Good afternoon. I am officer Jacob McLaughlin. This is for citation number 846 for 191 Pine Avenue, which is owned by Kenneth a Gilbert. On 09/24/2025, I received a complaint regarding outdoor storage at 191 Pine. I ins I inspected the property with my supervisor. We met Kenny Gilbert, the owner. There were outdoor storage violations, unpermitted fencing and structures, cars parked throughout the property, as well as inoperable vehicles, trailers, and boats. There were tarps laid out everywhere, dressers and furniture sitting outside, and a cooler with flies surrounding it. On October 13, I hand delivered a notice violation to the owner. We went through the property and identified all the violations and corrective actions.
On November 10, I reinspected and saw that there was progress. Some of the fencing had been removed. The outdoor storage was somewhat consolidated, and the tarps on the ground were mostly removed. On December 9, I was notified that Kenny got sick and needed additional time. I agreed to an extension until 01/05/2026. On January 5, I met with Kenny and saw he removed most of the fencing. He had placed tiles and other objects along the property line as a small makeshift ferry. I informed him that this would have to be removed. He also put mulch, shell, and rugs in the right of way, which had to be removed. No progress was made regarding permits for any accessory structures or the fencing.
I ensured Kenny understood that, one, he had too many accessory structures, and two, it was likely that most of them would not be permitted in their current state. The outdoor storage violations in the vehicle still remained. On February 9, I met with Kenny, his sister, and his brother-in-law. I went over all the violations again, and I explained the corrective actions required. I asked Kenny how to permit how the permit process was going to which he informed me he hasn't contacted the building department yet.
Due to the length of time already provided, I gave a final extension until March. I created a new notice of violation going over the remaining violations and hand delivered it. On March 4, I met with Kenny and walked the property. He had made minimal progress on some violations, but nothing was in compliance. After reviewing the nature of the violations and the ordinances, a citation for outdoor storage, permit required, and inoperable vehicles was issued on March 5.
On April 8, I reinspected the property with Kenny. The unpermitted structures were still present. The outdoor storage was piled near the entrance to the property, and the inoperable vehicle was still there. All notices and provisions of chapter 10 article 27 have been complied with. Staff recommends a civil fine of $75 for each of the three violations totaling $2.25 as well as daily fines of a $100 per day per violation that is still present after 05/09/2026.

I bought the property twenty five years almost, and I have turned an orange grove overgrown and tore up into the ground before I actually even moved into the house. It's a fixer upper home. I diligently been working for twenty years on this. Now I'm into varnishing the floor. I've been sidetracked here now to get rid of the clutter for four years ago.
The code enforcement came and asked me to get rid of some of these boats and trailers and vehicles. I did most of all of that, did. I have come a long way. I retired two years ago only. I've been diligently working since this year, early March or even September.
Before September 24, I was notified to clean up my act. Well, actually, I have already been working on it for years. But two years ago, now I have time, and I've been working on it for two years. I collected a lot of stuff in a lot of years. And a lot of it went to yard sale, damaged and thrown away. I've cleared out the clutter. I'm clearing out anything that looks like scrap metal because I don't do a handyman service anymore. I don't need the tin material for roofing. I don't need the two by fours or the wood pieces. It's all out of my life.
I can't get done quick enough. I have been injured, health reasons. I've been working on tearing down the fence that I put up for the gentleman next door. He moved along, health issues. And it was his fence that I tore down because the storm damaged it to beyond repair.
He and I agreed that we could save the panels of his fence. And with what I have saved while I did my handyman service, I have saved up many panels of fence. I also was at the time I was doing a newspaper route. And then I've collected stuff for scrap metal and stuff I could sell at my yard sale to resell and scrap and make money this way. It's little money.
It's not worth my while unless I have a regular pattern. I get disrupted easy in regular pattern. I have a shown of unorganizing. I have organization problems that I correct through the years. I was diagnosed as slow learner dyslexic.
But if I don't focus on what needs to be, I get distracted too easy. I have made a world of difference on this property. And if I have just I'm asking you please to give me another month, maybe, to extension, and I'll have this all cleared out. I want it out of my life. I'm retired now. I've got a backup vehicle, nonregistered, for my safety because I'm a homeowner. I need a backup. Like, I need a thousand dollars in the bank at all times for because I'm a homeowner. I have to have a vehicle running, and I have to have it's great to have a backup vehicle. I don't have the backup vehicle registered.
I have two boats in the yard that are registered and a trailer. I have another trailer non registered. And I have two other boats that need to be off the property. I have a structure that needs to come down because I'm not ready to build a permit to restructure it. It's coming down. After all of this, in six months, I've been delayed on health, mental, and physical. I had muscle spasms on the right, and I shook it off after three days. I worked it off because I had to get back out in the yard. And I don't recall when that was, but if I need a doctor's orders, I will follow-up with that. But I really need more time.
And it was after I shook off that muscle spasm on the right, within ten days, another muscle spasm on my left side. And this one wasn't shaken off in three days. This one took two weeks. I'm laid up, hurt. There's sick time. I got spider bite, infection, muscle spasm. Excuse me. I won't go on. That's too overwhelming for me. I have to live a life and it's been damaged.
And I'm correcting it for forty years now. I bought a home twenty four years ago with no money practically. I've lived in a van for sixteen months, saved a grand month, I saved, for not paying my rental anywhere. No more rental stuff. I lived in my van, separated.
I had a family. So here I am today pleading to the mercy of the courts to give me more time for health, sickness, and other issues. There's a very good possibility all the clutter will be gone, all the wood clutter, all the metal clutter, all the excess nonregistered boats, trailers, car. I've gone a lot. I was continuing with the debris pile, which a lot of it I had decided that I had it for enough years.
I've not used it this long. It's garbage. I'll throw it away. Garbage meant I've been keeping garbage and very busy. I have a house that's surrounded with an oak tree above it. The foliage dropped from one edge of the foliage tree to the other edge of the foliage tree is 75 yards. That oak tree deluges me every day, every other day, every week, or especially every six months of leaves and the pollen now have got me ankle deep in leaves and pollen. I can't just leave that on my roofs. I have to do that. That's urgent.
This pile of litter in my yard is being covered with all this tree debris. That slows me down. Yes, sir. I have recently cleaned off all my roof. I'm a little on the garage. Not worried. Project is in a month. It's cleared out because I want it off me. I've got registered boats. I'm not even using them. They sit in my yard and I look at them like, damn, I can't do it. I can't do it. And it sits there for six months. And I go do it. I put my boat on the water.
And I moo it at the park in Edgewater. Edgewater calls me because it was twelve hours. I left it. I didn't see the no mooring sign. They called Edgewater Towing. It was a $900 tow fee. The motor wasn't running right because I didn't use it for six months after. I had just put a lot of money into getting it running right and repaired. And it sits in my yard. Okay. Now it's still the same thing. I just repaired it again because it sat for six months no, three months now. And I just had it repaired a couple of months ago. I'm dying to put it on the water and actually flushing it.

Consider the gravity of the violation, the actions to correct the violation, and previous violations by the respondent. I order that respondent correct the violations on or before 05/09/2026.
In order to correct the violation, the respondent shall take the remedial action as set forth in the notices of violation and or citations. If the respondent does not comply with these orders, a fine in the amount of $100 will be imposed for each day the violations continue past 05/09/2026. The respondent is further ordered to contact code enforcement and to arrange an inspection of the property to verify compliance with this order. Additionally, I find the respondent is subject to a citation fine in the amount of $75 for each, A, B, and C case, which is

Next case, case 25Dash122898.
This is in relation to citation number 844, which is 414 Adele Street, which is owned by Mary Strode and Scott Bailey. On 09/29/2025, I received a complaint that the garbage can for 414 Adele was left in the road and animals were getting into it and making a mess. Upon inspection, there were multiple violations at the property. There was a metal carport in a shed without permits. Two cars parked in the front yard with overgrown grass underneath, overgrown weeds on the right side of the property.
There were outdoor storage items and scattered outdoor storage items scattered in the trees and bushes. The garbage can was in the road, and the trees on the right side of the property were overgrown into the road. I left a door hanger to make contact. Later that day, Mary called me and said she would begin correcting the violations. On October 14, I reinspected the property.
Most of the violations were corrected, but the trees were still overgrown and the metal carport was still unpermitted. On October 28, the trees were cut into compliance and Mary was working with the building department for the metal carport. On November 7, Mary informed me that the only way it would be permitted is if it were connected to the primary structure as an extension instead of as an accessory. She began looking for an engineer at this time. On December 8, she had an engineer working on a breezeway that connected the carport to the house.
She was waiting for him to provide her the plan so she could forward them to the building department. On 01/12/2026, Mary informed me that her engineer had ghosted her and was no longer working on the drawings. I extended the case to give her time to find a new engineer. On January 26, I was never contacted by Mary. I realized that I had not issued a notice of violation yet, so I issued a notice of violation for permit required. On February 11, no for no further progress was made. I spoke with Mary and issued her a citation for permit required. On April 9, I reinspected and saw that the carport was removed. All notices and provisions of chapter 10 article 27 have been complied with. Staff recommends a civil fine of $75. No daily fines are requested as the property is now in compliance.

is in relation to citation number 848, which is 3128 West Indian River Boulevard owned by Con Conrad Trust, SR four forty two Rev Trust, and Con Gerlin Trust. On 03/19/2026, I was forwarded an email from our fire chief regarding a shed on vacant property. I verified that there was a newer shed on the property next to a lawnmower. The shed had a dish on the roof and cables along the side. There is no permit on file for the shed, and no accessory structures, buildings, or uses are permitted on vacant lots.
On March 20, I posted a notice violation on the property for 21Dash36DotO1 and dot o two accessory use general. On March 26, Jerry Conn, Esquire came in representing the property owners. He stated the shed is not an accessory structure. I informed him that per the land development code and definitions, a shed is always considered an accessory structure building or use. These definitions are found in 21 dash 36 dot o one, which states the term other accessory buildings shall include, but not be limited to, such structures as storage building, storage shed, and the like.
They are also found in 21 dash 20 definitions. Accessory building means a structure, the use of which is customarily incidental and subordinate to that of the main building on the same lot, including sheds. Accessory use means a use that is incidental related appropriate and clearly subordinate to the principal use of the building lot or parcel. Jerry disagreed and requested that a citation be issued so we can dispute this at magistrate. I informed him that this would include a civil fine, which he understood. A citation was issued March 26 for violation of accessory use general. All notices and provisions of chapter 10 article 27 have been complied with. Staff recommends a civil fine of $75 for the unpermitted shed. We also request daily fines of a $100 per day that the violation is still present after 05/09/2026.

Hi. Okay. I expedited this because I just wanted to move it along. I just was notified a couple of weeks ago about this problem. I object to being cited on this because if you look at the law that's in front of you, the word accessory is used 17 times. This is the only building on the property. It's not an accessory. And those parts of the code have to do with accessory uses. We only use that because we need we have a tractor out there to mow the lawn. It's five acres.
We want to keep it clean and looking good for the city because it's right on 4 42 there. And all it does is hold some gasoline, some grease, and parts for the tractor. So I objected to the fine under that section of the code because I don't see where it's an accessory. It's the only building there. What say you?

So in dot o two of subsection two of 21 dash 36, it specifically covers any accessory buildings or structures on vacant lots. So that's where it states that you cannot have a shed on vacant property.

Well, it says accessory use, which is a shed is can it's not that the shed is being used as an accessory. A shed, by definition, is an accessory use.

This is in relation to citation number 849, which is 117 Fisherman's Cove Drive owned by Peter Paul Sutek. On 03/30/2026, I received a complaint from the HOA for Fisherman's Cove regarding trees that were cut down without a permit on their property. Upon inspection, there was a large amount of tree debris next to the road and on the sidewalk. I made contact with Pete, the owner, who showed me that the trees were from the HOA's wooded property directly beyond his backyard, close to the property line. He stated that he did not get a permit, and he did not get permission to cut the trees down from the HOA.
He also told me that Southern Turf was scheduled to pick up the debris, and they were who he hired to cut the trees down. A notice violation for the tree debris was posted since the damage is irreversible and irreparable. A citation was also posted for cutting the trees down without a permit. The tree debris, the tree debris has since been removed and cleared. All notices and provisions of chapter 10 article 27 have been complied with. Staff recommended a civil fine of $300 for the trees removed without permit, which has been paid. No daily fines are requested as this time as the damage is irreversible.
Thank you. Seeing no one here for the respondent, based on the testimony and evidence presented in case twenty six-two forty one, I find that the respondent is in violation of the city of Edgewater's code of ordinances as listed in the notice of violation and or citation filed in this matter. And consider the gravity of the violation, any actions to correct the violation, and previous violations by the respondent. We'll not be ordering any daily fines to be assessed as the property is now in compliance. Additionally, the citation was paid before this hearing, so there will be no additional citation fees.

This is in relation to citation number 847, which is a repeat, offense. The property address in violation is 2621 Royal Palm Drive, which is owned by Catherine a Schimmel. On 03/25/2026, I received a complaint regarding appliances and outdoor storage issues at 2621 Royal Palm. I inspected the property and saw washing machines, scrap and wires piled in front of the garage, a dresser on the right side of the property, and smaller piles of junk near the front door. There was also a reported there was also reported a large pile of junk and debris in the backyard, but I was not able to verify.
This property has had four prior cases for the same violation in 2025. Two of these cases had orders imposed for the outdoor storage dated 09/11/2025 and 01/08/2026. As this is a repeat offense, a citation was immediately posted for violation of ten five subsections one and four outdoor storage and debris. I hand delivered the citation to two men that were living at the property. A copy was mailed as well.
I explained that they needed to contact me as soon as the violations were corrected as daily fines of $500 per day were being immediately imposed on the property. All notices and provisions of chapter 10 article 27 have been complied with. Staff recommends a civil fine of a $150 for the repeated violation of ten five subsections one and four. We also request daily fines of $500 per day that the violation is present beginning on 03/25/2026.
