Judy Sprague will request that industry is permitted for a short-term rental at 142 Mills Lane. Also known as PMM ID number 052-00200-018411. It is the home of the new residential, rural residential car artistry. Thank you, Mr. Chair. Thank you, Mr. Chair. Thanks for being here. The existing zoning is subject appropriate to all residents who are a single family. The existing use is a single family residence and the proposed use is a short-term rental. The dwelling size is across the loop, about 2240 square feet. There are four bedrooms and three bathrooms. The maximum proposed occupancy are 12 guests. Frankfort County adopted regulations allowing short-term rentals as conditional use through the vote in special conditions 27. The regulations became effective July 23, 2021. The applicant is requesting conditional use permit to operate a short-term rental within the existing residence. Adjoining zoning includes rural residential B, RB, and rural residential RR. The property is located on Mills Lane, which is a county route 1129, a county-maintained and local route. Staff finds the proposed use is not anticipated to have a significant impact on traffic.
Staff recommends no on-street parking. Existing driveway is approximately 90 feet long.
Staff estimates the driveway can accommodate approximately eight vehicles. The closest short-term rental is approximately 1.5 miles from the subject site. Step nights require public facilities are available. Additional public services are not anticipated to accommodate the proposed use. Utility providers were contacted as part of the staff review. Farm to Water stated no problems reported. The FPV Electric and MPP FPV Telecom has no issues as well. The Family County Fire Department has no issues with the property or documentation. Staff finds the request consistent with the intent of the RR Rural Residential District. RR is intended to establish and preserve a quiet and single-family residential neighborhood. The district is intended to be very low density. Short-term rentals are specifically allowed as a conditional use in the borrower district under Special Noted Conditions 27. A comprehensive plan identifies the property as rural residential. Statifying short-term rentals may be appropriate in this land use category when the requirements and special conditions 27 are met. Set-wise, the proposed use should have no adverse effect on adjacent or surrounding properties. The property is considered large enough to accommodate the proposed use. Adequate parking is available on-site. Applicant proposes a maximum of 12 registered guests. Set-wise, the four-letter dwelling is large enough to accommodate the proposed occupancy. Applicant stays through as an acreage between the property and surrounding residences, helping limit potential neighborhood impacts. The home will be available as a short-term rental every day. This is according to the applicant's operation plan. Imagine if I could see what the 12th is. Applicant plans to enforce client hours from 9 p.m. to 9 a.m. The applicant anticipates no impact to the surrounding neighborhood. Applicant has a local emergency contact or boots on the ground, so to speak, available to address issues. Applicant currently operates three other short-term rentals, nine of which are located in Franklin, New York. The property will be subject to subsection 155.089 of special condition 27, including maximum stay of 29 consecutive days for the same occupant, only one short-term rental contract at a time, maximum occupancy calculated at two times the number of bedrooms plus work, no food or alcohol the bedroom is prepared or served to guests by the host, outdoor signage is prohibited, Because the property is not the host's primary residence, contact information must be provided within the rental. An evacuation plan and required smoke detectors must be provided. Parking must comply with the zoning ordinance. Annual STR registration is required. A Franklin County business license is required. County must be notified if the short-term rental ceases operation. applicable state and local taxes are required. The proposed use will not alter the essential character of the general facility, satisfies the use, will not create a hazard or nuisance to the public, the forebader of both is adequate for the professional users, adequate parking is available, necessary public services and facilities are available, satisfies the use, should not adversely affect public health, safety, or welfare, provided the recommended conditions are met. Staff also recommends approval of the conditional use permit for a short-term rental at 142 Mills Lane, subject to the following conditions. The conditional use permit applies only to 142 Mills Lane. It is granted specifically to Judy Sprinkle. CEP is not transferable and the change of ownership will make this permit null and void. I thank you to the Frederick County Board of Signing Adjustments for the notification of your receipt of a request for a conditional use permit for a short-term rental at 142 Mills Lane. As I stated, I am Lisa Dean. My husband Robert and I are homeowners of a direct-need adjacent property, which is our primary place of residence. Mills Lane is located in a single-family rural residential district, and we are against approving this application. We had an opportunity to review the staff report, and we noted their recommendation to approve the request. It appears the items included are not limited to such needs as an impact on traffic and sufficiency of utilities. However, I did not see an evaluation to determine the adequacy of the septic system, and I will make a note of that. The report also notes that the conditional use proposed is in accordance with the intent of the zoning district in which it will be located, stating further that the current zoning is single-family rural residential with the intent to establish and preserve a quiet single-family home neighborhood free from other uses. Allowing this property to be a short-term rental does not seem to align with that description. The staff report further states that the proposed use will have no adverse effect upon the adjacent or surrounding property, citing adequate parking and allowing up to only 12 registered guests. The adverse effect of using this property as a short-term rental goes beyond the adequacy of parking and the number of guests. Transient occupancy of a house erodes the sense of community and trust the neighborhoods are built on and establishes the property as a money-making venture for the property owner and bought as a home. Residential zones are meant for living, not for commercial operations such as short-term rentals. We simply ask the voting members of the board to consider this request as if it were your neighborhood. The place where your family resides, the place where folks have put down roots. But, yeah, I mean, reading this with myself online wouldn't end on a bunch of girls isolating a little girl with tears. And I think you did an excellent job of presenting your point of view. But I also think that when staff has looked at the law and it meets the criteria and they have said positive as far as, you know, their recommendation. I think that makes me feel for this board, just as a person, to go against that. I think the people you all need to be seeing are your fiscal reform members and having some regulation that tightens the requirements for short-term rentals. You know, having this run, and I think this was discussed on a city person, so I'll pay more attention to the city commission than I do this before, but I think this has been discussed in the city commission. having some regulation as to how many children or adults can be within a given area. That's just one avenue to look at.
So I think that in spite of our decision here, you need to go report this report.
all of you people here that are opposed to the short-term levels and let them know your viewpoint because they're the ones that is making the regulations that this board has to go by.
Do you have a comment? Mr. Chair, I think a lot of these that I personally know have been favorable and very liberal on this issue and rarely do we get Rarely do we have opposition. They're not somewhere, you know, far away from everything else. And, you know, and a lot of times I think, you know, there's not very much you can do except, except when it's getting in front of you.
Now I don't feel that it's my job to represent just everything that gets in the way. So I have an opportunity to speak and to hear the evidence and to give my point and to make the decisions that I want to get to where I want it. But honestly, we see it differently and that's why we're all different. Well, I agree with what you're proposing that we have to do.
And I look out, and there's my chair. And I kind of believe that in that chair, for me personally, I think we're going to be on for a while.
We're going to see a few years, things that are leading the way to being able to approach our school to get in position for this whole group of students we're having. to the neighbors. So that's a fundamental key. This is the importance.

The problem is this is what happens in most cities. That's true. We have a problem with this. In the sense that we need to rule changes. We need to think of the issues that we need to answer. That is what we need to do. Again, we Yes. You know, you probably think they would want to do something with it. Because, obviously, this is going to get approved. So I'm certain. I don't have to agree with you, but that may be a little bit of a limitation if you want to do this job. And I think that probably people only want to do what they want to do. They can't even do it. is that the man is in something like a room in the yard or in the street. And he's going to be upon neighbors who will probably live below him, letting them, because if they help people, they can also provide that to them. So there's only so much we can do to do this. Yeah. to the people who are keeping parties. That's taking more value for most of the South Indian system. So I have a lot of favor to make on Cuba.

Well, you should suppose that maybe they won't play hard to get. There has to be some sort of social inclusion. Maybe they have a sort of restriction on the middle school, and there's going to be prisons. I don't like the logic. Recently, there's something that we're going to try to put in the corner of the way that we're I'm just saying, in any deal of state of the art, do you think we ever, over the years, since this has been passed, have we ever had arguments? A lot of us have tried to put ourselves into other places. And I thought, you know, the album was for a certain idea for a song, and I labored at it as well. And I thought, yeah, you know, I really do feel concerned. And all of a sudden, it's like, yeah, we're going to come. Shit. over here in the same room this summer, picking and choosing the ones that they think might be preferable to us, and I'm a bit far away. The toilet has six bedrooms and four bathrooms. The proposed maximum occupancy is 60 guests. Franklin County adopted regulations allowing short-term rentals as a conditional use in the hardware sector. The applicable regulation is known as Special Conditions 27 under Section 155.009. The applicant is requesting approval to operate a short-term rental in the existing residence. Surrounding and nearby properties are primarily zoned rural residential or art. Property is located on South Vincent Road, County Route 1223 and County Route 18, Local Route. Self does not anticipate a significant traffic impact from the proposed use. Existing driveway is approximately 225 feet long and can accommodate approximately 12 standard vehicles. A 945 square foot parking pad can accommodate approximately 5 vehicles. Two garages totaling approximately 1600 square feet provide space for approximately 6 vehicles. Staff recommends no on-street parking for the property. The closest short-term rental from the subject site is approximately Okay, read my writing. 1.2 miles away. Sorry about that. Set fines that require public facilities and services are available. No additional public services are anticipated to be required. Health department records indicate the property does have safety records. The fire department reported no issues with the property. Stead finds the request consistent with the intent of the Rural Residential District. The RRA is intended to preserve a quiet, low-density residential neighborhood. Short-term rentals are specifically identified as a conditional use in the Rural Residential District under Special Tradition 27. Staff finds the property is sufficiently large enough to accommodate the proposed use. Adequate on-site parking is available. The proposed occupancy of 16 guests is consistent with the ordinance calculation 2 times 6 bedrooms plus 4 equals 16 equal maximum. Staff finds the use should not adversely affect adjacent or surrounding properties. The applicants' operating plan is as follows. applicant plans to self-manage a property with her husband. They will manage reservations, guest communications, check-in, out, house results, cleaning, and maintenance coordination. Applicant has identified a local cleaning team, a local handyman, a local emergency contact. Applicant states that neighbors will have contact information for the owners. The applicant plans to enforce quiet hours, prevent parties, use exterior cameras, use noise monitoring, and require guests to agree to house rules and local regulations. The applicant estimates the property will be rented approximately 50% of the time. staff recommends approval of the conditional use permit as follows. Permit only applies to 905 South Benson Road. Permit is granted only to Catherine D. Schoepfler. The short-term rental must be applied with section 155.089 special condition 27. Annual registration and business license are required. Working smoke alarms must be maintained. Carbon monoxide alarms are required if applicable due to gas utilities. The maximum occupancy is 16 guests. County must be notified if short-term rental operations cease. Number nine, short-term rental must operate according to the submitted application materials. Number 10, permit becomes null and void if no measure sites in one year of the Board's decision. And 11, no on-street parking is permitted. Based on the staff analysis, the proposed short-term rental is consistent with the RR zoning district, has adequate on-site parking, is not anticipated to create a significant traffic impact, and can apply the proposed maximum occupancy according to our regulations, formula of 16-S. Seth finds that the use will not adversely affect surrounding problems. Board the public held the safety of welfare provided the recommended conditions are followed. Staff therefore recommends approval of BZA CUP 2613. Thank you. We're looking for any questions you may have.

It's still a little unfortunate. Some communities and some people don't. And we do a technical review. We send out all of a report to our technical review team, which is all the utility companies that operate that site. They review it, and they send back comments to us stating whether they need to send a review, which happens a lot with these. So they did respond saying that there are records for this. So they didn't say there are any issues. And can you tell me how they estimate? Because, you know, when I was in a normal family situation, they were like, this is getting painful. And that's, you know, just, well, they're busy. The other day, my kids were talking about food, and I didn't even know about a lot of, so I just wondered if that stuff got into consideration.
And so, I presented some systems, okay. And I picked a great number of people that were probably going to use it.
I think our report states that they are wanting to do or proposing to do a short-term rental at that site. I don't think there was any number given to them to say there might be 16, there might be 10 this day, there might be 8 this day. So to answer that question, I don't think we go into that much detail about the board. And we decided we want to go into that much detail, I believe, in that report and going forward in the future.
But I don't think we get into that detail because we're working with a class that's . around that. And it's the real estate. First, it has to be traced down. So when they design a facility system for a house or something like that, it has to be in line with certain criteria. And on the part of the museum, they have to look on a solid bed. And they have to meet these criteria. And if they endure construction, they will take photos. They'll make sure it didn't flash with equipment usages. And then the system is sized so those are balanced. that it was essential. And so there's a calculation that the NJF current record said that the system was most plainly designed to prove that a pregnant woman had no problem. And it's all about the strength of the stronghold system. Just to be on the safe side of things, there's a process because they don't want a system to fail. I don't know. But if things, if the board feels like we needed it, if there's an action that them, that's the reason we're playing and accepting them. We've got to have the people in this fashion to see that the way this is functioning properly is something that we've ditched. It comes out before we even expect it to happen. And I would just ask you to just make sure that they're resistant to the word when they're out of safety.
I would caution against adding that as a condition. I think since the health department does review these as part of the dual review, they differently analyze for that inspection to occur if they feel that it is necessary. So I would be a little bit hesitant for this body to somehow have a level of expertise to be making that recommendation. I don't see what you need, but I would caution against it since they do review these. And we have had a lot of these returns over the past couple of years, and the health department has not expressed a particular concern about the use as it is. They work in each one of these and base their recommendations on that and evaluate them to do a system.
So I think that they're pretty comfortable with the recommendations they're making.
Thank you. I know really that, you know, there might not be any septic records, which is kind of not quite frequently with these short-term mentals. And so, they do an evaluation before we even get to this point. So, we're doing all the back work, but you don't see, really, septic organs before we write them. So, yeah.
It's a problem for me to consider the situation, to consider the value of my point of view. So I just want to ask you a few questions. Well, I think the definition of a short-term rental is quite different than a motel.
So I don't think, Steph, we have any trepidation for that. I'm not sure if Autumn might speak more to this. You know, I think everything that we do is on a case-by-case basis. And I couldn't speak to Michelle. I used to say, when we're looking at a short-term rental that's over 4,000 square feet and has six bedrooms, nine numbers, that kind of makes sense. You know, if it were, I don't know, 1,200 square feet and eight bedrooms, then perhaps I would search this and also write fines. You know, I'm just thinking in retrospect in a manner that it was clearly shoving people in there, you know. But again, I think the market kind of takes care of these short-term real estate degree as well.
Just people are looking for something when they see it. But, you know, we're evaluating it on a face-by-face basis. I'm sure that that scenario very well takes them up.

Utility providers were contacted as part of the staff report. The provider responses were included with the staff report. SOD finds the proposed use should not have any adverse effect on adjacent or surrounding properties. The property is considered large enough to accommodate the proposed use. SOD finds more than adequate parking is available. The ordinance occupancy calculation allows up to 12 guests for a four-bedroom dwelling. The applicant proposes a maximum of 12 guests, which is consistent with the ordinance. And the applicant's operation plan is as follows. The property is described as the applicant's personal vacation home. The applicants intend to rent the home to transit guests only when they are not occupying it. Expected traffic is described as standard residential traffic. The applicant anticipates approximately one to two vehicles per booking. All guest parking will be off-street on the existing driveway or parking pad. No parking when Mount Zion Road is permitted. Property will be managed by the owners. A local emergency contact will be available for immediate property or maintenance request. Second, does recommend approval of the conditional use permit for a short-term rental about 2565 Mount Zion Road. with the following conditions. Conditional use permit applies only to 25-65 miles on the road. The only thing I'll add is that I did take a course of, like, short-term rental safety, so we made sure to make sure that we have all of our fire alarms. We have fire extinguishers, carbon dioxide alarms in every single room. It's very important to me. They are requesting an educational use permit for a multifamily in a limited commercial zone in order to construct an affordable senior living apartment building. Three stories. They last year were approved for 60 units and a parking waiver to reduce their parking. They are now coming back to request 72 units, so an increase of 12 units. It's quite parking at the same rate they were providing previously for a total of 90 spaces. Let's go around and set it to 75, which they were approved for last time. So just have all the listed findings within our report. We are recommending approval. The parking where you're on Central Mile a little bit, the justification that the applicant provided to us was significantly related to the proposed use for senior housing. There is, it's proven to be, a lesser need for that type of apartment dwelling in comparison to your sort of standard market rate apartments. So that's kind of where their justification is coming from. And they say that in the IT annual background as well. So stuff is comparable with that. And again, they are providing apartments the same rate they were whenever their application was approved last year, just accommodating for the extra small units of apartments. So we do have positive findings, and in addition to those findings, we find that most initial use will not adversely affect the public health, safety, or welfare, will not alter the essential character of the general vicinity, or cause a hazard or nuisance to the public. The proposed use selects a buffer between single-family residential uses and other more intense uses in the general vicinity. All necessary public services and facilities are or will be available without an overall proposed use. The requested waiver is generally reasonable if the applicant is provided sufficient evidence that the intended users of the accepted property are less likely to generate a high demand for parking spaces as compared to the travel population. And that the requested waiver does not impact the basic seven district's permitted uses, both density and crime requirement, or maximum limit. As a permit in regards to supported footage, so we are recommending approval subject to seven conditions. Number one, that the conditional use of the waiver may inspire development to allow the use of the property for all two family dwelling units. Number two, that the conditional use of the waiver are permitted only in two members, place alone, being level one, personal one, a.k.a. under PEA requirement number 086-0000029.01. that the facilities shall be conducted in accordance with the submitted application materials and site plan. Number four, that all necessary permits and approvals, including a development plan and building permit, be obtained prior to construction. That action of the board is to be noted on the development plan. That off-site parking shall not be allowed along the frontage road. And that no parking sites shall be installed along the frontage road. And that a traffic impact setting be submitted at the time of the final development plan.

We're trying to get as many comments from the public as we can on the draft by September 15th, if possible. It's a full-scale zoning code and some of it is a regulation update. So there's a lot of update in there.
