We're going to start with our items requiring a public hearing. If I could get staff to please read that item.
Public hearing regarding a request to rezone for a property located at 311 East Elm Street, also known as Acres 0.53, track F9-11 and 11-1, abstract A136, A136 Milan County School Land, track F9-11 and 11-1, Acres . 4526 from an R1 single family residential district to R2M single and two to four family residential district and multi-building residential district.

We'll start with applicant. Do we have an applicant that would like to speak? Please give your name and address.
My name is David crew. My address is 13 to big Ben trail rows. Several months ago. You all passed an ordinance allowing 2500 square foot lots in a maximum 800 square foot house. My business up on 67 is patriot tiny homes in. watching your ordinance it occurred to me that there probably was some common interest in my what i do and what you're needing so we designed an 800 square foot house that we don't call a tiny house it's a small smaller house but not a tiny house and located this property to put six of the homes on We feel that, which incidentally we would call Grand Village, we feel that the lot is ideal because on three sides it's currently, while it's currently zoned R1, on three sides of it are buildings that are less desirable than what we would be putting on this site. It's also close to the block, it's close to the square, it's close to David's supermarket and Dollar General so that buyers could even walk to those locations. PNZ turned it down because they were worried that I put a fourplex on the site. I can assure you I have no desire to put a fourplex on the site and be happy to sign any sort of agreement to that effect if we could. be successful in getting the rezoning achieved. There's been some concern about property values and whether or not this would negatively affect property values. these houses will sell for somewhere between 200 and 225 000 at 225 000 or 281 a foot and that that would be the highest price property in the immediate area which i think would uh would probably not drive down property values don't see how you can sell more expensive properties and right at the same time drive down the property values There's been some talk about maybe some kind of a joint venture with the city where we put in sidewalks on our property and the city might want to put in one between the development and the park. I'm amenable to any of that, perfectly willing to put the sidewalks on our development. We also are willing to give an easement for the movement of the storm sewer, and I've discussed that with the city about doing that, moving it down to the property line between our property and Jim Gartrell's neighboring property. which would take care of the storm sewer issue. In closing, if you need affordable housing, workforce housing, and I think everybody agrees we need that, I'd be surprised if you'll be presented with anything nicer than this project. You have a picture there, admittedly AI generated. but of of something very very close to what we'll do and in fact we include in the purchase price to car parking fencing landscaping and i hope to be able to get into budget as sprinkler systems so it'll be just a turnkey purchase to the to the buyers. Pretty good solution for people with their possibly a first home or even older people wanting to access some of the equity out of their existing home and moving to something brand new and pocket a little money for their retirement. I respectfully request that you grant the rezoning so that we can have a nice project like this in the neighborhood. Thank you.

David, 114 Heritage Place. Wanted to come today to restate the neighborhood's opposition to this rezone request. I want you to also know that this is the third go around for this exact same lot in which the neighborhood has been consistently opposed through all three, including this most recent. The basis of the opposition is this. the existing severe traffic load that already exists in that corner along 144 to elm street is already severe backed up congested any multi-family there is not a good idea uh the intersection of elm street itself and 144 is already dangerous to make turns in any type of multi-family multi-unit construction is going to add a lot more vehicles right there right at that intersection The side street parking congestion is already a problem occasionally when there are cars parked on the street trying to weave in and out of there. You're talking about building as many as five or six units from what I've heard, possibly. So that could add 12, 18 plus vehicles, depending on number of family members and not even looking at guests. As mentioned, there's no sidewalks currently. This street is an access to the backside of Heritage Park, the Riverwalk. There is a lot of foot traffic. There's a lot of children that ride their bikes, scooters, whatnot. You're adding a lot of traffic and creating a dangerous situation. the multi-family multi-unit constructions which is we've always been opposed to are not consistent with the neighborhood it is an r1 single family that's what's there that's what's been there that's what the neighborhood would like to continue to be there and we tried to compromise previously to allow for that for this is a sub half acre lot that you're talking about splitting down into four five six Lots right? You're going to create lot sizes are dramatically less than the surrounding average lot size. You're going to create home sizes that are far less 25% or so less. The lot sizes I calculated about 75% less than the average lot size adjacent. So it's inconsistent in that regard. The current neighborhoods, like said, are established have been there. I realize this is not a construction permit request, but to really consider a rezone, you have to consider what you're enabling could go into this lot. So I think it's a bit disingenuous not to consider that you're opening up development of this one lot in an established neighborhood to construction, which is not consistent with that neighborhood. Everyone recognizes the need, the goal for to provide more low cost housing. This is not a great location for that. If nothing more than just because of the traffic loads it exists. At the zoning committee meeting recently, My recollection was that all of the feedback letters that came back in, I think there were seven, they were all negative, they were all opposed. That is consistent with the feel of the neighborhood going back the previous three efforts in this regard. So I hope that the council will take that into consideration in any consideration of a possible rezone change for this one single lot at this location.
i live on the other side of elm street where you have had multi-family units being built in the last several years where there's more that i understand this lot tends to propose nor towards the more expensive side of this neighborhood you have to think this is the split between wolf city and what people like to refer to as snob hill unfortunately i'm going to say it in this council meeting The more expensive houses are on the left, the less expensive houses are on the right. My mom bought her house in 2011 for $90,000. She is in a manufactured home that has two of them split back to back. I am tired of looking at this lot empty just because it's wasted space i don't think you could put a regular residential home there again i'm sure you could make it work but the one that was there didn't really work in that because the lot's awkward and it doesn't fit and you have if you go on the other side a lot guard trail is building more and more homes there which is going to drive up the value and if you go across the street you've got a house that is technically i would consider a trailer home um that they've refurbished and refi and i love it don't get me wrong it's a nice looking house now it was not a nice looking house a couple years ago um so i do think having these would be beneficial one it gets you the housing you need in this town it gets you affordable housing that you need in this town because 200 doesn't sound affordable but it is affordable in this town you can't buy a house try to sell the house next door for over 300 000. it's not that big we live in like a 2 000 square foot home wasn't worth it um on the if you're coming off elm street you've got a dilapidated trailer that sits there this would as much as you're gonna think these tiny homes aren't gonna improve the value i think they would improve the value because one it's not an empty lot sitting there two it's got houses on it that people can afford Three, it's just a good location for houses like that that, like he said, are for older people that want to downsize or younger families like myself. I wouldn't live in this town if my mom didn't have a house here. I couldn't afford it. Frankly, I just could not afford to live here. I'm thankful my mother has a home in this town and lets me live in it. I think that really good. And you also have to think we have a couple of these different kind of, I guess you could call them little neighborhood sectors in this town. Look at the hospital across the street from the hospital. You've got those little five or six. I don't know how many there are six or seven, the little green two story houses that are there. They work right there. They work. I think in this little corner they'd work because you're not really going to see them. Yeah. It's going to add traffic. But when in this town, do we not add traffic every day?

John Lenz, 1047 Quail Ridge. I helped David get this property kind of in a contingency agreement with Shelby and, uh, Once I have kind of a semi-prepared statement, once I complete the entire six lot development, we'll add 1.35 million in market valuation to just this one particular lot. MLS data I pulled here shows that currently the Somerville CAT is collecting property taxes on average of 91, almost 92% of the sole price for new construction. Therefore, this project alone will bring in or can bring in almost 20 grand a year in tax revenue before any applicable exemptions of which our ISP is eligible to almost 10 grand of that per month per year. The silver lining for existing property owners is that the premium price per square of $280 for this new workforce housing can actually lift the surrounding baseline property values benefiting existing homeowners the average current the average currently in a half mile radius of this property is 207 dollars a square foot heritage estates is only at 226 square and the new project grand village is at 280 a square foot Prospective workforce buyers want safety and security in their new home purchases just as much as high-end existing homeowners. If you're a downsizing empty nester or if your adult child or grandkid were hired as a med tech at the hospital or ISD or city staff or even in law enforcement here, would you want them to buy a new designer home across the street from an eyesore mobile with a dog chained to a tree? because sadly that is what we faced in our search across the r3 zoning landscape for many not all appropriate sized lots of which i approached over 12 landowners the current owner of this lot saw david's vision and is graciously supporting his effort to better this micro community based upon the ordinance that has been proclaimed and codified by city leadership council has previously rejected single family homes on this lot and some folks on zoning are a little afraid that an evil townhome might appear So what does the City Council and naysayers want? If none of the above is warm and fuzzy, the current landowner is compelled then to put a mobile on it or a very basic house. That scenario would allow the owner-renter to put unlimited vehicles, trailers, construction equipment, you name it, on the corner lot, whereas this project would not even allow such eyesores due to lot size, landscaping, fencing, and almost impossible street parking due to driveway limitations, not to mention pride of ownership. in a new construction. No developer will invest over a million dollars to put a project inside the current R3 zoning option if surrounded by neglected housing. This project works due to its immediate location next to the B1 zoning and abutting the R1 zoning. The 2,500 square foot lot ordinance needs expanded legs, zoning legs to stand on. It needs a council with a vision for propelling the immediate area into something new and more economically vibrant. I implore the council to improve the zoning change contingent on some form of zoning modification or development agreement roughed out prior to maybe even the next meeting. Thank you, Mr. Rentsch.

this is a contentious conversation and we're all very aware of that so this is just some facts the pnz voted no because in looking at the r2m There is the potential of things that we didn't want to see happen. And whether or not that's what David would have done, we're not allowed to look at what he wants to do in making our decision. We can only look at what the potential is. the negative votes constituted 16 of the um the opposition papers were 16 of the total that were sent out at 200 200 yard or feet radius and so this does not require a super majority of council one of the things that we have learned in the last two projects that have come forward nothing about them or the other project on fourth street is that we left gaps pnz when we created the 2500 ordinance square foot lot ordinance we left gaps and in conversations with patty over the last several days we felt that our best for forward unrelated to any vote you make tonight is that we need to add a new zone called an R5 that is specific to that 2500 square foot lot with the 800 square foot home so that we can limit what else could happen to that lot instead of asking people to go to R2M. So we are going to be bringing that to PNC this month, have a special meeting to get it voted through and bring it to you by your September meeting so that you have something to look at that is specific to these smaller micro projects. That's all I wanted to say. The vote is obviously up to you guys.
So the question I think is, and I guess I need some clarity, is do we have to vote on this today as the 2RM, or can we table this for more information to see what additional choices may be? in this R5 class and what we can do to understand how to, we've already done the first phase of this, which was in a prior council, which was understand that our comprehensive plan wanted housing that was accessible for workforce and first time home buyers. Council allowed for a 25 square foot lot up to, I guess, up to 6,000. And even over 6,000 is R1. But we don't really have the mechanism to put it in there without just picking like this R2M, which just seems to be the only available one. So that was sort of the impetus to sort of talk to Pam about the missing gap here. the other piece to this is knowing that council put this together meaning that smaller lot sizes based on our comprehensive plan specifically for recognizing accessible housing i think we need to look at that in full so that we don't run the chances of smaller homes smaller lot sizes being built on those smaller homes being built on the smaller lot sizes, those being purchased quickly by an investor and very quickly, immediately turning into a rental property. That defeats the whole purpose of the original council's vote to try to have smaller lot sizes so i think we need more information i think we need city attorney to address exactly what um we can ask um of this new zoning classification I'm super happy to understand that the builder is willing to sign something that allows for this to move forward. But I think I guess I just need clarity on are we asking for this vote right now to go through on the R2M or do we table it and look to see what council and staff and P&Z come back with?
You don't have to take action. you don't have to vote um i think i think some clarity would be some of the things we've talked about individually um obviously the property value is of concern for current neighbor neighborhood um our task to bring affordable homes to glenrose is still something that i i want to see now plan and zoning they look for the best use of each piece of land with the best use is that what we're talking about here i don't know but if we could limit the properties to an ongoing new r5 that might specify single family home occupancy, ownership only. I don't know if it can be done, but some of the questions we have for our legal representation on what we could do on R5 is that question here. Pam, quickly, if you have something.
We can definitely state that within the R5, it can't be used for short-term rentals. We will definitely need to get legal opinion if it has to be an owner occupied because they don't want long-term lease would be still more advantageous than somebody switching to Airbnb.
Yeah, I think maybe it's not under the R5, but it may be under a development plan of some, maybe a segment of the development plan.
And R5 will definitely state no short-term leases, but we'll have to figure out how to get owner off the pipe.
It may not be possible. I don't know. But I know council members have talked individually with others and looked at this. And I realize this is three times through. You made that clear. I understand.
Can I just interject on that? The last time we tried to compromise with Shelby and say, look, multi-family apartment. We offered to do, you know, that we were to say, look, the neighborhood's not opposed. If you want to divide this into two flats and put two single family homes on there, fine, go for it. Because now you can have parking, you can have carports, you can have things that it takes to make it consistent. That's what we're trying to do.

sewer drain line that basically runs through the uh northeast part of the property and it kind of goes up on a diagonal which basically means that that's an easement for the city and you really can't build something on top of that where we may have to dig it up sometime in the future so i don't i don't know i know we took the comment was made that we would relocate that and or re or move it um obviously we can't just move
property but um obviously that's a big concern i don't know how we address that and i think that is something that needs to be highly considered yeah that's that's um in the works i guess i was put in years ago i can't find a record of an easement So it's going to have to be relocated. I'm working with the neighboring property owner to try to secure an easement to where we can put that water over to the drainage way that . So it's not a done deal yet. at the guard trail property. And so I've been talking to him. He's under the weather, so kind of taking a little bit of time. That's the plan that I know for is to secure easement over to the property.
So another unanswered question that matters.
Mr. Mayor, I'm just a little confused, which is okay. So Mr. Holder stated that on that sewer line easement, that he cannot find a record of the recorded easement being granted to the city. Therefore, it has to be moved anyway. Is that what you stated, Mr. Holder? Yes. So you're going to have to move that sewer easement. I mean, sewer line. Is that right? The sewer line? Anyway, I was just wanting clarification. You can't find the easement, so you're going to have to move it. Is that correct?
I don't know what the limitations would be, and I know it's against the wishes of current residents. I'm not totally convinced myself, and it doesn't matter whether I am or not, but property values in this day and time with the way the inflationary prices of homes have gone, we're talking about a house that's more expensive and probably going to be relatively nice. Does the traffic come into play more than that? All these things. Matt, it's a tough gig to make that decision up here. Well, you know that. You all recognize that. But I think we should talk about the R5 potential, what we can do between a development agreement, between what the state will allow us to limit, say, single family, owner occupied only i don't know if that's even available but it might give some comfort to i would much rather have a owner occupied home in my neighborhood than a rental anytime and i i just counsel you decide if you want to consider it through legal and see what we can do to form a new um zoning with uh category
Yeah, I mean, is there any more discussion? Because I'll move that we table this and not vote on this and wait for additional information from P&Z and staff and the attorney. And then take up the vote when we have the information at the next meeting or the September meeting.

Item three discussion consideration of possible action regarding awarding a bid to the Texas Drive paving project.
Good evening Mayor, Council, I'm Chris Hay with EHT. We helped Jim put this project out for bid. We received bids on August 5th. two contractors bid on the project after review of the bids the lowest bidder was jay mills contracting out of stevenville they've done work for the city and various projects with us in the past um based on the review of their bid we're recommending award of the project to them in the amount of three hundred and forty nine thousand seven hundred and forty one dollars and five cents Just a little bit of information about the project. It's a reconstruction of Texas Drive from Bo Gibbs to Valley View Street. We've been in a few different ways and the cheapest way or the lowest bid ended up being a full base reconstruction reworking. the full width for the full length, and then a two-course chip seal surface treatment following reworking of the base. So we think that's going to be out of the alternatives that we put out there. That was the best alternative, I think, for the final product. And with JBL's contracting bid, that came out as the lowest bid as well for that moving forward. So with all that said, we are recommending a ward of the project to them. in that amount for the alternate bid and i'd be happy to answer any questions or expand on that if needed i'm sorry chris i missed it from gibbs to Okay, yeah, so there, if that's something that you want to look at adding to the project, the amount to move to work that in, depending on what we did would definitely fall within the allowable change order to the project. We. Talked with Jim a little bit about that. An option may be to do a surface treatment from Valley View to Vista Ridge to make it match and work. I think the majority of the issues was Texas Drive in Valley View. That was put out for Ben, but we can work that in if needed and coordinate with the contractor and Jim to help make that happen if needed.
Chris, when would the project start? When could they start? I think As Jim explains, there's weather considerations for these type of layerings. I want to see the perfect weather for it right now.

I think the only question I had was in the agenda item here, I think Jim might have put it together, that said water made its way under the current layer.
happens and then it freezes is there were you able to isolate where that happened make sure that it's not in an area where that's likely to happen again yeah so that's kind of the nature of so what it looks like to us is a surface failure issue and with chip seal surfaces over time that can happen And especially with moisture gets in between aggregates and then when it freezes, you see these kind of issues. So that's why we're going, we're proposing to go back with a two course treatment to help give that little extra surface course on top of that. I wouldn't call that. the failure that's happening is more just a longevity and over time that could has the potential to happen when you see freezes like we've had the past couple of years. So, um, over time it's going to happen and, and leads to projects like this, just to restore it back to, back to new condition or like new condition.

Well, I'd make a motion to accept the bid from J Mills. $349,741.05 for the asphalt replacement of Texas Drive from Gibbs to Valley View.

All right, I have number four discussion consideration of possible action regarding the city of Glen Rose benefits package for plan year twenty six twenty seven.
The broker went out for all the bids. He's actually on zoom. If you all have any questions for him regarding.
It's way too much information for me. That was just as crazy.
So what we currently have is Aetna. And as you can see, it will have a slight price increase for the next fiscal year. Or there was a second option that Mr. Rose was talking to me about that uses the same Aetna network. It's just a slightly lower a price for the employee. I don't know if y'all, I forget the initials like PMI or I forget, but it's right next to it. And then we're keeping Mutual of Omaha for our vision and dental because the rest of the quotes were higher than what we're currently paying. every uh plan would have an hsa option so this is the angle no good okay well there's he's still muted so okay oh he's unmuted hello sir hey everybody there he is um can you go over the the no The difference between the Aetna and then the one that is still on the Aetna network?
Yeah, no worries. Thank you.
So with Aetna, we were able to, the initial renewal was an 8.7% increase. We were able to negotiate that down to roughly 5%. The other option that we're looking at is called EMI Health. And EMI is just the TPA, the third party administrator. And what they're going to utilize
Would the levels of coverage be the same?
Yes, ma'am. Every carrier has just a few different nuances, but on the Aetna versus the EMI, there are so technically the co-pays are cheaper on the EMI health plan.
And as far as the formulae, it's going to be the same and the deductibles are going to be almost the same. Like for instance, So we were able to find savings. Our current $3,500 deductible, EMI has a $3,000 deductible.
So you could argue that the actual plan is going to be a better plan than the current one.
Are there any negatives to the plan?
The biggest disruption is the employee's ID card will have the EMI health logo and it also says
What about prescription meds? Any change in that?
The formulary is very, very similar.
That's a hard question to answer because every medication has a different drug contract with every different carrier. Those formularies are 200 plus pages. But overall, you're not going to see much disruption.
I'm just looking at your prescription deductibles. in the tier four, you're playing an $80 deductible, then Aetna, then EAT, whatever this other one is, was $150 deductible.
Correct.
Any other questions, council? Bronco, you've reviewed it. I know you know this backwards and forwards. How do you feel about it?
Well, once, because I was a little concerned about the EMI, but once he explained it to me, then I felt at ease, especially after he explained that there's really minimal disruption. This is actually, I believe, less expensive than what we're currently paying, where our employees are currently paying. And one of the things that our employees like is that HSA plan. So this will add a little bit extra onto their HSA plan. so you know there's if we stay with aetna then they're going to see less on their hsa i probably i think it was close to 60 a month less so versus stain which has a seven percent increase
for the employee. Can you do that?
You have to pick, Mitchell, you have to pick either EMI or Aetna, correct?
Yes, ma'am. That is correct. The insurance carriers, you can only offer one medical carrier.
But EMI has the tiered option set like we do with Aetna. So we have some employees who are on a not on the HSA plan, but they have chosen to bump up to the next tier or even that third higher tier where they pay extra to have more coverage, less deductible. So as long as I think we offer those three options for every employee, the EMI will be fine. And it'll be a cost savings.
Seems crazy. We're up here voting for other people's health benefits, doesn't it? But they've got choices for levels deductible.
Do you have any other questions that we need to or any other topics, anything else we need to explore with us?
I mean, this is the main one is the health care and you know, nobody's going to lose their primary care physician. The network is still the same. And then with them, we'll be able to, this risk pool, it works a lot like the TML risk pool that we're all in. So, you know, they, they're able to offer these lower deductibles and because they're, we're shared. So if I, if I'm explaining something incorrectly, Mitchell, please let me know.
The premise behind EMI Health is we're trying to pull risk, and when I say pull, I'm trying to put a bunch of employer groups into a pool and share basically the same
very volatile market right now and we have no idea what the next 12 months of
Mr. Holder is asking if there's other cities on the EMI currently. Currently, yes, sir. What's his answer?
I think he said no. Did he say no? Yeah, he said no. No other city.
I know I didn't sign up.
How about is there any?
you hear it can you hear what his question was yes i will have to get permission for that to to do that but i can i'll absolutely ask okay is this decision to be made soon well our open enrollment is scheduled for the 25th um but we can always push it until after our second meeting or second to our second budget meeting that'll just make the timeline for open enrollment and they build an employee navigator for us so that all of our employees can sign up online so i will that be more difficult on the timeline if we wait until our second meeting of the month that would be september
25th it would be the day that we were supposed to have our uh oh okay sorry uh yeah we should still be okay okay then yes we can we can push this decision okay why don't we ask and see if we can get some uh references to check and then we can uh i hate to say pull the employees but that's basically what i would really like us to do is see what the employees think see if they
can do. And I can have that by our workshop and include that in the budget amount. Okay. This includes dental? I mean, it's no, this has nothing to do with dental. It's just health. Our dental vision long term is not changing. This is just health insurance.
All right. Any changes in the out of coverage? Like if you go to a doctor that's not in the network?

But in reality, they're the competition. That's where that's within a reasonable commuting distance.
