Appeals of final decisions of the planning commission made this evening must be filed in writing with a city clerk before 5:00 pm Friday, July 25th, 2025 and must include the payment of a filing fee. If you wish to speak on either a non-aggenda or an agenda item tonight, please fill out a request to speak card located by the agenda and return it in to the secretary who will call you up to speak when the agenda item comes up for public comment. The second item is the Oakdale common interest conversion. The request is a conversion of an existing three-unit residential development to common interest and it's a SQA exempt and the city recommends approval of the city council approval. That all right. Uh good evening planning commissioners. My name is Spencer Hayes Flores and I am the associate planner with community development. Uh the first project for your consideration this evening is the Oakdale common interest conversion uh which was submitted by

streamline design and permitting. The proposed project project is a planned unit development a PUD to convert an existing uh residential development into a common interest development. And so basically that's to take existing rental units and convert them to for sale product. The project includes three residential units uh which are single family dwellings. uh they roughly share the same design and footprint at about 2200 square foot each. Uh the project includes establishing conditions uh covenants conditions and restrictions CCNRs and the formation of an HOA uh which would um maintain the development. The project includes a tenative parcel map in order to establish three subl lots. Uh and it also establishes an access uh access easement uh and easement for utilities. The project site is addressed as 1415 Oakdale Avenue uh which is on the south side of the street between um North Second Street and East Main Street. The site is directly adjacent to another plan unit development uh as well as other multif family residential developments. The general plan land use designation is medium density residential h and the site zone is residential multif family 6,000 square foot. The site is just shy of half an acre. Uh and uh the existing proposed project density is approximately 6.25 dwelling units per acre. The tenative parcel map includes uh shows sublotss which are re relatively equal in size ranging from 6,647 to 7,214 square ft. And it should be noted that the existing configuration of the site was permitted via a conditional use permit number 638 in 1974. Each of the single family residential units includes a two-car garage with parking in the private driveways.

This is the proposed tenative map and I've added a few colored lines to represent uh the divisions between parcels in blue and the proposed access and utilities easement in red. The PUD requires that units have separate gas and electric meters which are already in place. The also the units also have separate water meters uh that share a common sewer lateral to the sewer main. One of the requirements of a plan unit plan unit development to convert to common interest is a physical elements report uh which is a document which is used to document the existing conditions and any necessary updates prior to the sale of a unit. Overall the project report shows that the units are in good shape and uh the recommended work was limited to HV HVAC repair and replacement updates to vinyl uh windows and patio cover repairs. The proposed conditions of approval include those uh repair and replacement recommendations. Uh and then outside of these elements, the owner has indicated that items such as kitchen cabinets and flooring would be replaced. Uh but generally those items do not require us a building permit. As I mentioned before, uh the common interest development uh includes the requirement for uh covenants conditions and restrictions and the formation of a homeowners association and HOA. Uh common facilities outside of the private rear yards are generally maintained by the HOA. And the conversion process also includes 10 notification requirements uh which were addressed late last year by the project owner. Uh and a the the PUD also requires the right to contract to purchase uh the units uh which uh those requirements are incorporated into the proposed project conditions of approval. Uh the necessary uh findings for a PUD

are included in the the proposed uh resolution of approval. Uh basically the project is consistent with the MR designation of the general plan. Uh the PUD is compatible with surrounding development including other nearby PUDS. Each dwelling has adequate parking. Uh and the conversion will not result in unauthorized parking. Uh and the proposed site does not have value as habitat and there no existing hazardous conditions that would preclude map approval. It's proposed that the project is exempt from environmental review pursuant to sections 15301 and 15315 of the California Environmental Quality Act guidelines. These exemptions are for existing facilities where only minor improvements are proposed uh and for minor divisions in land. Uh no public comments were received after noticing and staff recommends that the planning commission recommend city council approval of the proposed PUB and TPM subject to conditions. and we're available to answer any questions you have. Um, I don't have any. Final commission, do you have any questions? Yes, Commissioner Circle. Just one question. And, uh, I noticed that the easement isn't like a common lot driveway. Uh, can you explain the difference between the common lot and an easement? Effectively, there's no real difference. Um, basically a common lot uh, in some regards might be easier to address in like CCNRs where you're just referring to lot whatever, but in this case you're going to be referring to an easement and as described in um, but it effectively accomplishes the same thing. Okay. I was just curious because I was like in the map included in our report, it shows the three lots. I was like, where's the driveway? Yeah, I think in some regards too it might be easier to survey for the proposed divisions because it's just a straight line across the lot basically.

Uh mid70s I believe is when building permits were finalized. Okay. And then just a quick question, since they are going to be for sale, are they doing anything with plumbing or is that something for the CCNR because it's 50 years already that the plumbing's been there. So they are for sale that be something that they'd have to consider doing a common interest type thing and how people are responsible for that. I would I assume that's more a question for the person. Right. So the physical elements report didn't note any major plumbing uh defects. Uh and so there were no major plumbing repairs required by the physical elements report. Uh, but you're right that eventually when these are ready for sale, the the HOA would be um responsible for like the common lateral that runs out to the street for sewer uh or any of the utility lines that are running through that common easement area uh but not necessarily um the portions that are on private lots property. Uh, my name is Bart Jacobs and I purchased the property on Oakdale um as a rental property to start with the idea of splitting the lot into three to uh bring uh affordable housing to the market. Um this is kind of my first foray into this kind of thing. So it's um hopefully not going to be too much of a lesson learner, but so far it's been great and the city staff has been great. So um I look forward to uh con you know completing the project and bringing these houses to market in a timely manner. Um and I appreciate your time. Thank you. Jacob, right? I know you're early in the game, but for pricing, how are you pricing thinking about pricing these? Do you know what how fair market value or you're going to wait till however long it takes and then take it from there? Yeah, I'm we'll see what market dictates at the time. I want to make these affordable. Um it just depends on kind of what I have to put into them to get to that point. My my gut feeling is they would be probably in the 750 range, maybe something like that. Perfect.

So be uh heard at the city council. Okay. Sure. The next one, agenda item number three, the project name is a charter school kidu academy and his request is a TK through 2 grade charter school. It's SQA exempt and the staff recommendation is approved. Staff. All right. Thank you. Uh, as stated, the second project for consideration this evening is a charter school submitted by Kadinu Academy. The project proposes to convert the first floor of an existing commercial office building uh to a charter school uh for up to 70 TK through 2 grade students. The school would have regular hours between 8 am and 3 p.m. with some afterchool programming until 6 pm. It's proposed that drop off and pickup times would be uh staggered uh generally at a 30-minut interval. Uh and they be staggered based on the different classes and grades. The project site is addressed as 1460 East Main Street, which is on the north side of Oakdale Avenue, just up the street from the the last project you reviewed. Uh also between North Second Street and East Main Street. Uh it's adjacent to the I8 to the north, a condominium development to the west, um vacant properties to the east, and then various uh retail uses uh to the south. Uh the site was formerly uh most recently operated by uh Sharp Healthcare. The general plan land use designation for the uh project site is general

commercial and that's shared with the zoning which is also general commercial. The site is nearly an acre at 38,768 square ft. Uh and that uh and it includes the 14,900 ft uh two-story office building which was authorized via specific plan number 418. The site includes 48 uh excuse me 67 parking spaces. However, 48 are proposed uh in order to make space for an outdoor recess area. The project aims to create five classrooms. Uh four of the classrooms would be for 15 students and the fifth classroom would be for uh 10 TK students. Uh as me as mentioned uh student arrivals uh and departures would be staggered by 30 minutes uh which uh which are which is sufficient for on-site parking spaces for staff and each individual student to be dropped off. In regard to traffic and public improvements, uh engineering services propo uh included proposed conditions to add flexible lane delineators uh to restrict left turn vehicle movements in order to avoid interrupting traffic. They also proposed additional red curb uh along Oakdale Avenue to prevent public street drop offs and pickups. And finally, uh the requirements for public uh there's a requirement proposed for a public improvement agreement to update the existing driveway. It's also it's proposed that the existing vehicle gate at the front of the site would be closed uh for to vehicle traffic during uh recess and physical activity times. And then lastly, the proposed tenant improvements are fairly minor in order in order to establish the five classrooms uh and administrative offices within the existing exterior walls of the structure and for the new occupancy. Uh and those plans are currently in uh review with the building safety and heartland uh fire departments.

Uh this is the proposed site plan. Uh again, this is a right only entry and exit on uh from and to Oakdale Avenue. The site includes 24 foot wide drive aisles throughout. And again, the repurposed parking areas for outdoor play are most immediately adjacent to the structure uh on the north side. The existing uh there's also a small existing shade structure uh seen in the center of the parking lot. And this is the proposed configuration uh for the interior of the site, interior of the building. Again, this shows multiple classrooms, space for administrative offices uh and other minor updates. And then uh just to better represent kind of what the proposed public improvements would be, uh the dotted line represents where the delineators would be restricting left turn traffic. Uh and then the red line represents uh where the area of red curb uh along the north side of Oakdale Avenue. Again, uh the site has sufficient on-site parking. Um get to my notes here. Um I'm sorry again the the proposed or the site includes sufficient on-site parking uh and other conditions of approval uh proposed conditions of approval are for public improvements for compatibility. Um the other conditions address normal operating hours for the school. Uh the no drop off and pickup from adjacent streets and the staff management of that. uh up to 70 enrolled students, again, TK through second grade, uh and no exterior PA system, public announcement system system, and a school bell that is in conformance with uh noise standards in the zoning code. So, the proposed conditions of approval also aim to address the academyy's expressed desire to expand enrollment in

the future. Um the proposed resolution would allow the director of community development to approve a minor amendment for future expansion. Um, this process includes notification to surrounding property owners. Uh, and it allows the director to update uh or add conditions to address the uh new project needs. Uh, the increase in enrollment would necessitate a uh a study for trip generation rates uh traffic and on-site queuing uh and would also involve a management plan of traffic and queuing and those would be approved by city engineering staff. The planning commission must make required findings uh when considering a conditional use permit and staff have recommended the following in the proposed resolution of approval. Uh generally the findings state that a charter school is anticipated to be compatible uh with land uses in the surrounding uh area and properties. Uh that issues are addressed by the uh proposed conditions of approval and through code enforcement action if necessary. Uh and that the project represents a benefit to the community. It's also proposed that the project is exempt from environmental review pursuant to section 15301 of the California Environmental Quality Act SQA guidance squa guidelines. Uh that exemption is for existing facilities. There were no public uh comments received for this project. Uh and finally, staff are recommending planning commission adopt the next resolution in order approving the SQA exemption and conditional use permit subject to uh conditions. We can answer any questions that you have. Yeah, Spencer, how come the screen in the back is not working? Speak to that. We'll have to work with uh staff to get that addressed, but we do have the uh exterior monitors above. Right. I I saw that, but it's nice to have that screen in the back. Okay. Uh yes. I've got a a small herd of questions. Uh the first one is I see an elevation showing a single rolling gate on the south side and a double rolling gate on the east side. And I'm just curious where on the east side there's a double rolling gate. Yeah, that's a good question. Uh and thank you for bringing that up. So uh the project uh kind of went through a little bit of a a downsizing uh in order to bring it to commission tonight. Uh so the original approval uh or the original uh submission included a secondary gate on the interior of the property uh which would kind of uh like their other sites kind of restrict vehicle traffic from only portions of the site during certain portions of the day. Um however to to get to planning commission um uh that was removed along with a few other features and so I apologize if there's any kind of uh inconsistencies uh but essentially there's no site work proposed except for essentially the removal of parking spaces uh and the work on the interior is just uh you know walls uh for the classrooms and restroom facilities. Uh you mentioned the exterior removal of parking spots and putting in something for recess because that's blacktop. Yeah, it it's proposed to be blacktop and this is actually similar. Um and I'm sorry I should also have mentioned that Kanu Academy Kadinu Academy uh operates two other locations within the city. Uh the most recent of which was approved in 2023 in January. um Dehesa and Granite Hills, correct? Dehisa and Granite Hills, 1701 uh Dehisa Road. Uh that one also included a a black top play area. Uh and I don't know if you've driven past it recently, but it seems rather effective. Um maybe the applicant can speak to

that. Okay. Um, and then just as a laughable note, because I live on Oakdale and I drive past this site twice a day, I don't think there's any reason for red curb on that corner because there's cars parked there 90% of the time. But, uh, uh, Oakdale from Maine to second, you might find five spots at various points in the day. We fight hard to keep our curb spot. And that's not an official note. That's just a personal observation. Like there's cars parked all the way to the corner. If you come down Maine and you turn west on Oakdale, you have to swing all the way around the car that's parked there. And I've seen several times when someone didn't. All right. Um uh the only other question I had was uh a lot of schools are talking about soft target, hard target type of things and uh with the recess area being in front of the buildings and being on the corner of very open space. Are they going to look at uh fencing that might hide the fact that there's 20 kids playing on the playground? Uh as far as I'm aware, no proposed changes. There are no proposed changes to fencing. Um uh fortunately or unfortunately, our zoning code does include uh visibility requirements for fencing that's at a a property line or within the exterior setback area. Yeah. Uh that's different for like an interior sideyard. So there are potential that some of the fencing could be um obscured. Okay, thank you. That's all for my flock of questions.

Okay, any other questions? Yeah, I think the the the red line as you heard was to prevent parents to drop off their kids on the sidewalk. Yeah. So they won't do that. But I understand also the dilemma with the parking spaces not being available. Yeah, that is a dilemma, too. Right. Exactly. I I think ironically, if there's red curb there preventing people from parking overnight, it might create space that people will turn their flashers on and drop off where without a red curb, there will be cars parked there and no one will be able to drop off because it's already taken. Is that a some I actually agree with that because if there's a if there's a red cur I people are people. They're gonna just do what they do. Is that a requirement from the city that that has to be um read? I mean because a car is a bigger deterrent than a a red curb. Good afternoon uh planning commissioners. Yeah. Um, it's not required, but it's something that we could uh postpone and see how it works out and then if it if it needs red curb, we can always go back and put it in. So, the the other also is when you're exiting, you know, a part uh a building, you know, from a driveway, if you have a a high-profile vehicle parked right there, you can't see who's coming or who's going, you're kind of taking your chances as well. So, that's also a danger there. with Commissioner Rebecca B Road. Well, I know a lot of the public schools do have red curb around the schools and they often put big signs out, you know, no drop off. I mean, people still try, but I think that I mean, there's options either way, you know, to deter people from dropping off if you throw some signs up, but they'll probably have to

purchase some quite a few times when someone runs it over. But there I do see a lot of the public schools do have little signs out in the red zone areas and probably just for vision too because you have kids running around. You have a cards? We do have a speaker card for Kristen Barkcus. Hello, I'm Kristen Burkus. I'm the executive director Burcus. B is in boy. A r k. I'm the executive director at Kadino Academy. I just wanted to come and say good evening and thank you so much for your support for the families and the students in Alcohon. We've been open since 2019 and um we have been doing phenomenal things in Alcohon. I hope you've seen our academic outcomes. But not only that, we build cultures and school spaces where kids feel known, valued, and respected. And we want to continue honoring the amazing weight list that we have. We had over 400 applicants um for next year. So, we are just trying to honor the community need, the community demand for great schools in Alcohon. Um, and that's kind of the aim of this project. I know that, um, we've been working a lot with the city staff. They've been a phenomenal to work with. So, it's been really a great project. Um, and we're hoping, you know, great things and even more growth is in the future, but we will keep you posted. So, thank you. I remember you, Christina, from 2023. Yes. And so it's been very successful. You have grown. So getting more locations.

That whole area is glad something's being done with that building. Um, soft cap, hard cap. I I hear the wait list. So, that way you don't have to come back here again and get amendments. And what is your hard cap for that particular location? Well, for you mean for next year? Well, next year obviously 70. Um, but our eventual goal is to have it be a TK through fifth grade campus with about 300 students. So, we know we're going to have to do some more in-depth traffic study and analysis to see if that's possible or try and figure out alternative means for getting kids to campus like busing, vans, um, car pooling, those kinds of things. So, not telling you how to do it, but there is an open lot across, too. [Laughter] We have our eyes on a lot of things, but yes, I noticed the open lot across. Well, yes, there are some just for parking. Yeah. Anyway, thank you. Thank you. And I hate to see an empty building, though. So, it's good that you're that we have an occupant of the building. I'll just Yes. address my question to you about the recess and the hard soft target because I know with the one on Deisa the recess space was behind the building and even there it's like far back. This one it's there's a vacant lot that I'm not sure what's going on on that corner. Yeah. If they build something there then it'll be kind of sheltered. At the moment, you drive Maine to Oakdale and the parking lot's just there. Are you going to put something in or

how are you are you thinking about how you can protect the kids just visibility wise? I think we want to limit I mean definitely limit visibility. I don't know if you've driven past our Cadino Academy North campus on North Second Street, but we've been able to do is kind of a fix a sort of visibility barrier to the existing fencing. Okay. Um, so I anticipate doing something very similar. Um, just limit visibility. Also, we have plans for security cameras around the perimeter so that there's like live stream that we have that at all of our campuses so that the office team is able to see all critical points and anyone accessing the campus at any times just to make sure that we're keeping kids safe. Yeah, it's important. And you're aware of the semiconstant homeless population in the alley or drain behind there? Yeah. Okay. Second Street had a similar situation when we moved in in 2019 and actually it's improved quite tremendously. I think a lot of people have been I've had a lot of conversations with community members who frequent the area and they are like this is a school. We don't want to be around the this environment either. So, I think it's just working with people and having those conversations with them. So, yes, I'm aware of those things. Okay. Yep. Yes, we've read all the report and the conditions of approval and so we'll wait on the red stripping or whatever you guys decide with that red paint piece, but yes, we're aware and yeah, accept all of the conditions. I know I'm very biased because I've got a curb spot further down Oakdale. I think it's a real concern though. I mean, there's only so much parking, so we eliminate more and take a trip. Anyone else? Um, Mario, you said you're open to uh to evaluate the uh the red street. Yes, we can hold off until after the building's occupied and see just monitor traffic operations. Okay. All right.
