All right, thanks everybody for joining me in my favorite part of the night. We're going to roll right into comments by the general public. Pursuant to NRS 241, this time is devoted to comments by the public. If any, a discussion of those comments. No action may be taken upon a matter raised under this item of the agenda until the matter itself has been specifically included on a successive agenda and identified as an item for possible action. Thank you. Can you hear me okay? Yes. My name is Vern Hatch. I'm from Spring Creek, 972 Tobiano Road, Spring Creek. And I'm looking at doing some things over here in Elko within the next few months. I've had a lot of people actually ask me about the data center that is possibly going into the Millard Farm area, and there's a lot of worry about it. So I've been asked to put together a report for them, and there's one that's going to go out. But I'm just curious to see if there's any added information from your perspective. I've interviewed a lot of people, and this is kind of my last stop.
Uh, so me personally, I heard about something about that the other day. Um, but I don't know anything about it. And of course that's out in the county. And so we just handled the city.

Oh, okay. Well, I don't know if anybody else knows anything about it. What do you say? A data center? Yeah. Not at the Miller.
Well, there's a huge one in Salt Lake. Why are they putting one out here? Water. I mean, is this speculation or is it in the planning stages? My understanding is that it has not been formally introduced anywhere, but it's just something that's being worked on by a utility company. So I was just wondering if that had,
approach the planning commission and if not that's okay it's just kind of my last thought and yeah they they haven't uh approached us at all okay we're usually uh we're not the last step but uh after they've already talked to the city officials then it comes when it gets serious it comes to us all right thank you very much i appreciate it you're welcome thanks again does anybody else have a public comment okay we'll move right along there is another uh time for public comment at the end and then of course every item will have a public comment uh if you guys are interested okay uh we're gonna move right along to approval of minutes the june 2nd 2026 regular meeting for possible action i make a motion that we approve the minutes as they stand okay do we have a second second i'll take a vote Aye. New business, A, public hearing one, review consideration of possible action on variance number 2-26 filed by Edmund Sandoval, a variance from Elko City Code 3-2-17D2A to allow the required off-street parking to be located in the front and side yard within a RMH mobile home park and mobile home subdivision zone district. and matters related thereto for possible action. The subject property is located on the northwest side of Panorama Drive, approximately 50 feet northeast of the intersection of Panorama Drive and South 9th Street at 919 Panorama Drive, APN 001-481-016. Thank you, Mr. Chairman and Planning Commission members. I am Bob Thibault with High Desert Engineering here on behalf of the applicant, Edgar Sandoval, who's also present this evening. As you can see, before you there and on the screen, the site plan that I have provided for this house to be developed. And you can see there that the proposed parking encroaches into the side yard by just 1.7 feet and into the front yard by just about a half a foot. And so this house was purchased, and then now we're trying to fit it onto this parcel. It's a modular home. And we've just about got everything fitting except for these two small encroachments with the off-street parking. We still will have the two off-street parking spaces as required. They're just going to be a little bit into the side yard and just very little bit into that front yard setback. We can't push it back any further because that's where the door is on the side of the unit. And so the stairs and the landing need to be there. And so that's why we're still just a half foot out into the front yard setback. Other than that, I'm happy to answer any questions you may have. OK. Thanks, Bob. Appreciate you coming.

My name is Lyle Yowell, and I have a lot across the street at 904 Panamera Drive, which is on the corner of Panamera Drive... the parking on the street. Because right now, we have parking situations all up and down town and around them. There's a lot of cars that are parked in the street. And this additional variance to be considered, you're adding more vehicles into that, and there's other vehicles that are parked in front of my residence in there. And this is, there's some instances where it's happened before, especially during the time last year when the fire optics were being installed on the south side of town. residents right next to my property was rented and the workers were using my street access in front of my residence for parking their personal vehicles and work vehicles. And so that was for about two or three months over here working in town, and then they left. So currently there's still, in that area, there's still a lot of cars, or rather there's a lot of the property there do have parking off the street for the rocks. And this would be basically given preference this individual over the other auto owners. And I'm looking at people who probably would be, if they're from this place, they're coming across the street and taking up my car response. That's one question I have. The next concern I have is the size of the building that's gonna be put there. Now, and looking over your ordinance that were cited in the variance application, It doesn't really spell it out, but it kind of infers that if you're going to replace the structure, it should be the same dimensions as the structure that's being replaced. Do you have that information available on the structure that was there previously before it was taken out? And what's that compared to the structure dimensions that's being proposed to be put there?
So I believe that's what they're doing. They're going to have the two off-street parking. So you're going to get what you want, I think. It might be a misnomer, but they're actually going to be putting the two off-street on the side of that house. So because it's it's it's doesn't fit the code it it goes into the setbacks you have to have legal setbacks and this one will go into the legal setbacks a little bit so what they're getting is that's what the variance is for so they'll still have the off street parking on their property next to the house so that should actually alleviate some of your problems with parking in that area.
I disagree. I say that it will add to it. Because you may only have people that are there that are using the existing space on the street in addition to their own lots. And then this other becomes into this downstream. You're not going to have more people there and more cars. So you're going to add to the parking congestion. will park their vehicles in their parking lots, on their lot, on their driveways. But if they've got people come over to visit, family, whatever, they'll park on the street. And a lot of that has happened. That's happened in my situation recently. As recently as three weeks ago, there's a vehicle that was parked in front of my residence for two and a half weeks. And after that, that vehicle was moved, and another vehicle was put there for another week. And that was moved last week. And then I know why they're there today. And there's a different vehicle parked there. I have photographs of that that I want to share with you folks. And I also have an aerial view of the street showing you the driveways of the residences there. So you can come up and

I can go ahead and address some of his questions if you would like. So the way that the city code is written right now is the city code requires for every residence, every single family residence, So the way that the Elko City Code is written right now, for every single family residence, they are required to off street, off the street parking, right? And they can be side by side, they can be in tandem, they can be in any configuration that they can fit on the lot. the code reads under 3217 of our code it reads that in the rmh 2 district which this is the off-street parking cannot be in the front yard setback or the side yard setback so if you look at this red line right here that mr tebow provided us that is the setback line right And each parking stall is required to be nine feet wide by 20 feet deep. So that's 40 feet that he needs to have for his two in tandem parking spaces. And he needs nine feet wide. Well, he's got 40 feet right here, but it's Half a foot, it's six inches into the front yard setback. Six inches, right? Then his width on here, it's projecting over, the concrete is projecting over 1.7 feet into that that setback on this side yard setback. So the variance is not for parking. The variance is to allow the required off street parking to be in this setback by 1.7 feet on the side and 0.5 feet in the front. He is providing the parking on his property that he's required by code with any residents. Just as whatever size house he had there before, they were also required to off-street parking. We do not count the on-street parking as his requirement. So he is putting in addition to what could be parked out here in the street, Right here in front of the home. Sure. So Mr. Chairman, members of the commission, The applicant is the actual property owner. And as stated, this property had been previously developed with a mobile home on the parcel. The parcel is approximately 4,050 square feet, which is a lot smaller than what our standard residential parcel size is or what our requirement is today. The lot does have frontage along Panorama Drive. frontage along Arena Way, but Arena Way is a private street that's located within a mobile home park and therefore there is no public access easement granted to this parcel from Arena Way. There's also a very large, and because we did have some public comment about this, there's a very large power pole right here with a guy wire that you can see comes down and along that property line. So really it would be very difficult for them to have any access from Arena Way in this property. And we'll talk about a potential condition if you feel like it's necessary. The master plan land use does show this area as medium-density residential. The RMH2, which is a residential mobile home subdivision, is a corresponding zoning district for medium-density residential. We do also believe that it meets objective number one, and therefore the variance is in conformance with the master plan land use component.
