2:57 – 3:360

The mayor's in the parking lot. Mayor's in the parking lot coming up. Excuse me. How yall doing? Tiffany Tiffany.

3:44 – 4:230

Hey there. How you doing? What's up? Good afternoon. Welcome to the city of Hampton Mayor City Council special call meeting for April the 24th at 2026, 3 p.m. held here at the council chamber at City Hall, 17 East Main Street, South Hampton, Georgia 30228. We have our opening unfinished business, second reading and adoption consideration and action on the adoption of ordinance number 202609, open containers. I need a motion to approve or to deny. I make a motion to approve. Second.

4:22 – 5:070

I have a motion by council member Duchaine and a second by council member Meeks to approve ordinance 20269. Discussion from the council. Did you look at the um the 20 I saw it change from 20 seat to 20 people. Did you look at that when I showed it to you and that's what you changed? Okay. So, anybody walking in with a container into businesses that don't have that, is that going to be a problem? No. Okay. No. I got a question. I didn't say they defined what a open container mean. Is it by by um the the u by the container, the original container or by um cup first?

5:06 – 5:500

Cup for cup. It's by cup. Yeah, it's my cup and it's actually special cups. Come, come on. Come on to explain to council. Good afternoon. I want to sit inside here. So, so we have special cups that are strictly for the festivals that have a label on it so you can identify what um what they're drinking or that they have a right to have that cup. I understand. But uh I I've been looking for it in here. Okay. You know what I'm saying? Because if it's not in there, it never happened. You know, anyone can say that. We can say today, you may be gone tomorrow, next two years down the line. This is

5:48 – 6:220

and that never happened. Okay. So, what do you need to say? I need to see something stated at I'm blind. I haven't seen it though. Eight. Item eight. You see when say may when you use see said um it said see the may require approve then may mean it's um optional

6:19 – 6:500

optional so it didn't state that exactly what I'm saying you didn't stated that the city will require if you want to change the wording I I I I will support it but I can't support something doesn't say may so can I make a motion that we approve it saying what is will and will absolutely chal okay

6:48 – 7:180

so I have a motion on the floor to amend the current motion to include on uh the resolution uh page eight of the exhibit B item eight instead of saying the city may require it. It should say the city shall require it. So, not page eight. I don't have seven. Seven. Seven. I'm sorry. Number eight. Number eight. All right. Okay. Yes. I'll second the motion.

7:17 – 7:590

All right. I have a motion on the floor to amend the the motion for ordinance 20269 to change that by council member Duchaine and a count and a second by council member Cheney for the amendment. All in favor of amending the motion. I have a 5. All right. One more thing. Sorry. Section 5 C. Um, when you say the city may establish and collect permit fee by the resolution, um, lawyer, what do you mean by that? There's no attorney here. She's on live. Oh, she's online. Hi everybody.

7:58 – 8:400

Hi. Um, so regarding that particular provision, it's it's usually with legislative writing, you want to do May because it puts the city in a position if they wish to or if they don't wish to. This is I know that this kind of um there's a city event happening in May, but there may be future events down the road um for a city event. So, I'm not necessarily sure if every single time you guys want to do a resolution or permit fees. I don't know administratively what's set up in the department. So, do you guys want to change that to shall absolutely um I I'll amend however you guys would like to. Can I ask a question?

8:38 – 9:220

Yes, go ahead. So other I mean we're using it as for our events. Are other people going to come and apply for this same permit if they're having an event? So that is an attorney question. I believe this is just for our events here in the city of Hampton for just for these are citywide events, city events. These are not for private events. Right. Right. Okay. Okay. Yes. Um so so May may is appropriate for us for or or or in a sense we wouldn't be charging ourselves. That's what I'm saying. Okay. I'm making sure. Um thank you very much. It is um you know if a vendor wants to come in though. So let's say you know the city is having an event and a vendor is coming in. No.

9:21 – 10:020

Um if you guys wanted to have some type of catering permit or alcohol permit um the city could do that if you guys chose to. Okay. But that would be a separate type of right ordinance. Yeah. Okay. M one of the reason why I asked this question because if the city if the city sponsor line C shouldn't exist. If we said that we're not going to um um accept um a permit doesn't it doesn't for the city it does should that line should not be exist at all. When I see like that it it doesn't seem to me a city mean a general public. That's why I look at it. Mhm.

9:59 – 10:420

So if you read five though, if you read five, all vendors selling and distributing alcoholic beverages within an approved event area shall obtain a temporary alcohol vendors permit for from the city prior to the event. The city may establish and collect a permit fee by resolution. So that is that when we're having an event, if we have someone that comes in that will be um um having So currently it stands as no one is able to sell alcohol in the city except for our alcohol vendors that have a permit already. That's right.

10:41 – 11:250

So go ahead. So that's what I was going to say. So you have to have a alcohol license here with the city of Hampton, which is our restaurants pretty much. Right. For the most part. Yeah. Well, so this this or agency is for city events and those who attends or who sponsor or get involved able to sell alcohol. That's what you're saying. Well, you not as a sponsor. So, what it's saying is that if someone is here in the city doing the event, if the the restaurants that sell alcohol already and already have permits through the city wants to sell alcohol, then that's already established,

11:23 – 12:080

right? They can already sell alcohol. What they want to be able to do is sell the alcohol on the event and they take their cup, our special cup around and walk. We have a lot of stuff beyond it that um Okay. All right. I'll move forward. All right. So, I have a motion on the floor that has been amended um with a vote of 50. Now, I need a um so I have a motion by council member Duchine and a second by council member Meeks to approve ordinance 202609 with the amendment. All in favor? All opposed? I have a 5-0. Seeing no further business, I need a motion to adjurnn.

12:06 – 12:170

I need a motion to adjurnn. Have a motion by council member Mitchell and a second by council member Duchaine to adjurnn. All in favor? I I have a 5-0.
