Yes. All right. I'd like to call to order the town of East Troy Planning Commission meeting for the month of January. I'd like to record to show that the commissioners are present with the exception of Commissioner Reyes. And uh Larry, thanks for filling in tonight. No problem.
Uh so we are now on a single meeting format. So what we will do is we will um have the presenter come up uh tell us what they're looking for, give us a little explanation. the plan the commission will then ask any questions of the applicant. Um and then the applicant would sit down. We'll have a small discussion amongst commissioners and at that point we would open it up to the public if anybody in the public would like to speak in favor of the proposal, anybody would like to speak against the proposal and then if necessary um there would be a small rebuttal from the applicant. Um if we can't make a decision tonight or something we we need more information, it would get rolled over to next month's meetings. First item on the agenda is to review and approve the planning commission meeting minutes from November 5th. Everybody got the minutes.

Thank you for getting my last name right too by the way. That's a tough one. Most people don't get hit by a swing and I just luckily hit them off. [laughter] Well, well done on that swing. So, uh, thanks for having me everyone. Chad Hippus, West 2159 Bua Heights Road. Um, essentially what we're looking to do is the property that we have, um, we recently um, built a house on there and we're looking to separate and get one additional lot that would be buildable um, in the future. It is our intent to not sell that property. Um, we have two girls that are in high school right now. Um, someday perhaps we would like to have the ability to build another house on there either for them or I have a lot of extended family. Um, so that's the reason why we're looking um to split the lot into two. It's really our long-term kind of legacy planning and we're doing that now with not, you know, intention of building, you know, imminently, but we do have since we've finished the house a year and a half or so ago, we have just gravel drive and stuff right now. So, we're looking to see if this could get approved, then that would then allow us to finish off our landscaping for the current house. Okay. Any questions of the applicant from the commissioners? Uh, I have one somewhat unrelated question. uh the DPW had actually saw that you guys were on the agenda and he mentioned to me, hey, since you'll have them, you know, in a confined space, it
was something with regards to them needing some uh easement to do some road work and he just said he hasn't heard back from you guys or whatever not related to this item and it has no bearing on our decision tonight. I just said u if I see Mr. I will I will see what's going on or if you got it or if there's Yeah. So, they do need a construction easement to do that um culvert bridge replacement on VA Heights Road.
Um so, somebody did drop off, you know, an agreement in the fall and then I contacted Todd because I had some questions about it and then he directed me to um somebody from Lynch. So, I talked to him and kind of had my my questions and I haven't heard anything back from them. If you want to, I have the piece of paper. If you don't, give Todd a call tomorrow. The piece of paper? Well, I think he's waiting for some questions to be asked. So, yeah, I have I have that. Somebody dropped it off at my house. Um, but there was a lot of questions that I had like they didn't have,
you know, any indemnity clause and they had, you know, where they're going through. So, I just had a lot of questions and the guy from Lynch said he was going to go back to Todd and kind of work out an an agreement to kind of address some of those questions that I had and I just haven't heard. And that was back in like probably Octoberish. Yeah. He just mentioned it was going to be a spring project and he said it's looming if you could. Yeah. So, I'm I'm happy to, you know, I've been just kind of waiting. In fact, I was it was on my list of things to do. I was going to send an email back to the guy from Lynch. Um, but this is a good reminder. I can even do that. I can I'll just mention it to Todd that maybe shake Lynch up to communicate with you. Yeah, that sounds great.
Um, so with no other questions for the applicant, you could have a seat. Thank you. Um, as far as I'm concerned, they're both conforming lots. It's currently our one. We're not taking any egg. um all the you know the lot lines the frontage everything is conforming everything will be conforming in in any if we were to split this so that's just my take any other concerns or discussion amongst commissioners agreed agreed at this point [clears throat] I want to open up to the audience would anybody in the audience like to speak in favor of the proposal would anybody like to speak against the proposal all right I could then maybe take a motion.

I oppose. Motion carries. Next item on the agenda is a reszone Honey Creek Trust Jack Schaefer um N7480 Bell School partial pet 36003. Hello Zan from Pentacle Engineering Group on behalf of Jack Schaer. Uh, if you recall, we were back in front of you guys, boy, like time flies, three months ago maybe for a comp plan amendment. You guys were the first step in our process. So, we we got the comp plan amendment from the town, then we took it to the county, went through that process, got the comp plan approval at the county, and now we're kind of here for step number two of a three-step process. So tonight we're here for a reason request and then hopefully if this goes well we'll go to the county and do their re reszone and then ultimately we'll come back to you guys with a certified survey map. Um if I'll just kind of again reiterate uh on the property there's the homes that Jack Schaefer has the house and then there's a pond to the south of that. uh he's basically just kind of uh estate planning. So he's trying to create a lot around that house and that pond. So that would be one property and then the remnant piece would be the second property. So it would be one property to two. Um in order to do that we had to get a comp plan amendment in order to come back and ask for a reszone. So, our comp plan amendment changed from AP to AG2. And then now that the comp plan allows us to come for the reszone, we're asking to go from A1 to C2. And [clears throat] the only area we're asking to reszone, uh, like this gentleman has the big map out, it's due
south of the house around the pond. There's, it's kind of proposed reszoning. So, that's the land that would ask to be zone. I did include the certified survey app last time we were [clears throat] excuse me last time we were here. There's some questions of what it would look like. So I did include the CSM and I stamped the draft. Again, we're not going to really discuss that unless you guys had questions on that. But I would come back if the reasoning goes well. I would come back for that certified. So the um so A1 to C2 9.7 acres and then everything remaining is A1.
Uh it's a combination the the property the piece that we would have the house on would be all C2 and then the rest of it is a combination of AP uh there's some AG2. So the the larger piece is going to be a combination of all the existing zoning. We're not asking to change anything else. I I guess where I'm going with that is I'm like if we split this off, are we going to create a nonconforming parcel that remains? But I guess it's
Yeah. No, it won't. So part of the reason why we had to do this uh with the A2 zoning, there has to be 35 acres and we only had 60 acres. So I couldn't divide [clears throat] the property into two. I would need 70 acres. So that's kind of why we're here. But no, we would be in conformance. The one thing, there's an existing [clears throat] driveway. The the lot, this lot would be served by an access easement. I did put a draft of that in your packet. Um, essentially, he's not going to cut in a new driveway. He's just going to continue to use the same driveway that's there, but both properties would conform to the zoning. Okay.
Any other questions for the applicant? Well, I thought I saw in reading some of the that you're going to actually ask for another driveway for this particular property, but that's later. Uh, we we're going to use the existing driveway and we're going to put an access ease over it. So, that essentially this the new when I come back for the CSM, this lot essentially would be landlocked and the way we would service it would be through that access easement. Yeah. So this driveway would be potentially for this lot but then for this for this one as well right. So this easement is for this new property. This easements associated with that. This property can kind of go I guess out to Bell School or wherever they want you know.
Okay. And there's no proposal to build another house on the large remnant piece. It's just you know ultimately one of his children may end up. He's got quite a bit of property in this area. Um, so they would mostly have ponds on them the homestead and then ultimately one of the kids is you know ideally would be on the other parcel at some point but even at that point I would assume they would still peel off that same driveway. Sure. And as part of the access easement agreement there'll be all the maintenance and everything will be in that agreement. Sure. Okay. Any other questions for the applicant then?

Um discussion commissioners been as far as I'm concerned again we we've already kind of seen this there's no changes there's no non-conforming parcels um to me just a personal I kind of stinks because it's cool huge property with ponds and a cool house but I don't own it and that so that was just just an editorial right there. something.
