Good evening, everybody. It's Wednesday, July 15th. The time is 5.04 p.m. I'd like to call this special town board meeting in order by asking everybody to please rise and stand for the pledge to the flag. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty Everybody who may be watching out there. This is a special board meeting. We needed to take care of some business before the next regular meeting. So we're going to start right off by asking if there is any public comments, questions on agenda items only. Anybody in the crowd please approach the podium for agenda items only. Seeing nobody approaching the podium will go on at this time. I'd like to move that the board please consider. The consent agenda, authorize budget transfers and budget amendments, waive a 30-day notice period for liquor license application for Ten Mile River Preserve Incorporated, and hire a seasonal lifeguard and aquatics director for Dover Day Camp. Resolution authorizing the issuance of a $315,500 serial bond of the town of Dover, Dutchess County, New York, to finance the purchase of a 2025 International Navistar Highway Vehicle Model HV507SFA chassis with body, plow, and wing. Before I read, just please make it known in the minutes that our legal counsel is on speakerphone monitoring and listening to this meeting. Okay, onward resolution. Be it resolved by the affirmative vote of not less than two-thirds of the total voting strength of the Town Board of the Town of Dover, Dutchess County, New York, as follows. Section 1, the purchase of a 2025 International Navistar Highway Vehicle Model HV507SFA chassis with body, plow, and wing. being a class of objects of purposes having a period of probable usefulness of 15 years pursuant to subdivision 28 of paragraph A of section 11.00 of the local finance law is hereby authorized in and for the town of Dover, Dutchess County, New York. Section two, the total maximum estimated cost of the aforesaid object or purpose is $315,500. And the plan for the financing thereof is by the issuance of a $315,500 bond of said town hereby authorized to be issued therefore pursuant to the local finance law. Section three, it is hereby further determined that the maximum maturity of the bonds herein authorized will be five years. Section 4, the faith and credit of the said town of Dover, Dutchess County, New York, are hereby irrevocably pledged by the payment of the principal and of the interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year there shall annually be levied on all the taxable real property of said town a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable section five subject to the provisions of the local finance law the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized including renewals of such notes is hereby delegated to the town supervisor the chief fiscal officer of the town such notes shall be of such terms form and contents, and shall be sold and eaten in such manner as may be prescribed by the town supervisor, consistent with the provisions of the local finance law, and may be executed by the town supervisor of the town of Dover. Section 6, all other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities, and interest payment dates within the limitations prescribed herein in the manner of execution of the same, including the consolidation with other issues and also the ability to issue serial bonds with substantially level or declining annual debt service shall be determined by the town supervisor, the chief fiscal officer of such town. Such bonds shall contain substantially the recital of validity clause provided for the section 52.00 of the local finance law and shall otherwise be in such form and contain such recitals in addition to those required by section 51.00 of the local finance law as the town supervisor shall determine consistent with the provisions of the local finance law. Section 7. The town supervisor is further authorized to take such actions and execute such documents as may be necessary to ensure the continued status of the interest on the bonds authorized by this resolution and any notes issued by in anticipation thereof as excludable from gross income of federal income tax purposes pursuant to Section 103 of the Internal Revenue Code of 1986, as amended the Code and the extent applicable to designate the bonds authorized by this resolution and any notes issued in anticipation thereof as qualified tax-exempt bonds for purposes of Section 265B, 3B, I of the Code. section eight the validity of such bonds and bond anticipation notes may be contested only if one such obligations are authorized for an object or purpose for which said town is not authorized to expend money or two The provisions of law should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit, or proceeding contesting such validity is commenced within 20 days after the date of such publication, or three, such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than a specified in this resolution, no monies are or are reasonably expected to be reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. This resolution, once it takes effect, shall be published in summary form in the Poughkeepsie Journal, which is hereby designated as the official newspaper for such purpose, together with a notice of the town clerk is substantially the form provided in Section 81.00 of the local finance law. Whereas the Town Board of the Town of Dover at its meeting on July 15, 2026, adopted a resolution effective as of July 15, 2026, authorizing the issuance of serial bonds in the amount of $315,500 for the purpose of paying for the purchase of a 2025 International Navistar Highway Vehicle Model HV507SFA chassis with body, plow, and wing. and whereas the town board of the town of dover now wishes to adopt a resolution authorizing the issuance of a bond anticipation note in anticipation of the sale of the aforesaid bonds in the amount of three hundred and fifteen thousand
$500 and other matters in connection therewith.
And now, therefore, be it resolved by the Town Board of the Town of Dover as follows. Section 1. The Town of Dover shall issue a bond anticipation note in the principal amount of $315,500 pursuant to the local finance law in order to finance the specific object or purpose hereinafter described in anticipation of the issuance of serial bonds authorized by the bond resolution of the Town of Dover dated July 15th, 2026. Section 2, the specific object or purpose for which the obligations are to be issued is purchasing a 2025 International Navistar Highway Vehicle Model HV507SFA chassis with body, plow, and wing. Section 3. As required by the local finance law, it is hereby stated that there is no bond anticipation note outstanding at this time. B. Said bond anticipation note will mature on July 15, 2027. C. Such notes are not issued in anticipation of bonds for an accessible improvement. Section 4. The power to prescribe the terms, forms, and contents of said bond anticipation note subject to the provisions of this resolution and to sell and deliver said bond anticipation note is hereby delegated to Richard Yeno, town supervisor of the town of Dover. Town Supervisor of the Town of Dover is hereby directed to sign any bond anticipation note issued pursuant to this resolution, and the Town Clerk is hereby directed to attest to said signature and to affix to such notes the corporate seal of the Town of Dover. Section 5. The faith and credit of the Town of Dover are hereby pledged for the payment of the principal of and interest of the bond anticipation note. Section 6, this resolution shall take effect immediately. The question of the adoption and foregoing resolution was duly put to vote, which resulted as follows.
