Lives we want to ask you tonight for the patience and the wisdom to do what's right for our community in our city thanks for uh the ability you give us to share what we have with others to minister to those you placed before us but most especially to pray for those beyond our reach uh we thank you for our community and please guide and protect us in your name we pray amen amen amen all right uh City excuse me Planning Commission secretary would you please take the role absolutely commissioner Luhan president commissioner sakali president commissioner present Vice chair UA excused and chair Gara I'm here thank you um this is the time set aside for oral communication from the Planning Commission does any commissioner uh wish to make any announcements report any conference meeting or request any items for future agenda mrby I have none sir okay I have none Hector I have none either okay great uh um we don't have any presentation but does the community development director have a report on any city council action or anything in general update um just a couple of things that I wanted to share uh we have in the pipeline with regard to planning we have uh various development projects that are in the pipeline um that are pending resubmittal over there received comments um one that you may be um hearing about soon um is related to um code amendments um that we're uh looking at uh cleaning up some outdated language in the code and uh streamlining codes um there's this has kind of been a long awaited uh code Amendment um that we'll bringing in a couple of months also related to uh moving some items that would come to Planning Commission that don't make sense to come to Planning

Commission like for example uh special events that have um have come to the Planning Commission in the past that have become more um procedural if you will uh so again if you have any ideas or any comments on that um if you could email me or let me know but I think we've kept a pretty good list of that that is a a very U large work effort that the uh staff is undertaking um and then just a quick update on the general plan we do continue to work on our comprehensive General Plan update of the city which includes all elements of the general plan um that also includes uh kicking off our environmental review process which would be an mental impact report and uh with the addition of swatti we hope to be making a little bit more Headway on our timeline for that we're um working with our consultant to um get a more public Outreach with regard to that and um you'll be hearing uh probably future presentations on our general Plan update that's all I have for now when do you think the code amendments will be coming the code amendments I believe are slated for July uh of uh 2025 okay another question Sur uh the eir which one are you referring to uh the eir would be related to the city's comprehensive General Plan update uh portion of that has that you've already seen is the implementation of the housing element the rezoning of the sites the other elements for example are the land use element updates the um Economic Development update design uh element update uh traffic and circulation open space thank you um just for um for some of the new members on there um the what the the the second item she was talking about is uh We've have it comes before the Planning Commission things like the Greek festival permit or I don't know I forgot a couple other events there annual

events and we're like why is that coming to us on there it should be handled by staff and they and that's what we are looking at doing thank you for this okay I was going to say I think it put some pressure off of them and they come and yelled at us yeah they didn't get what they wanted but but most of them you know the problem is they they forget that and they do it at the last minute and they put pressure on them when it's really not their fault that you only turn it in two days you know and then so no I've been there for many years that's happen so but now it's off of us and it's on the staff to work another question I may for the um Fourth of July celebration uh do they require I know they require permit but would they come to the Planning Commission meeting to to for us to select who should we choose on on a yearly basis or you already have that in mind for the thank you for that question if I may uh chair Garrett respond to that question uh the Fourth of July parade is that what you're referring to no the uh uh selling of the the opening of the uh for the sale fir fireworks Booth yeah fireworks stands fireworks Booth is is not part of the special event permit those are a separate permits that are processed through the fire department um and um I I can um refer you uh after the meeting um how that's okay I'm curious how the applicants is chosen yeah that's not through the Planning Commission that's a separate process I think there's like 20 and and you have to and there's usually like two or three in the wings but you need to comply with everything or next year you get lower down we used to have one when I was in West County little Le they still have it but it was yeah you were always scared of losing it because it was such a big money raiser for that but I know it's should be I don't know how they're chosen anymore I think it is the fire department or something so great okay um now is this time uh we have a public hearing now is the time set aside for public hearing for pln

2591 if the plan site program does the Planning Commission secretary Ria have proof of publication yes I do okay great can we have the staff presentation please uh uh chair and commissioners before we begin I just want to interject one item um on this item number one public hearing pn- 25- z91 the plan sign program commissioner legaspi is recusing himself from the deliberation and vote on this matter tonight on the basis um of his property ownership within 1,000 ft of the subject matter of these um of the decision tonight so on that basis he's recusing himself and we'll step away from the Das for the duration of the proceedings and the vote and we'll return for item two thank you Mr funk uh chair and commission I'd like to present our assistant planner Marissa Montero will be providing tonight's presentation on this item great go ahead Miss mono okay perfect I was waiting for the slides oh okay I'm sorry all right good evening uh chair Gara Commissioners and members of the audience uh my name is Marissa Montero and I'll be presenting uh pln d24 - 0091 just to clarify it is pln d24 0091 I'm sorry is that a 0025 0024 it's it's 0091 pln d25 yeah 0000 914 there's a typographical error on the agenda so just to for reference it's the number that's on the screen uh which starts with the 2024 thank you okay thanks for pointing that out I was looking at this okay all right uh so the item before you again is case number

pn24 0091 a request for a plan sign program to establish the size location and appearance of signs within an existing multi-tenant commercial property uh the slide shows an aerial image of the subject site which is located at 10207 to 10231 Lakewood Boulevard on the southwest corner of Lakewood Boulevard and Florence Avenue there are three structures on the property a multi-tenant commercial building uh a fast food restaurant and its dining area and Museum the subject property is zoned General commercial shown on the map uh to the left as C2 and has a general plan land use designation as General commercial uh the surrounding land use designations include General commercial to the north east and south and single family residential to the West right so a plan sign program is required for a site having three or more non-residential tenants the subject site the subject property has five tenants therefore the property is required to establish a plan sign program PSP on the screen is this plan sign program just for reference uh the proposed plan sign program identifies two areas within the parcel area a and area B area a includes the multi-tenant commercial building with four tenant spaces and related signage area B includes the oldest operating McDonald's its dining area Museum and related signage uh the McDonald's restaurant is not part of the subject application and no changes are proposed to any of its signage okay I just want to make that clear because I read it several times in here but for anybody watching later on

and everything else on there the McDonald's sign is not going to be changed whatsoever and I know you said that because you put it in there four times in the report so thank you we can cover that as we go through the presentation but to further elaborate the pl sign program does address uh signage at the uh historic McDonald's site uh but there's specific requirements they would need to undergo to ensure that any uh upgrades or modifications are related are historically compatible and not Replacements to Modern sence for example wa I'm sorry but this is just an interesting question right now if if that sign fell over because of you know Mother Mother Nature how can they build it up they couldn't build it up the same way no tornadoes in Downey uh so uh it was close by yeah the the way the sign I think we're jumping ahead but the way the sign program is designed it's uh designed that any modifications even Replacements would come to the Planning Commission okay and they would have to be historically sensitive so in that hypothetical scenario it would have to be possibly a reconstruction of a historic s okay s thank you and sorry of course of course good question we okay so for area a The Proposal includes design criteria for four tenant wall signs a new monument sign with four tenant sign panels and the removal of an existing freestanding pole sign the sign criteria States tenant wall signs must be internally illuminated Channel letters and must utilize pre-approved colors and fonts as shown on the slide however there are exceptions for corporate brand colors logos fonts um subject to the approval of the landlord the sign criteria also outlines specific locations limitations and maintenance requirements for each wall sign provided in the plan sign

program so this slide shows the allowed locations and dimensions for the proposed tenant wall signs the table shows the location of the proposed signs the maximum wall and Monument sign area per DMC the Downey Municipal Code the proposed sign area and the totals of each uh if you notice uh the wall all signs for tenants 1 and two will exceed the standard maximum of 1.5 Square ft per linear foot of the tenant building Frontage as prescribed in the C2 Zone however such deviations are permitted within a plan sign program as long as the total sign area for all signage on the site does not exceed the maximum combined total sign area the plan sign program has been designed to ensure the total allowable sign is not exceeded therefore the proposed sign program complies with the DMC all right uh in area a the plan sign program also proposes the installation of a new double-sided internally illuminated Monument sign along Lakewood Boulevard and the removal of an existing freestanding pole sign the new monument sign provides four tenant panels on each side totaling 70 squ ft of sign area this complies with the regulations outlined in the DMC which which allows for a maximum sign area of 85 square ft uh the monument sign is also architecturally compatible with the existing building design incorporating the same type of Stucco and Clay roof tile all right now moving on to area B so like we previously mentioned area B is developed with the oldest operating McDonald's and related signage the plan sign program does not Grant any approval to modify signs in area B the applicant is not proposing any changes to the signs any proposal to modify repair or

remove any or all portions of the signs or structures with historical signs in area B will require approval by the Planning Commission and approval of a revised plan sign program signs within area B would also be subject to the standards and regulations outlined in preser preservation brief 25 published by the National Park Service which has been included in the plan sign program uh a public notice was issued for this item on March 6 2025 the notice of the pending public hearing before the Planning Commission was published in the Downey Patriot and mailed to all tenants and Property Owners within 500 ft of the subject site uh as of the date this report was published uh or as of the date the report was published staff received has received no correspondence in response to the public hearing notice therefore staff recommends that the Planning Commission adopt resolution number 255-4467 to 10231 Lakewood Boulevard uh this concludes staff's presentation I'm available for any questions and thank you great does the uh Planning Commission have any questions recy I have one question what is the foot candle on these signs the foot candle the illumination the illumination um that's included in the plan sign program I don't know off the top of my head okay um but the uh the the idea the reason I'm asking that question if it's going to be facing Lakewood Boulevard yeah um and basically if it's way tooo bright it

will blind the drivers right I chair chair if I may on T to the question on so this the pl sign program really regulates the size of it the location of it pror conditions and pror procedures in the city they still have to apply for a specific building permit and a uh planning permit to have a it's what we call a signed permit so during that we get more technical or more specific and I don't have that type of information great thank you Mr [Music] Lan so like the Dollar Tree they have the regular that's I think they their um brand logo that they have so that's why that size is going to stay there it's not going to change yeah so um the Dollar Tree is allowed to keep their brand color the plan sign program regulates how big the sign can be okay thank you chair if I may add something to this as well well so one of the conditions of approval for um this item uh which is condition of approval number nine states that the illuminated signs shall have the ability to modify their illumination so going back to what you were stating if there is a situation or a scenario where the signs are too bright the condition requires them to be modifiable um so in the future any of those instances can be addressed thank you it was good to know thank you so that sign going on there reading the report it's going to be 8 ft tall is that what I what I read the monument sign right so the one the existing one that's going to be removed that's on a big pole I don't know how long but 20 ft tall or something maybe whatever okay so could they you know could they build the same thing at a different location or is 8 ft the the maximum that we're allowing here just that that new sign um they they're not requesting to build a new uh freestanding pole sign

um it is uh not code compliant anymore okay that's what I was asking kind of thing yeah no that's exactly what I was asking and then the one thing my question is on on page four on the PC agenda page four okay so I was reading so and it's interesting I don't know what other colors there are I don't care that's fine but there's only here there's only um these seven fonts or something like that so how do we choose fonts like this I mean what if somebody wants you know Times New Roman or something or some other area why are these particular sign is this a standard I guess in development or why these seven fonts so the fonts were chosen by the applicant um whether I mean I I think we can ask the applicant about uh maybe these are the most legible signs or fonts for signs um but yeah that's what was provided to us so okay but we didn't say these are the only seven went okay cuz I just said it says pre-approve so I figured okay we're telling them okay yeah I don't care what they do I was curious okay no that's that's uh the only questions I have thank you okay thank you I have another question uh is this sign going to be um elevated or is it going to be on on the ground on on a on a concrete pad door something the monument sign yes um that detail hasn't been provided yet because like we previously mentioned they'll still be uh applying for building permits okay so and just to add to the question about the monument sign the monument sign for the permit process the building permit process will require a foundation that it'll be set on okay of course thanks thank you okay great um before I open the public hearing and call the applicant or the representative this uh would be the time for the planning commissioner to disclose any prehearing site visits or prehearing discussions that commissioner have had

about the project I'll start off with Mr Luhan uh no no with me so I I drove by the property several times on there to get a better feel for it and I even stopped and walked around a little bit just to get a feel for it so uh the public hearing is now open on there and I see our applicant on there um if you please give your testimony sir uh testimony as far no what what is anything things you would like to add you want to tell us oh you had some questions regarding um fonts right so those are just like standard fonts that you find in any uh plan sign areas shopping districts so there's no specific reason why um those are just common okay um in regards to the monument yes we would have to uh um follow whatever building codes there is so it would be on some sort of platform uh I don't know if that's concrete I'm not sure what that is but we will follow that um sir could you give us your name I'm oh yes yeah my name is stepen Vasquez and I am the applicant okay yeah right thank you is there anything else any questions I can answer is there anything you'd like to add to the report sir okay no we're all good no so how long have you guys been in uh have this property oh man uh the property or the application in no the property oh I'm really not sure on that question at least I think something like 10 years okay yeah great are you guys working on another 10 if they're out of curiosity at the moment no this is the first step um the reason why this came about was we we were trying to get signage for um a new tenant but we couldn't get it until we had this in okay so um first we're going to get this done and then see if we can advance with signage for the other tenants great okay all right thank you any other questions all right thank you sir thank you very much um May staff confirm that there's any any correspondence in favor uh or

along Sicilia and liid which is currently the Aro gas station on there so following the enclosure of the ston center in 1990 the city council recognized that the improvements will attract additional Shoppers to the C Dany and this led to the creation of the lake with fireone specific plan in March of 1992 uh to enhance and expand upon the vibrancy of the Stonewood Center the specific plan reson all the properties highlighted on the screen that were previously C1 C2 C3 and M1 to create a specific plan with the goal of creating a large scale retail oriented area that will benefit from the proximity of the ston center the specific plant is composed of 362 acres and has been subdivided into five different sub areas as shown on the screen 1 2 3 4 and 5 a 5 b and 5 C could you go back real fast there absolutely so okay where's the 5A and the 5 C so the five the line between the 5A and the 5B is is is that Bradley bag H that's exactly right yes yes is there is there a reason why these we have a 5 a b and c and is is that just the way it was that was just the way it adopted uh my guess is maybe to better um I guess regulate the certain sites because theine goes into detail as far as site 21 20 22 and each site corresponds to a sub area which is is 5 a 5 b 5 C so this is what it is now you're saying okay all right so cuz when you see the Lakewood Boulevard sign to the left of that you know white language on there there's also I think now some

commercial building no I don't know what's there anymore I forgot but so that's not part of the specific plan correct anything to the left of what I'm looking at the letters the Lakewood Boulevard letters there correct and I'll go into the background of the uh other zones surrounding it but that zone as CP for where you are referring to okay thank you sir so here are some of the retail uses envisioned for the speciic plan uh on the left are uses permitted by right which are retail specific uses such as antique sales department stores drug stores furniture sales and others on the right we have conditioning permitted uses which are garden supply stores theaters and other automobile sales and sorry used automobile sales and since its adoption the specific plan has been amended twice once to allow grocery stores in 2016 and then again in 2017 to conditionally allow hotels with ancillary alcohol so the specific plan is surrounded by multiple zones and uses to the north we have the ston center and the CP Zone with office and residential uses to the East we have C2 and R2 zones developed with commercial centers and multif family to the South is zoned in uh industrial and multif family to the west and to the West is C2 C3 Zone developed with homes and Commercial uses and again this amendment will introduce commercial recreation throughout the specific plan subject to a land use application for a cup that is approved by the plan commission during the public hearing and to the right minor commercial recreation is subject to A administrative permit application for a minor condition use permit that is

approved by the director of Community Development or the city planner now named the deputy director of Community Development so the use and definition of commercial recreation already exists in the municipal code as a use or development to provide Amusement pleasure or sport diversion exercise or other resource resources affording relaxation and enjoyment this type of land use exists throughout the city in the C2 C3 and CM Zone requiring a conditional use permit uh the use is also currently allowed in the downtown Downey specific plan the Downey Landing specific plan and the stonewoods specific plan and some examples of commercial Recreation throughout the city uh one we have Galactic challenge which is a Indoor Shooting Gallery within the ston center and then Delo Lanes along Florence which is a indoor buling alley I didn't know we have that and again this land use will be allowed throughout the specific plan to provide an opportunity for property owners to repurpose large tenant spaces or buildings uh the introduction of this new land use will diversify the area the area's businesses and promote uh Community engagement active lifestyle and provide familyfriendly entertainment and now moving on to minor commercial recreation this is also an existing use throughout the city and it's defined in museal code AS recreational and instructional instructional uses including but not limited to Arts crafts Martial Arts yoga martial arts shall be specific to any of the tra tra tradition forms of self defense or combat that utilizes physical skill and

coordination this use is currently allowed in the C1 C2 C3 CM with a minor condition use permit and in addition the use is also currently allowed in the Rancher Los Amigo South Campus specific plan the downtown dowy specific plan and the Downey Landing specific plan and these are some examples of minor commercial recreation on the left we have a Jiu-Jitsu gym offering classes for all ages and on the right we have a palies and yoga studio and these uses will be allowed only in sub area five which is shown on the screen uh staff specifity chose sites 20 21 25 and 28 which all contain commercial strips with multitenant buildings staff considered the operations of these types of businesses to occupy smaller tenant sizes by allowing these uses to be part of the commercial strips other businesses would benefit by the increase of foot traffic caused by these types of minor commercial recreation uses so we're only allowing the minor M site 2120 25 and 28 correct yes that's the only point so you couldn't have it in one of the other areas there of area five you would not be able to know okay and to uh better orientate everyone uh site 20 is Right adjacent to the Bradley back Factory site 21 is Bradley back Factory site 25 currently has like the Wyman's liquor store and site 28 is a vacant uh building currently why why wouldn't you allow it in other places is there a reason for that the the benefit in providing in these locations because these are part of multi-tenant commercial spaces so by adding minor commercial recreation to these tenant spaces uh it would promote an active uh commercial center it would benefit from the the additional foot

traffic that you would get from like a palali or a personal training gym um it could benefit the other businesses as far as you know more customers to sell product or uh like a smoothie bar for example it could create a vibrant commercial space yes sure um Abraham I I I understand the concept of of why what we're proposing here um I I specifically site 28 that if I'm not mistaken at the re in the rear it's the Elks Lodge is that correct to the to the rear to the rear of 28 to the front it's it's about about 10,000 square fet of what used to be um U office and or I think calr at one point occupy that space um full disclosure um site 28 is no longer V there is a business a nonprofit operating out of there and again just for transparency purposes I was the listing broker on that transaction in uh 2024 last year um so with that said I'm curious that is not a multi-tenant project or property um so your your comment earlier that you selected specific ones with multi multiunit that would not I would not consider that a multi-unit property I'm just curious why that one was selected and let's say not the neighboring property and I wonder how the neighboring properties would um feel that their property was not selected for potential additional uses therefore maybe increasing the value of the property not being able to attract different types of tenants no you're absolutely right so we consider site 28 because uh during the time of the vacancy we received many calls with uses po poal uses for that site however

because of the limitation of the specific plan it's very retail oriented uh we consider the site just to provide an opportunity for the property owner to you know reach out to a tenant who can go in the site specifically um but yes you're absolutely right it's not part of a actual multi-tenant right thank you for that and and just to further elaborate on what Abraham just provided um the the the when it was vacant um we met with the Elks representatives and uh there was a certain level of frustration that the specific plan was limiting the types of tenants that they can attract there and at some point they even had interest from a uh exercise kind of Studio that uh we as staff felt would be complimentary and compatible but we were limited by the spec specific plan specificity and so this in the future would just provide that extra flexibility thank you for that it's wonderful so we don't we don't currently have anybody that wants on there we're just being proactive on all this unchanging getting ahead of it is that it correct yes gu to further elaborate on that um being proactive we do have interest on uh for a tenant to occupy potentially the former Big Lots but that would be uh under the commercial recreation C not minor that would potentially occupy the Big Lots building and uh staff has been a meeting with this applicant along with our Economic Development our department and economic development uh the property owner has uh really spent a lot of time in identifying a tenant that would be there in the long run that would occupy the entire space um and so that prompted

this discussion about the limitation of the specific plan and we could have proceeded with just addressing the problem at hand which was the commercial recreation but we thought it was a missed opportunity to also look at minor commercial recreation because we thought that' probably be something that would be asked of us or that even just we just didn't feel comfortable ignoring um and further the the former BR Bag Factory um has also been working with staff on potential upgrades to that building to create a multi-tenant vibrancy and so we thought that would also maybe provide them flexibility in the future again they haven't specifically said they want it but we thought it would be a proactive way to um incentivize and just again that that word vibrancy keeps coming up because we have seen a lot of these sites um suffer long exper extended periods of vacancy and so we thought from a land use perspective we can help in that in providing more land Ed options if if this passes tonight is that can we go that extra are we going to notify the property owners that now it's been expanded that I mean I think some notification would be good you know they don't even some of them may not even know this is going on so if this Planning Commission tonight approves this for us to go to them and saying hey by the way you now have more options or so forth no absolutely so part of the process of normal uh public hearings we notify Property Owners tenants of within 500 fee and including the sites that we are amending so they already have been notified of these changes yeah and and one last question on there so the the very n one you have the Big Lots and then you have what is it was that Walgreens I guess right next door to it correct yes so you know the question is again I mean I get you know Big Lots is too big for any of those that prodct but isn't the
