Thank you, Mr. Chair. Good evening. The board is considering applications tonight that are quasi-judicial in nature. On each of these items, the board must base its decision on the legal criteria that's detailed in the city's code that's also outlined in the cover memo, which is hereby incorporated into the record. Legal criteria are different for each item. However, for each of the items, your decision must be based on substantial competent evidence. Substantial competent evidence is evidence that a reasonable mind would accept as adequate to support a conclusion. Public sentiment alone is not considered evidence, although facts raised by members of the public may be considered and addressed by the parties. Staff will present its summary of each application, and then the applicant will present its case. The board may then ask questions. Then members of the public shall be allowed to speak for three minutes each. Because we have to follow rules of due process that allow parties to respond and provide evidence, members of the public will not get a second opportunity to speak. Staff and each applicant will get an opportunity to address those comments. The board may then ask questions to staff, the applicant, or the sworn experts. Once all questions are closed, there can be no further comments from any party. The board will then vote on the application. Mr. Chair, we're ready to proceed with item 7A.

Thank you. The first item, 7A, regarding Episcopal Church of St. Anne's. The address is 701 Northwest First Avenue concerning a conditional use permit and some variances to expand 1,526 square feet to an existing multi-use purpose building. Staff, you have the floor.

Check, check. Good evening, Board. Josiah Israel, Associate Planner with Planning and Zoning. Here to present St. Anne's Episcopal Church variance and conditional use application request. Here's the area of view, location of the church. Its location is 701 Northwest First Avenue. It is in the RD-12, residential two-family zoning district. And here are the requests from the applicant. Conditional use application number CU-26-02361 to expand the existing house of worship. It is the accessory multi-purpose building that will be having an addition to it. Also, the application number for the variance request, V-23-07357, pertains to house of worship. The minimum required site area for house of worship did not meet the minimum size area. One acre is required. They're at 0.96 acres. Required setback separation from House of Worship to adjacent residential. They do not reach the 50 feet, but certain locations they are at 35 feet and 23 feet. Maximum permitted gross floor area for accessory uses of House of Worship from 50% to 65% of total gross floor area of the facility. So the multi-purpose building is larger than the existing facility. House of Worship. And also variance from section 32-384E2 to reduce the minimum required width of landscape buffers butting side and rear from five feet to three feet. A little bit of background. As stated before, this is a conditional use to expand the non-conforming use. The House of Worship is conditionally allowed in the RD-12 zoning district, so they are able, under conditional use, to expand that use and expand that building. The property actually received conditional use approval in 2013 to construct the existing parking lot that's across the street. That parking lot contains 29 parking spaces, and the two parcels were unified through unity of title recorded in 2014. Analysis of the project. As stated before, 0.96 acres does not reach the one acre mark. A parking lot across the street, Northwest First Avenue, which is with 29 parking spaces. They have existing four parking back out spaces in front of the church that will be reconfigured into two accessible. They are also proposing a new parking lot with 27 parking spaces, which is located On the north portion of the parcel, they provide a total of 58 parking spaces and they exceed the minimum requirement of 56. Landscape area, 30%. They exceed the minimum requirement and a total of 48 tree credits where 27 trees are required. Here are the existing conditions. Top left, you can see the portion right next to the multi-purpose building, which has a tree, but that's where the addition will be. Top right, you see the green area, the vacant area north of the parcel. Bottom left, you see the front facade of the church and the multi-purpose building. And the bottom right, you see the existing parking lot. This is the site plan for the church. So the parking spaces that you see at the bottom left, those were initially four, but they're being reconfigured into two accessible parking spaces. And the shaded area at the bottom of the site plan is where the addition will be. They also have a portion to the right, as you see, that's shaded as well. So an L shape is being proposed to be added on to the property. So on the right side is where there is adjacent residential. So they are actually encroaching into the residential buffer that's required of that 50 feet. So they're already pre-existing in it, but they're going in seven feet more. And here is the new parking lot that's being proposed. That's a total of 27 parking spaces. They have 23 feet, two-way access way. And then above, you see that they have one way of 13 feet width with parallel parking along that side. And on the bottom where you see that shaded area, we're gonna go through the landscaping soon. That's the area that our branch was requested because they don't have that five foot buffer, that five foot landscape. Here are the elevations. The height is going to match the existing. The design is going to match the existing. So just in addition to that multi-purpose building to create more space for that building. And here is the landscape of the main parcel. A lot of trees are proposed to this property. Again, 27 trees are required. They're actually adding 48 total trees, total credited trees to the parcel. So that right portion, you see they're required to have five feet. They don't have that five feet. And where the addition is going, they don't have that 50-foot buffer that's required from residential uses. This is the accessory parking lot. So one of the conditions that has been made for them is trees 37, 42, 43, and 52. Those being 37 West Indian mahogany, 42 and 43 pink tabuya, and 52 gumbo limbo. Our city arborists went out there and saw that they were in poor condition. So the applicant is required to remove those trees and add some trees that are permitted species and would not be affected by overhead utilities. The findings of this application, the condition use application was reviewed and found compliant with the review criteria of section 32-964 for conditional use permit. for the expansion for the multi-purpose building. And for variance application number V-23-07357, the application was reviewed and found generally compliant with section 32-965, the criteria for variance is subject to conditions. Staff recommends that Planning and Zoning Board consider and forward a recommendation of approval of the requested conditional use permit and variances subject to the following conditions. Updated landscape plans to be provided at the time of building permit. Addressing the comments from the City Arborist and the applicant shall obtain permits for the removal of those trees. Again, as spoken earlier, trees number 52, 43, 42, and 37 to be removed and replaced. with permitted tree species and existing back out parking spaces located along Northwest First Avenue shall be reconfigured into handicapped parking spaces as shown on the proposed plans. And that concludes the presentation.

Number one, that's there. We have no objections to that. The trees, 52, 43, 42, and 37. We have no objections to that. I'm not a big fan. I'm just being honest of how we will have to do the handicap parking, but I understand that the city will not allow the back out parking any longer on that avenue so we can acquiesce and accommodate to meet that. So I have no objections and nothing further to say his presentation is a true representation of what we have already been discussing.

Good evening, Board. Once again, Josiah Israel, Planning and Zoning Division for City of Holiday Beach. This is 633 West Hollandale Shops, application number DB-24-01925, application number V-26-01191. The applicant, Gustavo Lomera, the location, 633 West Hollandale Beach Boulevard. The zoning is Hollandale Beach Boulevard West. The request here, applicant is requesting major development review approval to construct a single story commercial building of approximately 4,671 square feet of commercial space. The variance requested, Our branch is from Table 32-210A, reducing the minimum required 15-foot setback to 10 feet, and Section 32-212, reducing the required 20-foot wide street skip area to 15 feet. The subject site is currently vacant, approximately 22,500 square feet. The applicant had to obtain a cross-access agreement with the adjacent property located at 613 West Highlanddale Beach Boulevard, which delayed the process for them. The applicant worked closely with staff to mitigate variances the benefits requested, except for those we are having here tonight. The analysis for this project. There's the 10-foot-wide right-of-way easement proposed along Holladale Beach Boulevard that is directly in front of this property. 23 on-site parking spaces are provided where 17 is required. They are providing 23% of the landscape area, which exceeds the 10% minimum. 18 on-site trees and seven street trees are proposed for this property. They also have provided a decorative living wall On the east elevation, also, as stated earlier, brands requested for a 10-foot setback where 15 is required, and also for the streetscape area, a reduction by 5 feet. So here are the existing conditions. As stated before, this is a vacant parcel. On the left is the view from Holladale Beach Boulevard, and on the right is the view from Southwest 1st Street. Here are the renderings. Top left is the north elevations, the front of the building. On the right is the east elevation, and there you can see the proposed artificial green wall, or living wall. And this right here is the rear elevation of the proposed project. So here's the site plan. This is the overall picture of it. This right here is the cross-access easement that was required for them to make with the adjacent property. Here is a close-up of that site plan. So the 23 parking spaces provided. In the front, you will see the 10 feet proposed setback. And that... That reduction also reduced the required streetscape area. They were required to have 20 feet. There's going to be a breakdown of it later in this presentation. Here's the landscape. Again, they have 18 on-site trees, and they have seven street trees, four along Hollywood Boulevard, four Royal Palms. And then three orange Geiger trees upon Southwest First Street. So here are the variances. Again, they're deficient for the 15-foot required setback by five feet, and they're deficient for the streetscape by five feet as well. Here's a close-up of that. Here's the 10 feet that's being requested from the front of the structure line to the property line. They have 10 feet. What's required is for the streetscape area is 20 feet. They are providing 10 foot multi-use path and five feet of curb zone where they're required to have 20 feet. So what they did to mitigate that, what's left over, typically with that 20 foot streetscape area, you have five feet of setback area. So this property would be set back five feet and there'll be another five additional feet here. But the applicant, brought the building closer. They have 10 feet and then five feet. The findings the application was reviewed and found generally compliant with section 32-965 and the criteria for variances subject to conditions. For the major development review, the application was reviewed and staff recommends consideration by the planning and zoning board subject to conditions provided. So the conditions that are provided, one is the standard conditions for the impact fees that the applicant must pay at the time of building permit. And number two, compliance with the city green building program at enhanced level. Also number three, green building bond amount 3%. Then four, prior to the issuance of the building permit, the required 10-foot right-of-way easement along Honolulu Beach Boulevard must be recorded in the public record of Broward County. And number five, the artificial living wall located on the east side of the building shall be maintained in good aesthetic condition. This includes any replacement that's required. Deteriorated materials are fair to properly maintain the wall shall be subject to code compliance enforcement and repair of replacement upon notice by the city. Staff recommends that the planning is on the board. Consider the request subject to conditions.

How are you? Good evening. For the record, my name is Joseph Kaler, Kaler Architecture. Our offices are located at 2417 Hollywood Boulevard in Hollywood, Florida. And I'd like to thank both the chair and vice chair and all the members of the board for hearing this case tonight. Thank you so much. A little bit about my client. My client's here today, Mr. Loomer. And he's been with us from the very, very beginning to the end. And in addition to that, I have my associate that had worked on the project, Juan Diaz. as well so we're really uh we have the the team members here all together um you know we're proposing really a single uh story building which contains like was mentioned 4671 square feet it's located at 633 west hallandale beach boulevard it's on a half an acre of land uh it the building was designed so that we could accommodate either one tenant or two tenants so we can split it in half and the way the facade and the transparency was designed towards Allendale Beach Boulevard gave the flexibility to the client by having the parts that are solid so you can intersect with the mizing walls. If you wanted to have multiple more than one tenant in the building itself. The building basically is modern, clean in design, as you could see in your packages as well, and has a dialogue which really meets what is occurring in the neighboring buildings on either side, and it really harmonizes itself with any of the buildings in the neighborhood. A little bit about the proposed material sample board, which really was not discussed. Really, we have the main materials are black window fenestrations, white exterior walls with smooth stucco finish. Also, we created the illusion that the building frame is floating. You can see there's a lot of glass facing, and you can see all the structural elements. That was intentional. Also, we have provided a vertical garden on the east facade. We wanted to break the solidity, the solidness of that facade, especially as it faces south, so we opted for that softness, you know what I'm saying, of the green area, and as well as we placed UPVC as you could see them, into a grid somewhere at the top to give the building some dynamism and some more character and giving it a great composition. Basically, I do want to go over the two variances. The first variance is basically the required front setback is 15. We're asking for 10. We are matching with the building to the west. The building to the east, there is a very large raised platform that also goes out to that same line, as well as the overhang. The reason we really needed this variance was basically twofold. Number one, because of FDOT's requirement to share the roadway and forcing us no more than 50 feet to make a turn into our site, it created a very narrow tenant space that is part of that L that's on the east side. You notice, I don't know if you have your package, basically that tenant space right now is 30 or 31 feet. If you would have to take more setback, it's almost unworkable. It's like a 20-some-odd, 25-foot deep tenant space. The other part of the building has very deep tenant spaces, which is closer to the west end of the site. So you're aware of that. And basically, the second variance is very much related to the first variance, because one has to do with landscaping, and the other one has to do with the setback. And again, it's from instead of 20, we went to 15. You have a very good question that you asked, Charles. The actual, there is some parts, the front facade is not, it's 15 and in some areas it pulls back one foot. And that's the reason why we mentioned 16. So I apologize for the misunderstanding. Okay, if there's any questions, I mean, we really love the building. I don't know if we can show some of the renderings. Oh, there it is. Yeah, okay, good. Push this one here. I mean, it's really, really, really great in the sense that we wanted to give it presence on the street. We wanted to give it transparency. We wanted to give it, you know, so that when people are driving, you know, whether it be east or west, you can see all of what's happening in the shopping plaza, yet hiding the parking from public view all the way in the back so you don't see it. So really, it's a win-win situation for everybody, you know, on the site.

And if it doesn't live, it looks like crap.
