The privilege of the floor shall be extended to any person appearing for themselves in which case each individual appearing shall be limited to 3 minutes and to any person representing any group who shall be limited to maximum time of 5 minutes. Rather, it's an opportunity for members of the public to share their thoughts on the record. With that said, privilege of the floor is now open. Any members of the public who wish to speak, please step forward, state your name and address, and address the council. Good evening. My name is Jake Stern. I'm a resident of the city of Dunkerk. Uh but tonight I will be representing 24 uniformed firemen that make up local 616 Dunkerk professional firefighters. Uh this is to Mayor Kathy Delviaz, Attorney Elliot Reando, and members of the Dunkerk Common Council. Dear Mayor and members of the city council, the membership of the City Dunker Professional Firefighters Local 616 hereby submit this unanimous vote of no confidence.

City Mayor Mrs. Kathy Doz and attorney Elliot Roundo. This action follows a long and troubling pattern of leadership failures that have undermined public safety, increased financial risk to taxpayers, and diminish confidence in the administration of the city of Dunkerk. These actions undermine fair labor practices that harm employee relations and expose the city to unnecessarily legal and operational risks. These actions have also led to challenges with recruitment, retention, and resignation amongst our membership. Our decision is made in the best interest of our membership, the citizens and visitors and businesses we serve in this great city. Number one, failure to serve as an impartial and effective leader. The mayor's personal views dictate decisions made to withhold contractual obligations and earn benefits with zero negotiation or mediation. Number two, misrepresentation and halftruths. Although Mayor Dobz and Elliot Raymondo publicly claim to support public safety, her administration has repeatedly provided information that is incomplete, misleading, and selectively framed. Examples include recent articles, emails, and statistics shared with the public by Attorney Rayondo attempting to paint public safety employees in a bad light, incomplete updates to the city council, including on matters involving collective bargaining and firefighter working conditions. Number three, more than 450 days without a union contract for the firefighters. Local 616 has been working with an expired contract since December 31st, 2024. Number four, unprecedented loss of firefighter personnel. Since Mayor Dobby has assumed the role of city mayor, nine out of 24 firefighters have either resigned or chosen abrupt retirement in fear of the city withholding contractual benefits. These firefighters included a past fire chief, a captain, and veteran firefighters, some who sought employment with other departments. We are now struggling to replace those positions

due to a negative outlook of the city's political and financial standings. Cited reasoning includes lack of trust in city leadership, fear of negotiated benefits being withheld, and poor working conditions. This exodus has increased overtime costs, reduced institutional experience and knowledge and weakened emergency response capabilities. Number five, costly legal missteps. Numerous contract violations, grievances, and arbitrations continue to cost city taxpayers thousands upon thousands of dollars in unnecessarily legal fees. More concerning are the implementation of unilateral changes to benefits, full well knowing that these actions directly violate the collective bargaining agreement. The city offers no mediation nor negotiation on these matters and states simply to file another grievance. These decisions expose the city to litigation, reversal of unlawful actions, lost productivity and morale, and additional taxpayer funded legal costs. In conclusion, the city of Dunkerk needs stronger leadership from its mayor and legal council. After two long years of attempting to work constructively with our city mayor and attorney and after assessing the widespread harm caused to public safety during their tenure, the membership of the Dunker Professional Firefighters Local 616 have unanimously determined we no longer have confidence in Mayor Dovas and Elliot Rando's ability to protect the public and serve as city mayor and legal counsel. We respectfully urge the city council to take appropriate and timely action to provide effective and trustworthy leadership to the city of Dunkerk and its citizens. Good evening. My name is John Arns. I'm the president of the city of Dunkirk uh police benevolent association. I'm speaking on behalf of the Dunker Police Benevolent Association, 342 Central Avenue, Duck, New York. Speaking before you today is not something we take lightly. The concerns we are raising tonight reflect a breakdown in leadership that impacts not only officers and our safety but the safety of the public. Especially given recent events, safety is a primary concern for law enforcement. The city's administration administration's conduct has had both direct and indirect effects on the ability of the police department and its officers to maintain adequate staffing levels to protect this community. Although minimum staffing is maintained through overtime, it comes at a cost. It places increased strain on officers and our families, negatively impacts morale and affect and affects performance, which ultimately impacts the level of service we are able to provide to the public. On March 24th, one of our officers was shot in the line of duty. He nearly lost his life protecting his community. In moments like that, leadership is crucial. And yet, neither the mayor nor her staff reached out directly to that officer or his wife. Not an email, not a text message. We have to ask why. Since January 2024, there have been no fewer than 11 grievances under this administration. In the past in the previous 40 years, there are there were no arbitration and no per charges. This is not a coincidence. This is a pattern. So, PERB stands for Public Employee Relation Board. It is a New York State agency that oversees labor law matters for public employees. When a city breaks contracts, change terms without

negotiation, or retaliates against employees, PERB is where those violations are reviewed. These issues involve overtime, earn time, staffing, training, and compensation. These are not minor matters. These are contractual obligations. We have asked the city administration for answers. We have received none. Human resources has been unable to explain why officers are not being properly paid for overtime, that we are required to work. The city has even ignored guidance from the Department of Labor directing that overtime be paid at time and a half. The city is now facing 14 separate charges before PERB. Seven for unilateral changes to the contract without negotiation and seven for retaliation when we assert our rights under the contract and under law. The city has already missed eight deadlines before the administrative law judge. and additional charges are currently being filed. This is not an accident. This is not a mistake. This is a pattern and it is costing the taxpayers of this city. The current approach taken by this administration is going to cost the taxpayers hundreds of thousands of dollars, not just in litigation, but in ongoing legal fees, back pay, fines, and unnecessary disputes. All to avoid paying what amounts to pennies in comparison. This is spending dollars to save pennies. That money comes from the public. It's not being spent or it's being spent on legal battles, including payment to the city's contracted attorney instead of resolving the issues and honoring agreements that we negotiated and followed in good faith. There is a breakdown and how the city charter is being followed. The process is clear. The mayor proposes a budget. The council approves that budget. The chief fills

the positions. This process is stopped. Positions and necessary equipment are being funded and approved by council, but then blocked from being filled or implemented unless reapproved by the mayor. That undermines the authority of the police chief and directly impacts staffing and public safety. The mayor signed the PBA contract June 4th, 2024 after taking office and was involved in negotiation prior to that. The terms were agreed upon by both parties. They are now being changed unilaterally. That is not how contracts work. We are now looking at potential violations of federal law, Taylor law, the city charter, and the PBA contract. This is not sustainable and the public deserves better. For these reasons and in the interest of public safety, accountability, and the fair treatment of officers who serve this city, the Dunker Police Benevolent Association is issuing a unanimous vote of no confidence in the leadership of Mayor Kate Doyas and her administration. We respectfully call upon common council to take action and consider issuing its own vote of no confidence in the mayor. Thank you. THANK YOU, MR. ARNES. Good evening. My name is Raymond Debramitz, president of Local 912. I live in 19 East Tenny Street, Dunkerk, New York. We are here to show our solidarity with other city unions to address the issues of members that we are having to deal with the city. Our local previously addressed this council and we continue to stand by that statement that we made at that time. The frustration we all are feeling can be fixed through cooperation.

Hi, my name is Denise Abbott. I am the president of the Western New York Area Labor Federation, AFL CIO, where I have the honor of representing 140 local unions and their 145,000 union members and retirees here in Western New York. Five of those unions and their locals are the workers that keep Dunkirk working as firefighters, public works, administrative assistants, clerks, police, and more. The only way this city keeps moving forward each day is because hardworking men and women show up and do their jobs. What I am here tonight to ask of each of you is to do your jobs. As the elected representatives of this community, you have a responsibility to your residents and your workers. A responsibility to tax and spend with the health and safety and liberty of your constituents in mind. a responsibility to make the workplace you create a safe, respectful, and a responsive one for the people who clock in and out on behalf of their neighbors and families each day. You have a responsibility to serve the public transparently and with integrity. Unfortunately, I say all of this because it seems to be lost on the leadership of this city. By disrespecting the workers of this city, you are hurting the local economy, diminishing morale, and throwing away the public's trust in government's ability to serve its citizens. And it's not just disrespect. What I have been told by workers, union leaders, and city residents is that the environment of bullying, abuse, and outright illegality are out of control here in Dunkerk. The mayor and an inactive council have allowed the purposeful undermining and mishandling of city resources, collective bargaining agreements, public safety, and the livelihoods of workers and residents alike. I've heard about threats to withhold pay, which is illegal. I've heard of threats to furlow workers in

retaliation for speaking speaking up. That's illegal. And I've heard that required staff have not been hired or trained on the whims of a vengeful mayor. not just illegal, but it makes residents less safe in their community and workers less safe on the job. This is my first time meeting all of you, but what you see is what you get. Both with me and the labor movement here in Western New York in Western New York. We often say that an injury to one is an injury to all, but here in Dunkerk at this moment, what you're seeing is an attack on all. Several of you on the council are or have been union members yourselves. You know deep down that the situation facing your workers right now is wrong. You know they deserve better. If no one has asked you to to have the courage or to stand up for what's right, here I am. Please have the courage in this moment to do the right thing. Stand up to bullies. Stand up for your city and its people. No matter what, the Western New York Area Labor Federation AFL CIO will continue to stand by our members when they are under attack. We will use our solidarity and we will win this fight. Not just because we have the right on our side, but because we will work harder than you. We will organize better than you and we will mobilize as many people as it takes for you all to understand that working people in this city are done being taken advantage of. I'm here tonight Excuse me. You done? Yeah. Thanks. I'm here tonight to stand for the dogs who can't speak for themselves. The dogs who suffered because the cities chose not to follow the law. They chose not to listen. They chose not to act. And I'm here to confront the slanderous lies that have been used to distract from their suffering. Because what is being what has happened here is not fair. It's not just happening to me. It's happening to the animals and the city employees that the city has has vowed to protect. And instead, you failed to you failed by neglect, silence, and inaction. For months, I raised concerns about the conditions of the dogs that they were living in and the dogs in the city of Dunkerk. I reported the lack of supplies, the unsafe environment, the absence of proper protocols, the urgency, and the need to comply with New York State a markets laws that went into effect on December 15th. The required safe housing, sanitation, isolation areas, enrichment, and proper recordkeeping. That's article 26 C. Article 7, requiring humane handling, proper impound procedures, and accurate documentation. Section 113 requiring municipalities to provide necessary veterary care. The laws are not optional. They are legal obligations. And while I was documenting the violations and trying to bring the city to compliance, the dogs were suffering. They suffered because the city failed to provide the supplies under article 26 C. They suffered because the city refused to fix unsafe conditions or violated standards and chose not to be compliant. They suffered because the city ignored mandatory training, recordkeeping, and facility requirements that exist specifically to prevent the animals from

being harmed. Dogs went without proper enrichment and they're being right now without proper enrichment. Dogs were kept in conditions that would did not meet legal stand sanitation standards. Dogs were housed without isolation protections of the law that the law requires. Everyone of those failures put those dogs at risk. And while the dogs were suffering, I reached out again and again and I asked for one simple thing. I asked for a meeting. I asked for a conversation, a chance to address the problems. But they got worse. Not once, not twice, but 14 separate times, I asked for a meeting. I asked to discuss the dog safety, the new shelter laws, the required upgrades, the training, the recordkeeping, the veterary care, all the things the city were legally obligated to provide. And not once did they schedule a meeting. Not once did they offer a date. Not once did they respond with a plan of action. But I kept working. While I was out in the field doing the work, responding to calls, doing outreach, rescuing dogs, rescuing injured dogs, coordinating with the police, arranging emergencies to sheltering, and making sure no dog was left behind, the city refused to meet with me. Your time is up. Okay, great. Thank you, MR. UM, my name's um Judy Lutz Woods and I'm representing um a group of people that were loosely organized. We would like to have a rally and a march in honor of labor. It's International Labor Day on May 1st and we would like to use Washington Park um to start the rally and have a march over here to Silly Hall and then back to Washington Park where we have maybe a couple speakers and

maybe some music and it's all in honor of labor. I think all of us, you know, from hearing this labor is what built this city. It's what built our country. And so the international labor day, we would like to give them um some support and some gratitude for everything that they did. So anyway, we're asking even though we sent in the the forms, they told me to come to the council to ask you permission if we can do this.

When we did budget last fall, it was allotted in there for legal services that would include a parallegal with the assumption as we were told then that it would go through a resolution on whatever agency was picked outside agency was picked to represent the city. that thus has not happened and the residents of the city would like to know why it's not in house. We need a parallegal that is in city hall, not one that's um however many days you choose to have your representative be the parallegal. And the second thing is if um I understand there's going to be an appointment for a new uh dark control this evening and um if that person could just maybe briefly do a an article for the newspaper to let the residents of the city of Dunkerk know exactly what their responsibilities of being a dog owner or dog dogs multiple dogs owner are within the city. So, we don't want to have a cash situation inside the city, but the county does have a cash situation out of the transfer station on Webster Road. They're already set up for that. So, I know that you you brought that up at the DPW DPF meeting uh at the county and hopefully that gained some traction. Um one of the things that we talked about that we I find and that uh it's very critical is what we do with the wastewater treatment plan as far as personnel and we are talk that is uh something that we are uh it's a priority with us and we've t have several discussions on that and so I just want the public to know that that is a priority. the people at the wastewater treatment plant are working very hard. Um, and we I appreciate what they're doing. I think the citizens of the city of Dunkerk should appreciate what they're doing because when you get uh clean water is because these people are working very hard and they're putting in a lot of overtime. So, uh, that's one thing. The other thing is that u we, uh, as Natalie was saying, we are looking for a controller. Uh we are um um and we are in the process of uh of of of trying to find that. Now any other positions we we we're looking at uh also ask questions about summer help because that's that will definitely help DPW in the summertime and we're going to look at ways that uh and see if there's something that can be done to increase the amount of summer help that we're that we can get. But all that will depend on the budget. Budget is is everything right now. So uh our next meeting is going to be May 13th. I invite uh anyone who's interested to be at at uh at our meeting so that you can either share your ideas or at least hear what's going on.
