If you were leaving, I wanted to make sure we didn't forget to go get you, but you're going to be here. Okay, so Dr. Martin, please introduce the petitioner.

So as you stated, this is our petitioner is interested in subdividing two lots into one to build two structures. we made with petitioner last meeting and we gave him some recommendations to bring forth and he is here to give you a presentation on his project. So I'm going to turn it over to him and then following I will give staff recommendations in a different order.

All right. Good afternoon, all. My name is Kenneth Townsend again, the owner of Brotherhood of Builders. I hope you all have been well and blessed and definitely got some constructive criticism last time that we met from some of the neighbors. And I think it's pretty good. So we've taken our time to kind of go over what was said. And that's why we're here today to present to you guys what we've compiled to kind of show, you know, what we're looking to do, how we think you can still meet the needs of the neighbors looking for it while also providing good housing. Go ahead. All right. I know a lot of the neighbors obviously know the vicinity, know the area. They live there. Their homes are in close proximity. But I kind of want to familiarize you guys with the area. So this is just the first photo to kind of show you the lot that we are working with. And that photo on the top left, we use AI to help us. Work with me a little bit as far as not exactly the exact real-life image, but it is by scale, the actual lot. And so that's the lot we'll be working with. I'll show you a couple corners and that main lot. So just keep that in mind as we move forward. I want to show you guys what's currently there and what we intend to do. All right, these next four slides, I don't want to call them the boring slides, but just kind of show the elevations. And these photos are going to show actual designs from the architect that we used. And so currently this is what we'll be designing. Obviously, there may be changes along the way as we run this, you know, renovation. But as intended, for House A, Lot A, this is the current structure that it will be. You can go to the next one. And that's just going to show the side. So you've got the front and back. Then you have the two sides here. And pretty much the same here with lot B. It shows the elevations and just the style of the home to show that we're building a modern home to accommodate, you know, 2026 standards. Go to the next one, please. Go to the next one. All right. This is a proposed site plan. So I'll come a little closer to it. If you look over here, all of this is going to show that we did abide by all of the laws as far as the setback and what they are. It just shows the will for the lives and everything, and that it all is by code. We did it the right way. We wanted to show home A and home B because there was some discrepancy last time about what are we building and where is it going, things of that nature. And so home A will be on the first portion of the lot, if you will, and it will face Montgomery Street, which is the street here, facing over. And this home will have a separate driveway. And it will take place, it will be on Ash Place. And we face a piece. This will be Home A. Again, just want to kind of show a little bit more of what we're planning to do with the project, with the property. And so you're not just kind of guessing and taking, you know, for your imagination what we're doing. And then this is Home B. And so, We're trying to build similar homes, but just have different characteristics as far as color. It's a good creation for the buyer, but we want to keep it modern. And also make sure that we do focus on the character that's already built inside of Miller, the neighborhood. You know, but make sure you kind of meet both of these. This photo here is going to kind of just show all of them together. So we have home A, which would be right here. We have home B. Right here. I won't bore you guys, but it just kind of shows here what exactly we're providing to provide as far as increased property value, tax base, new quality housing. I know some of the neighbors asked last time, are there going to be rentals? Is it going to be for sale? We do intend to sell the property, so it wouldn't be a rental property. It is looking to add to the neighborhood, add value with on occupancy. A big... The issue I think we had, and obviously that's why we're here, because we're subject to that a lot during this subdivision, was is it possible to put two homes on this lot? And that is very hard to kind of see. You're not familiar with renovation and construction, especially for some of the neighbors having that happen. And so here we just have some facts of what the existing parcel was. It was 0.31 acres, about 13,000 square feet. And we're showing here what the lot size will be going forward. So you have a 8,000 square foot lot and just over 5,000 square foot lot. And we just want to reinforce here that we did stick to all the guidelines of the code as far as community everything they were supposed to. And just a little bit more facts that we want to provide. This one, the neighbors were kind of mentioning that it may not fit into the current culture of the neighborhoods that they currently have. And they also added maybe just the size of the home. What we did was put together just, you know, sizes in the area of some of the comparable homes that we were going to build, and just show you guys the square footage and the acreage that they currently have. And so our subject property is currently right now at about .30 acres, right? And so the house right next door is .26, and then right down the street, you're also at .25. This is the largest lot in the neighborhood. That's why we chose this lot to be able to subdivide it, because it has the square footage to do so. If you break down the lots to what we're looking to do, you have lot A and you have lot B. So lot A would be 8,000 square foot, about 0.19 acreage, 5,000 square foot. Sorry. And 0.12 acres. If you look at the smallest home in this neighborhood, this house is about eight houses down, it sits on the corner of opposite directions, it is 0.12 acres. That's the same size of lot B. This would be the smaller of the homes we're looking to do, but it would be equivalent to a similar home in the neighborhood that is that same size. If you want to know the square footage of this home, it's 1,500 square foot on 185 North Miami Street. We intend to do this lot, even though it's the same acreage, a 2,000 square foot home, or close to it. And so we're trying to fit it in and make sure it's not two small homes. We're trying to avoid that and go to the next one. I think I kind of highlight here. This is the survey that we had done by a survey engineer. This is lot A. He just wants some more of an aerial view. And this is lot B. So if you see here, this is the home that I'm preparing to, the House of Miami. So a little bit different layout, if you will. This is more of a square here. This is a different shape here. But both the same acreage as far as the lot dimensions. And this just kind of goes along with what I was just alluding to about the size of the homes. So both homes right now are living just under 2,000 square foot, but still, There's a little bit of give and take in that, again, based on what we're doing. But both homes intend to be four-bed, three-baths, two-car garages, and both with separate driveways. And we also all focus on another design that the neighbors brought up, I think in my initial photo that was shown, of the drive-in area, like come around the corner and whatnot. So we're looking to work the city, whatever we can do to make sure that it's safe. issues that were maybe brought up as far as too loud. It won't be some noise. Obviously, it's construction. But we do intend to work during day hours and obviously respect neighbors. And we're looking to be an advocate here and work with the neighbors and not, you know, be opposed to them. So hopefully what we put together today kind of shows you guys a better idea of what we can do. And regardless, I appreciate all of you for your time, and God bless you. So, thank you so much.

So, for, I just want to make the knowledge clear. We did the same thing in previous meetings. Our goal is to determine as the staff whether or not this lot is capable of being subdivided, and if it is capable of being subdivided, that is all our decision coincides as. We can't look outside of that scope. So our recommendation is favorable because the lot is buildable, subdivided. He does align with all regulations front, rear, and side setbacks. Because he does align with that, it puts us in a situation where we need to determine the health, safety, and general welfare surrounding the structure. It actually brings value by adding a new structure and adding a new housing type. As far as the curbage, that is human behavior, speeding, coming around curbs and things of that nature. As far as the sound and construction, that is natural construction behavior. process that happens regardless of where construction takes place. Protocols are put in place by the Board of Works, by all of our departments, and because of that, he does not violate any of the seven requirements for him to, and there is no actual seven requirements, but I like to have some basis, so I look at things in that nature to help safety and general welfare. And so because of that, we recommend a favorable recommendation for this subdivide. But ultimately, it is a decision upon this board.

Yeah, you know, I got me some conditions. So staff recommends that approval for PC-2026-04 subject to the following conditions. Submission of a final plat acceptable to the engineer Mr. William Allen over there, and Planning Department of us. Verification that all subdivision approvals and recording procedures have been satisfied. That corrects the county's error and put us in compliance. Recording of the final plot once staff has reviewed it to the county following all required approvals. Compliance with all applicable zoning, engineering, utility, draining, and building requirements. Separate review and approval of all future building permits and site development activities. That's basically, the last one's just saying if you do something outside of this scope, this review, our process will not cover that so you can utilize your subdivide conditions as oh, that's why I did X. Without getting a permit.

If you look at the whole, what do you call it, partial, they are different shades and sizes. So they're different. So it's not like, maybe we've had an average of the lot sizes. All right. So we're going to kind of just give you – update of where we are with this map. So we had a community meeting and what we did during our community meeting was we invited the neighbors to come out and we had a map first. And the neighbors got into groups and they rezoned their area based upon this presentation that I'm going to give you.

So we talked about why we're rezoning.

Our city has changed. We need clearer rules. and we want to gross with sustainable measures. We must prepare for our future. That's why we're rezoning. Understanding our zone. I'm not going to go into this because you had that long presentation where you understand all of the new zones, all of the new regulations, but we want you to know that we did present that same information in a more convinced and family-friendly atmosphere. We talked about our residential districts. We now broke it down by our ones, twos, threes, and fours. Gave out some visuals of what those things look like. We talked about the business districts. Found out one of them closed, so we're gonna check that out. And then we went and broke those down by the one, two, three, and four. So as you see in the transition in the first one, we have, you have it inside your binder. So you can see the first one, we have shifted it from seven or, I think it was seven or eight Rs to down to five. Convincing, making more sense. Bs, one through four, historically it was five, broke it down. And we have, I'm sorry, can you go back to the Bs? So as we inform the individuals, These are a little different because they're industrial, industry types, right? So you have neighborhood businesses, you know, as your mom and pop, communities, and the wholesale, and the automobile. So they are not, like, by size. Historically, the whole was by size. So I said B1-2-3. These are by industry. Keeping them in corridors that belong to that industry. These districts really didn't change. There are M1s, M2s, and M3s. Nothing changed within that because that is our bread and our butter. That is our history. Why change what works? Then we have this new endeavor. We have this mixed-use district. It talks about neighborhood mixed-use, downtown mixed-use, and we gave them some little background on what it is and what we're expecting it to look like. No, none of them are real things. They were just I've created a lot of them. I just put word zone and cop and Google. But it gives you a perspective. This one, I changed up the pictures, so I'm happy about that. But this is our destination. This is the foundation of our beautiful new zoning. And it breaks it down into destination civic, destination institution, destination park, and destination school. And then we have our entertainment district. What does this mean for our properties? So we told them. I'm not gonna break this down for you all because you all know. Is their properties changing? Yes. Some of them are. Can I still use my property as it is? Yes, they can. As we discussed in our first presentation, there is this process called legal non-conforming, which gives them the ability to do the things that they are doing currently until they shift that dynamic to expand or change or sale of the structure. Then it reverts back to the now new code. What if my use already existed, basically like I said? How do I find my zoning district? This map will be live, interactive, like the one that we have, but more dynamic. If you look in the background, that is actually how our map will be interactive, because it will be 3D and it will be a render. What happens next? We told them that this is the public forum. We told them that it will be refined, which we did. We told them that it will come back to you all, which is not that back, but it's coming back to you all. That's you all in that picture. Y'all see me? Then you'll go to Common Council, and then we will implement our proposed time. It's August 1st, but it's just contingent upon how everything goes. From there, we gave them this view and a QR code that they could scan to find the code, the math, and everything. It actually works. So, the last part of this is our math. Michelle is gonna scroll in and kinda show you basically the reason we want to take this extra time for you guys to grant us to keep this open until our special meeting is because we have certain anomalies Um, like as you can see up in here, well, I'm getting too close. Thank you for that. Up in here, because of our new code, it is Euclidean, but it's form-based, right? So the coding of it will make smaller lots, um, in one. When in actuality, those lots are having one building or one structure on them. So capturing that and speaking with, um, the individuals and just getting them to combine and making those little silver streaks more compatible with the area. And so having like little dots of purple in between a M3 block preventing them from being able to follow full regulations, right? Because the M3 is not gonna follow the same thing as a M1. Same thing over here, kind of looking at the little, the neighborhood's field and the state, right? By size, This is what it could be, but by virtue of us moving forward, this is what it should be. But like there, you see that destination? For some reason, that parcel is not combined anymore, and it's separated, and that size, in fact, that residential district made it R, when it should be destination. So those are the little nuances that we need to go through and kind of codify, like this little If you say little triangles and things of that nature, that means there's a parcel there, but it doesn't have its own because it's too small. So the system is confused. It's like, is this a parcel or not? So those are the things we want to walk through. Other than that, everything else is pretty 90% cleared out and cleaned, even the rows. And, you know, kind of just us looking through that as a team to bring you guys a full clean map so that when people click on it, there won't be any questions to the decisions that we made as a team. And I open that up for any questions that anybody have. You will get this map now that it is 90%. I like to hold these unless I have it, so I'll send it until it's ready. So following this, you will get the email this time.
