The second approval was for a conditional use permit for a parking lot within a UC zoning district for Ayers Associates and Mayo Clinic Health System at 1412 Whipple Street.

Good evening, everyone. It's 6 o'clock, and the July 6th session of the Eau Claire City Plan Commission is called to order. I will call the attendance roll. Commissioner Brewster?

During tonight's meeting, plan commission members will be participating in person to deliberate and take action on the agenda items before us. The plan commission attempts to conduct its public hearings in a relatively informal manner within the constraint that we must deal with the issues before us in an orderly and business-like fashion. We give the applicant an opportunity to speak first, and then others are each permitted to speak either for or against the proposal. We do request that everyone restrict their comments to the issues before us, avoid unnecessary repetition, and be prudent in the use of time. We want to be sure that we have adequate time to deal as carefully with the last items on the agenda as with the first. If you wish to view and not comment at tonight's meeting, it can be viewed through the live event link on the city's homepage under public notices and meetings. This meeting is being recorded at the same location. Agenda item number three is the open public comment period for those items that do not appear on this agenda as a public hearing. Therefore, if you're here to give public comment on items number seven or any item not appearing on this agenda as a public hearing, you can come up now. Item number four is our consent agenda. approval of the June 1st, 2026 plan commission minutes, a final plat SCS plat phase four, and a right of way dedication Marquette Street roundabout. The request is to recommend rezoning a portion of a property from NR to CC. The applicant is CCS Services, LLC, location 1718 Warden Street. Our staff presenter is Mr. Noel. Good evening, Mr. Noel.
Good evening, Vice Chair and Commissioners. This item before you has been submitted by Everyday Surveying and CCS. We'll try to get this thing to move here. It was working earlier. It's always something, isn't it?

This item is related to a zoning violation that was found related to parking in a residential district and our property that the owner actually owns. The CCS contractor owns this residential property that's just to the east of his business. And so there was some complaints, and the owner has addressed it by filing this rezoning application. At a later date, they will submit the formal site plan and the certified survey map to basically correct all the issues. But in order to do this land use on this property, he actually needs to get it rezoned to the proper zoning district. So in this case, we're moving forward. You want to keep going, Aaron, to the, yeah. Keep going to, yeah, there we go. Next slide. I'll just let you know. So here's the property in question. You can see some of the land use on the subject parcel to the west end of it with the parking, unimproved surfaces. So that was in violation. Next slide. in a little closer up view. This is the parcel that will actually be detached from the NR property, which is a single family unit that's rented. And the zoning for that will stay. It's large enough, over 10,000 square feet to meet the minimum lot size, so that's all good. And then they'll attach it with a CSM to the parent parcel, which is the property to the immediate west that CC Property zone and that will be zoned Similar CC with where the parking will be next slide These are some site photos that shows the single family home and then this driveway that approaches, there's actually a gate right here. We will need that to be closed so that the land uses are related to the actual property, the zoning district, so that will have to be completely enclosed there. But next slide. Again, you can see the unimproved surface with the parking for the employees. Next slide. This is the concept that was submitted. So we'll see a more refined site plan when that's submitted to the city. But really, what's before you is the conditional use permit, or sorry, the rezoning to be able to allow this land use to happen on this parcel of land. And then again, staff will approve the certified survey map at a later date with the site plan approved as well, meeting all the LDL standards. Next slide. So we've put that in the findings, the fact that they had a complete application, that the land use is consistent with the comprehensive plan. This area is actually transitional between low density and commercial, number two. Number three, that this rezoning would allow for this land use as a principal land use as part of the business. Number four, that the unimproved surface needs to be corrected with concrete or asphalt surfacing materials, which they have proposed, and we'll see that in the final site plan. Five, and then related to that condition of approval, that through access should be terminated so that we don't have contractor vehicle parking on the residential lot anymore, which we have found. And then six, that we do have that site plan that still needs to be approved to correct the violation, meeting all LDO standards. Any questions of staff?

I am Jeff Riebe, R-I-E-B-E. My address is 2010 Francis Street, Eau Claire. And I own CCS Services, and we also own 1718 Warden Street.
Would you like to share with us, Mr. Beebe, anything beyond what Mr. Noel has shared with us?
Well, you started asking a question about lighting. We don't plan to have lighting added to it. We don't need it. We're eight to five. If something was an emergency, a flashlight's great enough, we don't need lighting, so we'd rather not endure that expense. I don't know. If you have other questions, it's fairly straightforward. We are planning to hopefully put concrete in that area.

Would anybody like a copy of what I'm going to say? No, that's not necessary. So far, I have heard nothing about storm control, which is somewhat of the issue of what I'm having. If you look at the map, this would be me. This is them. I see this is all circled in yellow. My understanding was only the back half of the lot. And if you would look All the way around these three houses are higher than these three houses, with Mr. Reby's being the highest, mine the next lowest, and Mr. Schultz on the corner lower yet. Without hooking into the storm sewer, there is absolutely no way that that property can drain. Myself and 1626 buildings have gotten water in them from rain and from snow melt. This man has, he has no compassion to how he affects his neighbors. with the noise, the beepers, reverse beepers, the dust. For four years, he's been digging in this property. He even, at one point, backed through my fence. He has lied to the police that he had all the permits needed when he never even filed any. I was threatened by the officer to quit calling the city. I have talked to John Gettinger, Jill Christensen, City Attorney Taylor, All of them have replied. He can't do that, but nobody would step in to help the small guy And so after being threatened by the police officer I I shut up turned the other cheek and Felt that he probably did have the permits I should have checked then but things all came to a head when I when his youngest son moved in. This would be him. That's from the Allegiant Telegram. There's also two articles about his behaviors. Plus the house has seven kids living in it. And it's a tiny two bedroom, 960 square feet maybe, with an illegal bedroom attic space. And there's just way too many kids there. And they run the neighborhood till 10.30 at night. Most of them are like eight. I don't know if they're his grandchildren or foster children. I know there are some foster children there. And so he's obviously got male and female children living in the same bedrooms. I can't keep my house clean inside or out with all the dirt he creates. And if you look at your picture that was sent out, You can see all this dirt. It's just ridiculous. And so I get dirty water into my yard and sometimes into my small garage, which is just a storage shed. I don't see this guy stopping anything. He's just gonna keep pushing to the limits like he has for five years now. This has really been a problem that long and nobody would help. And I'm just, I don't know what else to do. There's no way this can pass. He's inflated property taxes. He's deflated my property value How much nobody really knows he has made my house harder to sell he has created light pollution he had a light hanging on the commercial building that shined my whole backyard and My daughter's bedroom and bathroom which he has since the violation He got rid of dirt pollution noise pollution visual pollution I don't know how this application can even be considered Being that he's been doing this for five years knowing knowing he could not do what he did and It's uh, it's a little crazy. He's he's violated city codes ordinances and Obviously, he knew he wasn't to be doing this, or he would not have lied to the police about it. I would really thank you from the bottom of my heart that you do not grant his request.

Everything around us is higher. And he took all the topsoil off of here and put it up in his front yard, making things even worse. And then he put some base course in, which really kicked up the dust every time they drove across. His son considered this as racetrack, going from Warden Street all the way through to the commercial property as much as 12 times a day, sometimes late at night. He was using his truck and trailer, a pickup truck with an enclosed trailer as a personal vehicle late at night. It was insane. So with everything being higher, there's no place to drain but to me and Nate, the house on the corner.
And that's Heimstead Plaza south of him?
Right here. This is a flat roof. It's the REACH building. And all that roof drains this way. Okay. Thank you.

No, make it worse.
Because of the dirt aspect, at least? No, because of runoff. If it was drained to the storm sewer, would that?
I don't know if that would work. I'm not an engineer. Okay. I do know that I'm getting flooded, and he's killed most of the vegetation, as you can see. So there's no roots or grass to help soak any rainwater or snow or anything. The water that comes over to me is just mud.

Yeah, I'm Nathaniel Schultz, last name spelled S-C-H-U-L-Z-E. You can go ahead, thank you. Yeah, I'm also a resident along Warden Street at the 1626 property. Yeah, I echo Dale's words, like he said, about the runoff. My property is the lowest in that immediate area. And there's been standing water in the past, like heavy snow melt, heavy rain in my backyard. But also a concern is the increased traffic due to the commercial property. I mean, Warden Street is a primarily residential area. opening that up to more commercial activity would continue to be additional commercial traffic. There's a lot of kids and grandkids that like to be in that area and play on the sidewalks and so on. So there's a safety aspect of it too. I'd also like to respectfully consider declining the application.

So, Mr. Noel, just to clarify, the only thing that's being zoned or done is currently the dirt parking lot behind 1718 Warden Street. So really, and that will be cut off from the lot itself so that there will be no through traffic, correct? Is that part of the stipulation?
The findings of facts will cut that off to reduce that traffic that he's concerned about. Also requires that it's hard surfaced. And the applicant understands that. They're going to submit a site plan that will meet the LTO. And if not, we'll reject it. So that's why these conditions are baked into the findings of fact for you to your consideration of the rezoning.
Okay, so Worden Street itself will not have any of,
effect currently it'll cut that access gate correct Okay and that'll definitely be helpful but is there a way to guarantee that the residential property won't be used as continued commercial parking or usage from Warden Street Mr. Noel can you respond to that
Yeah, I mean, the contractor's gonna have to park his vehicles on his lot. He does own that property as well, but all the contractor parking should be on his lot, otherwise it can be a violation.

Maybe it would be a good idea just to address each one of these issues that were brought up. Do you want to speak first to the storm control and the runoff issues?
I think I would like, with a little more expertise, I would like Gary, if he could come up and answer. He's our civil engineer. Certainly. While he's coming up, one thing I could explain is what a lot of people don't really notice But Reach is the building with the big flat roof that he was talking about. That road is their property. We never, ever drive through Reach's property during business hours. None of our employees, they go out.
onto North Claremont, or the frontage road, and then they go around and go wherever they want.
Right there, yeah. So right now, where the arrow is, and it goes straight out, we have an easement with Domino's Pizza. That's where we drive. That's the thoroughfare that we use, and that's all we use. As far as my son driving through the gate and not leaving the gate closed has been a father-son issue. I've been passionate about it. The gate has been closed. We will take the gate out and make it permanently not pass. You see it can't go through. That is not a problem.

my alias you're not supposed to use that right i i thought i thought that was a little odd but you know okay good evening folks mark erickson everyday surveying engineering thank you very much for hearing this request for rezoning um uh like like jeff had said so eloquently they have an access easement that goes out i i'm not there for their daily operations but it's prescribed and i believe him that most of if not all the vehicles go west out to north claremont's frontage road With regards to this, thank you, Mr. Noel, for bringing this up. There is a retention area that was done prior to us getting involved in the green hatch on the southern end of this proposed concrete parking lot area here. Perhaps more investigation needs to be done on the depth, the capacity of that thing to help it slow it down. We are putting more impervious surfaces down. That'll be an element for the planning and development and the engineering team to review and approve upon the rezoning and as part of the administrative process with approving the CSM too at that time. In regards to concerns about light pollution, I think it was answered by Mr. Eby the first time, there's no proposed lighting going out there. With regards to dust control, a lot better success when we have a hardscape surface down asphalt or concrete not generating any of that dust particulates to be floating in the air so items that we can address that site plan approval we are here for rezoning it meets all and checks all the boxes for the rezoning aspect of this thing being brought to cc instead of the nr zoning so I'd be happy to answer any questions that you folks may have.
Mr. Erickson, thank you. Can you address the noise issue, please? Well, the noise? Or Mr. Meany. Noise? Yes. Some of our trucks have backup alarms.
So they talked about the beepers? That's not actually occurring in that area even now. That occurs up. by our building, when trucks back in, they have backup alarms. And so we get deliveries, a couple of our trucks have backup alarms as part of the truck. That's not going on very much.
It's not really an issue. Is there anything else, Mr. Riebe, that you would like to add before we ask if there's any questions from the commissioners for you? Or for Mr. Erickson? I... I don't think so. Okay. There's something else. Okay. Commissioner Brewster.
Thank you, chair. Acting chair. The space immediately to the west of the parcel in question, is that also paved or is that unpaved? It's hard for me to tell from the picture.
So the only, the, the, the dark area, gray on the picture that's all that's paved then when you get up to the property line of ccs services as it is now that's paved parking currently it is paved okay i'm just looking at the satellite and i can't tell there probably because there's been a lot of dust great photo i'm a snow um
So just to add to that, you can see now what would be the existing conditions of the site of what we're talking about, the rezone. There's a layer of base course down where we're driving down towards the east, towards 718, and we can see where the asphalt parking lot stops. If you could be as kind to flip back one more time, sir. Okay. There he goes, he's hitting home runs tonight, folks. So yeah, so right where it says concept, the con, that gray called double hatch area, that's proposed. There was another sheet we made that showed the existing limits of the base course, which very close in shape and square footage of coverage, but that is proposed and how it's gonna connect to the existing, like Mr. Brewster asked to the due west where the access point will be, so. Does that make sense to you, sir?

What is the time frame if this is voted on to pass to get this all rectified and fixed?
We would like to have it done before fall. You know, if we're able to start right away, we want to get it done before frost, basically.
And when you say if, what is the if?
Well, we have to go to the city yet.
I mean, once you get approvals.
Once we have approval, we're planning to start right away. Okay.
So to follow up on that question, we will have, obviously rezoning will go to council next week, and then we already have the materials in for review for site plan and CSM. They've all been submitted, probably by staff's desire as well as respectiveness. They don't start reviewing that until the rezoning is approved. So they're there. Now, there could be comments with due respect on either of those two items, and we would address them promptly. give or take three, probably weeks is a fair assessment of when we would have site plan, CSM, in concert with rezoning.
Commissioner Lenard. Thank you. I'm just wondering if the current impervious surface has any sort of drainage currently, or if that is something that is currently going just into this empty loft.
Great question. Thank you for it. So, oh, yeah. You were so perfect. I'll go back. There we go.
Talking about the current parking lots?
So the current parking lot, the reference in a quick way is if we're coming from 718, we get off on the pavement of the driveway into the site, then that's gravel, then that was gravel up and back and over there. And in... In respect to how they built that, when they put the base course down, they created a rock line basin of semi-depression. To the depth and the value of what is coming at it, probably still really could use a justification or an order. proving that's functional, sir. So that would be part of the stormwater review with myself and the team with city engineers and see if it warrants to be perhaps reshaped, supply a different volume of capacity, those kinds of things.
The existing parking lot for our building, if you see our building is in the red hash mark, from the corner of the top right corner of the building, all the water drains that way. In fact, Reach's property all drains that direction. There's a storm sewer toward the frontage road. Everything drains that way. And then from the parking lot in the back, all drains straight this way. More toward Dumb. I don't know what that's... Planned South is the way it drains. Pardon me?

Mrs. Chairman, may I approach the monitor just to point out some things up here for you, and then I can show the rest. I'm sure you know what I mean. So here we are, and I'll go back and I'll show this to folks here. This is... the rehab facility right here in the reach, okay? This curb line drains water. There's actually a catch curb line that drains water down the area, drains and drains it that way. Like Mr. Eby was saying, basically his site has a Mason-Dixon line here for drainage east and drainage west, including all of his roof goes west. So there was, in history of the property, there's always been drainage that has come down that way by natural grain, he's letting me improve the gravel dug a respectable spot to store or retain some of the storm water and then we are here so One of the folks at home was showing there's a pointer. Is that too much?

Oh, there you go. So Ned knows the system all of them. So that curb line, Ned, a little bit up next. Yep, so this is off the... the reedy and or the 718 property right there is a concrete curb line that flows water predominantly from west east and most of the case site there is a little bit that goes out to warden on the very eastern extremes um that's what i was showing them there and then The right there on the building line, there you go. So if we were to draw a imaginary line north and south on Mr. Riebe's property right there, stuff on page left drains left or west, page stuff on page right drains right or east. So that's why I was just trying to elaborate a little bit on that. Thank you for that opportunity.

Thank you, Chair. Would it be possible to, like within the parameters, I'm not exactly sure what's allowable under the LDO with how far you have to stay from property lines with parking lots, but would it be possible to shift the entire parking lot north? slightly to leave like a larger space for either retaining pond or potentially some some additional plantings maybe some trees or something that would help block the view and maybe some noise we could easily go about eight or ten feet north however that would require cutting a lot of trees down and we'd rather not cut them down so that's part of why we've
want to be where we are.

That's a great photo, Mr. Ned, Mr. Noel. On photo left side, that's the north side of the property. We're looking due east on that left photo. And it's a lot of understorage and then some respectable significant mature trees in that area. And the other aspect of it, it's a slope. It's about four feet down and about eight feet. So it's like a two-to-one slope down from the neighboring property line north down to this area. this new parking lot potential area.
So we wouldn't be able to move much. Any other questions from the commissioners? Commissioner Holzman.
Okay, I'm gonna, I see on the south, just south of your parking lot area, you've got this storm water storage swale of some sort. Is there any possibility, I don't know if there's a storm sewer in the street going to the east of this, where it'd be possible to put a drain line in along that side of that lot, take it into a storm sewer which would intercept that water off of the parking lot and take it into a storm sewer so that that drainage then doesn't go into the neighboring property or we intercept a certain amount of prevent it from going into the neighboring property since they were having problems with with drainage and water coming into those properties and this would be a way to address some of that this might be something that the city staff might want to look into and consider as a possible condition for
if that question was i can specify so they'll have to submit a drainage and grading plan as part of the site plan engineering will review and we'll make requirements of what they will have to do to control stormwater runoff so that will be part of the requirement to get a site plan approval that will be addressed by our engineers with their engineer
You might want to make a point to see to it that they look into this possibility as possible to get some of that drainage out of there since we do have existing neighbors with problems and it'd be nice to be able to say that would have gone above and beyond potentially to say we're trying to address the neighbors drainage problem.
And that's part of the process that engineering will do when they look and approve the grading plan.

The ditch he's talking about that he dug is right next to my fence. It's sizable that he filled with rock. And henceforth, my fence sits in water most of the time. There's just absolute no way to drain that lot. If you look at picture on the left, you could see how that's all higher than everything. And all of that, all of this right here which is part of the commercial right now is now blacktop and it all flows right towards me right to that corner and it's just no way everything else is higher you know eventually a ditch fills up and then it has to spill over he's not going to get anything done and if he does you know it's going to be another five years and then he's just gonna keep adding in adding in adding he doesn't care about rules permits ordinances any such thing uh... he just believes he could just do whatever he pleases and he's proven this over the last five years he's been told he couldn't do it over and over in somehow everybody just capital You know, everybody just quit, and they wouldn't help me. I don't know. It's very strange. And he's absolutely untruthful about driving through... Driving through here off of Warden Street. Even today, quarter to five, I saw two pickup trucks and two enclosed trailers coming through there. And it's been continuous. Not only do I have him, and then they're going back and forth this way. And not only do I have him going through here, I also have dominoes until three in the morning. Oh, my hand was in the way. I also have dominoes racing through there at 3 in the morning, sometimes with loud exhaust. I mean, this all started when he paid $20,000 over asking price for the Warden Street property. It raised all of our taxes, immediately raised our property taxes. We all know that's how it works. We don't have to question that in any which way. That's about all I wanted to add.

Excuse me, Sean Coley, K-O-L-L-E, 1629 Warden. I'm actually across the street. Pretty much for all the same reasons as my neighbors, sorry, why I am opposing this. So the reason this is being approved is it sounds like what we're doing is going to relieve all of these issues that the neighbors have had by following the rules. I mean, it'll be a different lot, but honestly, you think anything's going to be done to the lot that you'll still have drainage and all the issues that were there, so doing this, we're pretty much relieving a lot of the issues since the owner of the property is gonna have to fix it to be a commercial zone.

Thank you, Chair. I'm a little concerned that this has been, like, a problematic issue for five years and it's taken this long to come to us. I'm not sure exactly why that has been the case, but that's of substantial concern to me. That being said, you know... We do have really good engineers for the way the stormwater is handled. I think paving the space, as long as there's sufficient drainage, would alleviate a lot of the dust problems. And, you know, I don't think a lot of those improvements are necessarily going to be cheap, but if they're willing to do them and then, you know, we sign off after it's been done, I'd like to imagine that it'll be an improvement for the neighbors. So I, yeah, I don't know. Thoughts?

just let it go i don't know if you guys have thoughts commissioner zeig well i know our rezoning ordinances that we've spent how many years redoing has given our staff our knowledgeable staff the ability to make those wise decisions on on based on the comprehensive plan and the new zoning laws so i've entrusted them into making the right decisions that are best for the city and its residents. So that's where I feel is that. And that we can't sit here and criticize every little thing as we are. We have a comprehensive plan to acknowledge and abide by, so.
I have a point of information about something in the LDO. Are there requirements that drainage swales be X amount of feet from property lines and things like that in the LDO, if you happen to know offhand?
No, that's going to be the city engineer's review on that in terms of site control. So we'll work with their engineer to make sure that we address that concern. I think that's been made clear tonight. but yeah there is buffering that's needed with the fencing they'll have to upgrade the fencing with the slats those are no longer allowed with the LDO so that will have to be privacy fence they're gonna have to upgrade possible landscaping in the area they're gonna have to grasp the surfaces that remain dirt So there are more standards from the LDO that will improve the site. The hard surface, there used to be a waiver that the plan commission could grant for unimproved surfaces that no longer exists. So the standards are more restrictive.

So we move on to item number six. Item number six is a public hearing for consideration by the plan commission. A conditional use permit for a parking lot. The request is to consider a parking lot within a UC zoning district. The application is Ayers Associates and Mayo Clinic Health System. The location is 1412 Whipple Street. Mr. Noel, thank you.
Okay, this is somewhat similar in nature with the parking lot. This is a standalone site, though, that's isolated, and it's zoned for urban commercial. So typically when we're not having a building in an urban environment, there's a little more standards that are applied to it, in this case a conditional use permit with a public hearing. The site you're probably familiar with, the old Luther Apartments, And so it's that's the zoning map right there When you have a parking lot of principal land use in the urban commercial district is required a conditional use permit Does require to meet certain screening standards as well being more of an urban environment obviously this is a unique situation with the medical campus And here's just the LDO, again, to kind of get familiar with it. We'll work with the applicant when they actually submit the site plan. They already have. We're already working with them on some revisions to make sure we meet the LDO standards. But this is a call out in terms of the different types of screening. They could do a masonry wall. We're working with them more beefed up landscaping within the site. This is some site photos again. Using the existing parking lot that was for the apartments or what remains of that and then expanding that. My understanding is that this will be more for patients. They can correct me if I'm wrong. To the north of it is where the employees park and then there's a lot more parking even further north and west. This is the concept that was submitted. Again, this is going to be revised, meeting the LDO standards. I think everybody in the development community is getting used to LDO standards and just kind of fine-tuning things, whether it's parking islands or landscaping and screening. So we'll continue to work with them on some of the things that we've already addressed. to date with some emails back and forth. But again, this application is for the land use, the parking lot, not the details related to the actual site plan that's coming in. It will be dealt with staff and engineering as well with stormwater. But this is for the parking lot in the UC district as a conditional use permit So basically they have submitted a complete application and then with the final approval of the site plan to meet all the screening standards of the LDO the stormwater the hard surface very similar to what we just talked about with the CCS property So we do recommend approval of the conditional use permit, being consistent with what they've submitted already with the concept, and then we'll approve it, make sure everything is finalized with the LDO. Ned did indicate we want to use this lot for patients. It's mixed use. Patients can park wherever they want on our campus. Primarily, we're using this to offset some parking we're going to lose when we relocate our childcare facility up to lot 15 near the radio station along Cameron. It should be net neutral. We do have some parking constraints due to construction. We'll get that back once the emergency department's finished. The temporary helipad goes back up on top of the building. So right now we're pretty stretched as far as staff parking goes, but this is a plan to get us to our future state where we have ample parking. You'll see us more and more in the future as we come back with more exciting projects to hopefully get approved, but again, I don't want to rehash everything Ned said, but I'm happy to answer any questions.

Yeah, just a brief update that the committee, the advisory committee, we had a great turnout of applicants, 33. And the appointments committee recommended a list of 15 members, including the two on the planning commission, Susan and Josh. And so we'll have then two city council members as well as the other 11. And city council will approve that list of individuals July 14th. We are working with a consultant right now to stand up the website, the project website. Our goal is to actually have our official launch on National Night Out so that the website would be up, we'd be able to engage the public at that event, have a QR code for survey release to start getting input from the public. So that's our tentative plan is to launch August 4th.
