Code Enforcement/ Magistrate - Special Meeting

All right, we will call the meeting to order or the hearing to order at 2pm on June 11, 2026. First order of business the April 9, 2026 minutes are approved. Good afternoon and welcome to the City of Edgewater Code Enforcement hearing. My name is Ryan Knight and I am the Special Magistrate for the City of Edgewater. These hearings are open to the public under Florida's government and the Sunshine Law. The procedures of this hearing are that due process is emphasized to each respondent and to the city in accordance with Florida Statute 162.07, subsection 3, which states formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern the proceedings. Hearsay is admissible, but only to support other competent substantial evidence. Any decision made today may be appealed by sending notice of appeal to the circuit court within 30 days of the execution of any order. The city of Edgewater will present its case first as it has the burden of proof. Afterwards, the respondents will have an opportunity to respond. Thank you. All right, first matter case number 26-376.

Carol A. Mahalco is the property owner located at 1515 Juniper Drive, Edgewater, Florida. It has been found in violation of Section 10-5, Subsection 1-4, Outdoor Storage and Debris of the City of Edgewater's Code of Ordinances. On May 24th, 2026, I received an email from Officer Feliciano of the Edgewater Police Department, reference to the condition of the property at the listed location. I arrived shortly after and observed the listed location to have junk, debris, scrap type items about the property. I was confronted by the owner's son and he was not happy about my presence. I explained the violation and that a citation will be issued due to repeated offenses at this location. He later explained that scrapping is the only way to earn money due to mistakes he made when he was younger. He apologized for his actions and stated he understood how to correct the violation. Citation 0553, notice of hearing was subsequently issued. It was posted to the property, sent certified mail to the owner, and posted at City Hall. All notices and provisions of Chapter 10, Article 27 have been complied with. Staff recommends a special magistrate fine Carol Mahalco in violation of Section 105714, outdoor storage and debris, and assess the repeat citation fine of $150 and $200 a day daily fines to start May 22nd. until a violation has been corrected.

Seeing nobody here for the respondent, based on the testimony and evidence presented in case 26-376, I find that the respondent is in violation of the City of Edgewater's code of ordinances as listed in the notice of violation and or citation filed in this matter. Consider the gravity of the violation and the actions to correct the violation and the previous violations. I find that these violations constitute a repeat violation. of the prior order of the special magistrate. I order the respondent to pay the citation fine in the amount of $150. Further, the respondent shall be subject to a fine of $200 per day for each and every day. The violation continues past May 22, 2026. The respondent is ordered to contact code enforcement to arrange a re-inspection of the property to verify compliance with this order. Case 26-377.

Wesley Maltrom and Lewis Shetter are the owners of the property located at 2911 Unity Tree Drive, Edgewater, Florida. It's found in violation of section 10400 property maintenance of the city Edgewater's code of ordinances. On May 21st, 2026, code enforcement received a voice message complaint from a neighbor of the listed location advising the property has been unkept for over two years. I arrived and observed the listed location have grass weeds in excess of 12 inches. The resident appeared to be vacant, and as a result, a notice of abatement was issued with a correction date of June 1, 2026. Due to this property being cited for the same in July of 2025, Citation 0661, Notice of Hearing, was subsequently issued. It was posted to the property, sent certified mail to the owner, and posted at City Hall. All notices and provisions of Chapter 10, Article 27 have been complied with. No contact has been made with the owner or tenants of this property. Staff recommends a special magistrate find Wesley Maltram and Lewis Shetter in violation of Section 10400 property maintenance of the code ordinances and assess the repeat citation fine of $150.

And this has been abated, so there's no request for daily fines? Correct. Seeing nobody here for the respondents, based on the testimony and evidence presented in case 26-377, I find that the respondent is in violation of the City of Edgewater's Code of Ordinances as listed in the Notice of Violation and or Citation filed in this matter. Consider the gravity of the violation, any actions to correct the violation, and previous violations. I find that these violations constitute a repeat violation of a prior order of the special magistrate. I find that the respondents shall be subject to a citation fine in the amount of $150 and no daily fines since the property is currently in compliance. All right, case number 26-386.

Marr Development Central Florida Incorporated is the owner of the property located at 3313 Umbrella Tree Drive, Edgewater, Florida. It has been found in violation of Section 10400 Property Maintenance of the City of Edgewater's Code of Ordinances. On May 23, 2026, code enforcement received a complaint from a neighbor of the listed location advising the property as overgrown grass and weeds. arrived to observe the list of location they have grass and weeds in excess of 12 inches through the property being cited for the same in june of 2025 citation 0662 notice of hearing was subsequently issued it was posted the property sent certified mail the owner and posted at city hall all notices and provisions chapter 10 article 27 have been complied with no contact has been made with the owners or tenants of the property Staff recommends a special magistrate fine MAR Development Central Florida Incorporated in violation of section 10400 property maintenance of the code ordinances and assess the repeat citation fine of $150.00.

Seeing nobody here for the respondent based on the testimony and evidence presented in case 26-386. I find that the respondent is in violation of the City of Edgewater's Code of Ordinances as listed in the notice of violation and or citation filed in this matter. Consider the gravity of the violation, any actions to correct the violation, and any previous violations. I find that these violations constitute a repeat violation. of the prior order of the special magistrate or the repeat citation. Find that the respondent is subject to a citation fine in the amount of $150 as a repeat citation. No daily fines or liens are to be assessed as the property is now in compliance. That's it.
