Afternoon. I'll call this meeting to order. Today is Tuesday, April 7th, 2026. This is a regular meeting of the Fargo Planning Commission. Item A is approving the order of agenda. Skip that. We've got one announcement. LDC update. Reminder, there is an LDC workshop on Thursday, April 9th from 12 to 1:30 p.m. in Sky Commons, second floor of the Civic Center for a project update, a preview of April discussion, draft, and an opportunity to learn more about specific parts of the LDC. meet meeting format is is presentation at noon followed by breakout sessions. So again that is Thursday April 9th 12 to 1:30 p.m. at Sky Commons. Um okay now we will move to item A approving order of agenda.

Good afternoon, commissioners. Donald Crest of the Department of Planning and Development. Our first item here today is Selkerk Place fifth edition uh located uh here. This is 64th Avenue South I29 uh drain 53. That's this large lot here that was originally platted in Selkerk Place, first edition in 2019. Uh here's uh the property is undeveloped here. This is 67th Avenue South. This road over here is Selkerk Drive. Here's that detention basin. And then over the levy here is drain 53. So we're looking at this is a 2.11 acre property. You're on 67th looking north. And then here we're uh standing at the other end. This is the corner of that house up there looking south. As you see an undeveloped property zoning here is SR2 single dwelling residential and there is no zone change proposed. Uh this lot as I said was originally uh platted in uh the Selk Place first edition with the intent that it would be replplatted into smaller lots in the future and that has come to pass here. Uh this uh subdivision plat divides the property into five lots continuous with the style of lots along to the north. Uh, again, pretty straightforward here. Um, we did get one question from a neighbor as a result of our notice. Just wondered what was going to happen down there. So, we responded to that. Uh, and then the, uh, applicants representative, Jeremy Host, is with us this afternoon. May wish to address the commission. Chelsea Leverson with the planning department. Agenda item two is Simonson Company's fifth edition. It is located at 5237 38th Street South. Um is right on the corner of 52nd Avenue South and 38th Street. Interstate 29 is to the west and the South Fargo Walmart is located right here. Commissioners, you did receive a layown item for this case. It is a revised plat with some changes to the placement of dimensions on the plan. Here's a photo of the the property facing northeast. You can see the intersection of 52nd Avenue and 38th Street stoplight in the background here. And here's a photo facing northwest taken from the Autozone parking lot across 38th Street. The property is zoned LC, limited commercial, with a conditional overlay. The conditional overlay provides design standards, separates vehicle and pedestrian traffic, and prohibits some uses. No zone changes being proposed, and the conditional overlay will carry through with this subdivision. This minor subdivision is a replat of lot 2, block one, Simonsson Company's fourth edition. It'll be titled Simonsson Company's fifth edition. It will consist of one lot, one block. The only access to the property is provided uh by a private road with a connection to 38th Street. It's right here. No property lines are changing. This plat relocates an existing utility easement. The easement was established by PLA. Therefore, platt therefore it
needs to be vacated by platt. The existing easement is located right here. This will be vacated and the new easement will be located right here. We have not received any inquiries about the property. Staff's recommendation is for approval as all criteria are met. The motion is stated in the staff report and shown on your screen. I have one. I just wanted to confirm the access point. Is that going to be just a right in right out into that property or is that a full service turn? I believe it's right in um Nathan. Yes, today off of 38th Street that is already a right in and right out. There's a median in the middle of 38th Street that would prevent a left turning movements out of the site. Thank you. Good afternoon. I'm Elena Espth and today I'll be presenting agenda item number three. This is Jured Thompson second subdivision. It's a minor subdivision. It's located at 2722 and 2748 44th Avenue North. This is just north of the airport. Um the top image is taken facing northwest looking at the subject property from the roundabout um that is on 27th Street North. The bottom image was taken facing southwest looking at the subject property from the intersection of 44th Avenue North and 27th Street North. Subject property is zoned LI and there's no J no zone CH zone change proposed. Sorry. Um so the proposal is for a minor subdivision which is a replat of lots five and six block three of Jerid Thompson's subdivision into a one lot oneb block subdivision entitled Jerid Thompson second subdivision to date staff has received no inquiries on the subject property from Lowry and Engineering is here and uh staff's recommendation is for approval and stated in as stated in the staff report and shown on the screen. Good afternoon, commissioners. Luke Mormon with the planning department presenting agenda item two or sorry, four. Uh this is Reeves Edition. This is located at 610 University Drive North. If uh if you follow my cursor on screen, I'll give some context here. 7th Avenue North University Drive. Uh the BNSF Railroad is here. The applicant is requesting a CUP to allow manufacturing and production in a GC general commercial zone. The applicant proposes to renovate the existing building on the site to be used as a signed manufacturing company, coffee shop, and offices. Aside from the proposed CUP, a building permit will be required to review applicable lane development code requirements along with other cityart department code reviews. Looking at some context with some site photos on the top, we're facing southeast from the intersection of university and 7th Avenue. Can see the existing building in front and then turn on the right hand side, you see the existing parking lot. And then on the bottom right of the screen, we're facing east from the parking lot towards the building. The existing zoning is GC general commercial and no zone changes proposed. Here's a preliminary pre preliminary floor plan provided by the applicant. And as you can see the sign badgers is the business that will be using the well with the manufacturing production use. And then you have the coffee shop and existing patio kind of in the purple here. And then the office uses uh towards the east of the building. And then a preliminary site plan also shows the um this one shows the landscape buffer in the green. So shrubs and trees here, existing parking, loading zone, and then uh the dumpster is uh moved uh moved to this area to be fenced in. And then again the existing
patios and green space on the bottom right hand of this of the screen. staff has received and responded to two inquiries in response to this project. We received one inquiry after the publication or one of those was the after the publication which was included as a layown item and that was from a neighbor uh curious about the potential noise and odors which uh describing the conditions uh they didn't note any additional concern. The planning staff has developed a standard conditions for industrial uses like this in general commercial zones. The only exception listed here is item six was just just a additional landscape buffer to help screen of uh any nuisances of the property. Staff find all criteria to be met and are recommending approval with these conditions shown on the screen and your staff report. The project representative Dawson Shfter is present to answer any questions. And just one note for CS, any appeal of this planning commission decision would go to city commission and then pursuant to the LDC, appeals of final decisions must be filed within 10 days of the date of the decision. Good afternoon chair and planning commission. Megan Ell with the planning department. This agenda item is D1. This is a non-public hearing item. This is review of a final plan of a plan unit development. The site is located at 4410, 4448 24th Avenue South and 4409 and 4417 26th Avenue South. So up on my uh cursor here at the bottom of the screen, you can see the the four easternmost lots in this development. This is between 24th Avenue and 26th Avenue South along 45th Street. Couple images of the site. This is if you were looking north from the culde-sac of 26th Avenue South. Uh on the left side of the image, you can see the mocked building that has been constructed. And this image is shown from as if you were standing on 24th Avenue South looking southeasterly into the site. So this is the area that we're talking about. And just off the photo to the right would be that mocked building. This is the zoning map. This is a general commercial as a base zoning district with a PUD overlay. This is the approved master plan. Your commission reviewed an an amended master plan and PUD overlay. PUD master plan and PUB ordinance back last year, last fall, last summer and last fall. Um this is the approved master plan. And so what your commission is reviewing today is those final plans and consistency of those final plans with the PUD master plan. the first phase of um outside of the mocked building, but the first phase with this JNO um 45th Street Apartments edition you reviewed last fall for that final plan that is uh this lot here that I'm circling. So, there's been one review of the final plan already. Uh and what we're looking at today are these four easterly buildings as kind of that next phase in that plan.
The PUD final plan is that third component of the of a PUD. There's the PUB master plan which is up on the screen that's been approved. The zoning ordinance that's also been approved and the final plans which are which are essentially the building permit plans. Uh this does not take place of a permit review that will also occur but this is your review in terms of of that zoning uh zoning of basically the the site plan, the civil plan. So this is the portion on the north side. This is closest to 24th and a couple slides later I have kind of a composite uh and comparison with the master plan. So this is on the north side the hatched area is the building foundation and in between is the circulation. This is the final plan that is off of 26th Avenue South. And this shows the comparison between the final plan on the right side and the beauty master plan on the left side. on your screen and in your packet is also elevations of each of the buildings. I won't go into detail about these, but they're just for your reference. Up on the screen is the recommended motion. I'll note there's just a slight change for grammar um from in your packet. So, if you do make a motion um reference this motion. This is a non-public hearing item and Brian Patentale is here as the applicant to answer any questions that you have. The culde-sacs were dedicated as rightway with the plat that your commission reviewed last year. So those are those are there. They're already in place. They're there. And there will be a project upcoming I believe this summer to a infrastructure project. Okay. So the in order to have this approved, you'd have to have these culde-sacs in place right before you start building or how's that work if they weren't there the theoretically?
Yeah. So those part of the plat include a developer agreement and the developer agreed to wave the right to protest those improvements. So we have the ability to construct those. So we're under design right now. Anticipate those being constructed this summer. So they may require an early building permit to be allowed to build departments while our project is going on. But if they're there, I mean, they have to be in before you get a a before you get approved, before they can move in, before you get a seal. Right. Correct. Yeah. They'll be constructed before any sort of certificate is issued there. Okay. Thank you.

Afternoon, commissioners. Brian Patingale with Houston Engineering. Uh just to follow up on Commissioner Rosenberg's concerns. Uh we've have c been coordinating with the city's engineering department as far as making sure our design matches in with their design. Uh so we're coordinated on grades, driveways, utility services, that kind of thing. Um, as Nathan said, that project's going to be let this year still, I believe, with construction before the end of the year. I believe our project probably is going to typically take 12 to 18 months for construction before they'll actually get into the building. So, yeah, there'll be some coordination. We won't be occupying that till sometime next year, probably early spring time frame versus the streets culach, which should be completed this year. So,
