Public hearing. First item up is application requesting a plat of urban plains by Brandt 8th edition. Donald Crest is our presenter today for all of them. Yes, ma'am. Thank you. It's a hattick. I'm doing all three. So, Donald Crest of the Department of Planning and Development. Uh, good afternoon, commissioners. Our first item, as the chair has stated, is Urban Plains by Brandt, 8th edition, uh, located here. We're looking at the map here, uh, on Veterans and 32nd and Cedar Parkway. Uh, you've seen this a few times before. There's actually a chart in your staff report that uh gives you a little background on the couple of times this has been replatted. The underlying plat earned planes by Brandt 7th was recently before you in 2024 when Brad Garcia was with us. He uh he did that subdivision. Uh the uh requested entitlement is a subdivision here. We're actually a little different. We're standing in the middle here of the uh well, you don't see it on this. Um some of the uh private streets are are installed already. Ace Allen Way uh part of Ace Allen Way and Karen Way are installed. That's shown on your plat. So this just uh looking north. Here's the sports bubble and uh where the uh location of the potential uh convention center is up there. One of the four potential locations of the convention center here. Again, just uh looking northwesterly and uh and then looking southwesterly. As is referred to in your staff report, there is an existing conditional use permit for the sign. I'm sure we've all seen that sign. That's down there on the corner of 32nd and Veterans. And then this is just looking straight down Karen Way here. This be 32nd Avenue South on the on the distance there. Zoning here is LC Limited Commercial with a conditional overlay. The conditional overlay will remain in place. That was

conditional overlay was established by the previous plat, the seventh edition, which consolidated three different existing cups. Uh urban plains has uh has had several iterations over the years that it's uh it's been in play. Uh this shows the plat that takes the the lot here and divides it into five. This again these are all private streets. So these are not dedicated public streets and uh maintenance of the roadways and utilities is the responsibility of the property owners through their association and their covenants. Uh there is as you see nothing on there. Theis bank is down here. uh you see that uh in the photos. Uh we do uh we under the uh understanding that uh in the near future we'll see some development proposed on these two lots. Uh you might be seeing some entitlements for that in the next month or so. And then uh on one of these one of these lots here would be a building permit coming forward uh for development there. And so again, just uh recap that there's the existing conditional use permit and conditional overlay carry through and all development will be uh have to meet that conditional overlay. The applicant's representative Tim Gleason uh is uh with us this afternoon along with uh Sam Soulberg from Lowry Engineering and wish to address the commission. Thank you ma'am. Our next item here is the old Broadway second edition uh located down here along Northern Pacific Avenue uh commonly referred to as NP Avenue and Broadway. I believe we're probably all familiar with the uh the old Broadway itself and the related properties, including this alley back here, which is in fact a private alley. That's not a city alley. Here's a closeup of this. The requested uh entitlement is a subdivision. Again, probably familiar with this, but these are the subject properties here. Uh just some different views here along Broadway and NP Avenue. This is the new uh parking ramp and uh community theater that's under construction in the back here. And then this is looking down uh the alley here. This is standing in the BNSF right away looking along the alley here. Uh so this subject property includes the alley but not these buildings, just the alleyway. And again looking on the corner here uh just a little history for you. Uh NP Avenue is of course Northern Pacific which has a long and complex and fascinating economic history if you ever want to read it. That actually uh merged into the Burlington Northern in 1970 and then that became the Burlington Northern Santa Fe in 1996. We just have had a lot of NP stuff. Last month we had Northern Pacific third edition. My grandfather worked for the Northern Pacific, so I had to get a pitch in there for that. Um, this uh property is zoned DMU. It shows as gray on here because uh recently we approved the your commission recommended for approval the Old Broadway First Edition. And this is shown in transition, but it is actually DMU. The zoning did not change. Um, here's the plat similar to the old Broadway first edition. After that plat was recorded, uh the owner uh after evaluating it determined that he would rather have that set up as two lots instead of one big lot. And so they submitted a plat to do that. Basically just drawing this line here down the uh down the old Broadway first edition. The uh applicants representatives uh Patrick Johannic and Warren Aley are with us this afternoon and may wish to address the commission. Staff's

motion carries. Last item three, hearing on an application requesting a plat of Champion State at Farm Edition. Thank you, ma'am. Again, uh this one is another replat of a recent replplat here. Uh this is located on 31st Street South. Uh 52nd Avenue is is to the north here and uh city of Frontier is here. Uh you may recall uh platting this recently. Again, there's a chart in your staff report that shows the recent replplats of this property. And this uh when this was platted most There you go. most recently, this was uh one large 2.06 acre lot. Uh the proposal here is to replplat it. Here is uh the uh the site here basically on this side of that's the this side of the pickup truck. You see that there's the uh access easement that's paved in here. That's there are two driveways here. One's here and one is the other end off 31st Street. So there don't have to be individual driveways onto 31st uh street. And then again here's looking at the subject property. Here's that same pickup again. They'll they'll come in here and then the plat depicts a a little addition to the uh uh to the easement to allow access to lot two on there. Uh the zoning here is uh SR3 and that will remain. And so here's the here's the plat. Here's that uh driveway we saw. That pickup is parked out here. So this area is the entire property. Lot two uh is where the that white pickup starts. There's the addition to the access easement. So again, just taking a look at that whole area down there. And then in the background is the city of Frontier. We did get a couple of inquiries on this property on this project uh from uh Frontier residents. Just curious as to what was going on and we uh we did answer their questions and

they were uh satisfied with that. They had no objection. And so again, pretty straightforward uh subdivision plat here. The applicant's representative, Brian Patgale of Houston Engineering, is with us this afternoon and may wish to address the commission. Is that something that they bring or that we I How did that come about, Mr. Mr. Patel, I think we asked for it and we Oh, sorry. Uh, no, that's we we worked with them. We I think we wanted that. Okay. This has been as as indicated. Well, Mr. Patel comes up to the mic there. Uh, there's been a couple iterations of this. It was originally six big lots, then it was 25 smaller lots, and that's where that easement originally came from. So, there wouldn't be 25 busy driveways on there. And then as it evolved into this, we kept that.

Correct. It's originally it was a proposal with we had 20 some odd lot 20 plus lots. We had driveways. The city didn't want that many accesses off of the what functions as a collector road more or less. We came back with this reduced lot count. They still like the idea the developers still like the idea of the private sort of boutique neighborhood thing. So we kept the driveway access portion. Um and essentially we w up with sort of a reduced access points. They line up better. It's better traffic flow. Again that's pretty heavy traffic flow road. So it reduces conflict points and generally makes everything flow a little bit better traffic-wise. So that's why we wind up with sort of that shared private access, a little bit of both city and developer desires.

Yeah. And they're very deep lots as you see, Commissioner. So there's there's room to do that. And as was recently observed, 31st can give you be a busy street connecting between 52nd and uh 64th down there. Yes, I think it's a good idea, right? Um especially for the traffic and then the town homes to the south have the same thing, right? So there's correct. So I think it's a really good idea. So I really like that.
