Adrienne. Yes. Alright, Adrienne. The floor is now yours. Thank you. Good evening, everyone. My name is Adrienne Gilbert. I'm with the planning and development department. Just wanna make you all aware of a text moment to the development code that we are working on. So we are preparing a amendment to our development code in compliance with the California government code section six five five eight zero through six five five eight nine point eleven.
And that government code section requires cities to adopt, update, and implement a compliant housing element. This is part of our Fresno general plan. It's a housing element. And as a requirement of state law, we are preparing this text amendment that would amend sections fifteen ten zero two, fifteen eleven zero two, fifteen fifteen zero two, fifteen fifty one zero two, and fifteen sixty eight zero two of our municipal code, to permit housing developments that provide at least 20% of the unit units affordable to lower income households through a ministerial zone clearance process, assuming that the project is consistent with our objective development and design standards. And this would apply to any non vacant site that's been identified in a prior housing element and a vacant site that has been included in two or more consecutive housing elements.

Yes. So this text amendment would apply to sites that are it's either any nonvacant site that's been identified in a prior housing element and then a vacant site that has been included in two or more consecutive housing elements. And so this is a requirement of state law, so we are preparing this amendment in accordance with state law, in accordance with our housing element. Our housing element has 37 different programs in which we are required to comply with. This specific text amendment is program nine in our housing element, and that is a part of our twenty twenty three to twenty thirty one six cycle housing element that was adopted by the city council in December 2024 and certified by the state in January 2025.
So we have been tasked with with carrying out many of these amendments, and this is one of those. And, again, this would permit housing developments that provide at least 20% of the unit units affordable to lower income households on those parameters of sites in which I mentioned previously. But I am I'm available to answer any questions. I do want to make you all aware this has been noticed in the Fresno b. It was published in the notice in the b today. It will be presented to our planning commission on June 3 and city council on June 18. Thank you. But, again, I'm I'm available to answer any questions you may have.

Well, it sounds a little generic without a lot of detail because vacant sites in prior housing developments, you said? Housing element. Housing I'm sorry.
So it's it's a vacant site that was identified in our two prior housing elements and then a non vacant site identified in the in a prior housing element. So not housing developments, but our housing element, we update that. It it runs on an eight year planning period. So the housing element was just recently adopted in 2024, December 2024 by the city council and certified by the state in 2025. So we are there are 37 programs in the housing element, and this is program nine of those 37 programs. And we are required to comply with our housing element as a requirement of the state.
Can you define what housing element means?
So the housing element is a chapter within our general plan. So we have we call them elements. It could be very confusing. Instead of calling them chapters, we call them elements. And our general plan has different chapters or elements, if you will.
The housing element is one of those chapters, essentially. So we have, you know, land use and urban form is an element of our general plan, noise and safety, transportation, you know, healthy communities, and the housing element is a chapter essentially of our general plan. It is a little bit unique, in terms of all of the other chapters of the general plan and that, it has various programs that we are required to monitor. The state monitors our progress on how we are implementing the programs in the housing element. It's, you know, very tied to we are assigned a number of housing units in which we have to provide capacity for in our city.
The state gives us that allocation, and that's a part of our housing element is we have to show that we are creating housing capacity in our city to show that we are meeting the requirements from the state and our housing allocation that was assigned to us.
So how is this defined? So you you have a housing development or a developer building a an area that's going to be filled with homes. Correct? Is that what this is applying to?
So this would so this does not this text amendment does not approve any development project. It it simply updates our development code. So there is no specific project that this is tied to. It's just an update to our development code.
So Is it required, though, if you're if there's going to be a new housing development built? Like, when we get all of the presentations here to approve a development, say, over a Copper River area, and they wanna put in, like, a 120 houses, is that part of the situation then?
No. It is not a requirement. It is only if projects want to receive ministerial approval. And what that means is if a project wants to provide at least 20% of the units as low income and the site has been identified as a housing element site, if they want to achieve ministerial approval, which is a streamlined review process and approval process, that would only apply in these instances. So it's it does not apply to every development project.
It is only projects which seek to provide 20% of the units affordable to lower income households that are on a site designated as a housing element site and that are seeking that streamlined review process.

So if it back to a housing project. Okay. How do you determine? So do you build lower cost homes for that 20% then if you have, like, a certain cost basis or cost terminated terminated. Determined for that development. Like, there will be $600,000 homes, approximately 22,000 square feet. Then do you also have to that would be meaning that they would provide smaller homes that are less expensive within that development?
Yes. So so, typically, we see this in multiunit projects. And and in that, the state sets what we call affordability levels. So we get those from the state. They said, you know, this is what qualifies as very low income. This is what qualifies as a low income household. So we get those affordability levels. Those are provided to us by the state. And so if it if a developer, you know, chooses to include 20% of units in this case, the units must be reserved 20% for low income households. So you might have, you know, x amount of your units designated as market rate, and then you're providing 20% for low income or lower income households.
Those affordability levels are are determined, you know, through a calculation that is a a a level that is set by the state. So, yeah, we we are given those or, you know, that that's set by the state.

We're just gonna replace and upgrade it. Really, we just wanna provide our customers with more choices and options towards their selection of. Are any

It's the Northwest Corner of Alluvial And Willow. Right. To the south of us, Scott Ellis just built 240 new apartments. We built that facility back in 1992. And we've always had a type 20 and entered the drawing last year. The state says Fresno County gets eight new type 21 licenses. We entered the drawing, and we were one of the lucky drawers
to get a new license. There's a house there that's gonna be taken down then?
