Two Board and Commission appointments, one for the Board of Adjustment, appointment of alternate Bill Ernst for a partial term to expire in 2027, and planning and zoning, appointment of Dan Healey for a partial term to expire in 2029. All those opposed, please say no. Okay, so I requested for the consent agenda item for discussion. Mr. Healy for planning and zoning, I've known him for years and years and years, great person, but he doesn't live in the city limits to my knowledge. So how does that work?

Yeah, Kathy, I know you had some discussions with our city attorney. Would you like to give a little recap on that, please?

I sent out the Board of Adjustment mailing to our Board of Adjustment members and Mr. Healy was reviewing the code and he said he was told that if you had property inside the city limits, you could be on the Board of Adjustment. Apparently at some point that was a mistake and you can only, you have to be a citizen, a resident of the city to be on that board. And so after Tom reviewed it, he said that we could implement the plan. zoning because that was just a citizen and not a resident. That's the requirement.

Yeah, I don't understand that either.

I'm so sorry. So on the Board of Adjustment, Mr. Healy was a member. And after reviewing the code for that, he stepped out, or he told me that he is actually a landowner here in town. And so we reviewed it with our legal, and Tom said, no, the state statute, and so does our city code, say you have to be a resident of the city to be on the Board of Adjustment. But planning and zoning, that's not a requirement to be a resident of the city, only a citizen.

A citizen.

It's made up of four citizens or however many number of citizens. There's no fewer than four.

But a citizen of what?

So a citizen of the city. That's a very subjective question. Based on what our city attorney has indicated, because he is a property owner of property inside the city limits, he is eligible statutorily to be on the Planning and Zoning Commission. And the mayor put him forward as an appointment for this evening.

Well, it's a bit odd.

Because I remember I used to serve with Mr. Healy on Parks and Rec at one time a year ago. And when he moved out of town, he resigned. So that's why it was kind of a surprise to me. So what's your pleasure?

Before you do that, Mr. Healy works for a contractor here in Fulton, and he's on a planning and zoning. Would that affect him? Would he have to accuse himself if some vote that his contractors applied? Would he have to step away from that, or is that correct?

Yes, so I would clarify that Mr. Healy does not work for Andrew Huey. To my knowledge, he works for Andrew Huey's father, Andy Huey. And yes, if either his employer or he had any sort of conflict of interest, he would have to recuse himself from whatever item was up for questioning. And he's aware of that? Yes.

Thank you, Deputy Mayor. I appreciate that. I do want to just highlight one event that we hosted mid-July, and that was the Chamber Business Breakfast with the Kingdom Pilots Association and Meyers Aviation at Elton Hensley Airport. is very well attended and I appreciate the council members and the staff and members of the community and business community who were able to come out and take a look at our airport and see how wonderful it is and why it's such a great asset here in the community. We also have been reviewing some operational things at Tanglewood Golf Course and exploring opportunities to improve some efficiencies. So no decisions have been made at this point as far as the operations at the golf course, but we continue to review future possibilities there. And then I just want to highlight again, we want to thank former Police Chief Bill Ladwig for his many, many years of service. I think it was almost 26 years of service and recently had his retirement in the appointment of now chief. dal hedges so july was a busy month for us as always staff is here and if you guys have any specific questions we are happy to answer those for you anyone if not entertain that motion

hello hi andy johnson cfo city of fulton recorded six months of sales tax in 2026. collections are up 1.7 percent from fiscal year 2025. use tax is down 1.2 percent from fiscal year 2025. july we had two payroll cycles and overall year-to-date financial performance remains consistent with budget expectations does anybody have any questions have any idea what's going on with use tax just I think it's all, it's not just us. I mean, it's all over the board.

I have had more than several concerns from constituents in my ward with regard to mowing, with regard to flooding of their backyards from the rain, with regarding, it doesn't really matter, just quite several phone calls. every single time i bring it to the city they address it i don't know that they take care of it right away but they address it so i just want my constituents to know that i do take it where it needs to go and it is addressed and i don't know if it's solved immediately but i feel very confident that it will be and i thank you all for doing that sometimes the answer is not the city's responsibility

it's always good to check in thank you councilwoman recluse good evening everyone um i jump on what martin said um we have water in our backyard right now there's a lot of construction going out of south and uh so yeah we've got a lot of promises out there and uh we deal with it one at a time yes every time that i have approached cities to talk about this kind of thing There are things they can't repair, and it's the homeowner's responsibility on some of these things. I would just note that we were recently made aware of a grant deadline, which unfortunately is going to occur prior to our next meeting. So the City of Fulton tries not to have any emergency ordinances unless they're really, really needed, and we can justify the reasoning behind it. but the city has an opportunity to get approximately $137,000 in grant funding, while our portion that we pay out is approximately $1,397. So really important funding for our airport, and we wish we could have known about this a little earlier, otherwise it would not be an emergency at this evening's meeting.

The Council hereby authorizes the Mayor on behalf of the City of Fulton, Missouri to execute all necessary documents in relation to Amendment 1 to the State Block Grant Agreement with the Missouri Highways and Transportation Commission for Project 24-040A-1 The amendment provides additional grant funding in the amount not to exceed $137,000 and requires the city to provide additional matching funds of not less than $7,210. An unexecuted copy of the amendment is attached for Exhibit A. Section 2, that the ordinance is an emergency ordinance within the meaning of Article 3, Section 3.10, of the Fulton City Charter due to the requirement that amendment number one be executed by the city on or before August 31st, 2026 in order to secure the additional grant funding for the project to ensure timely action on this matter. Yes, the explanation I'm going to give you is that the city was notified by the county clerk's office after discussions with the county clerk, I believe the commissioners and the county assessor's office that they needed to reconfigure the number a couple times. So, while I can't speak to their reconfigurations or what prompted that we were notified that there was a change and then received our pro forma from the state auditor's office.

It seems like we're always pushing these. Mike's opinion, we're always pushing this at the last minute. I know the timeline's pretty tight for the county, but it'd really be nice to get this a little earlier than the last meeting. That's my editorial comment. Next city council meeting will be held on Tuesday, September 8th at 6.30 p.m. The City of Fulton, Legends RecPlex, and the Solid Waste Department will be closed Monday, September 7 in observance of the Labor Day holiday. Emergency service will remain in normal operation. The Fulton City Council will meet only once in September due to the Missouri Municipal League Conference. Any other announcements, anyone?

One thing, obviously, school started this week, and with that brings a lot of additional traffic and some different patterns with that traffic. So just a reminder to the community, mind those school zones. Please be careful when driving, especially when pedestrians are nearby. and practice a little bit of patience. School buses and school personnel, I know, are working very diligently to try to keep everyone safe and get everyone in the facilities in a timely manner. So you might notice some changes. Plan a couple extra minutes to get yourself to where you need to go. And then lastly, I just want to say thank you again to staff. It's been warm again lately. So for everybody who's been out there working very, very hard, we appreciate all that you're doing and we want you to stay cool and safe. But whether it's making sure that your trash gets picked up or taking care of the roadways or making sure that you know where there should be a stop sign, because sometimes people take those, we appreciate all of that kind of stuff being taken care of, especially when it's really hot outside.
