No action may be taken upon a matter raised under this item on the agenda until the matter itself has been specifically included on this agenda and identified to be an action item. The public participation in our meeting is valued and appreciated. The board commissioners can only take action on items that are listed on the agenda properly posted prior to the meeting. This is an application submitted by Beth Mini Air requesting a variance for a rear yard setback reduction from 30 feet to 10 feet. in an agricultural residential district for a proposed new three-sided pole barn carport for RV storage. Location is APN 023-017-003, being lot 3 of block Q, Pleasant Valley State subdivision, as shown on the map thereof, filed in the Office of the County Recorder of Elko County, State of Nevada, on October 6, 1961, as file number 5976. BEING A PORTION OF LAND, 0.86 ACRES, MORE OR LESS IN SIZE, SITUATED IN A PORTION OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 26, TOWNSHIP 33 NORTH, RANGE 57 EAST, MOUNT DIABLO BASIN, MERIDIAN COUNTY OF ELKO STATE OF NEVADA. THE PHYSICAL ADDRESS IS 330 SUN MOUNTAIN LANE IN SPRING CREEK. So this is a request for, as I stated, a rear yard setback reduction from 30 feet to 10 feet. They want to build a carport, a pole barn structure for covered RV storage right here. There are some existing utilities that are coming in from the, this would be the, sorry, the southeast side of the property here. Thank you, Justin. That are in the way. And then the septic, the leach field for the septic's over here. The septic tank sits over here. You can kind of see it better on this plot plan. So that's the reason for the variance request. So I'll read our proposed, our recommended conditions. We did notify the local agencies listed here and the 30 closest property owners. We didn't receive any comments from local agencies or the 30 closest owners. Recommended conditions are as follows. This variance is subject to restrictions and conditions as outlined in Elko County Code Title IV, Chapter 9, Section 5. At the time of development, the developer shall comply with all applicable provisions of the Nevada revised statutes, Elko County Code development criteria, and all local building and development requirements pertaining to the proposed residential development and agricultural residential district properties. If said property is sold in whole or otherwise conveyed to a new owner or owners, the deed of conveyance shall contain verbiage that identifies and adopts the recommendations, findings, conditions, and requirements of approval of this specific variance. And so the minimum rear yard setback shall be 10 feet as applies to the proposed. Carport, as shown on the attached site plan, drawing submitted with application VAR 26-004. And that concludes our recommended conditions. Staff does recommend approval with those conditions.

Can I ask a question, Corey, real quick before you sit down? Just going back to this Thane Church thing, just for clarity, what are we looking at on timetable for a potential report back to us? Is it a 30-, 60-day investigation period? Thank you.
Real quick, a couple of meetings ago, this body received a bunch of variance applications that had to do with buildings that were too close together that also weren't required to be permitted. THERE WAS A CONFLICT OF OPINION AMONG STAFF. I BELIEVE THERE WAS SOME INSTRUCTION TO LOOK INTO IT. WITHIN A COUPLE OF WEEKS AFTER THAT WE DID IDENTIFY WHERE THE CONFLICT IN THE LANGUAGE IS AND THE WAY TO REMEDY. I SUBMITTED A DRAFT OF of a change in the Elko County code to Corey, we just need to finalize the language and get it on an agenda before this body for approval to the County Commission to amend the Elko County code to kind of just solve the issue and to where these folks aren't having to submit so many variance applications.

I think that, so on that Don Knight appeal, red tag appeal that we had on the agenda in March, it may have been in February and March, but I think the final action taken in March was that it would be revisited by this board six months after a A boundary line adjustment or application was received by our department. And so we did receive that boundary line adjustment application in the last week or two or so. So just an update on that. That's all. Perfect.
