I am submitting into the record 13 items. um the staff report you received in the mail or email listed 12 So the applicant, Pachamama LLC, is requesting a comprehensive plan amendment from commercial CO to committed residential 2-acre RC2 of a 0.61-acre lot of record together with a zone change from CRC rural community commercial to RR rural residential 2. The property lies within the Days Creek rural community, located on the west side of Tiller Trail Highway at its intersection with Days Creek Road. The property currently contains two pre-existing commercial structures, which previously served as a market and shop, along with two miscellaneous sheds. The purpose of this quasi-judicial application is to allow for the conversion of the existing family dwellings, accessory structures, limited farm uses, and other various uses. If approved, the applicant will convert the old vacant commercial building and garage into a rural residential use. The subject property is located within the Days Creek rural community. located on the west side of tiller trail highway and the intersection of days creek road where there is a mix of zoning and land use activities properties lying to the north are either developed with single-family residences and or Properties to the east, west, and south are designated rural community commercial, but are developed with single-family dwellings, with the only exceptions being the store market on the subject property and the U.S. post office across the street. These properties are zoned CRC, rural community commercial. The zoning surrounding this cluster of commercial zoning is predominantly RR, rural residential, with some FCs. use cropland to the north, and public reserve Days Creek Charter School to the south. Notice that the proposed amendment was provided to the Oregon Department of Land Conservation and Development, DLCD, on May 13th, 2026, which was at least 35 days prior to this hearing. Property owners within 250 feet affected public districts and agencies and the South County Planning Advisory Committee were notified of this request by mail. Notice was published in a newspaper of general circulation and as of this writing and as of today, no comments have been received. So the recommendation, based upon the findings outlined above, planning staff recommends approval of the requested comprehensive plan amendment from commercial CO to committed residential two acre RC2 and zone change from CRC rural community commercial to RR rural residential two of a 0.61 acre meets the criteria of Chapter 6, Section 6.500, and Chapter 3, Article 38 of the Douglas County Land Use and Development Ordinance. Chair Burke, Commissioners, Mark Garrett, my address is 12975 Tiller Trail Highway, Bates Creek, Oregon. And first of all, I want to thank you for coming in for this rather short hearing. We appreciate that. The staff report is reflective of our desires as far as the rezoning of the property. And once that is completed, the applicant will work with planning and with the building department to make sure that those buildings are brought into residential compliance. They're largely there now. just a couple of interior adjustments that need to be made as far as bathroom access and some electrical work. But essentially, it's ready to go currently. So we ask that you approve it. It's recommended by your staff.

I do have one question. I wanted to know it's an LLC which means it's essentially a business. Why is it going from commercial to residential?

The property is under the ownership of the LLC, but it's functioned largely as a residential use. The building that is there was the old mercantile. There was actually one also across the street years and years ago. But over the years, those have kind of fallen away. The county ended up with a property across the street, and it's now vacant. They tore the old building down. So even though it's under an LLC, it's functioning as a residential use. It's an old market.
It was the old Days Creek Market. I don't spend much time there.
But I just wanted to know. It's an LLC, so why would a business want it to be residential?
I think the store's been closed for a number of years. The store, the mercantile, the grocery store, whatever, it's been closed for a number of years.

I remember going in as a kid, wanted to go play at Days Creek.
We'd all walk up there and go there. The Stones that originally owned it, you know, they passed away. Well, she passed away first. She was kind of the hub of Days Creek and the distributor of information to everyone. And then the husband kind of held things together. And then when she passed, he continued to run it for a while.

One plan of zone change, same developer might have another one in the works, but that might be tight with the timeline and the notice requirements we have to get in August. But that might mean, actually it could be better one in August than one in September, potentially.
