAN COMMISSION AT THE DIRECTION OF THE PLAN COMMISSION AUGUST 18TH IS THE NEXT OFFICIAL MEETING OF THE CITIZENS COMMITTEE AND THAT IS A MEETING WHERE WE PLAN TO TAKE PUBLIC COMMENT AND REVIEW THIS DRAFT RECOMMENDATION SOME MORE AND MAKE FINAL ADJUSTMENTS TO THAT AND HOPEFULLY ADOPT A FINAL RECOMMENDATION THAT WOULD COME TO THE PLAN COMMISSION. AND THEN OF COURSE AUGUST 25TH IS OUR NEXT MEETING WHICH IS WHERE WE WOULD CONSIDER THAT AS WELL. Advertise for public hearing and then you know kind of move on from there in our normal our normal process with hopefully having something resolved here before winter So that's THAT'S ALL OF IT FOR RIGHT NOW. THE PURPOSE OF THIS WAS TO GIVE YOU AN UPDATE BECAUSE THERE'S A LOT OF INFORMATION SO IT'S GOING TO BE HARD TO DIGEST IT ALL AT ONCE. THIS INFORMATION IS HERE FOR YOU TO START TO STUDY IT AND SEE WHAT YOUR TIMELINE IS AND HOW YOU HAVE TO FEEL COMFORTABLE WITH ALL THIS INFORMATION TO START UNDERSTANDING AN ORDINANCE AND MAKE SOME RECOMMENDATIONS THEN TO THE COMMISSIONERS. now with that i'll also say we have options this evening if you are browsing through this and and you like what you see we can do some different things with it we could also forward it on to the commissioners if we want to share it with the commissioners in its current state here which is still a little rough like like Lacey said there's still a lot of red marks here and a lot of like questions that probably need to be resolved Another option was that there is a lot of great information here probably even to a point where we could probably direct our staff to start working on a draft ordinance. That's another option that we could do. And then that way the staff could bring an ordinance to a draft ordinance to the August 18th meeting of the citizens committee. So they just kind of jumpstart that process a little bit. So they could actually have something as a framework to react to as well. So kind of creates a little back and forth, so.
I LIKE THAT IDEA OF OUR STAFF PUTTING IT TOGETHER AND THEN TAKING THE FIRST ROUND AT THE ORDINANCE.
SOMETIMES JUST HAVING A JUST LIKE THIS DOCUMENT IS HERE ONCE YOU START PUTTING STUFF ON PAPER IN A FORMAT IT STARTS TO HELP TO DRIVE THE CONVERSATION. I THINK IT WOULD HELP THE COMMITTEE TO START TO UNDERSTAND WHAT WE'RE TRYING TO GET TO AND WHAT THE DISCUSSION POINTS NEED TO BE.
Because last night there was a lot of good conversation about things like that. And I think we've got that, for the most part, nailed down here. And it would be just a really good starting point before it ever even goes to the commissioners.
I would agree, especially because so many of these items may already be addressed in our existing ordinance, and who would know that better than staff and council? Or if it is addressed but not sufficiently, knowing the process it's going to take to make those changes would be important. So staff sounds like an excellent next step.
Yeah, I think we're at a point where some professional input is needed. So I think that it's the little things that YOU KNOW EVEN THIS COMMITTEE OR THIS BOARD OR THE CITIZENS COMMITTEE WOULD MAYBE STRUGGLE WITH A LITTLE BIT THAT KAYLA AND HER STAFF IS GOING TO KNOW SPECIFICALLY LIKE HERE'S A PROPOSED SETBACK YOU KNOW HERE'S A PROPOSED LANDSCAPE OR LEVEL YOU KNOW BUFFER YARD YOU KNOW THOSE TYPES OF THINGS AND SO IT GIVES US SOMETHING TO REACT TO AS OPPOSED TO JUST CONTINUE TO OPEN CONVERSATIONS SO I THINK IT WOULD BE VERY HELPFUL TO HAVE IT BE TIME WELL SPENT AND WHETHER YOU HAVE TIME TO DO IT OR NOT KAYLA YOU COULD OUTSOURCE IT UNDER YOUR NEW AGREEMENT AS WELL IF YOU'D LIKE TO DO THAT AS LONG AS IT COULD HAPPEN WITHIN OUR
I THINK THE DATA CENTER TASK FORCE COMMITTEE HAS DONE A GOOD JOB OF COMPILING ALL THIS STUFF. IT WAS THE RIGHT THING TO DO.
Yeah, the discussion has been, I don't know if you've watched any of this stuff online. If not, I would encourage you to take a look on YouTube. It's all there. I think Dusty's got it all uploaded. And there's a lot of great conversation, a lot of things come up that we haven't thought about. So yeah, it's definitely been a very, very good process thus far. And our speakers... Our speakers have been excellent. And Dr. Gallardo from Purdue University was outstanding. And I think he's actually done some work with the schools too, with AI and things like that.
Would you anticipate that Kayla would work with Rhonda as they're drafting this, just so that we would be in a line?
I meant and obviously say yeah so it's just effort yeah so they follow the same process of when they're drafting any ordinance for the county so she would coordinate with with legal for sure yeah so we can that's that's an option so if anybody would like to I don't know that we'd need a motion for that but we just need an agreement if we want to direct the staff to start working on that or if you don't want to do that and you just want to take this under advisement and OFFER UP ANY SUGGESTIONS TO THE COMMITTEE FOR THEIR NEXT MEETING, WE COULD DO THAT AS WELL.

I'll make a motion. As long as it doesn't take away from her time doing other things that get us in trouble where we have to use a consultant. I don't think that'd be a good thing. I don't know. I mean, I think Janine and I understand this. I don't know. Because otherwise, you know, we've added her to the ability to have consultants that are paid at a higher rate.

And so my concern is that I don't want to overburden her if this is a busy time. If it's not and she can handle that, because she's going to have to do it. It's great if she gets started, but I don't want to force her to have a certain deadline.
Well, I think we should allow her at least to engage HWC if need be, just so we can continue on the path.

I think I'm with you as well, Scott. I will say one of the other things about kind of jump-starting that now is to give her additional time to deal with this. Because like you said, she's going to have to do it at some point. And this way she can take our direction to go do it and start on it now. Thanks for volunteering this late in the evening. If you look up at the screen, the areas in question that you're discussing today, I have called out as proposed additional parcels, and I've called out the other areas there. The one on the south eastern part is a little L that's kind of already encompassed within a tax increment financed area. So it's just kind of been abandoned. And the one to the north is a sliver of area between the current area and McCordsville town limits. The current land use, because there's two questions that are pertinent here. Let me go to the ordinance. That the amending declaratory resolution conforms to the plan of development within the county, so that's why I have the land use here. These are, well, outside of obviously the, that's on the opposite side of the paper I handed you, or you could look at the screen in front of you. They are gray areas that are inside the industrialized area. Some of them are actually already zoned industrial. So that's item number one. Item number two is the amenity declaratory resolution. Sorry, I can't speak very well. That's just you guys have proven it. And then saying that it does meet the planned land use. In this case, it would be the comprehensive plan. And then you'd file a copy of this for the permanent meeting with the ministers. I'm sure Rhonda can go through all this as well. But the main part of it is item number one. The amending declaratory resolution conforms to the plan of development for the county. This is mainly to capture one orphan parcel to the south and to capture an area between our control and McCordsville's control to make sure that this group, through the commissioners, will be able to have some control of that in any future development in the area. Rene brought up a good question to me prior to the meeting, which I'll research with her. If you're ready to get a hold of me, I'd like to talk to him. And Ms. Willard, I'd like to talk about what your group's working on too at some point. But that is all I have here. I try to keep it as simple as possible. The question du jour is, does this conform to the plan for development of the county? And I believe industrial one is already zoned, so those are pretty straightforward and the rest are within the land use, the comprehensive plan. No one's fallen asleep, so I don't have anything to add to that.
So I think the important thing that you said there, Gary, for this group is that it conforms with, we're not necessarily making a decision. This board is not making a decision on TIF area per se. That's the RDC's place. We're looking at, is this... Is it proper land use? Does it conform with our comprehensive plan that development of industrial development would happen in this area? So you're basically just comparing this to the comp plan? Is that an accurate statement? Kayla, what would you say?
However, I am interested in some of the stuff we've talked about, so I can pass that through to the commissioners. So if anybody has anything you want me to carry forward to the commissioners with this, I can. Janine's here herself, but she's on a different person.
So the total, is it the total of the 581.7 acres?
On the second page, I sum up the acres. 581 and the one down to the south is 117.6. I hate when people don't bring the acreage to me. I apologize, that's the case.

We typically would ask for staff recommendation or major objections. Have you encountered anything from a planning and zoning perspective that would flag or a objection we should consider?
I have not. I had a conversation with Renee prior to this meeting that I want to look into as a Hancock County resident. But other than that, I've not had any direct. No one's given me feedback.
Will it go to the RDC first or the commissioners?
It's it's been the it will it kind of lays out what's gonna happen next. I know it's circular but Iterative we like the word iterative We go back to it This will Be filed And then that file will be referenced by both the RDC and the commissioners. So you're going to file this copy of this amending declaratory resolution with the permanent meetings of this minute. And then those groups are going to look into the permanent meetings of this minute to see that you've received it and that you answered question one.
So this would be the first of the TIF areas to go east of 300 West, is that correct?

Adding those additional... Well, obviously, the one's internal, so it's fully contiguous. The one has like a foot notched into it.

They're kind of intertwined. Why was the one not included the first time? Because I'm an amateur at best. And back then, they were afraid that the state was going to take... those areas and create a lead district?
Yes.
So it was a somewhat defensive maneuver to make sure that we had self-determination of those areas, that this group and the commissioners would retain, because they're elected by the locals, I think they should retain it. And this is in the similar vein.
Further enhances the county's control of the land. Yeah. Aside from all of the other economic things that we don't talk about here, so.

All right, item number three today is an update to our zoning ordinance that will make it a lot easier for members of the public to publish their public notices in the newspaper by changing out the requirement that a legal description, meaning that deed legal description, point of beginning, going, you know, 25 feet at this bearing, and then south, and da-da-da-da-da, very long document, be shortened to just the parcel identification number. of the land in question. So the result will be that if you are a member of, if you're a landowner in Hancock County and you want to go to the BZA for a variance or special exception or come to the plan commission with a primary plat or a rezone, you can simply include your parcel identification number instead of that full legal description to have published in the newspaper, which will be much cheaper. So that is a very expensive thing right now for the people we have coming to this board and to the BZA. Rhonda, do you have anything to add?
Just that the existing ordinance already requires that the general location of the subject property also be included as well as the common address. I think most people can find parcels easier with that information than if they try to read that really confusing document. you know, legal description.
I think the only concern here, knowing that as an attorney I can tell you, not every parcel in Hancock County has a common address.
Correct.
So I think the legal description may be more beneficial there in those instances. It's not every situation. It's actually probably pretty rare. I've seen it only a few times where you don't have a common address. But there are some farm fields that don't have a common address. And so there has to be more specific information. I think as long as we have a, okay, do this ordinance like this, but then you're still going to have to have some addendum or something to give to the... to the petitioners where it tells them how to be specific if there's no common address, how they're going to have to be more specific on the general location as you gave in your example.

So that notice is sent there. But in 27, if the law does not change this next session, there will no longer be the requirement that you have to publish in the newspaper. You will be allowed to put these types of notices on the county website. which, you know, we're gradually getting there. I think with the county website that there's now a public notice right on the homepage, a public notice place, and that's where these new notices will start going from then on, and they wouldn't necessarily have to be published in the newspaper. That will be optional. So that would be kind of a question of, you know, for the commissioners, So we transition whether they want to continue using the newspaper for a while. Some people don't have internet and it might be a good idea to keep continuing or if they want us to just rely on the website.

We're prepared to review a draft here in August and go over any changes in organization or anything like that. And then I guess the important part of this is we are expecting to introduce the document to the plan commission. August 25th so that's the big one we're hoping to get a get a copy in front of you all and so you can ponder it basically over the course of August or potentially adopt it or give a recommendation to the county commissioners if you so choose but that will be on your next agenda so be ready and then we're hopeful that the county commissioners will consider it on their agenda following a recommendation from this body.
Will that draft come to us 10 days before the meeting or something like that?
It will have to be a public hearing, correct Rhonda? I'm sorry? The UDO draft will be a public hearing in August?
Yeah, there will have to be a Public hearing, just like we did this last ordinance, which is a text ordinance, so it would come here for the public hearing before it went to the commissioners.

Yeah, I've listened in on a few of these meetings and the presentation. I think HWC has done a really good job. They have found a few like note areas of conflict, which was good. Like so they've started, they've deleted things and they're doing a good job of making sure that it's clear what was deleted. So when it shows up at the commissioners, you'll be able to, just like we hoped, you'd be able to look at it quickly and understand what you have.
