Well, this is a copy of the completion report for DD6. And also, I don't know if you guys accept the hearing date for the reclass? We are after this. OK. Yep. So that's the reclassification report also.

We are now 9 o'clock. And we will work on the DD six completion hearing column.

Yeah. So this is the completion hearing PD six. Uh, we did a open ditch, technically an improvement. Uh, we basically the upper one mile of the main open ditch of drainage district six. It's, uh, just Northeast the lake park. We actually changed the grade of that from 0.05% to 0.03%. We talked about whether to just do repairs or to do an improvement. The improvement was basically to try to get some additional depth for the main tile of DD6, which comes in at the very north end, at the upper end. It's significantly undersized, and if you put something bigger in there, were going to need some depth so while you're out there you know a little bit of more scooping isn't going to be a lot of additional cost um let's see so just kind of a background of the project we had but i did when i when we had the hearing and had the report i had an estimate for the improvements of 67 to 72 thousand dollars and that's more like 70 to 75 with the reclassification um and kind of my ending estimate for the reclass was six you know with everything was 62 000 so we came in under budget which is which is always a good thing uh we did have a TAB, Mark McIntyre:" Good bids my estimate or the instruction was 46,000 and joshua's excavation out of esterville had a little bit of 35,000 160 1080 cents. TAB, Mark McIntyre:" About 10,000 there. The completion hearing, when you do a drainage district project, it's kind of a procedural thing that's required by state law. And basically, it's to accept the completion of the contract with the contractor. And also, we send notices out to the landowners where the work was done. So in this case, there was only two. There wasn't a lot of landowners where work was actually being done. And it gives them an opportunity to file claims for damages. And so like for this project, the damages would have been to a grass buffer strip on Jim Hemphill's land. And then there was a little bit of corn Where they needed a little bit of extra room, because the buffer strip wasn't that wide, just a little bit of corn and then in the north half mile there was pasture grass basically that was destroyed as part of it when they dug out the material and then smoothed it out. So what we've got We've got recommendations in our report for damage reimbursement to these landowners. The total recommended reimbursement is $1,832.70. And the basics for that is basically we went out there with the GPS and we're figuring out the areas that were damaged as part of the project immediately in order to complete the work. The corn basis was $851.13 and so that's based on Dickinson County five year yield average of 193 bushels an acre at the 2026 year to date average closing price of $4.41 a bushel. And for the grass, the pasture lands $400 an acre that basis. Jordan, I didn't hear anything from Jim or Bob.

We didn't either.

Okay. Let's see. So the other thing with the completion hearing is that we've been holding back. Well, there's only been one pay claim to the contract. And when we do that, Drainings Law says that we hold back 10% of what they've done, basically. So we've got 10%, it's called retainage. And 30 days from completion hearing, then you can release the final 10% to the contractor. So that 10% retainage is $3,913.41, the work that they have completed but have not yet completed. The other thing that I will point out is after the work was done, we did do a quick drone flight, took a video of that, and it's on the Jacobson Westergaard YouTube channel. If anybody's interested in watching that, I think it's a few minutes long or something, but you can get a bird's eye view basically of the ditch. Any questions at all at this point? Yeah, I guess the action to be taken would be to accept the work as complete. Oh, the other thing, sorry. The other thing that this, there's a, with the contract, there is a one-year warranty period. If there's anything that's found to be, you know, a problem, the contractor would be responsible to come back and remedy it. So this would trigger the start of that one year warranty period. Okay, so the action to be taken would be to accept the work under the contract as complete. And then also the damage reimbursement recommendation of $1,832.70. The retainage, we'll just do a separate separate pay claim um and that would be that'll just be a topic for a different um fork but it should be pretty simple it's just it'll be that amount signed and can execute it or you know approve it at that time so don't approve that today I've seen it done both ways.

We usually do. And then we just pay it within the 30 days.

That's fine too. Historically, with multiple projects that I've done, since we've got these pay estimates in a certain form, to have all that accounted for within that same form consistency in what I've done, it's not a big deal. If you want to approve that today, that's fine.

we could if you want since we have a plethora all right yeah plethora kill first of all it's kind of a sad week for me last week i lost my brother uh always tough to lose one of your siblings that was a real shock and then also to hear about the loss of doug prignance that also was a shock and he's been very involved and helpful in the county so Our thoughts and prayers definitely go out to his family. One of the good things that came out of my brother passing, his two daughters came and had Labor Day with us. So that was great for us to have memories of my brother. Work-wise, I had a Silver Lake Improvement Association meeting. Lots going on over there. The DNR is going to be involved with Phase 4 of the shoreline restoration, which includes west side of the lake. that will begin in the fall of 27. along with that another project we are finally getting the dnr to be involved in constructing three fish barriers to try and keep the carp out of the lake which has a lot to do with the poor sediment because remember it's only about a nine foot lake and so keeping the fish the carp out of there particularly is is a big deal they continue to harvest a ton of fish out there by the way so that's all good news um The board reelected their three current board members. No one else was interested in joining that board. So we thank the three that are serving again. And they continue to have a committee forum to work on the North Basin project. Again, having places where water can come and filter into really makes a difference before it just comes automatically into your lake. So at some point, we're going to see that on all the lakes, I hope. That's all I have. Oh, one more thing. Please make your appointments to get your wellness materials done. We need you. Mr. Dullard. Last week, I had a very slow week. I thought so myself. On the second, I sat in on a webinar from the Iowa Environmental Council about Iowa's power generation in 2026. And the biggest thing that they kept talking about in the whole thing was climate change, climate change, climate change.

Did they talk about nuclear?

No, not that much. Their main focus was on getting rid of the coal plants. That's what it seemed like to me. On the third, I helped with our unloading of our church food pantry truck, getting ready for this coming weekend, which will be our handout. And on the fourth, I talked with Atlas about both food pantry stuff and about housing issues with upper Des Moines opportunities. Trying to get a memorandum of understanding between us and Atlas on emergency handout for food. And then very interested about, we haven't gotten anybody off that, one person off that list in a year for the county. So that's something that I'm going to start

talking a whole lot more up in the morning about good and that concludes my week it was a good week Mr Clark I had no official meetings last week on Wednesday I did spend a little over an hour on the phone with the constituent explaining property taxes and uh the, the portion of his property taxes that went to each of the other taxing entities that, and, you know, I think, uh, it was a really good conversation. He, uh, seemed very pleased with the, the outcome, you know, that, you know, it's not all just the county, you know, and it takes some people, you know, he was real receptive and understanding and, and, uh, So.

I hope you also explain valuation because that was the thing that nailed everybody again. Again. And we do not set that.

You know, so, and normally that, you know, when you're doing the county budget, you don't have the valuation increase or decrease if there ever is one. You don't have that when you're doing the budget. So, it was a good conversation. Um, I think he was, in fact, he even invited me for coffee some morning when he's up to on a weekend. So, uh, yeah, it must've been fairly well received.

And did you give him a invitation with taxpayers?

I told him that there was a taxpayers group that he can get ahold of. And so, well,

know just just one more of those little things that comes up so but that's all i really did for countywide so now i have an interesting one of those the poor guy bought a house and the previous owner didn't pay property taxes apparently wounded veteran or something and so he was surprised that his house was valued more than he paid for

and of course he couldn't take it to anybody because you gotta do that what in April I think yeah he bought it devil nothing I could do for it Levi uh I also did not have much scheduled last week for uh official business but this week I've got Board of Health tomorrow and um I'm going to be discussing some things with um brandy uh specifically to uh the better babies program here for dixon county and i'm not exactly sure um what that conversation is going to entail but i think it's something that she needs to come to the board with so we'll do that and then the regular scheduled board of health on thursday i'm going to sit in at the iowa tax relief luncheon and try to absorb

um trails board meets that's good very good I'm like the rescue I have nothing official going on that was my week unfortunately we can't adjourn now like we usually do still got 12 minutes before the next hearing

There is a water conference coming up that's being held by a statewide water group that has a conference up here. They're going to have an arrowwood this year that is in a couple weeks. I believe maybe next week.

Yeah, but if you agree to be a participant on a panel, which I agreed to when they pounded on my door, then you don't have to pay that. So, but yeah, it's supposed to be a pretty big deal on statewide water. clean up and control and so on. So next week, the 16th and 17th. So they're expecting a lot of people to that. So we'll see. It'll be interesting.

The great thing I'm finding is you can never have clean water. there'll always be you know you've got seagulls geese whatever you have things naturally occurring like arsenic I think the trick is to figure out how much you're willing to tolerate yeah I think a lot of this is driven by the uh

Raccoon River watershed and how much the city of Des Moines and all the surrounding communities have to pay for cleaning up the water down there.

They have a site where Daiko used to be right off in the Raccoon River, and they have a more stuff on a farm runoff than they used to with uh daiko one night daiko used to bad bet the history of the past on that place was batteries and all kinds of stuff they just buried a lot of junk out in the yard and they still got more from the farm runoff and so forth

all the stuff it's, you know, it's pretty tough to get pure water anywhere. I just read an article on where they converted a whole bunch of areas back into all pasture. And they were still getting a lot of, you know, things into the stream that weren't

well and then you also have your microplastics yeah boy you know we all have this

And all you gotta do is get some money to take it.

And turn everything upside down on the shelves till the next time you need it. Like they used to do 50 years ago. I remember my parents had a fruit room downstairs, a cold room, and just shelves. By the time the summer came along, all those glass jars and stuff were all cleaned and filled again the next year. Nobody seems to want to be able to do that anymore.

Unfortunately, we've turned to a convenience society.

One of the solutions would be it seems the feds and the state will allow some companies like Brides to give tours. well it is now 9 30 and so we will have a public hearing on the action from the planning and zoning committee megan all righty good morning recommendation of the board of supervisors for rezoning from the gc general commercial district to the a1 agricultural district for parcel k being a part of the northeast corridor of the southwest corridor section 2 township 99 range 37 nickinson county iowa property is located along highway 86 um in spirit lake accepted properties owned by ivan simpson mr simpson is requesting to change the zoning designation of the property from gt general commercial to the a1 district for the purpose of construction of a new single-family home residential uses are not permitted within the general commercial zoning designation while the a1 agricultural district allows for single-family um residential uses subject to the applicable regulations and other county requirements The subject parcel is proposed to be combined with the parcel immediately to the south. The resulting combined property will have a net acreage greater than the 10-acre minimum lot size requirement in the A1 Agricultural District. Previously in 2022, Mr. Simpson was granted a rezoning request to the General Commercial District for a purpose. The purpose of that rezoning was to allow commercial uses that were not primarily adapted to agricultural activities. The property continues to contain agricultural uses. Agricultural operations are exempt from county zoning regulations pursuant to Iowa Code 335.2 to the extent that the activities qualify for the statutory exemption. So, once again, the Planning and Zoning Commission voted 5-0. to rezone parcel K from the commercial district to the agricultural district with the stipulation that a retention pond or stormwater management plan will be increased from the 1.25 inches by infiltration process according to the Iowa Stormwater Management Manual to 4 inches by infiltration process.

that is all i have at this point i do have one correspondence i don't know if i have any you'd like to say should i give an explanation good morning good morning when we originally did the zoning to commercial we put that track in because it was already a survey track and the plan was to probably leave it highway commercial uh spurt lake has moved into my residential area on the east side of the lake and we feel like It's time to move back to the home farm. All the grandkids are there, and we do a lot of activity with the horses there. So we're selling the house on the east side of the lake by the Smith Addition property and ready to build in this side. We could have built a house 400 foot further south, but the elevation was much higher and a much better location to go 400 foot north. So we elected to do the rezoning to take 400 for the highway commercial and go with the residential property. TAB, Probably pretty positive thing to the my neighbors I mean it's not going to be a dumpster site or a truck stop or something is going to be residential properties, a lot of grasslands and pasture so. TAB, I just have one correspondence that i'll read. Our names are Greg and Allison Alvine, and we live at 15808 Tradewind Drive, Spirit Lake. Our home is directly across the road from the subject property owner.

We would agree with our neighbors to then

prospects regarding the property change across interstate 86 from us as written below although we are not concerned about what zoning classification is for the property across the road our current concern is a serious water runoff with more and more buildings getting built and already having a runoff issue we firmly believe a retention pond is necessary similar to the property with storage units at the corner of highway 86 and 9. it does not seem proper that the property owner can On one hand, be concerned about water vacating his property yet, and on the other hand, add strain to the culvert system. FYI, the property owner has complained to the Dickinson County Board of Supervisors claiming the culverts in the harbor are not large enough, despite these same culverts having served the area for nearly 50 plus years. Dickinson County and or the harbor cannot be expected to install additional... or larger culverts to remove water simply because the property owner adds more buildings or other changes that negatively affect water runoff the property owner needs to share in this responsibility the current culvert system carries water from subject property to the beautiful blue waters of west bocce our retention pond would ease the flow and equally important clean the water i would imagine this is one of great components to the board of supervisors the zoning administrator the property owner and all that enjoy the beautiful waters thank you for hearing our concern i hope we can find a solution that is fair to all property owners while protecting the lake And that too was a concern that we heard at the Planning and Zoning Commission meeting in August, which is why they voted to put out the stipulation that a retention pond or stormwater management plan, which they only have to abide by the 1.25 by infiltration, according to the Iowa Stormwater Management Manual, but they asked that the stipulation be placed that he addressed four inches. by infiltration process. So how he chooses to achieve that is up to him or his surveyor to address that concern. But he does not have to address the entire watershed coming down in that drainage district.

Can I add, Megan, that on the building permit that's already been taken care of for the acres, 12,000 square foot was put in for the infiltration system for the roof water.

so it's uh for the pre for the north building is that what you're talking about for the new building for the house I'm gonna thank you today okay I was like I haven't seen anything yet Ivan right well so it's obviously we're gonna get through the process there's the page underwater I might help you okay so um yes apparently uh Pat Moaning has already um started work on that um stipulation for the new home so what's it going to be water retention pond or something else it is 12 inches of soil quality restoration area which is 10 740 square feet um i can this is what is what was just handed to me so it'll all be on the south and the west side of that home that's adequate to meet what the pnz is requiring yeah as long as yes i mean pat moding signed his name to it and so i mean his design will need to be implemented okay so one of the biggest issues there with the storefront

So this side of the highway or the other side of that's causing the complaints about runoff conditions.

Well, as I said, you know the the zoning ordinance. requires a water quality management plan and according to the ordinance it has to manage water quality volume of 1.25 inches by infiltration so he is to address the water quality in as a result of the impervious improvements on his property do we know that there's issues with that watershed yes but he's not required to fix the entire drainage district that's coming down there so um and that's why pnz they're like yes it's only 1.25 Let's try to strike a balance with some of the folks that were concerned about this house being built in Salo. That's why they asked to do the four inches. So I'm just shy.
