So for this petition um we recommend um approval of uh reszoning from B1 to B3 um as is consistent with our plan. Um this petition did have two support letters that we would like to make sure that we now chose. Um, one from Patricia Davis Davis. She said, "I would like to tell you how excited myself and my neighbors are to be a cafe in our neighborhood. We are excited group that would love to meet up now and then. Hello. I am at the property next door at 704 Street. So, we actually um before I fully support this petition, I would like to learn some answers to some really important questions. Why can't the proposed full service restaurant seek a specially reduced variance in its current zoning classification instead of on its own? Two, will a special exception variance allow the city to impose additional regulations such as hours of operation, screening, lighting, and noise? If this zone does get approved, will it now allow other uses to be permitted that are listed in your B3 document? Will the res cause the structure of yard parking setbacks sliding noise and landscaping requirements to now be nonconforming in the proposed zone? And aside from change in use, what other changes are being proposed? Is there or will there be a site plan or development plan proposed? And by the way, it's my understanding that the zoning committee was created to protect people and property with or us and our family. Will our home still be protected if this resone is approved? In particular, I would like to know, will the reszone make my property more susceptible to eminent domain? And will we be able to get a resident party for a handicap designation in front of our property to ensure that my 92-year-old dad has access to his home? And I will say this I have the job and I do love to but there just are lots of questions you know and obviously I know very resident we have lived here my dad and I too have lived here his whole life and they actually are supporting businesses. I just am concerned until we know some of these other answers because I just think we need to proceed cautiously. Um, and those of us that have lived there and our residential
nature, we like our neighborhood, you know, and we just want to make sure that all considerations are so I am Chris and I know several places. The one closer to reach box is 737. Um, I am so happy they're coming. We definitely need something down on the north side of Lake Street. Um, the reason why we actually bought our property is because it was zone for business and residential. So, we love the beach.
Thank you. [Music] State address. Um, let me just say quick basically. My name is Jason Bush. I have property since 29 Hamilton which I'm developing now and I live at 1628 Juniper. First of all, hugely supportive of local entrepreneurs. Um, building businesses is hard. Anybody wants to do it around here without my support. I also think investment in the area generally is a good thing. Um, but I think I've spoken to a lot of residents around corn or around block. I think there's a real misunderstanding among people as to what the zoning is about. Um that was owned as was a business that existed for years. So what is going to be done based on the zoning? Some of the concern as well is my Hamilton property that was the alley behind literally you could underhand your bottle from the reing there onto my back window. And I think that's a real concern given how small the alley is in the houses in those areas based on what it's going to be used for. Again, with a caveat, we'd love to see something along North Lake Street there. There's also been a history of crime in the area as we know it's not gotten better in the past couple years. It's gotten worse and about mile down street, we had a murder or at least a homicide ago. So certainly alcohol, you know, without food or without copious menu food can lead to issues uh in a bar setting and I think given all of us who live there and are investing in the area to think quite a bit about. Um I also voice concern based on my neighbors that I've spoken to as well about locally on the development uh further on the street for a lot of other activity which is not in keeping with the residential nature and residential
zoning of North Street. uh as well in that regard. And then last um and this is anecdotal, I haven't spoken to others about the zoning as well. Um given that property could be used for dancing, does that imply as well gentleman's club in future? So anyway, a lot of questions. I applaud you as an entrepreneur, but uh there's a lot of responsibility. Okay. Thank you. Anyone else?

Directly across the street from the beach house. I do not have any problem at all with a small business. I welcome small business. What I do not welcome is noise. I'm not comfortable with the carry out alcohol place so close to the water. If you've ever walked in a chain find a dead body, you'll understand why. Noise, parking, and our biggest concern. This red district could very easily lead as a gateway to further development of our pristine lakefront. That's why I pay the taxes I do to enjoy the lakefront. If I want to go dancing, if I want to go drinking, I'll go downtown. I'll go to Tiny's. I'll go, you know, there are other options. My concern is where does it end? Okay. I don't I don't need the noise. I don't traffic and I'm being very selfish. I understand that. But to have just a small carry out bar food kind of after work go sit in on wine. Absolutely. I'm not against the business. I'm against what it will lead to.

Uh this is to our director. the um uh these only processes being done takes into account some of the issues that have been raised um and may satisfy the concerns. Would it be appropriate um unfortunately to postpone this for a month or two until that is completed so that whatever reasoning is done is subject to the new regulations that we're proposing. Um so this is just
because we can't specifically say when the zone regulations will be updated because there are several processes it has to go through to be approved several ratings and uh it's up to you all whether you want to continue it based upon um your parameters. We our recommendation is approval. But we do have some conditions and those issues as far as parking as far as the site plan. All that's required um if you access a detailed parking circulation plan and a site plan for you.
Yes. If you look at the back and it's at the back of the petition. Um did one more detail kind of running behind but that those are requirements for approval from us. Um and that will help identify the things in the park where they're going to park off.
Um but ultimately we just give a replication and then you all make that determination. But we can't say that a day or a month or anything as far as signing um a day or week. Just so that you're aware, one of the issues that we um considering the regulations is uh screening um you know with trees, bushes, whatever it happens to be. so that the concern of you know a nextdoor neighbor would be reduced because there would be some um physical uh barrier in essence between the two properties. Um but I don't believe it's in the current uh zoning. So that you know you wouldn't be subject to that currently and that that's so the issue that I'm thinking of is is that I pass my question.

Attorney Roberts wants some lots in this uh subdivision where to vacate the uh streets. The first issue I have is that I don't believe this petitioner has legal standing to petition for this. This petitioner is the apparently the uh owner of an LLC called in a clutch LLC and I tender to the board attorney Mr. Molina evidence that in a clutch LLC does not own the land in this subdivision it's owned by clutch LLC which is based on the secretary of state records that I've also tender to Mr. Molina is not owned by his petition. So I don't think he has standing this this petition. Um second of all, Mr. is here. He would uh tell the board if you'd like to hear from him that he would become landlocked by this petition. So um based on what I feel is his lack of proper notice to him and uh based on the fact that the petitioner is not the owner of the LLC that has petitioned um is not the owner of the land that the he has petitioned the name of he's petitioning it again in a clutch LLC and this land is owned by a clutch LLC and the documentation on the secretary of state's record show today Julia L. So when got uh vacated, there was still the alley in between to let you into these two two properties. When uh the petitioner combined all that properties together, the alley is gone. And so now there's no way to come through the alley to these properties. There's no way to come from Homer Street to these properties. And now he's vacating this side and the back side. No way to get you to the alley to get to these two properties. So you would be landlocking these two parcels that he's trying to do. This is totally wrong. Either one of two things need to happen. Either you unveil the road and give us access to those or deny this or give us the alley back in the middle so we can get to the properties.

Uh the next item on the agenda is the uh public hearing for the city of Gary comprehensive plan. Uh we won't have a presentation today by the city. Uh, I think Cory's going to kick it off and we will have a a presentation from Notre Dame and then we'll be entertaining comments uh from the public uh at 2 minutes each of where Cory is standing right now. Cory, please kick us off. Thank you.
First of all, thank you all for coming out tonight, especially to Marquette Pavilion. Thank you for welcoming us here as we work on our ADA accessibility at city hall. So uh we have been working on this comprehensive plan for the last several months. Uh we kicked it off earlier this year and we began working with MKSA doing a lot of research uh reading through the existing plans that the city has done over the last 8 years. And uh then we moved into throwing out some ideas and listening to your ideas. Over the last eight weeks, we have made our way uh through several drafts of the comprehensive plan and around the community at different events. In fact, the board that you see here is torn and written on. Um we continue to get input and in fact yesterday we were out at 16 weeks of summer getting input from the community as well. Um, we have a full presentation that was recorded at last month's planning commission meeting and then we also have a full presentation that was recorded at the city council from last week. In that presentation, I walk through our process which I just explained to you and then the chapters that we're covering for each of the specialty areas. A comprehensive plan is the vision for the city. This is a 10-year vision and uh it does not get into the weeds of zoning. Like for instance, we just our first uh petitioner today was in regards to zoning like landscape and setbacks. That is zoning. Comprehensive plan is how can land be used in the future. So, a big
portion of our comprehensive plan involves land use and we had developed a map that was based on the 2019 comprehensive plan and then uh feedback from city council incorporation of our plans that we've done over the last several years and feedback from the community on what the land use should be in the vision. We also have chapter on our school redevelopment sites. We have several vacant and abandoned schools. When we started this initiative, uh there was a lot of discussion around uh the back school site and as a result of that we incorporated um 10 schools, 10 properties, nine or 10 properties into the comprehensive plan that was specifically how can those sites be redeveloped if they are not if there's a school site not specifically in the chapter is represented on the planes. that we also have a section on uh nature and that includes our parks. We uh currently the chapter includes climate environment uh through input from our sustainability uh committees. We will be breaking that up, but I'm pretty sure we also we've been gathering input casually from you and our stakeholders over the last few weeks. This is our formal public hearing that is required by state statute. So, uh this is an opportunity for you to come and speak and on the
record and uh we can incorporate those comments into the comprehensive plan as we continue to finish it out. One of um our great partners in developing the comprehensive plan was uh Notre Dame. They last summer came out and did a plan for the downtown specifically. And so you'll see some language from their downtown vision plan written into the town plan. And we have a representative from brother David here today that's going to give us an overview of the downtown vision plan. So with that President I'll turn it over to you.

We're going to give them full 10 minutes uh uh to do what they what what they want to do to to uh give us a summary of their findings or what's next and then we'll open it up for public comment immediately following that. Yes. Hello, my name is Mara. I'm the director of housing and community regeneration at Michigan at the school of architecture at the University of Mona. First of all, I want to thank you very much for inviting me um to be here and the opportunity to be here today uh to speak a little bit about the the plan we did last year. the one-year anniversary of a community engagement design workshop where we really focused on the downtown establishing a vision for what regeneration um restoration and reactivation of the downtown area the core city might be. You have a report which has been issued which is on your website right now which goes into much more detail. The key piece of the team you're at crossroads to determine what is the future of the city you want. Um and you have an excellent team to put it together. You're dealing with issues that are universal. Everybody has his own issue. Everybody has some form of asking the question where do we start to activate and get the social and economic outcomes we're looking for. You guys just have it on a much larger scale. So navigating this is is something that most cities are working with. You guys are working with a larger scale. So the plan here that put together through community engagement and is is being carried forward now with the the mayor's office um is really looking to answer those questions. How do we take limited funds and activate them in a way that can be happening that can that one one development leads to the next um something that can happen in the process of really identifying what your identity is. these these really the first few
pieces that come into place, the scale of development, which looks to how do we make make a city that is truly Gary and at the same time making sure that the the existing residents are part of a process and new residents are not here. And so it's a really exciting moment. that you have um the vision is a piece that needs to continue to always be in the forefront but then you have to get down and that's the ultimate. So looking at very specific places to start looking at essentially what we're doing is creating um city building. We don't build downtowns anymore. We we push out to spraw. We push out um to build far away. And as there's a renewed need to have a walkable place that we can live, work, and play, um we have to reinvent the entire ecosystem around that. So, it's it's really exciting to see the progression happen and the opportunities that are coming to Gary. Um, I want to make myself available for anyone on the plan commission to the public that has questions about how these next steps might come to be about some of the steps of the process you've already taken um from Shur Report the Zoning 911 moving forward and doing amazing things in removing the barriers because once we once we say yes, we want to have a mentality then you have to start one by one addressing the barriers that are shopping And one of the main things of zoning is it's illegal to build on the lots because the typical lot size is narrower than the frontage and so you're addressing that changing that. So these are really important really successful moves that you're making. And then the next question is what is the scale of development that you put in place? And
that's a really big big question because very often there's a one sizefits all model that we use and it's the big what we call the Texas donut of the big uh apartment complex. Um that's a really hard thing in finance. And so from planning point incentivizing and looking at a model of growth that is not a default setting is going to be a really key thing. We're working within our um within our initiative. been working in cities in 100 mile areas and pure communities to you that are dealing with these exact same issues as I was saying before not at the scale that you are at the exact same issues and their planning boards and the planning commissions are looking at tools to to activate their economy through smaller midsize increments of growth and that's really something that we really strongly recommend that you look at Elar specifically is doing exactly that right now. They started in the river district with three and four story buildings with no parking in them. Just parking that on the surface. There's no shortage of parking in the city. Um that you can find ways to build small buildings that need a smaller increment incentizing these and building several times. We're working with Jim Brainer who's the former mayor of Carl, Indiana. They built a city in a strong suburb of Indianapolis. Um they started very similar cases too. They had they had nothing there. So just surface parking with strip malls. They started in small now it's major buckets. They're doing big structured parking and everything around it. But they they were very strategic. So we want to make ourselves available to you guys as we're looking at our next steps to take what is the vision, the mayor's vision, the community's vision um to activate that
and turn it into a reality. Um, this is the the you can be in all three the drawings, but now it's the fun part of actually figuring out how to take those next steps. Um, but we'd love to continue to help out as you do that and make yourself available. Um, as you try and unlock the basically 100 years of disinvestment that every city is having, you're unraveling and trying to do it all in these next few steps. Um so I want to congratulate you too on the amazing strides that you have made and uh and continue to make ourselves available walk with you in the process. Thank you.

We have an empty garden on Broadway on between 21st and 22nd Avenue. And we've been asked to dedicate the garden. The garden is community garden because we Gary is a does not have the resources, the groceries, the present, it's a food desert. And not only is it a food desert, our community garden brings community together. It is our goal and our purpose to have a peaceful place and we don't charge for our vegetables. People stop all the time and we don't even make it. We want them to have that experience and that connection with nature. We have children working in the garden. We want them to have that connection. And what makes this time right now so important is we all understand what's happening on the federal level with the um immigration issues. The people who plant our food and pick our food, they're not available and they will be less available in the future. So we have to start developing our own food sources. Right now we use gas stations as grocery stores and that is ridiculous and how they appease us. They put a bus for that count. That doesn't help. So like I said it is
a source for community come. We have young people who come and spread the word in the garden. We work with literacy coalition. We have read the garden of those children in the garden. That's my time. Our vision is of course economically based you know the area in general but a green space is also important and I'd like to come down if you heard of the blue zone I don't know if you could be a blue zone but we could do something similar to having a blue zone we can consider having a mult all the neighborhoods. If let's say 21st Midtown is full of businesses, I guarantee you that people driving past will slow down if they see the dark because that's what's happening. That's what's happening now. What's on Broadway now is being cleaned up, but that garden is the brightest spot on. So I said, "Who's on?" Go ahead.

Okay, Jenniferlock. [Music] Uh Jenny 75 Avenue first district. Um I'm here as myself advocates for responsible development and also the Gary environmental and sustainability advisory council GAC. Um which I know has submitted a draft section to be added to this. Um, I was hoping that you guys would refer and continue to accept comments and not accept the plan yet because I know there are still many pieces coming in. Specifically, two things that I think were done really well for the site, the school site um the way that those were all the comments around that and the um rings that have been created I think were very well done and I appreciate seeing so much residential um brought to those areas. I also think just getting the feedback from Check and things like that and focusing on sustainability and bringing that into our vision is really important where I think the plan is still efficient is one it doesn't really attract one of the things that we have a lot of in the city which doesn't really benefit the city a lot which is trucking. So as it is right now trucking is not a designation on here. I've been told it falls under your business. So unfortunately there's a lot of areas zone business and some of those are not places where we want truck parking lots, truck parking storage facilities and you can imagine there's quite a few areas in all of our districts that passes and it doesn't actually boost our tax base all that much and it also isn't the kind of business that we want to attract. So I think it might be worth considering having that be a separate kind of land use and figuring out where it really would be best fit in the city. The second thing I think that really needs to be reexamined is some of the legacy
manufacturing um zoning that is on the map. Some areas that I think are problematic is areas where I see manufacturing can be completely marked as fluctu as well. And finally some manufacturing sites that are immediately adjacent to existing schools. So these are not the old school site. It's Westside Homeman. I think actually one of the schools manufacturing here was really STEM. Um so I think there's some things around that that really needs to be looked at a little bit more thoroughly to make sure we're making really good choices in those areas for the people and the children in those communities and schools. Use it because there's so much And it's very hard to understand [Music] a member of guard advocates for responsible development and also the mayor's uh sustainability committee that he initiated about a year and a half ago. I'm very concerned with the renance I guess I would say the remnants of 2019 plan that I think still need as J mentioned trucking is a huge issue um right now these businesses these trucking businesses are coming in under the oices of being a business they're not just a business they are losers they are losers and are climate action plan the two main sources of pollution industrial and transportation. And so we really need to be very careful when we think about allowing truckers to come into into our city as businesses because they're not just businesses, you know, they're not stores. They're they're bringing in more uh more pollution that as we know is very very much linked to the health experience that we experience cancer respiratory diseases as health and also sorry heart disease. So I think that we need to rethink where we we actually
businesses are because I don't think we have that never done I think it's time to do it because we don't have the same thing allow me our city to be overcome with Chinese climate action And we are supposed to be reducing the amount of pollution in our city. So I think the comprehensive plan needs to uh address that also data centers. No reason to please your vote today on this more time to really So many people are so pleased with where we're going in the city right now. We just need a little Thank you.

So again, just want to make sure that that doesn't take place, that it doesn't spread capital property, lot of property, a lot of area that it also can be used to a lot of things that I see happen residential areas that I was concerned for reser
that I saw and I looked I saw residential but whether it's truck right now [Music] and then right next door put in this I saw our counselor stays on top of that make sure that we just got to be careful because we're going to right now so this this plan is so important I was there a year ago when you all came from South a lot of others who are here downtown I'm talking about downtown and being good to see things come forward and also very much happy about the way. We need food around our community. It's getting worse. You see it for upper level. I see it. I see people come by every day from the farm needs for food that are hungry that are needed. I think we we miss that there's some agriculture spaces in there. I need give us some
time to refer to give us some time to get our view to the food in the areas beautiful place out there to act but we need to have this in not only is that food for our community that's education for our learning how to grow food they're learning how to sustain this environment by exper hear the air around you.
