good afternoon everyone and welcome to the regular meeting of delco city council for june 9th 2026 let the record reflect that we do have a quorum of members here with council members morris and stone absent at this time please join me in the pledge jim foster would you lead us please allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. All right. This is the time allotted to comments from the general public pertaining to items that are not on this evening's agenda. If there are any, please come forward.
Yes, for the record, Scott Gavorski, I rise on behalf of the Elko County Republican Party. First, just a friendly reminder, if you haven't voted yet, you still have time until 7 p.m. tonight. And remember, you can vote at any polling location in Elko County. It doesn't have to be the one assigned for your precinct. And I do want to take an effort just to thank everybody who's working the elections today. It's been a pretty smooth process. But I also wanted to make the Council of Mayor aware that We're going to be joining with the Elko County Democratic Party again September 16th for a joint Constitution Week event. We're going to try to get either a CD2 or a gubernatorial debate here in Elko. And to do that, we're probably going to be bringing back the city for consideration if they want to sign into our invite letter to the candidates. What we're going to do is, even though the candidates might want to work with the parties, we think we have a greater chance, one, because there's a lot of rural issues floating around right now. But also we're going to be working with the city, the county. I've spoken to some community partners already, Spring Creek, Elko Chamber, spoke to the Lions Club at lunch, the Lions. But the more community partners we can get to sign on is going to make this much more possible when we go to the campaigns to show there's really community interest. So, like I said, a couple sessions from now, once this election winds down, we'll have a letter that we'd like to see if the county can or the city can go ahead and support us on that. So, thank you.
Scott, to my recollection, it's been many, many years. I can think back to Gibbons time, I think, since we've had. Oh, no, you said gubernatorial. I was thinking CD2.
Well, it's going to be one or two. We'll have to see. Part of it, unfortunately, is going to depend on the candidates that win tonight, and then the campaigns are going to have to decide. But we think those two, again, both on the statewide races and in terms of the congressional federal races, there is a lot of interest right now in rural issues. So being able to get that, it is going to be at the Elko High School Performing Arts Building. We've already got it booked. The party's going to be doing something anyway. We just think this is the best option. Nice celebration for the America 250th as well. So like I said, we're just going to try to give it all, and the more community partners we think we can line up signing on to that letter is just going to be icing on the cake for these campaigns to actually commit. And we think we can accommodate, of course we live streamed events last year out of the Performing Arts Center. They're set up, we think, to handle enough media bandwidth where if we do get the CD2 debate, the Reno stations can stream it live. here from Elko, which is another enticement. Great.
And there's still three hours to vote. Is it up at Adobe and the library?
No, no, just Adobe right now. And remember, again, if you're from out of town, you can vote at any polling location. If somebody wants to text a neighbor or something, they're also taking mail ballots. In fact, we somewhat suspect that there's going to be a higher than average number of mail ballots being dropped off at the polling locations this year. Not confirmed. Good afternoon, everyone. I am Ruby Sutton, and I am the director for the Miss Elko County Pageant. And I just wanted to announce that I live in Elko County, in Elko, Nevada. I just wanted to announce that we'll be having the Elko County Pageant this Saturday, and it's going to be at the Elko Performing Arts Building, and we'll be crowning from as young as little Miss Elko County all the way to our Miss Elko County, who are much older girls this year. It's going to be a fun event. The girls get to perform talents. They share their personal platform, which is something they advocate for in our community. And then they also get to do evening gown and then onstage questions and just share their heart for the community. You may have already seen some of my girls in the last few years at different events. My program is... a leadership program so i'm very big on service especially servant leadership and so i highly encourage you to just come check it out with amazing young talented girls who are excited to entertain you but also share their hearts for our community and also their ambitions for themselves and what they plan to do with their titles in the past some of my girls have represented elko county at the Nevada State Pageant and won and went on to compete all the way to nationals. And my current title holders who are crowning the new ones this Saturday, they are going to be heading next to Georgia in September representing Nevada at the America's National Miss Pageant. And so before they do that in September, they're going to crown their successors this Saturday. So please come check it out. Hello, town members. It's very nice to meet you. My name is Seth Jones. Let's see, a little bit about me. I'm from, born in Hawaii, Nevada. Lived in Spring Creek. We moved here in 89. in 1989, so I went to school out there. And then lived here in Elko pretty much all of my life. My dad was a general contractor, so I have lots of construction experience from him. I am also a silversmith and jeweler. And I'm sure most of you have seen the mural up on the water tower. That's my big sister. And then I'm going to be, I'm still working on the Mayor Awards for this year. Earlier this year they selected some medallions that I made and I'm excited. This is a cool opportunity. I've had lots of experience with the building department over my I've had many, many past and a few failed inspections with them.

Jeff's pretty good to me so far. He's very fair, and I'm really enjoying learning from him and Janet and the ladies over there. It's a nice little crew.

all right justin get someone here to introduce as well thank you mayor keener city council so yeah um we have a new addition to the facilities department and he comes to us from the elko county buildings and grounds department uh where he worked for a little bit south of 16 years in a similar role so i'm kind of excited about this to have him He's already hit the ground running and showing some initiative. He shows up early, likes to get his hands dirty and get straight to work. Not much of a talker, but he does like to work. I had him tethered to Brad for the last week, so they've been going full throttle. I think he's pretty encouraging, especially when he shows up on the first day with a tape measure strapped to him and ready to go with his own tools. That's always a good sign. All right, appropriations item B, review consideration and possible award or rejection of a bid for rehab terminal sidewalks through Airport Improvement Program 3-2, excuse me, 3-2-555-064-2026 and matters related thereto for possible action. City Council previously authorized staff to apply for FAA grant application AIP 6-4 and average for bid for rehab terminal sidewalks on April 28th, 2026. Bids were opened on June 4th and reviewed by staff and Wolpert Incorporated for possible recommendation of award to the lowest responsive bidder. As a reminder, the FAA awards grants based on bids and funding available.
Jim. Thank you, Mr. Mayor and members of council. So we only received one bid for this project. And so what I have given you is kind of some of the scenarios based upon that one bid. So they were basically the lowest responsive bidder that we received. They came in higher than the engineer's estimate. The engineer's estimate was 441 on this project. So what we did is we put it into scenarios. So the thing with what we have going on is we have some expiring funding. And it used to be called bill funding. It's IJA funding now. It's the infrastructure funding. This is the type of funds that we can use on terminal enhancements, which we've never been able to use before.
Everything's always usually from the front door back, correct?
Yeah, pretty much. Airfield stuff, the construction project that we have going on right now, that's all AIP funding. So this project, the repair terminal sidewalks, was... We were able to do it with this other funding source as opposed to AIP funding. So we have some funding that's going to get ready to expire in September. So the end of September is when that funding expires. So we have $416,709 that's getting ready to expire. The other deadline that we're dealing with is that we have to have our grants into the FAA for allocation of funding by June 30th. And so with this one we didn't really have time to put it in there to accept or and to re-bid and that's why we don't have another item later on potentially to re-bid this because We don't have time in order to do that. So we've gone through it. We've had discussions for the last six days or so back and forth with engineers, with some city staff. Dale and I were discussing some of the concrete prices that we've seen on some other projects to figure out why it was so high. We just don't really know why it came in so high for this project. So that's why we have the three scenarios. We can award the project as planned. We use up all of our IGF funding. It chews into our overall balance, but we don't lose any funding. And then we use all of our entitlements for the other two bids that you'll see coming up later on. And we award this project to the lowest responsive bidder, which was MKD. scenario two is a design only and and we rebid the sidewalks and we ask the FAA if we can use part of this available funding to pay for the design and construction management costs for this project we go to rebid and hopefully we get better bids on down the road There's also the possibility that we don't get better bids down the road, and this is potentially the only one that we have again, and that's happened to us before. And then we still have the entitlement funding that's available for our other two projects. The other one is that we award this bid as well, and we use some other funding sources through the FAA for allocation. So we use our entitlement funding for this project as opposed to for the terminal construction. We can use our entitlements and pay for this project. which is fine to do, but it cuts into the fund that's allowed for terminal construction projects. So we take away, let's just call it for all intents and purposes, a million dollars out of that. So it takes away from that funding. don't really like that one of it because we don't ever have the opportunity we don't ever get the opportunity to use federal funding for terminal projects and we want to try to get all of the money that we possibly can out of those projects um the thing about this also that we uh need to think about is right now we're at a five percent match um and so this next year if if if we don't award it right away and we go to rebid The next go-around for allocation, we go back to our 6.25%. So the matching side of things does go up a bit. And once again, we could get better bids or we get the same type of bids. So I just wanted to kind of give you guys and this is kind of the struggles of what we've been Shooting back and forth Dane is here from Wolpert our engineers if you guys have any questions We can give you guys more information on Kind of the way that we're Leaning on this what staffs recommendation I I've been trying to stay extremely neutral and I Ask me again in five minutes and I might have a different opinion. I don't like the fact that I understand it's prudent to take care of funding when it's available. I don't like the fact that giving funding back to the FAA, but it's not that we're giving it back. It will go to another airport for use. It's also one of those things that we're never going to have this opportunity again as far as getting this type of funding available for this. Two days ago, I would have said reject the bids and let's go to re-bid. in discussions that we've had today it's kind of changed my opinions a little bit because of the matching but once again it's it's it's a crapshoot when it comes to are we gonna get anything better is everybody so busy right now that this project was just you know not not Anybody wanted to bid on it? I don't know why we only got one bid. That's the problem. I wish we would have gotten two bids, but it's not the first time in the airport's history that we've only gotten one bid on stuff.
Jim, can you give us a little insight on what the cost of concrete was on other jobs that you guys have currently done and the cost of concrete that came in on this bid? What the difference was? Are they pretty similar?
So I know Dale's got some numbers of current or past city projects, but I'll give you... one that we've done at the airport. So about three years ago, four years ago now, when we went out to bid for concrete for the replacement of our terminal ramp, and that was bringing, and that was 15 inches of concrete, and that was bringing in aggregate from Wendover to meet the FAA specifications. That was 225, what was it? 285. 285 a square yard. for that and this project was 425 square yard and it wasn't FAA spec, it was City of Elko or NDOT, whatever the Orange Book spec was for that project. And Dale has some other information as well.
Yeah, to put it in perspective, it's $47.22 per square foot. Our RDA project downtown was $15 a square foot.

Same contractor. Sports complex was $20.50 a square foot. Convention center drive, our estimate for the road out back here and the sidewalk work there is $16.25 a square foot. The park rehabilitation project for the post-tension slabs, which is $28.74 for the one here in the park and then the other one down across south side is $29.05 a square foot. But the sidewalks for this same project is $40.11 a square foot.
I'm sorry, can you repeat the square footage bid for the sidewalks that we're looking at tonight?
It's $47.22 a square foot versus the park rehabilitation project was $40.11. $7.11 higher. Same grade of mud? City spec for the sidewalks.
And that's, let's see, the $40.11, that's been how long ago?
That's what they're working on right now.
Okay, the post-tension.
Okay. It's all over the board. So if you rebid it, it could come back close to it or the same.
and if they're busy this summer they might be busier next summer and that could be it that everybody's busy at this time and that was the whole point of what we tried to do is tried to get this project we wanted it done i wanted it done before winter because it also there's another schedule that's part of it that included heated sidewalks and it was one of the cool parts about this is is to provide that extra part of it. And those numbers will ride on with our engineer's estimate as compared to what was bid as well. And so that's why we just wanted to get in, get out, and have them done before the wintertime.
So Jim, the heated sidewalks, is that part of what we're looking at?
That is... That is part of the bid, the total bid. Right, Dane? So I got those numbers real quick. So it's 441 for the federal. I'm sorry, this was the estimate. It was 441 for the federal and 119 for the non-federal. We didn't break it down in this bid, this one. So that is just the federal portion is at 889,400. Sorry about that.
I guess I still don't understand everything on this. It's not real clear to me. So we've got the MKD bid that's listed there in the left-hand column for $889,400, and then we've got the consultant's fees and the admin on top of that. Is that only for the sidewalk, or is that also for the equipment that we're acquiring as well?
That would be just for the sidewalks, yes. So that's included in the, that would be included in part of the reimbursable part of the federal grant.
Okay. And then future sidewalk bids with $500,000.
So that was, that's if we're anticipating a different type of a scenario. If we go out to rebid, we're hoping that it would come back in near the engineer's estimate. And that's where if we look down to like the Scenario 3, for example, would hopefully those bids would come in at those prices. OK.
So if I add up the bid, $889,400, and then plus the $500,000, 1.389 million. So that's what we're looking at then for the sidewalk costs. Is that correct? Is that from the bid tabs? I've got it. So that's Schedule 1, Schedule 2, and the total bid was $1,055,000. Does that make sense?
Yeah, and then add in the engineer's costs on top of that. That would be the total grant amount that we apply to the FAA.
Okay, Schedule 1 and Schedule 2.
Plus the $500,000. No.
No, the $250,000. No, it'd be just the $250,000. So we would be looking at... So you're correct.
Because you included...

So $1,305,000 would be the... or the grant amount that we would ask the FAA for. And then that would be at the 5% match, which would be just a little bit over $50,000 as far as, and it's been budgeted in the upcoming new budget for the airport.
So, Jim, if we had to go out to rebid this, what kind of schedule, I mean, is that going to totally throw off your schedule, or is this because we're going to lose the grant money? Give me a scenario of what that looks like with a rebid.
So timelines are kind of out of the picture if we go to rebid. So we would probably be back at next Council. I'd ask for permission to go to rebid, go out to bid again, come back for potentially award. We wouldn't be able to get into this round of funding, so we would be looking at a few future years of funding potentially. I don't know if we could get in the final. So the funding comes in waves. There's like a July, August, September. We're trying to get all bids in hand to the FAA by June 30th to get into this funding cycle. And so that's just kind of how it happens sometimes.
So my only, I guess, somewhat concern is, of course, the cost of the concrete. Full disclosure, I have a construction background. We've done a lot of concrete jobs very recently. Our bids are coming in anywhere between $25 to $30 a square foot. So to basically have that be almost double at the $47, I think is excessive. And I know everybody's busy, and you're dependent on the availability of the concrete, and especially if you're having to get a special mix to meet FAA requirements. But not on this project. So this is just city mix. So city mix.
Yeah, we're just popping the concrete out. We're not even doing sub base or anything like that, and we're putting it back in. We're throwing some heated mesh in it. We're adding some new bollards for some additional safety and things of that nature.
Jim, I didn't see the bid tab on this. How much of that cost was involved with just tearing it out and the landfilling?
Dane, do you have those numbers?
I've never been one to project, sorry. So the $425 per square yard is just the installation of the concrete itself. The removal for the same area is $135 per square yard. So that would be the removal and filling all of that. And obviously, we have several other bid items that add up to that total of $889,000 for the federal schedule. Oh, and that's got it all up there now.
Okay, I didn't see that.
Can you tell us what your engineer's estimate was?
So for the federal portion was $441,000. And I'll make a point of clarification on that. That estimate was based on the RDA site or the project. I was under the assumption when I made my estimate that RDA was federally funded and reflected those special conditions that come with federal funding. I understand now that was not the case, so I recognize my estimate was lower than it probably should have been for a federal project, but it still reflected the same materials, the same labor pool, both types of things, same conditions as the RDA project. I wish I could go back and put my engineer's estimate up a little bit, but certainly not by double.
When you say a little bit, are we talking like 10%, 20%?
Yeah, somewhere in that neighborhood.
Because I would feel a lot more comfortable if we were within a 10% to 20% range and be able to move forward. But something that's coming in double what an engineer's estimate is, I mean, again, we understand it's an estimate, but the cost of the concrete is basically double and the estimate is double. I just have a hard time moving forward with those kind of numbers.
Is there a representative from MKD on the phone on the meeting?
There's not.
Okay. That's too bad they're not here to. to explain this a little bit further.
I did speak with Gary from MKD a little bit and asked for some clarifications on the bid prices just to help me understand maybe what went into that and maybe there was something we missed. And he pointed out a few factors with the potential of going into cold weather concrete. And we tried to clarify that be an addendum that we weren't going to push it too far into the year. Like if we thought we were going to get into cold weather, we were going to kick it to spring. But he tells me that he still considered cold weather concreting as part of his bid prices. I'm trying to think what else he had pointed to as elevating the cost. But I thought that was one of the big ones. Oh, there's also, remembering now, there's some concerns about the schedule. Potentially he thought our schedule was too tight and it built the cost of liquidated damages into his bid price as well.
Now, are the liquidated damages, are those required by the FAA?
Yeah, so the way the liquidated damages work for our project, for this one specifically, it was $1,000 a day plus the additional inspection time for the engineer. So it could have been upwards of $3,000 to $3,500 per day in liquidated damages that he could have faced if the airport had chosen to leverage those.
Yeah, that's pretty insignificant compared to the overall cost on this. Yeah, I wish there was someone here from the contractor to just provide a little bit better context for the board. I could go either way on this. I know that there's risks associated with going out to bid again. I know that this money expires on September 30th. Does it have to be committed, or does it have to be spent?
It has to be committed basically through the grant process.
So at what point does it get committed, Jim, when we award the contract?
So basically tonight, if you guys accept this award, we take this and we put it into the grant application. And we send that to the FAA within the next couple of days. And then that's how the award of the grant gets allocated. But they need to have it by June 30.
If I could point, make one clarification there. The funds are obligated when the FAA issues the grant. That's the deadline to say, yes, the funds are ours. The FAA has given us a deadline of June 30th to have the information to them so that they can work it through their process to have it obligated or have the grant awarded no later than September 30th. Does that make sense? So that's where the June 30th date, that's an internal FAA deadline. The September 30th is the end of the federal fiscal year, and that's what we're getting ready for.
Do we have enough time to send this? Like if we said today we want to send this out for a rebid, do we have enough time to get this back to have a complete rebid that we can vote on for our next June 23rd meeting? Does that give us enough time?
We don't have an agenda item. getting authorization to go to rebid and then I'm not sure how the NRS is set up if there's a different if there's 21 days or 28 days of advertising for rebids so we'd still have to go out to 21 days
So no. And my opinion here as well, I don't think going to re-bid immediately would be fruitful. I think we would see a repeat of what we just experienced last week. If we were going to re-bid, I think it would be a lot more productive to do it over the winter. So contractors are looking at it as early spring work rather than end of the season.
At that point, though, the funds are expired and can't be tapped.
Is that right, Dave? So that $416,000 would expire, or at least a portion of it. As Jim mentioned earlier, we believe the FAA would be a willing partner to move at least the engineering fees onto that $416,000, so we don't. lose all that 416. It would just be a portion of it that we would lose. So that 416, but there's an extra, I forget, it's 3.1 million, I think, looking off the top of Excuse me, $3.6 million in IJA money that is not expiring, that's still available for future years. And that will start expiring starting next year, a portion of that, and fade out over time. So all the IJA money doesn't go away, only a small portion of the IJA money that would not be available to the city.
And some of that 416 could be tapped for the engineering. Yes. We don't know how much yet.
We need to negotiate that with the FAA.
I'm kind of thinking it's best to hold off and do this in a future construction season. Jim, what are your thoughts on that?
Yeah, once again, I'm mixed on it. I would tend to agree with some of the conversations that I've had over the past few days, just looking at the overall costs of it. Initially, I knew as soon as we read those that I knew it probably wasn't a viable option. project based upon that and yeah like I said before I hate to lose the funding but it's not anything that we're it's just the funding we're losing we're not really losing it's not coming out of our pocket we just it's just in on paper with the FAA it goes back into the airports You know, we had to value engineer our commercial terminal ramp when we wanted to put it back with concrete and we had to value engineer that down. And we initially working with Wolpert, we value engineered this down. It was initially a million dollar project. And we value engineered it down to where it is now by changing out some of the heating. Originally, the heating was a big portion of this. We went from 20 foot wide heated sidewalks down to six foot wide heated sidewalks, things like that. We took out lighted bollards Um, cause those weren't federally funded. We put in normal bollards, um, for things like that. So we have done things like that already. Um, so I've seen it, uh, I've seen it go both ways. We were, we value engineered our commercial thermal ramp down. Um, and then we got a really good product out of it. And so we were able to come in five, $5 million cheaper with a different type of material though. And so, um, On the other side of things, I do need new sidewalks out there. I'm not going to lie. And this would have been a great project to do this year. But I am a realist and understand that this is expensive. And I get it.
Now, Jim, if we went with the... scenario one and scenario two for a total amount of $1,305,000. How much would the city be out of pocket? for the matches, would it just be the 5%?
Yeah, the 5% of the 1.3 million and change. That's what would, that's the scenario one, yeah.
Scenario two, you wouldn't know until you got the bid back though, right? But it'd be six and a quarter though, right?
would potentially be six and a quarter because we're we would be in the next fiscal year of the FAA and if that if that price yes we would go up to the next potentially go up to the six and a quarter percent after and the bids could definitely come in cheaper sure or they could stay the same so It was one of those things when going out to bid to begin with, you know, we only got one bid. That's the part that's a bummer out of this whole thing. Had we gotten two, probably not be that bad of an issue, but...
Listening to conversations, I'll be honest with you, I was leaning towards one, but more and more we get into this and listen to everybody's comments about it. I'm leaning more towards two now, myself. But, I mean, I'd be perfectly fine with that. Just wait until, like you said, the next construction site. You know, I know you need the sidewalks, but I think that might be the best idea, personally.

I'll make a motion to, let me see, where is it? I'll make a motion to reject the bid for the rehab terminal sidewalks through airport improvement program number 3-32-0005-064-2026 and go with scenario 1 for design and re-bid on the sidewalks. Is that okay? I think so.

Scenario two that's why it was scenario two and this says design design only and rebid on the sidewalks I Don't necessarily know if we need to award the bid on the design portion because we're already under contract with Wolpert for the design part of it and I think staff would understand that that is what the direction that council is giving us.
But this has to do with this particular program.
To reject the bids.
And so Wolford has the design portion. This is just for the sidewalk construction. So we're just rejecting the bid.

One's a power broom with a chassis, and one is a blower with a chassis. We had two companies bid on it. One was Alamo Company, which is Wausau Equipment Company, and the other one was MB Companies. MB so the schedule one subtotal for MB companies and that was the snowblower the total on that bid and they were the lowest responsive bidder was seven hundred and twenty seven thousand two hundred and eleven dollars and ninety cents for the schedule two is was the was our equipment company they came in and that was for the the power room and they came in at 842 235 dollars for that piece of equipment okay so
I guess I'm a little bit confused. Are you recommending the bid from LaSalle even though it's not the low bid?
So we were able to, so it's under one, for the FAA purposes, it's under one grant, but there's two schedules. So one would go to Wausau and one would go to MB companies. Gotcha, okay. Under those schedules. Okay. With each one of them were the low bidder and their prospective pieces of equipment.
Okay. All right, I understand now. All right, and then do these, does this equipment have warranties at all?
Yeah, I believe it, I believe that they do. I didn't check when we looked at the bids. I don't know if you guys remember that.
It's a one-year warranty.
And do they have like regional service in the west or is it something that could come out of Salt Lake?
So, um, I know with the, cause we have some MB products already and we do have lost out products already. They initially come out and do, um, trainings, but most of the stuff, um, when they come out and do trainings, they'll, um, for warranty stuff, they bring the people to us. I don't know if they come out of Salt Lake. Both of the companies are typically out of Wisconsin, um, is the location and they'll, they'll bring people in for warranty work. And then that first year they consider that training and what they'll do is they'll provide training to our fleet maintenance department. So things moving forward beyond that would be handled by our fleet maintenance.
Okay. And then, you know, we have those multi-state purchasing compacts, and I can't remember the name. NASPO is one of them. Is this equipment too specialized to be on any of those schedules?
So typically it is. I know when I was looking, doing some background on one of the bidders there on like source well and things of that nature, but we're following the federal guidelines for procurement when it comes to that and going out to bid.

The bids received range in value from $750,000 to $1,060,211. The lowest bid was deemed unresponsive as they did not submit any documents with the bid. Additionally, two bids were deemed responsive and one was unresponsive. Staff recommends City Council award the contract to Sierra Nevada Construction, the lowest responsive bidder, for $791,007.

Prices were going to be up, so I kept our square yardage down. And then prices came in lower. So we're down a little bit from last year and the year before.

Or three, will not serve the best interest of the public. We believe that condition number three is met in this circumstance because this property as well as the adjacent properties already have sanitary sewer and therefore an extension of the sewer has no benefit to be met. Thank you, Mr. Mayor, members of council. So this is a corner lot on the corner of Jennings and Mountain City Highway, and there is sewer already on Jennings Way. And the subdivision to the east is already being served. And that connects into Mountain City Highway and runs down. So basically, there's no benefit to the city to extend sewer along that frontage at this time on Mountain City Highway.
So is the building being situated closer to Mountain City Highway then so that there wouldn't be something isolated on the corner that might come up in the future?
I believe it's being situated in that location. It's closer to Mountain City Highway from the plans that I looked at. But it would be served on to Jennings Way. The building would be served on Jennings. And so there's an existing sewer there, and it looks like there's already an existing service line going to that lot off of Jennings.

Item B, review consideration and possible acceptance of a deed of dedication granted to the City of Elko by Chris Earl Beardmore, APN 001620074. for a permanent right of way for public roads and streets and public utilities and matters related thereto for possible action. Mr. Beardmore requested that the portion of Ruby Vista that has been developed and is located on his parcel be dedicated to the City of Elko.
Mr. Mayor, members of the council, thank you. We do have Mr. Beardmore here in the audience. And through the mapping process, this parcel previously had a public utility and access easement granted over the entire area that Ruby Vista will extend on. Unfortunately, there was a section of the road that was continued and built, and that section of road is on Mr. Beardmore's property. It is within that easement, so it is granted as a public access and utility easement, but it is on his property. So Mr. Birdmore asked the city if he could dedicate that section that is already developed to the city of Elko so that his property line will now end at the end of the pavement, because there are some some concrete barriers there that stop traffic from continuing on. The rest of it is still his private property. So we don't want the traffic to continue through the Ruby Vista area until it is an actual public access right of way through there. So when that property develops, then it will be the rest of that Ruby Vista Drive will be dedicated at that time. So this is just a very small little sliver of Ruby Vista, but it is the area that is already paved. So if you look in the very last exhibit, if you go one more, that is just an overview look of it. You can see the concrete barriers there. The yellow line was his property line. He will be dedicating that other area to us as Ruby Vista Drive. And everything that is paved will now be in City of Elko right of way, not on his property.

Mr. Mayor, members of council, thank you. We did put this out to our list of our appraisers. And we did receive 13 proposals back. They ranged from $5,500 to $27,000 for the three appraisals. That's quite a range. It was quite a range. And with that, of course, the applicant and the city, Velko, selected the lowest appraisal proposal. We then worked with Mr. Stanton on the agreement. And then the agreement has been with the property owners for quite some time. We had some issues with the title of the property and such that we needed to clean up. And then they have a hard time getting all of the entities in the family to sign the agreement. So we finally got it signed and could put this on the agenda once this is signed by the mayor, we will engage with the appraiser and start the appraisal process on all three parcels. Once that comes back, then it goes into the next step. this is the the next step is getting the agreement they will be responsible for the cost of the appraisal that will need to be paid before i go into contract with the appraiser right okay uh understood and and they're crystal clear on that right they're very crystal clear i've told them multiple times and and to ask them to put the check in the mail so okay

Item B, review, consideration, and possible approval. of a variance related to the improvement of the existing structure located at 123 2nd street from section 385 subsection 3 of the Elko city code which stipulates the lowest floor elevation requirement of two feet above the base flood elevation allowing the building to remain at the base flood elevation matters related thereto for possible action. Property owners proposing a remodel of the existing office space for Walsh Reclamation incorporated at 123 2nd Street. The estimated value of the role model exceeds 50% of the estimated property value. Therefore, the development is considered substantial improvement and the floodplain management code applies which requires the finished floor to be constructed two feet above base flood elevation or integrate flood-proofing measures. The owner's engineer has filed a variance request to maintain the existing finish floor elevation, which is two feet lower than the required two feet above base flood elevation stipulated in the code. The basis for this request is that the existing structure has not been impacted during the past flooding events and the proposed variance is not expected to result in adverse impacts to the surrounding areas.
Mayor, members of the Council, thank you. So like you said, this is a tenant improvement of an existing structure on Second Street that is in the floodplain. It's actually right on the border of the floodplain, so the parking lot is not in the floodplain, and the structure itself is listed in the floodplain. So we're right on the boundary there. The existing structure was built prior to any floodplain firm mapping being done. So at the time of its construction, it was not out of compliance. The current elevation of the structure is at base flood elevation. So FEMA's requirement is for structures to be elevated at or above base flood elevation, whereas the city's code requires to be above the base flood elevation. So this variance is just requesting to be built at base flood elevations. So that is a variance from the city of Elko code, but still in compliance with FEMA. And it does meet all of the requirements for variance in the Elko city code, and staff is recommending approval.
You know, this is really unusual because as long as I've been on this board, I don't remember any similar hearing like this to where it was a 50% improvement that triggered that restriction on there. So good on staff for catching that. So, yeah, I think it'll be a wonderful improvement, and obviously they realize they're taking the risk and they're willing to take that on. Hopefully they don't have a mortgage on it, otherwise they might be stuck with flood insurance, but it'll be nice to see that improve down there. So any comments or concerns from board members?
I just also wanted to kind of piggyback off of you, Reese, in the sense of the 50% improvement. Again, this was construction prior to the FEMA maps being designated. So realistically, this is the only use for that building. So without the variance, this is a hardship for the property owners, and they wouldn't be able to do anything with the building. So I'm definitely in favor of doing this to help them out.
Yeah, absolutely. They've communicated that their other option is complete demolition.
That's the only other option. It's demolition or variance. So I would definitely be in favor of, instead of incurring the cost of complete demolition and reconstruction, that's just not economically feasible.
They've had this building for a while too, haven't they?

Mr. Viner was on that tour as well. And I got to hear some of the exciting things happening up there at the hospital. New equipment, new medical professionals coming in. There was a baby delivered while we were there. and another one on the way. And so the hospital has done a lot in recent years to, when Steve Simpson came in, he was very frank that he had a lot of work to do and he's been able to really be instrumental in moving the bar in improving employee morale as well as the patient experience and they do have their 25 year anniversary coming up And the 25, the actual anniversary date is September 11th, and it probably wasn't a very good day to plan the party for that day. So they're doing it in August, and there'll be some forthcoming information on that, because that'll be a community-wide event that everyone's invited to. A couple of Thursdays ago, I traveled down to Lander County to Battle Mountain with Jan and Commissioner Steninger, who's also on the FAN Board. And we were there groveling for funding for Flight Alliance of Northeastern Nevada. They had chipped in $250,000 last year. and that funding was in jeopardy. Nevada Gold Mines really helped us out a lot with a letter of recommendation indicating how important the regional airport is to their workforce. They have many contractors and consultants that depend on SkyWest to get in, and we were delighted that that they did decide to extend that for another year. And we've already gotten paid, which is even better, so very thankful for that. Um, I will be absent at the next meeting. So, um, if you have any complaints, you can bring those up at the mayor pro tem. Uh, there was also a, uh, food bank, uh, food bank of northeastern Nevada. Uh, they have, uh, repurposed. building that is on Front Street in Southside. It's the old Frontier Communications building and they were able through the help of JJ Gogichia with Nevada Department of Agriculture to obtain a grant to purchase that and and repurpose that and so they have 12 associate agencies in the Elko County area, for instance, like fish. And fish then will go there to get their provisions. And so it will enable them to come to Elko more frequently, to bring fresher food. And I think it'll be a terrific thing for the community. I think that both of you were there poking around there. It was kind of a pre-launch. They've got a lot of work to do, but should have everything rolling in like fourth quarter, right?
The one thing that's good about it is it's serving not just Elko County, but You know, Eureka, Lander, and White Pines. So, I mean, it's making it easier for them to serve those counties as well. All right. I'm selfish. I just think that's quite all right. That's all right. It's focused.
Our borders are only so far. Let's see. I was at the Government Affairs Committee meeting yesterday at the Chamber of Commerce, and John Carr, Elko County Commissioner, was just talking about some of the regional things, and really I'm looking at you, Dale, expressed a real desire to get you know, the city and the county in the same room. Like for instance, for working on the air cart and other, and like the conveyance of public lands, get everybody on the same team so that we're all working together for the same thing on that. And I do recall we put in for a grant that was kind of a long shot deal for air cart. When will we have an answer on that?
We should have that answer pretty soon. We think this month. But we haven't heard anything yet.
And do you recall what the total ask was on that or the total available? $17 million. $17 million. Okay, good. That'd be awesome. It'd be a miracle if that got funded. That'd be great, because I know there's always a lot of competition for those grants. And as a reminder, On the 23rd, our next meeting, there will be an RDA meeting immediately prior to that at 3 p.m., Kathy. Is that right? Okay. Yeah, so it's been quite a while since we've gone this route with hosting tournaments. We actually negotiated or worked with a regional tournament director for this event. So we're pretty excited about it. I think for this first year, we're doing very well in a turnout for it. We expected a little more, a few more teams, but I'd say we did pretty well with this. Kicks off Friday morning and Saturday afternoon. It will be on Herrera Complex, Ernie Hall, then Holdren Field, and both, well, Galen Christine Field now, Cump Field, and the Sports Complex.
Any idea how many people coming from out of town for this?
There's quite a few. I think we have, I want to say there's four teams coming from California. Two or three coming from Idaho, and then there's a bunch within our state that are coming. There's quite a few from out of town, out of the area.

That'll be starting in the courtyard over at the county, and then we'll go to the corridor and dedicate all those projects that are being constructed.
Great. Great. And we've got an update that was provided to us. I'm not going to be there, but there'll be someone from the city there, I'm sure, to cover for that. And then I was speaking with – I did an interview last week, a radio interview – And they were asking about the boots. And, you know, I think it might be interesting to see if we could, you know, push out with another campaign for the boots and, you know, see if there might be some interested parties. And there's some of them, including the one out front here, that desperately needs some attention because the paint's so faded on it.
Okay. We have had one local business owner ask us about getting a boot, so I did give them the information on that. So I can bring that to the arts board and see how they want to handle that. Good.

And that probably has some other things to mention. But yesterday the Elko County recorded a treasurer's deed on that property from unpaid property taxes. So that was recorded yesterday. There's a statutory process that takes place now with potentially a tax sale. There are other things that can happen in the interim. As I understand it, this is kind of the county's area, not mine, but the county holds periodic property tax sales. And there's a notice requirement. There's not really a redemption like you have prior to recording the treasurer's deed. The property owner does have the ability to obtain a reconveyance. The city also has potentially the ability to acquire the property if the city does under certain circumstances. But I drove over there over the noon hour and it's closed. Wow. And there were a few cars there with some people just kind of hanging out, leaning up against things. So I don't know what that means. But other than that, it looked locked up to me.
So...
It takes three years to get to that point, correct, of unpaid property taxes?
Yeah, something like that, yeah. So they had the opportunity to redeem it.
Well, based on our collections experience, it can't come as any shock to anyone that they've come to this.
Yeah, and Tyler Ingram sent an article around, it was kind of interesting, but it was from a few years ago, but apparently the whole Shiloh Inn chain has been sort of going downhill for quite a while. And some of them have, they all seem to have their own LLCs for each particular hotel, but they're really just, I think, a... A relative handful of them left. And they're in trouble. There was a big IRS tax liability, apparently, on the part of maybe the ownership. And it sounds like it's been a mess for a while.
Yeah. Yeah, it certainly sounds like it. And I would imagine, Annette, that they're probably way behind on their transient lodging taxes.
So, funny enough, they actually paid us yesterday. We got February's transient lodging tax, and they actually contacted me today to find out what their total for their March was with their penalties, and I gave that to them, and they promised that they'd have that paid before the 15th of this month.
So they're shaking down all their other property management. That's correct.
So like Dave said, Mr. Hamstreet was in trouble with the IRS. He owned 52 properties prior to that. The IRS made him sell most of his properties. He only has 14 properties he has left. And then one I know just not recently also got closed in Oregon. It was just closed up. Yeah, they're functioning and everything's good. We're hoping that we can get through the rest of the season because we will be doing a pump replacement in the off season, brand new pumps. So we're holding good for now. I did also want to mention that the following weekend, Elko is hosting District 3 Little League All-Star Tournament. Age groups 10U, 12U, 13U, and 14U. And that'll go on for about seven days, so about a week. Puccinelli's probably going to be a little busy with that one possibly as well. Then in July we have a youth girls softball tournament scheduled as well. And then today was our first day of youth day camps. We had nine participants in the morning session and 16 in the afternoon. We'd like to see that go up, so we're going to make another effort to get some more advertisement out, but they're Tuesdays, Wednesdays, and Thursdays every week right over here at the Girl Scout house. We'll be doing those up until right before school starts back up.
Great. And then a question for you. Would we be able to host these events without the sports complex fields?
This one's pretty big. We're pushing 40 teams in this tournament, so that's why you see us utilizing most of them. So the sports complex definitely helped that out with those three additional fields. Good.
So yeah. Thank you. All right. Jim. While you're coming up, I saw the numbers from air planners, and it's heartening to see that the load factor keeps slowly increasing. I believe that we were at 71% year-to-date. Is that right? Yeah, that seems about right. And that's going through like, you know, January and February, some of the slow months. Yeah. So, you know, if they can just keep that schedule consistent and to where people, oh, you don't have News to the contrary, do you? Oh, no, not at all.
It just drives me nuts that they mess with our midday flight. That's where the error came from. But consistency is so important when it comes to that midday flight. I saw last month's numbers, and they were really good, 1,700 employments, which is another large month for us. So that's great. So people are utilizing that. We just ended our campaign for the SCASD grant, so we have a meeting next week with Arcstar to discuss. We're going to do another deep dive to see what worked what didn't work as far as that that was a three-month campaign that we paid for as far as our match for the scarcity grant and so that's going to be uh interesting to see along with the final update on that but we saw some really good numbers it's all the website click-throughs and different google stuff that they understand it but um We were above the national average when it came to people going to Delta.com through those advertisements that you saw on Facebook and those destinations. So that was pretty cool. Last week we did host the, I think it was last week, everything blends together. the moving memorial for the National EMS service came through and we have a little event out at the the terminal there at our memorial site and it was a really nice event thanks for everyone that did participate in that it was nice to have it come back through we are doing our airfield pavement maintenance program. I know a few people got some, I got a phone call from a gentleman last week complaining about having the runway closed during the mining expo, which in a sense yeah i get it but we're pretty accommodating to everybody if they would have just called the airport first and asked what was going on we were able to get him in and out without any other issues so we do these pro these types of projects not all the time but this is the fifth time that i've done one of these projects and we're always accommodating not only for our commercial service people but for our general aviation people too so um but we're getting down to the last part of that we're doing the alpha taxiway this week and so we should be finished up in the next couple days with that they'll be back in 30 days to put all of our permanent markings down and then that project will be done then the other thing I just received the draft of the phase two of a focus planning study so I started looking at that today to review it and plan on meeting with Kauffman and associates as the planning consultants that we hired to do that and once we talk about that and In that draft, it was approximately $202 million to move the runway 90 feet to the north. We still feel that's probably not economically feasible to do that. So we'll meet with the FAA after that and start finalizing our airport layout plan and seeing how we move forward with that plan. So it was nice to finally see a draft of that focus planning study. Great.

Thank you. Just a real quick update on the exit 298 lift station. Tomorrow we're scheduled to commission the generator. So we're going to commission the generator. We were hoping to test the big launchers, but after some developments today, that's probably going to be pushed out to next week. And the punch list items are, there's just a couple of small little items that are left that won't, they shouldn't hold this up from startup. But the pig launchers is a big thing. So right now, we're looking at probably middle of next week, I'm hoping, to test those and commission those, I hope. So it's moving along. I know it's slow, but we're getting there.

I saw something in the news that the EPA is relaxing the standards on refrigerants, which should make it easier for commercial companies to recharge certain systems. Do you know how that might affect the equipment we have here at the city? And do those rules apply, do you know, to municipalities?

Now, at least, when it first came out, we were limiting people on who would get it. I mean, if there was a... Our A++ customers were the only ones that were getting it. They would get three bottles. We were allocating certain amounts. So company-wide for Western, we'd get 400 bottles when we're selling... $2,000 a month, you know, but that's how they limited it. Water restrictions are going to come up on the 15th, so I remember I was asked about the last time, so I want to be prepared this time that I do know. No watering on Mondays and you know there's. putting in meters as much as possible. So you're paying for it more so than the flat rate, but everybody's going to get metered, so just remember that. No. Well, we get complaints. But... You know, this is not a perfect world, but, you know, we're trying our best. But billing-wise, we've got issues. So I know that there's some concerns, but we're making it work. You know, everybody's being very cordial and polite, and it's very, very nice.

They either have to do a cashier's check or an ACH payment and they did send us a cashier's check and they now know that that's all they can send if that's what they're going to do. We're still having issues with the roadway in the new owner. He's still behind His transient lodging since January because his one of his checks bounced to so we are
