Certainly. The Finance Committee met earlier this evening and covered a couple of topics. On the agenda tonight, we're recommending for approval item 8 on the agenda, 061526, which acts as a correction from the prior council meeting. So we did recommend that for approval tonight. We also discussed our TIF funding and making sure that with the recent enactment of the property tax legislation that our TIF revenue is not going to be subject to that. Also, Lisa was nice enough to share some financial information, a monthly report that we're going to be getting amongst the Finance Committee on a monthly basis, and the audit for the city is well underway and should be completed very soon. So a lot of good stuff going on there. That's it.

All right, Megan Baumgartner, the Director of Community and Economic Development for the City of Fishers. I'm very excited today to bring two different project agreements in front of you for consideration since these projects are really tied together as an overall next expansion and phase of Fishers District. Hoping I, with your permission, am able to present both of these tonight, bring up representatives from both groups to be able to speak and then receive approval for these separately following that. Um, first and kind of an overview for all of this, obviously back in 2016, when Fisher's district and that that was the yard at the time was announced and now here today with our, I don't know if they can turn these.

So, back in 2016, when the yard was announced, obviously up along 116th Street, we've gone through multiple phases and expansions, all with their fun names of the Union and the Crossing. But today, we're excited for this next vision and this next phase of Fishers District that really has this great sports focus to it. Um, so, on the upper right hand side, obviously, is Fisher's District. That, um, the logo is on top of what is Thompson Thrift's multifamily projects. And so, those were the bonds that Elliot just, um, brought forward for you today. Underneath the, the Fisher's Event Center is obviously the key landmark of all of that in the middle of that development. The box that's to the upper left of where the event center is located is the new hotel that we had brought forward for council and excited in the next couple of weeks to be able to share that official name and flag with that hotel. And then underneath the Buckingham logo are the two buildings that are under construction right now, which are BW's retail buildings that'll each have two restaurants within there. So excited to start to see some additional momentum happen here. But obviously the projects today for this expansion include the JD Sports. So, JD Finish Line North American Headquarters. Which will include the purchase of the Link Building. Formerly known as the Sally Mae Building. Formerly known as the Navient Building. But obviously an institutional building along I-69 and within the City of Fishers. And so, excited to share more about them and what their plans are, then obviously the contrast by Buckingham, which is another mixed-use development, it'll have 166 multifamily units and 88 four-rent townhomes there. And so really wanting to create this walkable, this continuation of a walkable community and a walkable district and connecting to JD's new headquarters and down to our new Fisher's Fieldhouse, which will be home to the Indy Ignite corporate headquarters and their training and practice facility. So that facility itself will include 10 basketball courts that can be converted into 20 volleyball courts and really be another addition to this great sports, youth sports initiative that we're continuing to invest in within our community. With JD Sports, so that is the first project agreement. They are, again, planning to purchase this 400,000 square foot building off of I-69. They plan on relocating 400 existing employees here. So these are their corporate level folks who are going to be relocating from the east side of Indianapolis into this facility. JD is really expanding within the U.S. and plans to over the next few years add an additional 250 additional employees to this location. Currently, there are tenants that are in that space right now. The leases with those will continue on as planned, but JD really is excited about building this out as a campus. For their incentive package, this is where Buckingham ties into this as well. So this building right now is currently and will be purchased via finish line by Buckingham Companies, which then will sell the building to JD Sports. When we started talking about this overall Fishers District and some of the needs that we were finding with the event center and adding all of this additional development, parking obviously came into play and how do we add sufficient parking within this area. And so what better way than to leverage city assets instead of spending 30 to 40 million dollars for a parking garage to then instead partner with a corporate headquarters. And so as part of our deal directly to Buckingham but to the benefit of JD Sports is a six million dollar um buy down of that purchase price for JD Sports. Um so as in return for that the road that is currently USA Drive is a private road. So we're not able to utilize that in our traffic efforts and planning for the Fisher's Event Center or getting folks in and out of that overall development. So we will that will now become a public road. Um all of the majority of the parking here will become available for public parking during event days as well. So again instead of us spending $40 million to build a parking garage that's used during our events, leveraging and kind of nesting the resources that we have here that exists today. Additionally, there's two outlot parcels that are on USA Parkway right now. So for those who remember it a while ago, it was an old daycare that was there, but it was torn down 15 plus years ago. So the city will now own those two properties, which again is a great location for us to be able to partner with JD, to partner with additional users who might have an interest in locating near this facility. So before I go on to the Buckingham side of the house, I would love to invite Matt Poskey to come up. He's the VP of Real Estate for JD Sports Finish Line. So he can share a little bit with you about what led them to choosing to invest here in Fishers in this way and with their corporate headquarters.

Thanks, Megan. Thank you, Council, for having us. It's been a great opportunity to work with the City of Fishers to bring JD Sports here. We've been residents of Indianapolis since our formation when finish line was formed back in the 80s. And now we've been looking for our next chapter. So, you know, we are excited to bring over 400 employees here. These are our global, or sorry, our North American leadership, as well as all of our operations. We've been a partner and a resident of the Far East side. We love getting involved in our community, and that's what we're looking for here at Fishers. You know, some fun facts. We built the Boys and Girls Club on the Far East side. We spent probably over $5 million in that community on the Far East side, and we're excited to bring that here. You know, one of the big pieces that brought us to Fishers, other than me being a resident, is... is just the community and the sport coming together. You know, our president and CEO, John Hall, talked about that in the press conference. That was unique to Fishers in this development, and that's where we think our culture and this development will kind of come along. So can't say that we're excited enough. We wish we could get in tomorrow, but we got some building to do. Happy to take any questions or thoughts, but we're real excited to work on this project with you guys. Thanks.

So again, our partner in facilitating all of this is Buckingham Properties. And so Buckingham is not only our master developer for this next phase of Fishers District, but obviously then constructing two pretty pivotal pieces of this overall development. So as part of the extension of the crossing development, wanting to create this walkable community and additional density to help support this significant amount of retail that we have coming to our community. They will be building a, so the two buildings in the green, those are kind of your traditional multifamily buildings. So four stories, those will have 166 multifamily units. And again, this is catered towards people who want to be part of the excitement of the event center, want to be a part of the excitement of the plaza. and all of these great amenities that are there. And then they're also adding a really unique product that we haven't seen frequently in Fishers aside from the slate project, our for-rent townhomes. These will be two, three, and four bedroom townhomes. They'll be lining the primary addition from an infrastructure perspective is this diagonal road, which is the extension of Maiden Lane. So that'll be a public road that'll have parking along there as well. So focusing on creating this really great walkable experience if folks do arrive a little bit later and have to park over in JD Sports' new headquarters and in their parking lots, giving them a great experience, not only just for the residents who live in that area, but any visitors who are attending the event center or at the new Fisher's Fieldhouse. So as I mentioned, that's a 180,000 square foot facility, home to Indy Ignite and their practice and training facility. Buckingham will be the builder and owner of that property, and the city will lease that. And so contemplate it as part of their incentive package. Obviously, as I mentioned earlier, the $6.1 million that the city will be paying to reduce the land price, but obviously get the benefits of parking, USA Drive, and JD Sports headquarters. Um, that will go to Buckingham as part of their closing. Um, and then we're also requesting an approval of a 10 year personal and, um, real property tax abatement for that facility since it will be privately owned. Um, this allows Indy Ignite to ramp up their operations. Um, we'll have an additional operating partner that will be within that facility as well. Um, so that really helps allow people to not have to worry about the, um, taxes associated with the ramp of, of those locations. Um, for JD Sports directly, I can't remember if I mentioned this already, uh, we're requesting a 10-year, 100% real property and personal property tax abatement for them going into that building. As you can probably expect, um, that building hasn't been assessed at a super high level right now, and so we anticipate with them coming into the facility, renovating it extensively. We've done this with a couple of other companies like DMC Insurance and Round Room. by abating the additional increment that would be generated from their improvements to that facility. So very, very big project, kind of all in. We're close to $150 million, I believe, between all of these three different groups, bringing now Fisher's District to a total of $950 million of investment within this area. So pretty incredible project and happy to answer. Oh, and then for Buckingham, though, before I take any questions, Brett Davis is here with Buckingham to talk a little bit about their role in this development and why they're excited to partner with us.

When we first had conversations about this, heard the vision, we instantly became excited about it and really just looking forward to continued collaboration as we put the final touches on this. I think one thing I would like to just make a comment about Megan's economic development efforts over the last five or six years in a downturn office market. If you look at the old Marsh headquarters, the old Roche office building, the Wiley building, and the Wilco building, well Navient for those that use that term, they're now all filled with corporate headquarters and significant reinvestment into those office buildings. And that's in a time where office is really not a business you want to be in necessarily. So that's pretty extraordinary along that I-69 corridor that we've been able to turn things around.

get those things and say, oh, jobs, jobs. And then you talk about traffic or what, you know, those things come up with legitimate concern, right? Legitimate concerns to things, but amazing work, like simply amazing in this market where all the numbers are pointing in one direction, we're going the other direction. Megan, you never cease to amaze me. I'm just like, to bring in a world headquarters, for a U.S. headquarters here to Fishers is just absolutely amazing. Mayor, I will say, I think you missed the mark by about $50 million. You know, it would have been nice if you had... We're not done yet. The other thing I will say is that in conversation, since this big announcement, there seems to be a lot of interest in getting pedestrian and bike connectivity over the interstate. I've ran into that at least two times since this big announcement came out.

I think it's just going to be such a vibrant place with all the sports. groups that are there now and then with this new facility as well and it just adds another dynamic to a pretty dynamic place that we already have there.

I have a quick question. With the overflow parking at JD Sports for events, will it be free parking or will LAS oversee that for us? How will we work that in lieu of a parking deck?

Most, so LAS has been our partner and is partnering with all the developments around here. So I would anticipate, anticipate that they would be our partner as well for this location. Elliot continues to be our parking expert here, but we will bring forward and would have a parking easement that would go before Board of Public Works that would outline exactly what our allowances are. It would be contemplated that we could put facilities in the same license plate readers up, but a final determination on that hasn't been made yet.

Correct. So it'll be two different abatements. So we'll bring back declaratory and confirmatory resolutions as two separate buildings, so two separate areas. So JD, because of the investment that they're making, plus they anticipate, obviously now property tax changes with personal property has changed, but they anticipate a significant amount of new personal property going into that building. And then with the field house, obviously with all of the equipment that's going to be installed in there, Receiving a benefit and a tax abatement on that personal property would be helpful as well so is the is the purchase price of the headquarters and

in the 169 number that's been, or is that outside of that?

That is, the purchase price of that building, I believe, is $19.1 million, or $19.2. Our contribution will take that down to $13.1, which is then for JD Sports, and then that's where the road comes into play and this perpetual easement of all this parking.

They would, so however their leases are currently structured and however property like their real estate taxes are in there because this is for new increment that would be generated on the real property side. I think that's a question probably for Matt and his team as they would start to dig in to see how the the taxes are passed along and on like a full service lease. But again, those tenants that are in there, they have leases that are in place that then would extend beyond the sale and the purchase of the building.

I'm here this evening to talk about a couple of things. As a person in a wheelchair, I have found a couple of difficulties. One, I live right off of Nickel Plate Trail and rolling on the trail in the afternoons or evenings or even in the mornings, I find it difficult. when there are people on the motor vehicles with the helmets and they are flying around and I may have my grandson with me or something like that. I'm about to get a support dog for myself and I just think that it's very dangerous and I know that there have been signs and things that those aren't allowed And I have even in our building, we have the garage. And I have stopped young boys that are just zooming up our garage that don't live in the building. And I'm like, I have no problem sitting on the trail and writing tickets. I'm just letting you know that this evening. All right. Yes. There we are. Let's go. And then my second thing is I also roll around the city to get to places, CVS or McAllister's and things like that, and I'm finding it very difficult to get across the street in time as the signal changes. And so I know you are building, they're building this 55 and over community on the corner of 116th and Lantern. I'm thinking people are going to get extra points for hitting older people. So I'm just going to ask that the Council would consider maybe extending the time on those signals for people to cross the street. We are the current co-presidents of the club at our school called Future Black Leaders, and we're here to promote our event, our seventh annual Juneteenth Jubilee, which is being held on June 19th from 5 to 8 p.m. at Connor Prairie. And basically, the Jubilee was created to bring the community together to celebrate a day of freedom and independence. We think it's important that people attend because it provides an opportunity for people of all backgrounds to learn, connect, and celebrate together.

Hey, Russ Reinhart, 7704 Cookside Court. I mainly wanted to share a positive thing I encountered. So I was on my way somewhere on the Nickel Plate Trail, really disheartened as you can imagine when I looked ahead and I saw that it was blocked off, it was closed right over here as you approach North Street. And I was disappointed, but then as I got closer I noticed that somebody had gone into trouble to come up with detour signs for bike and pedestrian. There was an actual marked bike and pedestrian detour to get around where it was closed. and I wanted to call that out as I'm not sure who is responsible for that at the city but I thought that was just a really great example of really taking seriously you know biking walking as a form of transportation around the city especially when you're walking or biking you can imagine that having to go well out of your way can be a much bigger deal than if there's a detour in a car, and in the worst case scenarios, sometimes there just isn't another way to get around. So I wanted to call that out. It was something I thought that was just really exceptional that somebody had taken the time to have that marked detour. And I was working at the coffee shop next to it today and saw tons of people on the trail being able to see that and have clarity. So just a great job to the city. I just wanted to call that out. It's something that hopefully as we go forward, we can continue to do anytime we have a place where we have to obstruct a thoroughfare for biking and walking. Also, I wanted to say I'm really excited about the development around the district, and it's really cool to see that grow in the event center. And I definitely agree, too, that the biking pedestrian connection to that would be a huge boon. I think it would be a prudent thing for us to think about. as we consider not wanting to have to have both that area and the nickel plate overrun with parking. If people can get between those two, that takes pressure off of parking and traffic on the street. I can imagine a lot of people that are going to be moving in over there would love to come over and enjoy our farmers markets over here and be able to come to city council meetings and all that kind of good stuff that happens on this side of the road. And I know I would love to be able to bike and walk to the district over there to enjoy the restaurants and just all the fun, engaging stuff that's going in over there. And on a similar note, I think as we continue to build out these areas, it's going to be also critical for us as a city to think about public transit and how we're going to create those connections, especially with somebody like JD moving up from the east side of Indy. How are people going to come up here, get transportation back and forth to work, to home? Just ensuring that mobility in our community, it's just increasingly going to become something I think we need to ponder as a city in order to Keep our traffic and parking Pleasant for everybody and ensure everybody has freedom the freedom of mobility travel community.

Justin Berkner, 15621 Wellsprings Place. I'm up here to talk again about Ordinance Amendment 031626A. Continue to provide transparency to the general officials public about the impact of the ordinance change. If you're not aware, on May 28th, the mayor executed a use agreement between the city, and a partner organization for the six fields at Cynthia Park. As a result, the partner organization will have, per the agreement, exclusive access to Cynthia Park fields for the next 10 years with an optional five-year extension. That's a public park, exclusive access. In total, the partner organization will compensate the city $1.3 million over that 15-year period should they choose to go all 15 years. The agreement gives the partner organization authority to decide if any additional organizations that serve the Fishers community will be able to access the fields over that 15 year period. Again, it's a public park. Per Fishers ordinance, the city athletic director is responsible for determining field allocation, but the mayor's decided this responsibility should also belong to a partner organization. I believe this directly goes against the ordinance that you all approved. The agreement as executed also conflicts with the ordinance you passed regarding roster composition. The agreement only requires the 60% Fisher's participation test to be based on the players that practice at that field, not on the partner organization's overall registrations, which again, was a requirement of the ordinance you approved. Rather than having an open and honest discussion about the ordinance change, the mayor's office has continued to shift narratives around the reason for the change. The original explanation was that Mud Sock Athletics prevented other groups from accessing Fisher's parks. How does granting a 15 year agreement to a public park open up access to the emerging programs in Fisher's public that you said yourself you wanted to have access to? Prior to the ordinance change, Cynthia and Park served no fewer than four different athletic organizations focused on the kids in our community. That's four organizations. We're down to one now, okay? And then we were also asking taxpayers to foot the bill for this Cynthia Park and any maintenance over the next 15 years. As I indicated earlier, the partner organization is going to give $1.3 million over 15 years. Conservative estimate is going to say that's going to cost $12 million plus over 15 years to maintain. That bill is going to be footed by the Fishers taxpayers. Why are we footing the bill for a private organization at the hands of our taxpayers? I ask Mayor Fenness that we finally decide to have a transparent and open, honest discussion about the impact of the ordinance change. The mayor's office has communicated the change was to open Fishers Parks. I just told you that's not happening. They communicated the change was also to bring kids to practice here in Fishers. The mayor and I both know that that organization has multiple fields that are being used historically.
